General Provisions
Sec. 1 – This Act shall be known as “The Magna Carta
of Women”
Sec. 2 – Declaration of Policy – The State affirms the
role of women in nation building and ensures
the substantive equality of women and
men.
- It shall promote empowerment of women
and pursue opportunities for women and men.
- In line with the Convention on the
Elimination of all Forms of Discrimination
Against Women, (CEDAW) the State affirms
women’s rights as human right and shall
recognize, respect, protect, fulfill and promote
all human rights and fundamental freedom of
women.
Definition of Terms
Sec. 4 – a. Women Empowerment – refers to the
provisions availability of opportunities for
women.
b.Discrimination Against Women - refers to
any gender-based distinction, exclusion or
restriction.
c. Marginalization – refers to a condition where
a whole category of people is excluded from
useful and meaningful participation in
political, economic, social and cultural life.
d. Marginalized - refers to the disadvantaged
group, who are mostly living in poverty, the
indigenous people like the Moro Islamic
Natives of Mindanao, senior citizens, solo
parents and the urban poor workers.
Rights and Empowerment
Sec. 8 - Human Rights of Women - All rights in the
Constitution of the Philippines shall be the
rights of women without discrimination.
Sec. 9 - Protection from Violence - Women shall be
protected from all forms of violence and gender-
based offenses.(stated in Violence Against Women
Act)
Sec. 10 – Women Affected by Disasters, Calamities
and other Crisis Situations - Women have the
right to protection and security in times of
calamities and disasters.
Sec. 11 – Participation and Representation – The State shall
undertake special measures to accelerate the
participation and equitable representaion of
women in all spheres of society – particularly in
the decision-making and policy-making in the
government.
Ex. Empowerment in the Civil Service and
Integration in Political Parties
Sec. 12 - Equal Treatment before the Law
- The State shall review or amend the existing
laws that are discriminatory to women.
Sec. 13 –Equal Access and Elimination of
Discrimination in Education, Scholarships,
and Training
- Enrollment of women in non-traditional
skills training in vocational and tertiary levels
shall be encouraged.
Ex. Expulsion and non-admission of women
faculty, female student due to pregnancy
outside marriage shall be outlawed.
Sec. 14 - Women in Sports - Participation of women in
Palarong Pambansa, Southeast Asian Games
and Olympics shall be strengthen.
Sec. 15 - Women in the Military - The State shall
eliminate discrimination of women in the
military, instead women shall be given
promotional privileges
in police services.
Sec. 16 –Nondiscriminatory and Nonderogatory
Portrayal of Women in Media and Film
- refers to the advancement of women in
government and non-government media-
related organization
Sec. 17 - Women’s Right to Health - The State shall
provide at all times, gender-responsive health
services and the right of women to protection
from hazardous drugs, devices and
interventions.
Sec. 18 - Special Leave Benefits for Women - refers to
two-month full payment based on gross
monthly compensation (maternity leave).
Sec. 19 - Equal Rights in all Matters Relating to
Marriage and Family – as atated in VAW
(Violence Against Women Act) as the lead
agency, the PCW (Phil. Commission on
Women) shall promote the rights and welfare
of Filipino women and girls.
