Every personal or business dispute that is drawn into
mediation or collaboration is rooted in a relationship.
Two sides of a once successful partnership that have at
least some history of shared purpose and goals. This
“common ground” is easily overlooked or lost in the
heat of the moment, but it is the first thing we seek to
reveal and re-establish as we help our clients arrive at a
mutually satisfactory result. Our goal is a resolution that
enables and empowers both parties to move forward
with confidence and without acrimony or regret.

At SettleAssist™, we work to resolve disputes outside
the courtroom. Solving problems takes precedence over
filing papers. Our way is through a dialogue delivered in
confidence and without compromise. It’s a less stressful,
more comfortable and far more cost-efficient way to
help couples and companies move on without becoming
bogged down in the legal system. While the courts look
to the past, we focus on the future, and bring as much
equity and as many resources to it as possible. Every
day we prove that coming to an agreement can be an
enlightening and empowering experience.

At the outset of mediation or collaboration, both parties
are typically looking to minimize the damage. To cut their
loses and retain as much as possible moving forward.
Often, a sense of enmity prevails. We work to turn
‘them vs. us’ into ‘we’ through a truly collaborative and
totally comfortable process of discovery that reveals
personal and shared aspirations to create a win-win
situation. Our goal is to have both parties move as
quickly as possible to the next stage with understanding,
confidence and enthusiasm.

Our goal at the end of mediation or collaboration is
to present you with a fresh sheet of paper on which
to write an exciting new chapter in your personal or
business life. With the past resolved, the present dealt
with fairly and the future filled with promise.

A successful mediation is one that brings both parties
a sense of winning, but also with a new sense of what
winning really is. We focus not on minimizing loss,
but on maximizing gain. We show how an unfortunate
and unwelcome situation can form the foundation for
positive action and a fresh perspective. You will find us
open, honest, without bias and with a passion not only
for resolving the situation, but enhancing it.

Moosa graduated from Dalhousie Law School
in 1990 and established his own law firm in
Edmonton. In over 20 years practicing in all areas
of law he has gained particular expertise in dealing
with Family Law.
Early in his career, Moosa began to question the
conventional legal approach to resolving divorce
and dispute issues. He was struck by how long the process took, and by
how much it cost; frequently consuming large portions of the assets which
would be better put to helping clients get on with their lives. He committed
to following a path focused on sensibilities rather than systems; one that
sees beyond differences and draws strength from relationships that while
in dispute, are based on tenure and respect.
As a designated Chartered Mediator, Moosa created a framework for a
Mediation Program for the Alberta Court of Queen’s Bench. During his
time with Court Services, Moosa supervised the Provincial Civil Mediation
Program. A Registered Collaborative Lawyer, he has previously served on
various Law Society committees, the Alberta Human Rights Commission
and as a Board Member with the Centre for Mediation and Restorative
Justice. Moosa has presented papers at LESA Seminars, the Alberta
Dispute Resolution Institute of Alberta (ADRIA) Conferences and the
Alberta Government Dispute Resolution Network.
