1. Pregnancy
An employer may ask an applicant questions about intended duration of
stay on the job or anticipated absences. However, the questions must be
made to males and females. Employers may not inquire in pregnancy
or medical history concerning pregnancy and related matters.
Pre-employment drug Testing
Is generally allowed in the United States if it is not designed to identify
legal use of drugs or past or present addiction to legal illegal drugs,
which is barred under the American with Disabilities Act.
The American with Disabilities Act of 1990 Title 1
Qualified individual with a disability – shall not include any employee
or applicant who is currently engaged in the illegal use of drugs.
Exclusions:
1. Successfully completed a supervised rehabilitation program
2. Is participating in a rehab program
3. Is erroneously regarded as engaging of such use
