enthusiast residing in Dubai. When I AM - on visit to India I do participate
in outdoor activities in Maharashtra with family & friends. Now with the
new procedure in GR do I have to take prior permissions and pay for this
activity each time I engage in to, either as an individual or a group?
A There are three parts to our response:
a) Present draft of GR states restriction of five persons which is confusing
– this is one of the points that all of us are seeking clarity on.
b) MAC’s stand: such individual activity should not be regulated since all
those who go do so on their own responsibility
c) MAC recommends that such a group should anyway study guidelines
relevant to adventure activity undertaken, as it will only help enhance
safety.

MAC’s stand is that the draft of this GR is only applicable to adventure
activities (like mountaineering or rock climbing) that are only organised
for participants (who participate only for recreational purpose and
exercise no control over the activity). Adventure activities (e.g., Pinnacle
Climbing or Peak climbing expeditions) undertaken on individual basis or
by organisations like clubs on their own responsibility are not covered in
this draft. Since there seems to be some confusion about this point we
can suggest government to clarify the provisions.

availability for NRI & also for residents?? there are hardly any insurance
companies who provide insurance for adventure activities India
A There is one company now in India that brokers with insurance
companies to provide policies specifically for adventure activities. This is
still a developing field. MAC has had one dialogue with an entity abroad
to get an idea about the status of this topic in that country, and our
understanding is this is a complicated topic everywhere. The whole thing
probably gets more complicated when one considers insurance for NRIs
and foreigners. More study is needed. MAC would welcome contribution
in the form of research and suggestions in this area!
7. From Nitin Bodas to Everyone: 11:17 AM - Myself Nitin Bodas, I AM -
having my own business for adventure activities. My question is I do the
activities for not more than 5 to 6 people at a time. So whether I required
4. to prepare all the documents. Generally my participants came from out of
our state, we do activity outside our state, still do I have to submit all
documents required as per new GR ?. Any concession for document
preparation in such case and not for registration with Govt.
A MAC’s understanding about the draft of GR: all provisions are applicable
to any entity engaged in organizing adventure activities for participants.
The number-restriction is for individuals who go in groups. E.g., office
colleagues, group of friends etc.
8. From Mrudula to Everyone: 11:17 AM - My company: Mabel Holidays, do
organise Summer camps and Himalayan adventure trips. What kind of
registration I will have to do?
A MAC’s understanding about the draft of GR: your organis ation’s
registration should follow all provisions stated in the draft of GR since
they are applicable to any entity engaged in organizing adventure
activities for participants.
9. From Anuj Khare NW to Everyone: 11:19 AM - how many wildlife tour
operators were consulted and involved in this entire process while
drafting the rules & regulations regarding wildlife Safaris. Why group of
adventure experts have drafted wildlife SOPs. ? One person's view can be
considered as view of the entire tour operators community.
A Further to response given by Vasant Limaye during panel discussion:
The guidelines created by MAC and sent to government certainly had
gaps in some areas, and MAC was clear about not attempting to create
guidelines where we did not have expertise.
5. Since there is a directive from Central Ministry of Tourism to
Government of Maharashtra to adopt the ATOAI guidelines, MAC
decided to ‘fill a few gaps’ by respecting the ATOAI guidelines and add to
it some content that was i) specific to Maharashtra (if relevant) and ii) as
advised by Safety management System approach.
Consider the example of wildlife safaris:
a) MAC adopted the wildlife safari guideline of ATOAI
b) MAC added to that document just the generic leadership content
according to what the Safety Management System approach
recommends
c) MAC made sure that the leadership content mentions that all such
safaris comply with existing legal requirements (with the knowledge
that there already are existing laws and guidelines in the Forest
Department and other concerned authorities like NTCA), and that the
leader / instructor has copies of all compliance documents (along with
other)
d) MAC suggested to government to have a single-window registration
process where hopefully such challenges will be taken care of
While MAC keeps revising its own guidelines (we are on our 4th
version), MAC does have its limitations primarily because all work is
done on voluntary-basis. MAC would welcome people like you and
your friends/colleagues to help this process; alternatively, you could
write directly to the government in order to bring about a change as
you see fit. It is true that MAC could have done more work on this,
and also that the government could have done the same.
6. 10. From Nitin bodas to Everyone: 11:22 AM - Myself Nitin Bodas from Pune,
we have registered club for adventure. We do number of climbs only for
members with no profit. Our activities restricted only for few members
with contributing the actual charges. So with this new rule we will
registered with govt. My question is whether we required to prepare all
such documents and records which is must for profit making activities
organised by other clubs. Also we do some practice activities before our
major activity, does it comes under same rule?Another aspect is for last
say 20 years we do activities with permission taken from forest dept. For
stay, camp and activities. We have all records with us, still we have to
follow all such rules given under new GR
A MAC stand: If adventure activities (like rock climbing) are undertaken by
climbers themselves and everybody is responsible for own safety then
such activity is beyond the purview of the draft of the GR. So, rock
climbing practice undertaken by rock climbers is beyond the purview of
the draft of the GR.
Stay at camp and conduct of activities are covered by draft of GR. But if
they are falling under wildlife safaris then Vasant Limaye has replied to
this question during panel discussion.
11. From Mrudula to Everyone: 11:24 AM - My daughter participate in
climbing competitions. So is there any registration required for it?
A Not required under the draft of this GR. Shirish Sahasrbuddhe has
answered this question during panel discussion.

A MAC’s understanding of the draft of this GR: the organisations/resorts
with whom a participant is enrolled are required to be registered. Also if
external experts are providing such services to resorts then their
organisation needs to be registered as service provider. The safety
guideline for ‘service provider’ may be considered.

certified with at least basic mountaineering course. So your safety will be
assured otherwise Maharashtrian adventure activities are not life
threatening if you follow the guidelines
A MAC’s understanding of the draft of the GR: The guidelines refer to such
qualification criteria – they vary from activity to activity. BMC does
prepare a person for many leadership responsibilities but may not be
enough by itself in many cases. Guidelines can definitely help lower risk
in adventure programmes organised for participants anywhere including
in Maharashtra. But it may be noted that risk can never be brought down
to zero.

leader to participant ratios given on page 32, 56, 61, (English version)
?leader to participant ratio is not part of other land based activities like
basic rock climbing, Pinnacle climbing, Rappelling, W. rappelling, rope
course, valley crossing etc. Is it right ?
A MAC’s point of view: the ratios given in a few guidelines are to be taken
as ‘indicative’, a guiding example. Also, it is easier to state such
8. examples for hikes, and much more difficult for any rock climbing
project. More work is definitely required in this area.

organizer..we have our own start up and we tie up with the respective
people of rural respective spots.. what guidelines should respective
people of adventure sector should follow?
A MAC’s point of view: Thanks for asking such a crucial question! The
implementation of such safety guidelines is an extremely complicated
challenge for both, the government and all of us adventure programme
organisers. Work related to safety guidelines that are relevant to local
populations needs to be done. At the moment, MAC would recommend
that a group leader follow whatever is under his/her control and is
supported by his/her organisation through the guidelines of draft of GR.

A No, as long as you and your group members hike on your own
responsibility.

not require, registration. This GR applies mainly to organised activity
where the inexperienced participants depend on organisers for safety

A MAC’s stand: The list of copies of papers suggested in the draft of the GR
is comprehensive – any programme should carry with it only those
documents that are relevant. There should be minimum burden of
paperwork and no official apart from DoT should routinely ask for
document except where it is required by law (e.g., inner line permits,
forest permits, etc.). The qualifications of such a DoT official are not
clear, and if there is a concern about this then MAC encourages people to
write to GoM with reference to specific sections of the draft of the GR.
19. From Saurabh to Everyone: 11:42 AM - can we take police assistance if
we r stopped by villagers on the way?
In the current times, with uncertainty about what to do for protection of
local communities from spread of COVID-19, villagers may have their
own ‘rules’. You need to check whether there is any valid reason for such
an act of being stopped. If there is no reason, you can take help of police.

15. A A 12 mm. kernmantle rope is good to be used if the rope is i) used for
activities it is meant for; e.g., use will depend on whether it is static or
dynamic ii) if it meets UIAA certification standards; note that there are
Indian companies today that sell UIAA certified ropes or ropes that meet
UIAA certification standards iii) accompanied by information about the
rope specs given by the manufacturer.

A MAC proposes to hold seminars to spread awareness about a lot of issues
about the GR that will come out: the seminars aim at: guiding
organisations, field instructors/leaders, individual participants and
parents who want to send their children on adventure programmes, etc.
MAC is also aiming to facilitate training workshops to be made available.

for different adventure activities - will it make sense to associate with
experts in those fields who have their registrations sorted and the
activities be carried on by them with due fees given by the organising
group?
A Such a decision will have to be taken by respective entity based on its
own resources and capacities. The present draft of the GR has a
guideline for a contracted party titled as ‘service provider’ which may be
referred to for guiding such a decision.

A The present draft of the GR has some ‘rules’ in the form of some basic
mandatory requirements (like first aid qualification and experience of a
leader). MAC is also aiming to facilitate training workshops to be made
available.

registration of trek group .what to do in this case ?
A Family outings are not covered in draft of GR. A government employee
can a) go out on their own, on their own responsibility (ensuring that
they have required competence) and/or b) participate in programmes
organised by others.

17. MAC’s understanding of “guidelines”: all safety guidelines are meant for
the safety of both instructors/leaders as well as participants; each
guideline has a section for the paperwork that is to be with
instructor/leader which includes medical history of participants. There is

A MAC’s understanding: Local guide is required to be registered as ‘service
provider’ as per the provisions in GR-draft. The non-clarity about number
of group members needs to be communicated to the government.
The implementation of such safety guidelines is an extremely
complicated challenge. Work related to safety guidelines that are relevant
to local populations needs to be done. At the moment, MAC would
recommend that a group leader follow whatever is under his/her control
and is supported by his/her organisation through the guidelines in the
present draft of the GR.

Any organisation that takes on the responsibility of participants needs
to be registered. Cost/profit is irrelevant because what is in focus is ‘who
18. bears the responsibility of safety of participants’. With specially-abled
people participating in adventure programmes, the responsibility is very
clearly on the organisation taking them out, and the field
instructors/leaders.

By default, yes: with disabled people participating in adventure
programmes, the responsibility is very clearly on the organisation taking
them out, and the field instructors/leaders.

that are needed to be addressed for disabled persons. This is an area
where more work needs to be done.

A There are guidelines for individual participants and parents who want to
send their children on adventure programmes.

discussion. MAC is not averse to any dialogue and will always take
positive actions to unite the field.

A There is one guideline for caving in the present draft of the GR. MAC
welcomes suggestions from experienced cavers – when it does the next
revisions of its own guidelines.

conducted by a Vendor based in other state and unfortunately any
accident happens, Who will be held responsible for the same? Vendor or
the co. who has collected the payment from the customer?
A This will need more legal advice. The approach that MAC would like to
recommend: the organisation that conducts a programme should take
maximum care to ensure that its participants’ safety is maximised. There
are relevant guidelines for any organisation in the systems and processes
that it should adopt, and also for a contracted ‘party’ titled ‘guidelines
for service provider’.

institution clubs need registration? It is not commercial activity, but
organised by one of the staff member (mostly teacher) for larger number
of students, one day or an overnight.

A MAC’s understanding of draft of GR: There are specific guidelines to
guide choice of equipment – please refer to those guidelines. You can ask
the organising team to explain the suitability of its equipment.

A MAC is trying to communicate about registration fees to make it possible
for the smallest of small organisations to be able to function.

"Organizers based out of Maharashtra wishing to conduct adventure

registration outlined under the Adventure Policy." hence the question is :
if you are a from Maharashtra, but carrying out adventure activities only
outside the state of Maharashtra then one does not need to register
under the Adventure Policy?
A This and related aspects need more clarification – MAC will include this
when seeking clarity from the government.

A MAC proposes to help review a case in order to throw clarity on the how
and why of an incident. As the MAC website states:
MAC is not a) A regulatory body b) A legal firm to fight cases for its
members in case of any mishap (It is possible that MAC would intervene
by investigating incident and state facts to the Government authorities)
भ्रष्टाचारापासून कसे सूंरक्षण लमळिू शकतात: this is way beyond the scope of
the functioning of MAC.
BUT: you have raised very pertinent and important points that need
further thought to see what more can be done by all of us, including MAC.
51. Pankaj Rajmachikar: Illustration : item No.4 in the Guidelines for
Mountaineering and Trekking – "The tools used for mountaineering and
trekking must be UIAA certified or accredited by Indian Mountaineering
Institute." If one does not use such tools and there is an accident, clearly
the leader or organiser will be held liable for violation.
24. A MAC’s point of view:
There is no ‘Indian Mountaineering Institute’ – so that needs to be
corrected in the draft of the GR. Our request to Govt is to delete this
statement from the draft GR.
MAC has submitted a detailed sheet of what equipment can be used on
adventure programmes, including alternatives for UIAA certified items.
The technical specification sheet, which is MAC’s suggestion, is also there
in the draft-GR published by Govt. of Maharashtra. Pls see pages 159 to
164 in the English version of draft-GR., for Marathi, see pages 131 to 134.
In MAC’s understanding, the ‘root cause’ of an accident may be due to
any of multiple factors and not only certification-status of equipment.
Some possible equipment-related reasons why an accident may happen:
- Appropriate certified equipment but improper use – points towards
wrong decisions and actions of instructors/leaders
- Appropriate certified equipment but incompetent instructors/leaders
– points towards wrong appointment of leaders/instructors
- Certified but inappropriate equipment
- Certified but damaged equipment which was unfit to be used
- Etc.
