MENA states share a cultural and religious heritage. In almost all of them Islam is the religion of
the state, and the first source of legislation is Sharia’a law. Under Sharia’a, the death penalty is
explicitly provided for, and governments use this argument to justify why they retain it. Penal
Reform International (PRI) has been working with Islamic scholars to better understand how to
interpret Sharia’a law with regard to the death penalty. On the international World Day Against
the Death Penalty, PRI will publish the results of this research by launching the book “Criminal
sanctions in Islam: case of the death penalty” written by Dr Mohamad Al Habach.
Dr Mohamad Al Habach, the son of an imam, studied Islamic Law at Damascus University, the
Universities of Beirut, Tripoli and Khartoum. He has obtained the highest distinction in the Koran
memorisation of the House of Fatwa (Dar al-Ifta). Dr Al Habach has served as director of two
institutes of the Koran in Syria. Elected to the Syrian Parliament, he is now an independent
member and member of the administrative committee of parliament.
