The trade show industry is a large marketing tool like no other. According to the research group Statista, the trade show industry
was valued at over US$15 billion in 2019. Then, the pandemic hit. Now, the late summer and fall seasons in the U.S. and
Europe, have brought with it a plethora of health and wellness trade shows. And am I delighted to see them.
August brought back SupplySide East in Secaucus, NJ. September featured Expo East in Philadelphia, PA. Vitafoods in
Geneva, Switzerland, appeared to be a huge success. And now the industry will take part in SupplySide West in Las Vegas, NV.
Add to the line-up MJBIZCON, also in Las Vegas, the largest CBD/Cannabis trade show of that category, and 2021 is going out
with a bang.
As the pandemic seems to have cooled off in many corners of the globe, numerous organizations have come back to the trade
show circuit. And 2022 shows have already started to attract a huge amount of interest. Of course, every organization will need
to make their own decision about when the right time to come back is and how to do so.
Some organizations have already announced plans to get back into in-person events. In cities like Las Vegas, where trade
shows are a key component of the economy, the signs of a resurgence have begun at a rapid pace, although not quite at
pre-pandemic levels.
Before we know it, Expo West, the largest natural products industry trade show featuring retail supplements, ingredients, and
food products, will take place March 2022 in Southern California. But before Expo West, Nutrify Today will celebrate its one-year
anniversary in February. Over the past year while we were all fighting off the pandemic crisis, Nutrify Today continued to bring
the industry together with news and information about various health and wellness issues affecting the business-to-business

3. A LOOK AT AUSTRALIA’S TGA ADVERTISING
GUIDELINES
TGA APPROVED OR TGA REGISTERED
Many companies have and are considering introducing products in Australia. But there are
several government advertising guidelines that must be considered.
The inclusion of a therapeutic good in the Australian Register of Therapeutic Goods (ARTG)
is not an endorsement of that good by the Therapeutic Goods Administration (TGA).
Advertisers must not use terms such as 'TGA approved' or 'TGA registered' in therapeutic
goods advertising, including on labels or packaging. The use of a TGA logo or
Commonwealth Coat of Arms is also prohibited.
However, advertisers can include details of the product's ARTG number (and this number is
mandatory on medicine labels and packaging). For certain medicines, a 'TGA assessed
claim' can also be used in advertising1
.

4. INCLUDING THE ARTG NUMBER

The ARTG contains information about
therapeutic goods that can be supplied in
Australia. Advertisers are encouraged to
provide the public with a product's 'AUST
L', 'AUST R' or ARTG number in
advertising as it assists consumers to
identify a product, and to look up the entry
in the ARTG if they wish to. Advertisers
can refer to the product's ARTG entry in a
compliant way by using terms such as:
However, advertisers should not make a broad statement that a therapeutic good is
listed, registered, or included in the ARTG unless it includes the ARTG number.

NT: What advice can you offer health and wellness
companies who want to enter the U.S. nutraceutical
marketplace?
Mr. Amin: We strongly suggest protecting your IP,
trademark protection and patent protection filing if
innovative and protectable, and buttoning up FDA and
FTC regulatory compliance as it applies to ingredients,
labeling and packaging prior to importation as an
ounce of prevention is worth 10 pounds of cure
nowadays in the U.S.
NT: What is the biggest challenge facing nutraceutical
senior management?
Mr. Amin: Preventing class action suits, Prop 65
(California) and similar shakedowns costing precious
time, focus and money.
NT: Does having close contact with the FDA help better
serve your clients?
Mr. Amin: Absolutely. We are friends and close
colleagues with FDA leaders and decision-makers. We
connect the government & compliance with our clients.
NT: Any new regulations on the horizon that may affect dietary supplement industry manufacturers?
Mr. Amin: There is nothing new regarding FDA regulatory. But what is newsworthy is new legislation coming from
California which is huge for the U.S. Hemp and CBD companies. Again, this relates in part to Prop 65.
The Hemp and CBD industry has been anxiously waiting for California to legalize the use of CBD in food,
supplements, and cosmetics, as well as pet products. After months of negotiation between the various
stakeholders, that day is finally arrived. California Governor Newson signed into law Assembly Bill 45, which is
effective immediately. Like other U.S. states that have legalized the sale of CBD products in recent years,
California’s law comes with its own testing, labeling, approved source, and registration requirements. For
example, the new law requires labels to include certain warning statements and a scannable barcode, website,
7. or QR Code linked to a certificate of analysis that provides specific testing information, among other label
requirements. These provisions only apply to products manufactured 90 days after the effective date.
AB 45 defines “THC” to include THCA, and any THC, including Delta-8 THC, Delta-9 THC, and Delta-10 THC. It
authorizes the Department of Public Health (DPH) to include or exclude comparable cannabinoids from the
definition of THC, based on their intoxicating effect, or lack thereof. In addition, DPH may impose maximum
serving sizes for hemp-derived cannabinoids, hemp extract, and products derived therefrom, active
cannabinoid concentration per serving size, the number of servings per container, and any other requirements it
deems necessary. In summary, the majority of the requirements under the new law are similar to existing
requirements, but some are unique to California, with possibly more on the way via future regulations, adding to
the ever-growing patchwork of state laws governing hemp and CBD products.
In other California news, the state’s Office of Environmental Health Hazard Assessment (OEHHA) issued a Notice
of Modification to its proposed regulations to require tailored warnings for Delta-9 THC (and cannabis smoke)
exposure warnings. The proposed regulations were originally the subject of a Notice of Proposed Rulemaking
issued on March 19, 2021, which was followed by a public hearing and comment period that ended in May. In
response to public comment, OEHHA has now proposed a one-year delayed effective date for the regulation to
allow businesses to transition to the new warnings (if they choose to use them). The agency has also proposed
an unlimited sell-through period for products manufactured prior to the effective date of the regulation and that
use the general “safe harbor” warning content. Comments regarding the notice are due by October 8.
In federal news, the FDA issued a Consumer Update in September on Delta-8 THC products. FDA outlines a
number of public health and safety risks associated with Delta-8 THC products, including the potential for
psychoactive and intoxicating effects, an uptick in adverse event reports to FDA and poison control centers, the
marketing of products in manner that is appealing to children, and concerns regarding contamination due to
methods of manufacturing and chemicals that may be used to produce Delta-8 THC products. FDA is actively
working with federal and state partners to further address the concerns related to these products and is
monitoring the market for product complaints, adverse events, and other emerging cannabis-derived products
of potential concern. On the same day, the Centers for Disease Control (CDC) issued its own advisory on Delta-8
THC, which discusses similar health and safety concerns. Of note, both FDA and CDC mention the potential for
consumers to confuse Delta-8 THC products with non-intoxicating hemp or CBD products, citing insufficient
labeling.
NT: Any legal and product trends you are seeing?
Mr. Amin: Increasing private enforcement with false advertising and Prop 65 challenges in California. Regarding
trends, plant-based proteins are on the rise.
NT: How do you evaluate success?
Mr. Amin: Doing my best to meet goals and initiatives one day at a time with a positive state of mind.

developed genetically modified foods and supplements. These nutraceuticals have received
considerable interest due to potential nutritional, safety and therapeutic effects.
The incidence of COVID-19 pandemic had bought in a paradigm shift in the nutraceutical
