As we continue to receive receipts for H-1B filings on April 2nd, we remind H-1B hopefuls to be mindful of considering their fallback plan and H-1B options.
The "roller-coaster ride" that we now call the "US immigration law" was recently marked by the following events... (1) An estimated 8,950 Nepalese nationals currently receiving Temporary Protected Status (TPS) will now lose this protection; and (2) the US Supreme Court this held arguments on President Trump's travel ban and it seems to be erring on the side of the President's power to implement a Travel Ban in the name of "National Security; and (3) Only a short time after the Department of Justice (DOJ) announced a suspension of the Legal Orientation Program, the Attorney General testified that DOJ will reverse and continue the program; and (4) More deportation cases are being filed in immigration court that involve longer-term residents of the United States rather than recent arrivals.

FY 2018-2019 H-1B CAP REACHED: NOW IS THE TIME
TO THINK ABOUT YOUR H-1B BACK-UP PLAN.
On April 12, 2018, U.S. Citizenship and Immigration Services
(USCIS) announced that it has reached the congressionally mandated
H-1B cap for fiscal year (FY) 2018-2019. USCIS also received
more than the limit of 20,000 H-1B petitions filed under the U.S.
advanced degree exemption.
USCIS received over 190,098 H-1B petitions during the filing period,
which began April 2, including petitions filed for the advanced degree
exemption. On April 12, USCIS used a computer-generated random
selection process, or lottery, to select enough petitions to meet the
65,000 general-category cap and the 20,000 cap under the advanced
degree exemption.
With uncertainty looming large as to who may or may not get selected
in the H-1B lottery, it is time that H-1B visa hopefuls (and their
prospective H-1B employers) start to explore other nonimmigrant
work visa options to allow them to work and live in the United States
on a temporary basis.

HOW MANY TIMES CAN I RENEW MY H-1B VISA?
H-1B visas are granted for a period of three years. Often, H-1B visa
holders may find that they wish to remain in the United States to
continue working for their sponsored employer. Visa holders have the
option to renew their visa for another three-year period. The renewal
process, which was once fairly simple, may now be more complex
as the Trump Administration has vowed to review renewals with
additional scrutiny.

renew your H-1B visa and what changes you should anticipate to the
renewal process below.
Renewal Periods for H-1B Visas
Once you have achieved the grant of an H-1B visa, you may want to
extend your time living and working within the United States. You
can apply for an H-1B extension six months prior to your visa's
expiration. It can take the USCIS two to three months or longer to
process your renewal, so ideally you should start the process as soon
as possible. You may need to gather documents and your employer
will need to complete additional paperwork, so delaying your
application could result in a lapse of your visa.

USCIS NEWS: USCIS TO BEGIN USING MORE
SECURE MAIL DELIVERY SERVICE.
On April 27, 2018, U.S. Citizenship and Immigration Services
(USCIS) announced that the agency will begin phasing in use of the
U.S. Postal Service's (USPS) Signature Confirmation Restricted
Delivery service to mail Green Cards and other secure documents
beginning April 30, 2018.
The first phase will affect documents that need to be re-mailed
because they have been returned as non-deliverable. These documents
include Permanent Resident Cards (also called Green Cards),
Employment Authorization Cards, and Travel Booklets. Applicants
who have changed mailing addresses during the course of the
application process are more likely to have their secure documents
sent with the new delivery method, which USCIS will expand to all
secure documents in the future.
As part of the new delivery method, applicants must present
identification to sign for their documents upon delivery.

DHS ANNOUNCES END TO TPS FOR NEPAL.
On April 26, 2018, Secretary of Homeland Security Kirstjen M.
Nielsen announced her decision to terminate the Temporary Protected
Status (TPS) designation for Nepal with a delayed effective date of
12 months to allow for an orderly transition before the designation
terminates on June 24, 2019.
The decision to terminate TPS for Nepal was made after a review of
the environmental disaster-related conditions upon which the
country's original designation was based and an assessment of
whether those originating conditions continue to exist as required by
statute.
Nepali citizens with current TPS registrations will be required to re-
register for TPS and apply for Employment Authorization Documents
in order to legally work in the United States until the termination of
Nepal's TPS designation becomes effective June 24, 2019.

DACA UPDATES: COURT RULED FAVORS DACA AND
ASK DHS TO ACCEPT NEW APPLICATIONS.
On April 24, 2018, U.S. district court judge John Bates issued an
order vacating the decision to rescind DACA, requiring DHS to
accept and process both new and renewal DACA applications. The
court stayed its order of vacatur for 90 days. It was the third time a
federal court has ruled against efforts to scrap the popular program.

several dramatic final action date advancements in the April Visa
Bulletin. The motivation for and timing of these movements was to
