أثارت تعديلات قانون العقوبات المصري والقانون رقم 62 لسنة 1975 في شأن الكسب غير المشروع بالقانون رقم 97 لسنة 2015 ومن قبله القانون 4 لسنة 2012 , بحيث يسمح بالتصالح مع الفاسدين في جرائم المال العام , وهذا في رأينا إتجاه مرفوض من الأساس , حيث يتم بذلك إنقضاء الدعوى الجنائية , وإنقضاء سلطة المجتمع في عقاب المجرم , بالإضافة إلى الإستفادة من عدم تطبيق العقوبات التبعية , التي تعزل الفاسد عن المجتمع بما يمنعه من الإستفادة من جرائمه , وفي مقابل إمكانية إسترداد الأموال المتحصلة عن جرائم الفساد بإرادة سياسية في عقاب الفاسدين , سواء تلك المهربة للخارج أو المتواجدة في الداخل.
