No.9262 on March
8,2004 during the
celebration of the
International women's
day and took effect on
March 27,2004
Purpose
The state shall
recognize the need to
protect the family
and each members
particularly women
and their children
from violence and
threats to their
personal safety and
security.
WHO ARE PROTECTED?
1. Women
• wife
• former wife
• a woman with whom the person has or had a
sexual or dating relationship
• a woman with whom the offender has a
common child
2. Children
• a child below 18 years of age, whether
legitimate or illegitimate, within or without the
family abode
Violence against women and their children
Refers to any act or a series of any acts committed by any
person against a woman who is his wife, former wife or
against a woman who is or had a sexual or dating
relationship, or with whom he has a common child, or against
her child whether legitimate or illegitimate, within or without
the family adobe, which result in or is likely to result in
physical, sexual, psychological harm or suffering or economic
abuse including threats of such acts, battery, assault,
coercion, harassment or arbitrary deprivation of liberty.

5. Person with whom the
woman has a common child

woman has/had a sexual or

IS VAWC COMMITTED BY MEN ALONE?
NO!
"As defined above, VAWC may likewise be
committed 'against a woman with whom
the person has or had a sexual or dating
relationship’
Clearly, the use of the gender-neutral word
'person' who has or had a sexual or dating
relationship with the woman encompasses
even lesbian relationships."
WHO ELSE MAY
BE LIABLE?
It must be further
noted that Section 5 of
R.A. No. 9262
expressly recognizes
that the acts of
violence against
women and their
children may be
committed by an
offender through
another.
PROTECTION ORDER
It is an order prescribed in the Anti-VAWC
Act to prevent further abuse of or
violence against a woman and her child.
It also provides them relief from said
abuse or violence such as:
Physical Violence
Refers to
acts that
include bodily
or physical
harm
Sexual Violence
Refers to an act which is sexual
in nature, committed against a
woman or her child. Example:
rape, sexual harassment, acts
of lasciviousness, forcing the
wife and mistress/lover to live
in the conjugal home or sleep
together in the same room with
abuser.
Psychological Violence
Refers to acts or omission causing
or likely to cause mental or
emotional suffering of the victim.
Example: intimidation,
harassment, stalking, repeated
verbal abuse and marital infidelity.
Economic Abuse
Refers to acts that make or
attempt to make a woman
financially dependent. Example:
withdrawal of financial support,
preventing the victim from
engaging in any legitimate
profession, occupation or
business, destroying household
property, and controlling the
conjugal money or property.
WHO MAY FILE?
• The offended party;
• Parents or guardians of the offended
party
• Children and grandchildren
• Relatives
• Local officials and DSWD social
workers
• Police officers
• Punong Barangay or Barangay
Kagawad;
• Lawyer, counselor, therapist
• Any two (2) concerned citizens of the
city or municipality where the violence
against women and their children
occurred and who has personal
knowledge of the offense committed.
Penalties
Constituting the crime of violence against women
and their children shall be punished by the
following rules:
• attempted, frustrated, or consummated parricide or
murder or homicide shall be punished in accordance
with a provision of the REVISED PENAL CODE
• those constituting physical injuries have the penalty of
prision mayor.
• those constituting less physical injuries shall be
punished by prision correccional.
• those constituting slight physical injuries shall be
punished by arresto mayor
Duration of
Penalties
Fine and Counseling
• In addition to imprisonment, the
perpetrator shall pay a fine in
the amount of not less than one
hundred thousand pesos but
not more than three hundred
thousand pesos.
• undergo mandatory psychiatric
counseling or psychiatric
treatment and shall report
compliance to the court.
PROTECTION ORDERS
A protection order is an order issued under this
act for the purpose of preventing further acts of
violence against women or her child and
granting other necessary relief. The relief
granted under a protection order should serve
the purpose of safeguarding the victim from
further harm, minimizing any disruption in the
victim daily life, and facilitating the opportunity
and ability of the victim to independently rein
control over her life.
RIGHTS OF VICTIM-
SURVIVORS
• to be treated with respect and dignity
• to have legal assistance from the Public
Attorneys Office(PAO) of the Department of
Justice(DOJ) or any public legal assistance
• to be entitled to support services from the
DSWD and LGU.
• to be entitled to all legal remedies and support
as provided for under the family code
• to be informed of their rights and the services
available to them including their right to apply
for a protection order
To eliminate VAWC, the following agencies
have their own duties and responsibilities
• CHR (Commission on Human Rights)
• CSC (Civil Service Commission)
• DepEd (Department of Education)
• DILG (Department of the Interior and local Government)
• DOH (Department of Health)
• DOJ (Department of Justice)
• DSWD (Department of Social Welfare and Development
