Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

5. Nemzetiségek jogainak deklarációjában kilátásba
helyezett jogok
E dokumentum szerint, a független Ukrajnában, a nemzetiségek
jogosultak lesznek:
- Az általuk hagyományosan lakott területek megőrzésére és e
területeken a nemzetiségi-közigazgatási egységek létrehozásra.
- Nemzeti szimbólumuk szabad használatára.
- Történelmi örökségük védelmére.
- Az anyanyelv szabad használatára a közélet minden területén,
különösen az oktatásban, a gazdaság és a hírközlés területein.
Előirányozza, hogy a Nyelvtörvény vonatkozó normáját úgy kell
értelmezni, miszerint nem csak azokban a közigazgatási egységekben
lehet a nemzetiség nyelvét az államnyelvvel egyenrangúként
használni, ahol valamely nemzetiség többséget alkot, hanem bárhol,
ahol hagyományosan, illetve egy tömbben él.
6. Kisebbségek törvényben szavatolt jogai
A nemzeti kulturális autonómiára, és annak keretében:
- az anyanyelv használatára és az anyanyelven történő oktatásra;
- a nemzeti kulturális hagyományok megőrzésére és fejlesztésére;
- a nemzeti szimbólumok használatára;
- nemzeti ünnepeik méltatására;
- hitük megvallására, gyakorlására;
- irodalmi, művészeti, tömeghírközlési igényeik kielégítésére;
- nemzeti-kulturális szervezetek és oktatási intézmények létrehozására.
Ezeken túl, a kisebbséghez tartozó személyek jogosultak:
- választani, és megválasztatni, illetve kineveztetni bármelyik hatalmi szerv
bármelyik beosztásába, a nemzetiségi kulturális szervezetek jelölteket
indíthatnak a helyi és országos választásokon;
- meghatározni saját nemzetiségi hovatartozásukat;
- nemzetiségi nevük használatára;
- szabad kapcsolattartásra nemzettársaikkal, mint az országon belül, mint más
országokban.
7. Az állam kötelezettségei a kisebbségek jogainak szavatolása terén
- Az állam polgárai számára, nemzetiségi származásuktól
függetlenül a jogegyenlőség garantálása.
- Megfelelő intézményi háttér, így országos szinten, Nemzetiségi
Ügyek Minisztériumának létrehozása.
- Minden nemzeti kisebbség számára a nemzeti-kulturális
autonómia jogának garantálása.
- Intézkedések foganatosítása a nemzetiségi oktatási és
kulturális intézmények megfelelő káderellátására.
- Ott, ahol az adott nemzetiség többséget alkot, a nemzetiségi
nyelv hivatalos használatának biztosítása.
- A kisebbségek élettere megőrzésének garantálása mind azok
történelmi, mint jelenkori szálláshelyén.
- A kisebbségek társadalmi szervezetei működésnek elősegítése.
- Az állami költségvetésben a kisebbségek fejlődésére
pénzösszeg biztosítása.
8. Az Alkotmánynak a kisebbségi jogok vonatkozásában releváns
tételei
- A preambulum szerint az alkotmányozás alanya az Ukrán
Nép – Ukrajna minden nemzetiségű állampolgára.
Az Alkotmány :
- garantálja az orosz és más kisebbségi nyelvek szabad
fejlődését és alkalmazását (10. cikkely);
- meghatározza, hogy a nyelvek alkalmazása Alkotmány által
garantált, és annak rendjét törvény állapítja meg (10.
cikkely);
- elősegíti minden őshonos nép és nemzeti kisebbség etnikai,
kulturális, nyelvi és felekezeti önazonosságának a
megőrzését (11. cikkely);
- garantálja az anyanyelven való oktatást, illetve az anyanyelv
tanulását állami és önkormányzati oktatási
intézményekben, illetve a nemzetiségi-kulturális
szervezetek által (53. cikkely).
9. Európa Tanácsi csatlakozás és az ebből fakadó kisebbségvédelmi
kötelezettségek
- Az ET PK 190 (1995) sz. döntése Ukrajna csatlakozásáról: „a kisebbségekkel
kapcsolatos politikáját a Parlamenti Közgyűlés 1201. sz. Ajánlása, és ezen
okmány elveinek megfelelően alakítani, beépíteni ezeket jogrendszerébe
és közigazgatási gyakorlatába”.
- 1997 december 9-én a Verhovna Rada ratifikálta a Nemzeti Kisebbségek
Védelméről szóló Keretegyezményt.
- A Kisebbségi és Regionális Nyelvek Európai Chartájáról 1999
decemberében a Verhovna Rada által elfogadott ratifikációs okmány nem
kerül letétbehelyezésre az ET Főtitkáránál. 2000 júniusában az Ukrán
Alkotmány Bíróság ügyrendi hibára való hivatkozással hatályon kívül
helyezi azt.
- A 2003 májusában elfogadott ratifikációs törvény által meghatározott
követelményszint jelentősen elmarad a meglévő és gyakorolt nyelvi
jogoktól.
- A Keretegyezményt illetően, folyamatban van a végrehajtást ellenőrző
monitoring harmadik, míg a Nyelvi Charta tekintetében második köre.
10. Jogalkalmazási problémákról
A nemzeti kisebbségek fogalmának tág meghatározása: „az
állampolgárok azon csoportjai, akik nem ukrán
nemzetiségűek, nemzeti önérzetről és közösségi
összetartozásról tesznek tanúbizonyságot” (Törv. 3.cikk).
A törvényben garantált kulturális autonómiának a
meghatározatlansága.
Törvényi előírások be nem tartása, többek között:
- az állami intézményi háttér tejes hiánya;
- a választásokat szabályzó törvények figyelmen kívül hagyják a
kisebbségi törvény vonatkozó szabályait (jelöltállítási jog);
- nincs, illetve elenyésző mértékű a kisebbségi szervezetek
állami támogatása.
Esetenként, a nemzetközi kötelezettségek következetes és
lelkiismeretes végrehajtása szándékának hiánya.
11. 5. A nyelvi jogok, mint a gyakorlati kisebbségvédelem alapkérdése:
Nyelvtörvény (2012)
• Ukrajnában, a törvényekben deklarált, és nemzetközi szerződésekben is
szavatolt kisebbségi jogok választékos érvényese nem jelentkezik fajsúlyos
problémaként az országos szintű belpolitikában, hiszen az érdekeltek, az orosz
„mega” kisebbséget leszámítva az ország lakosságának alig 2%-át teszik ki,
külön-külön egyik sem haladja meg a 0,6%-ot.
• Ugyanakkor, az országban meglévő sajátságos kétnyelvűség miatt „perdöntő”
súllyal bír a nyelvi kérdés. Míg az 1996-2010, különösen a 2005-2010 között, a
született jogszabályok, függetlenül az Alkotmány, az érvényes 1989. évi
Nyelvtörvény, és az ország nemzetközi-jogi kötelezettségeitől, kizárólagosan az
államnyelv pozícióinak erősítésére irányultak, a 2010 évi Államelnök választás
után e kérdést illetően gyökeres fordulat állt be. Történetesen, kiiktatásra
kerültek a kisebbségi oktatást hátrányosan érintő miniszteri rendeletek, az
újonnan elfogadásra kerülő PEK (polgári eljárás kódex) már az Alkotmánnyal és
a nemzetközi kötelezettséggel összhangban határozza meg a kisebbségi
nyelvek alkalmazásának lehetőségeit.
• Ezt a fordulatot koronázta meg Az állami nyelvpolitika alapjairól szóló 5029-
VI sz. 2012. július 3-án elfogadott Törvény. E jogszabály a helyi hagyományok
(1989. évi Nyelvtörvény) és a Nyelvi Charta ötvözete. Megőrizve előbbi
strukturális jegyeit, utóbbi elveire épülve alkalmazza annak mechanizmusait .

13. Nyelvi sajátosságok
• Az országban jóval nagyobb az ukrán nemzetiségűek aránya (közel 78%), mint
azoké, akik az államnyelvet anyanyelvüknek tekintik (kevesebb, mint 68%).
• Nemzetiségi szempontból az ország összlakosságának kevesebb mint negyede
tekinti magát valamely kisebbséghez tartozónak (22,18%), nyelvi alapon
csaknem minden harmadik ukrajnai állampolgár (32,47%) valamely nyelvi
kisebbséghez tartozik.
• Az orosz nemzetiségűek aránya sokkal kisebb, mint azoké, akik az oroszt
nevezték meg anyanyelvként. A mindennapi nyelvhasználat tekintetében,
országos általánosításban még ma is az orosz nyelv túlsúlya mutatható ki,
szociológiai felmérések szerint meghaladja a 60%-ot.
• Az ország közigazgatási egységeinek (megye) zömében jelentős számú nyelvi
kisebbség él. Így 13 közigazgatási egységben az oroszt anyanyelvüknek tekintők
száma meghaladja a 10%-ot. E százalékhatár fölött van Kárpátalján a magyar,
Csernivci megyében a román, és Krím-félszigeten a krími tatár nyelvet
anyanyelvűkként vallók aránya.
• Jelentős a számottevőbb nyelvi kisebbségek területi koncentráltsága –
regionális jellege: a krími tatárok 98,1%-a a Krím-félszigeten, a magyarok
96,8%-a Kárpátalján, a gagauzok 86,5%-a és a bolgárok 73,3%-a Odessza
megyében, a görögök 84,7%-a Donyeck megyében, a románok 75,9%-a
Csernyivci megyében él.
15. 5.1. A Nyelvtörvény elvi jellegű rendelkezései :
• Kinyilatkozza és meghatározza az egyén nyelvi önmeghatározásának jogát, történetesen: az
egyén jogát eldönteni azt, hogy melyik nyelvet tartja anyanyelvének, szabadon megválasztani
a kapcsolattartás nyelvét, elismeri a többes nyelvi identitást (3. cikk).
• Az állami nyelvpolitika egyik céljaként határozza meg a regionális vagy a kisebbségi nyelvek
szóbeli és írásbeli alkalmazásának elősegítését az oktatásban, a tömegtájékoztatási
eszközökben, és alkalmazásuk lehetőségének megteremtését az államhatalmi szervek és a
helyi önkormányzatok tevékenységében, a bírósági eljárásokban, a gazdasági és a szociális
tevékenységben, kulturális rendezvények lebonyolításában és a társadalmi élet egyéb
szféráiban (5. cikk 3. p).
• Előírja, hogy a kisebbségi-regionális nyelv a saját területének határain kívül is szabadon
alkalmazható (7. cikk 8. p.).
• Lehetőséget biztosit, a törvényben meghatározott jogok bírósági védelmére, illetve
érvényesítésre (8. cikk 3.p).
• Az oktatás és a tudományos tevékenység nyelvének szabad megválasztását az állampolgár
elidegeníthetetlen jogaként határozza meg (20. cikk 1. p., 21. cikk).
• Meghatározza a tömegtájékoztatási eszközök nyelvének szabad megválasztásnak jogát, és az
államhatalom kötelezettségét a kisebbségi nyelveken való tájékoztatásra (24. cikk),
• Meghatározza a személy család és utónevének anyanyelve hagyományai (szabályai) szerinti
használatának jogát (28. cikk),
• Meghatározza a földrajzi megnevezések kisebbségi nyelven (nyelveken) való
megjelenítésének kötelezettségét (27. cikk).
16. 5.2. Rendelkezések, melyek elősegítik az egyértelmű, korrekt
alkalmazást:
• Pontos értelmezését adja az alkalmazott
szakkifejezéseknek: államnyelv, regionális vagy
kisebbségi nyelv, anyanyelv, régió, terület stb. (1. cikk).
• A nyelvhasználatot érintő társadalmi viszonyok
területére előírja e törvény elsőbbségét (4. cikk).
• Tartalmazza az ország regionális vagy kisebbségi
nyelveinek felsorolását, melyek: az orosz, a belorusz, a
bolgár, az örmény, a gagauz, a jiddis, a krími tatár, a
moldáv, a német, az újgörög, a lengyel, a roma, a román,
a szlovák, a magyar, a ruszin, a karaim, a krimcsak (7. cikk
2 p.).
17. 5.3.A törvény alkalmazási mechanizmusai:
• a Törvényben előirt opciók abban az esetben kerülnek kötelező
érvénnyel alkalmazásra, amennyiben az adott területen (régió), az
adott kisebbségi nyelv hordozóinak az összlakossághoz viszonyított
aránya a lakosság legalább 10%-át teszi ki.
• A fenti kritérium nem kizárólagos , a törvény előírásai
alkalmazhatóak megfelelő helyi önkormányzati döntés, illetve helyi
népszavazás eredménye alapján, abban az esetben is, ha az adott
nyelvi kisebbség aránya nem éri el a 10%-ot. (7. cikk 3.p.).
• Bár a Törvény 10%-ban határozza meg az alkalmazási küszöböt,
ugyanakkor, a helyhatalmi szervek számára előirt kötelezettségek,
csak egy része lép életbe közvetlenül, mások esetében
önkormányzati döntés szükséges az érvényesülésükhöz – vagyis
vannak automatikus normák, és olyanok, melyeket illetően az
önkormányzat képviseleti szervének mérlegelési joga van – ami
normál körülmények között „kisebbségi” többséget feltételez ezen
opciók érvényesüléséhez. Számos, az egyéni jogokkal kapcsolatos
rendelkezés, az egyén szándékától függően kerül alkalmazásra.
18. 5.3.1. Közvetlenül alkalmazandó rendelkezések:
• helyi államhatalmi és a helyi önkormányzati szervek rendeleteinek
kisebbségi nyelven való kihirdetésének kötelezettsége (10. cikk
2.p.);
• helyi államhatalmi és a helyi önkormányzati szervek által nyújtott
lakossági szolgáltatások kisebbségi nyelven való nyújtásának
kötelezettsége (11. cikk 2. p.);
• a szóbeli és írásbeli kérelmeknek kisebbségi nyelven való
benyújtásának és e nyelveken való válasz igénylésének lehetősége
(11. cikk 3 p.);
• minden általános középfokú tanintézetben a kisebbségi nyelv
oktatásának biztosítása (20. cikk 7. p.);
• a kisebbségi oktatási nyelvű tanintézetekben, az ukrán nyelv és
irodalom tantárgyak kivételével minden tantárgy kisebbségi
nyelven való oktatása (20. cikk 8. p);
• a földrajzi megnevezések kisebbségi nyelven való megjelenítése
(27.cikk).
19. 5.3.2. Helyhatalmi döntés alapján kerül alkalmazásra:
• helyi államhatalmi és önkormányzati szervek munkájában,
ügyintézésében és okmányaiban való alkalmazása (11. cikk 1
p.);
• helyi államhatalmi és önkormányzati szervek által szervezett
konferenciák, gyűlések munkájában való alkalmazása (11. cikk
4. p.);
• a hivatalos hirdetmények közzététele, a pecsétek és
bélyegzők, fejléces űrlapok, cégtáblák kivitelezésénél (11.cikk
5, 6 p.);
• a választások és népszavazások dokumentációjának vitele,
szavazólapjainak elkészítése során (12. cikk 1, 2 p.);
• a kisebbségi nyelv oktatásának mértéke megállapításakor (20.
cikk 7. p.).
20. 5.3.3.A személy döntése, szándéka alapján kerül alkalmazásra :
• a választások, népszavasok agitációs anyagainak nyelvét (nyelveit) a jelölt
határozza meg (12. cikk 3 p.);
• a személyazonossági igazolványban a személy adatainak kisebbségi nyelven való
feltüntetése. E rendelkezés hatálya kiterjed az anyakönyvi kivonatokra és az
anyakönyvi hivatal által kiadott okmányokra, a végzettséget igazoló okmányra, a
munkakönyvre, a katonakönyvre és az egyéb hivatalos dokumentumokra (13.
cikk);
• a felek közös megegyezése alapján, kisebbségi nyelven is lefolytatható a polgári
peres eljárás, más jellegű perek és eljárások esetében is alkalmazható a kisebbségi
nyelv (14. cikk);
• az oktatás-nevelés nyelvének meghatározása (20. cikk);
• szabadon alkalmazhatják az oroszt és más kisebbségi nyelvet tevékenységük során
a vállalatok, intézmények, szervezetek (18 cikk);
• a magán oktatási intézményekben az oktatás nyelvéről az intézmény alapítója
(tulajdonosa) dönt (20. cikk 6. p.);
• a felsőoktatási felvételi tudásfelmérés tesztjeinek kisebbségi nyelvekre való
lefordítása, illetve alkalmazása (20. cikk 9. p.);
• a reklám és az árumarkírozás nyelvéről a termék előállítója dönt (26. cikk);
• a személyazonosságot igazoló okmányokban a személy nevének kisebbségi
nyelven történő beírása a tulajdonos előzetes jóváhagyásával történik (28. cikk 4.
21. Dilemmák
• Maradéktalan megvalósulásának akadályai, többek között:
• a kérdés politikai érzékenysége és az ukrán nemzeti vonal elkeseredett,
erőszaktól sem visszariadó ellenállása;
• a szükséges anyagi eszközök hiánya – pénzhiány;

• Ezért részünkről:
• mindenképpen elismerés és köszönet illeti e jogszabály megalkotóit és
elfogadóit;
• következetesen törekedve jogaink érvényesítésére, a végrehajtás
folyamatában tekintettel kell lennünk a többség érzékenységére, belátást
kell tanúsítanunk;
• nem követelőznünk kell (helyi körülmények között ez egyébkén is
kontrproduktív magatartás), bátorítanunk kell a többséget, és tevőlegesen
(szervezetileg, módszertanilag, anyagilag stb.) hozzájárulni a
megvalósításához.
