Respond to chapter 51, Problem 3 on Title VII: 
Dianne Rawlinson, a female applicant who was rejected for 
employment as a prison guard in the Alabama prison system, 
challenged certain state rules restricting her employment 
prospects under Title VII. They were (1) requirements that all 
prison employees be at least 5 feet 2 inches tall and weigh at 
least 120 pounds, and (2) a rule expressly prohibiting women 
from assuming close-contact prison guard positions in 
maximum-security prisons (most of which were all male). 
What method of proving a Title VII case should Rawlinson use 
in attacking the height and weight requirements? Does she 
need to use one of these methods to attack the second rule? 
What argument should the state use if Rawlinson establishes 
that the height and weight requirements have an adverse 
impact? What Title VII defense might the state have for the 
second rule? With regard to the second rule, assume that at 
this time Alabama

different lawsuits. In one paragraph, discuss how you might 
limit your liability exposure within each particular business 
organizational form. 
b. After completing the first part of this exercise, describe 
one business that you may own some day or that you 
currently own. (Even if you never plan to own a business, 
pretend as if you will do so for the purposes of this 
assignment.) Identify the best business organizational form 
for the type of business that you have described, considering 
personal liability exposure as well as management, taxation, 
and ease of formation. 
Negligent Tort . The paper must be four to five pages, 
excluding the title page and references page(s), and 
formatted according to APA style as outlined in the Ashford 
Writing Center. 
Address all of the following parts of this assignment: 
1. Visit the Consumer Product Safety Division website. Click 
on “Consumer Safety,” and then click on “Recalls.” Choose 
one product that has been recalled. 
a. Identify the product subject to recall. 
b. Determine whether the manufacturer would be liable in 
negligence if the product had not been recalled and had 
caused harm to a consumer. 
c. At a minimum, your analysis must discuss the concepts of 
duty of care, standard of care, breach of the duty of care, 
actual causation, proximate causation, actual injury, and
defenses to negligence. 
2. Identify and discuss a relevant consumer protection 
statute identified under “Consumer Protection” in Chapter 8 
of your text in conjunction with the product recall that you 
have identified. 
Elements of a Contract . The paper must be four to five 
pages, excluding the title page and references page(s), and 
formatted according to APA style as outlined in the Ashford 
Writing Center. 
Address all of the following parts of this assignment: 
Suppose that the Fabulous Hotel hires you as head chef 
under a two-year employment contract. After two years, 
another hotel wants to hire you. However, in the original 
employment contract you signed with the Fabulous Hotel, 
the following paragraph appears: “The below-signed agrees 
not to work as a chef for another hotel in the same 
metropolitan area for a period of two years after leaving our 
employ.” 
Identify which elements of contract must exist for this 
agreement to be enforceable. At a minimum, your paper 
must include a detailed description of the concepts of offer, 
acceptance, legal consideration, capacity, and legality of 
purpose. Is this contract governed by common law or the 
UCC? Why? Discuss under which circumstances this non-compete 
agreement would be unenforceable. 
Outline of Final Paper . The paper must be one to two pages, 
excluding the title page and references page(s), and 
formatted according to APA style as outlined in the Ashford 
Writing Center. 
Address all of the following parts of this assignment: 
a. Prepare a one- to two-page, single-spaced outline of your
Final Paper. 
b. The outline must contain all major sections that will exist 
in the Final Paper 
c. The outline must be accompanied by a references page 
that includes at least 10 scholarly sources that will be used in 
your Final Paper. 
Anti-Discrimination Laws Related to Employment. The paper 
must be two to three pages, excluding the title page and 
references page(s), and formatted according to APA style as 
outlined in the Ashford Writing Center. 
Address all of the following parts of this assignment: 
Your supervisor has placed you in charge of hiring a new, full-time 
administrative assistant for your department. 
a. Write an advertisement for that position that complies 
with federal law. This advertisement must be detailed. The 
minimum length of your job description must be 300 words. 
You can make up the job details. 
b. Write 10 illegal questions that must not be asked, and 10 
legal questions that may be asked during the interview. 
Clearly indicate which questions are legal, and which ones 
are illegal. Explain your reasoning. 
Focus of the Final Paper 
Prepare an 11- to 15-page paper (excluding title page and 
reference page) that analyzes a legal/ethical issue or 
situation relating to a current, previous, or potential future 
work environment. Use at least 10 scholarly sources that are 
suitable for research in a graduate-level course. 
Your paper must include the following: 
1. A description of a business situation that presents a legal 
and ethical issue. The business situation must be from prior, 
current, or anticipated future employment experiences, or a
current event. The description of the business situation must 
not exceed two pages. 
2. Analysis of the ethical concerns raised by the situation. 
a. Apply at least two different ethical theories to the situation 
to support at least two different outcomes. 
b. The paper must identify which ethical outlook, as applied 
to this particular situation, will result in the best legal 
outcome for the business. 
3. Application of the relevant area(s) of law that has (have) 
been addressed in this course to the situation (e.g., 
constitutional law, contracts, anti-trust law, securities 
regulations, employment law, environmental law, crimes, or 
torts) and a discussion of the applicable law as it applies to 
the situation identified.
