• 1. No obstante lo dispuesto en el artículo 28, en circunstancias especiales,
un Estado miembro podrá autorizar, por un período no superior a 120 días,
la comercialización de productos fitosanitarios para una utilización
controlada y limitada, si tal medida fuera necesaria debido a un peligro que
no pueda controlarse por otros medios razonables. El Estado miembro de
que se trate informará inmediatamente de la medida adoptada a los demás
Estados miembros y a la Comisión y proporcionará información detallada
sobre la situación y cualquier medida adoptada para garantizar la
seguridad de los consumidores.

• 2. La Comisión podrá solicitar a la Autoridad un dictamen o asistencia
científica o técnica. La Autoridad emitirá su dictamen o facilitará los
resultados de su trabajo a la Comisión en el plazo de un mes a partir de la
fecha de la solicitud.
• 3. En caso necesario, se adoptará, de conformidad con el procedimiento
de reglamentación contemplado en el artículo 79, apartado 3, una decisión
sobre el momento y las condiciones en que el Estado miembro:
a) puede prorrogar o no la duración de la medida, o repetirla, o
b) debe retirar o modificar la medida que ha adoptado.
• 4. Los apartados 1 a 3 no serán de aplicación a los productos fitosanitarios
que contengan organismos modificados

1. Un producto fitosanitario que esté autorizado en un Estado miembro
(Estado miembro de origen), podrá, previa concesión de un permiso de
comercio paralelo, introducirse, comercializarse o utilizarse en otro Estado
miembro (Estado miembro de introducción), si este Estado miembro determina
que el producto fitosanitario es idéntico en su composición al producto
fitosanitario ya autorizado en su territorio (producto de referencia). La solicitud
se presentará ante la autoridad competente del Estado miembro de
introducción.
