3. Introduction
Sexual harassment is bullying or coercion of a
sexual nature, or the unwelcome or inappropriate
promise of rewards in exchange for sexual favours.
In most modern legal contexts, sexual harassment
is illegal.
It includes a range of actions from mild
transgressions to sexual abuse or sexual assault.
4. There are some common misconceptions about sexual
harassment which are :
1. Touching is required
2. Harassment is motivated by a desire for sex.
3. The person who is directly harassed is the only victim.
4. It needs to occur again and again repeatedly to be
addressed as Sexual Harassment.

about the assault.

chronic physical or psychological conditions.
3. 40% of rape survivors develop sexually transmitted
diseases as a result of sexual assault.

trust: a family member, family friend, or a caretaker.

The Vishaka Judgment - 1997
Supreme Court acknowledged that:
Sexual harassment is a human rights violation
Sexual harassment is a violation of the constitutionally
guaranteed fundamental rights:
Articles 14 and 15: Right to equality
Article 21: Right to life - to live with dignity
Article 19(1)(g) - Right to practice any
profession/trade/occupation/business, i.e., a right
to a safe environment free from harassment
There is a need for guidelines to fill the legislative
vacuum
