Rockit Summit, Andrei Caciurenco - Headquarter in Moldova?! Law hacks regardi...Rockit Conference
This document discusses starting and operating an IT business in Moldova. It notes that Moldova's laws are evolving to align with EU directives and favor fair competition and online public services. Some key laws related to e-commerce, digital signatures, electronic communications, and payment services were mentioned. The document also discusses Moldova's national strategy to promote the digital economy and IT sector competitiveness. It addresses common questions from IT clients around setting up a company, employment regulations, data protection rules, tax incentives for IT businesses, and intellectual property. Overall, the document presents Moldova as working to develop a favorable legal environment for IT startups and businesses.
The document discusses challenges facing Australia's business registry system and proposals to modernize it. It notes the ASIC registry faces outdated technology, increasing data loads, and growing customer expectations. Two modernization proposals are outlined: a private sector proposal, and a proposal to modernize within the government by creating a new consolidated registry platform managed by the ATO. The benefits of modernization would include being more responsive to changes, having an entity-based data model, and consolidating the ASIC and ABR registries. Key challenges of implementation include legislation changes, business process reengineering, organizational change, new technology, and user transition management.
This document discusses enforcement of online copyright in the UK and challenges around implementing the Digital Economy Act. It provides 3 key points:
1. The Digital Economy Act outlines 3 measures for addressing online copyright infringement, including initial obligations for ISPs to identify and notify subscribers of alleged infringement.
2. There are several complexities in implementing the Act, such as ensuring an appropriate appeals process, defining standards of evidence, and determining the scope of which ISPs are covered.
3. A survey found that many infringers claim they are not confident about what is legal online, and that improvements to legal digital services would encourage infringers to stop illegal downloading and streaming.
The Belgian tax authorities have launched an unprecedented wave of audits on company withholding tax exemptions and reductions, resulting in over 2,000 notices so far. While the information requests have been extensive at times, the tax inspectors have generally taken a cooperative approach. However, negotiation room for extensions is limited. The notices received vary widely in their questions, which aren't always aligned with legislation. Failing to provide answers to all questions could lead to tax reassessments, so expert support is recommended to minimize exposure. While the initial wave targeted larger companies, a second round of notices is expected to include smaller companies claiming multiple exemptions or reductions. Companies are advised to carefully review their current exemptions and ensure compliance.
This document summarizes key trends from the 2012 AGM season in the UK and globally. It finds that shareholder activism increased, particularly through social media. While electronic proxy voting is growing, there is still room for more electronic voting over paper. The UK trends of increasing shareholder opposition to executive pay and the influence of proxy advisors are consistent with global trends. New technologies like virtual meetings, mobile voting, and quick response codes are emerging. UK legislation will soon require binding shareholder votes on executive pay policies and advisory votes on pay applications. Globally, attendance varies but electronic voting is growing relative to paper, and sentiments around executive pay and shareholder rights are increasing across regions.
The document describes investment strategy for a foreign player to make strategic long term investment in the renewable energy sector in the republic of India. The concept paper explores, key criteria for selection of country. Further the document highlights key risks being envisaged in investing in the developing country. Further, it also explores how to apply impact investing or ESG investing principles in your investment?

It outlines challenges ASIC faces in moving more services online, including developing and supporting new online systems, transitioning from paper-based to online registers, and handling unreliable legacy data in the new online environment. Political and legislative uncertainties also pose challenges.

The document describes ACRA's Seamless Filing project which streamlines the process for Singapore companies to file statutory returns. It reduces preparation time from 9 hours to 35 minutes. Accounting software generates draft filings which companies can review and submit through a single authentication to both ACRA and IRAS. This promotes ease of transaction with government agencies and data quality by standardizing required data fields.
HMRC is refocusing on employer compliance around the employment status of freelancers to raise tax revenue. Reviewing existing arrangements with freelancers is advised. Determining a freelancer's status is complicated, but engaging them through a personal service company (PSC) generally protects the end user from PAYE/NIC liability if IR35 does not apply. IR35 now applies if the freelancer would be an employee or officeholder of the end user absent the PSC. When using a PSC or third party intermediary, ensure all tax obligations are properly met.

Ian will cover the legal and tax aspects of dividends received from companies and, in particular, owner-managed businesses rather than dividends from shares on the stock exchange, etc.

Employers need to prepare for IR35 reforms which are being introduced in the private sector this April. Like the public sector, clients will have to determine whether the contractor falls inside or outside IR35. There is a right way and a wrong way to comply with IR35 rules. Just putting all contractors ‘inside IR35’ and hoping for the best isn’t good enough.
During this webinar, Jas Jhooty, Director at emTax, will explore the steps that need to be taken to obtain ‘outside IR35’ SDS rulings for as many contractors as possible. By making simple changes to contracts and working conditions, businesses can keep 'inside IR35’ contractors to a minimum and reduce costs from April 2021.
Plus, see how BrightPay caters for IR35, including automatic disabling of employee benefits that off-payroll workers are not entitled to.

Under the new legislation, whenever Irish employers pay their employees, a file must be submitted (electronically) to Revenue containing details of these payments.
The contents of this file will be similar to the details currently submitted in the annual P35, however, unlike the annual P35, this file must be submitted each pay period. Therefore, in most cases, the submission will be made either weekly or monthly.
This real time information will enable Revenue to ensure that employees are receiving their correct credits and cut off points. This in turn should mean that the incidence of year end over/underpayments of income tax will be substantially reduced.

17. HMRC TOOL
“HMRC will stand by the result given unless a compliance check finds the
information provided isn't accurate.
HMRC won't stand by results achieved through contrived arrangements
designed to get a particular outcome from the service. This would be treated
as evidence of deliberate non-compliance with associated higher penalties.
HMRC can review your taxes for up to 20 years.”
18. WHERE WE ARE NOW
• Significant numbers of contractors left public sector
• Things starting to stabilise
• NHS U-turn
• Compliance activity starting
• Questionable ‘schemes’ appearing
19. THE FUTURE
• Reform in the private sector
• “Early indications are that public sector compliance is increasing as a
result, and therefore a possible next step would be to extend the reforms to
the private sector, to ensure individuals who effectively work as employees
are taxed as employees even if they choose to structure their work through
a company.”
• Likely to be April 2019
