1. Dear Sirs,
Since the subject is very well-known and all parties are extensively familiar we see no reason to
repeat the whole history of the project from the beginning however we certainly believe we should at
least emphasize what has happened since our convoy was unfairly declared as "illegal" due to the
false and unfounded allegations information on 26th August 2022 after leaving Brazil on 4th August
upon completing all required procedures as per the all relevant regulations.
Our company, Sok Denizcilik, has always acted in accordance and respected the regulations, laws and
rules since the establishment therefore we followed the instructions of the exporter country's
competent authorithy, IBAMA, regarding returning the waste (as per Basel Convention) to the
exporter country, Brazil.
On 5th October 2022 the convoy arrived to Suape roads (destrict of Pernambuco-BR), to the location
which was instructed to us by the Brazilian Navy.
Even though we had requested numerous times during the return voyage, no refugee port (or at least a
berth place) was unfortunately appointed. On the contrary we were ordered to keep the "waste" off
Brazilian inland waters as if the waste had not exported from Brazil nor it was not used be owned by
the Brazil.
At the same time it was instructed us to provide a Salvage Master Report as a damage was determined
on the waste on arrival. We completed the same report which was also supported by an underwater
survey and also obtained the Non-Coral Sun Report. These were the instructed items to us for being
able to get the permission to enter the inland waters. During this time we attended several meetings
with the Navy, Engeprom and local Authorities for stating our intention to find a proper way which
would enable us to continue the project which was the environmentally sound recycling & disposal of
a Brazilian Waste.
We stated several times that the Brazilian Authorities should step in responsibly in this respect and
appoint us a berth place but unfortunately we did not find any serious response. On the contrary,
despite of all our affords, the Authorities kept decling providing solid and efficient assistance and the
convoy kept outside with unreasonable excuses. Actually same could easily be considered as
irresponsible as the required Salvage Master Report clearly stated that the damage on the waste should
be repaired without much delay.
While we were expecting a sheltered berth place for the repairs and completing the required procedure
for re-initiating the re-export process all we happended to face was declines and refusals with
unreasonable excuses. At the end, the Brazilian Waste (hull of ex Sao Paulo) was completely rejected
for any kind of entrance to the inland waters in Recife (State of Pernambuco) as the State Government
opened a court case against the Federal Government.

2. All of a sudden our convoy, and surely our company, has just become a victim of a vendetta where we
were even not a party. This conflict costed us around USD 5 Mio. which might easily be considered as
a small fortune and unfortunately the Authorities just ignored our situation and acted this financial
bleeding had no relation with them even though they were the actual owners of this waste around a
year ago.
Loosing the hope for a safe place in Pernambuco (which was ordered to us as destination by the
Navy...) then we tried with all possible options; all shipyards & almost ports in Brazil but all ended up
with further declines & refusals. We even tried, with our own capabilities, to find an anchorage
location however by the instruction of the Navy in regards of prohibiting any anchorage this became
also impossible.
At the end, despite of all our efforts we were not able to get the required assistance from the
Authorities which would enable us to continue on this project. As we stated several times our firm
intention was to get the re-export procedure completed and complete the recycling & disposal of the
Brazilian Waste as per the contract that we signed. However as of today it has been 77 days since our
arrival and yet all our assistance & cooperation requests have been completely ignored which brought
us to a conclusion that we are not in a position to maintain this waste recycling & disposal project
anymore, especially while any of the States involved taking any responsibility.
It should be also appreciated by involved parties, that we as a professional approved and certified
Green Ship recycling yard, do all efforts to continue the sustainability and protecting the environment
since the first day of our involvement.
From now on, any action from us is going to be solely for protecting ourselves from the "battles" that
we are certainly not a part nor a frontier
