Consequently, this company cannot claim the ownership of the BRCA Gene. Unless Myriad is able to create a human being and make its own BRCA Gene, I don't think that they should be allowed patent the BRCA Gene. I believe that it is a good thing that this company cannot patent the BRCA Gene because it could lead to others trying to patent things like the BRCA Gene while they have never created them initially. The case of the BRCA Gene reminded me of Nestle and the fennel flower. I really hope that in this case similarly to the BRCA Gene, the patent will not be possible. In fact, thinking about some of the benefits of the fennel flower the idea of a patent on such a natural product appears to be problematic like for the BRCA Gene. It would be sad for such a natural creation like the BRCA Gene to be owned by a company. I hope that rulings like the one made for the BRCA Gene becomes a big deterrent for anyone who wants to patent something they have not created. I am not aware of a case similar to the BRCA Gene going on for other creations.
