Costa Blanca North:
A Paradise of Diversity Along Spain’s White Coast
Nestled on the eastern coast of Spain, Costa Blanca is a beloved tourist destination
known for its stunning beaches and impeccable weather. The Costa Blanca, or ‘White
Coast’, stretches over 200 kilometers along the Mediterranean Sea in the province of Ali-
cante. While most travelers are acquainted with the bustling south of Costa Blanca, the
northern part of this coastline is a hidden treasure waiting to be explored. Costa Blanca
North boasts an exceptional blend of history, culture, natural beauty, and modern
luxuries.
Charming Towns
One of the defining characteristics of Costa Blanca North is its collection of picturesque
towns. Among the most enchanting are Denia, Javea, Moraira, Altea, and Calpe. Denia, a
historical coastal town, is recognized for its ancient castle, excellent seafood, and natural
harbor. Javea, with its pristine beaches and coves, appeals to those seeking solace in
nature. Moraira is a former fishing village that has evolved into an upscale resort town
without losing its authenticity. Altea, distinguished by its white-washed houses and blue-
domed church, offers a touch of artistic charm, while Calpe invites visitors with its impos-
ing rock formation, Peñón de Ifach.
Culture and History
Costa Blanca North is steeped in history. Denia’s Castle and Archaeological Museum are
must-visit sites, dating back over 2000 years and providing a glimpse into the region’s
Roman and Moorish past. The town of Guadalest, perched atop a mountain, is another
historical gem with its ancient fortress and breathtaking views. Festivals like the Moors
and Christians in Altea and the Bonfires of San Juan in Alicante, showcase the rich cul-
tural heritage and traditions of the area.
Natural Beauty
The region’s natural landscapes are as varied as they are striking. With its miles of coast-
line, Costa Blanca North offers an array of beaches and coves. The Montgó Natural Park,
between Denia and Javea, is a haven for hikers and nature enthusiasts, boasting a rich
biodiversity and magnificent views of the surrounding areas. The Algar Waterfalls near
Callosa d’En Sarrià are another natural attraction that shouldn’t be missed.
Culinary Delights
The gastronomic scene in Costa Blanca North is a reflection of its Mediterranean setting.
Local markets are laden with fresh fruits, vegetables, and seafood. Paella is a regional
specialty, and visitors should not miss trying the authentic version with rabbit and snails,
or the seafood variation. Tapas bars are abundant, and a glass of local wine pairs perfectly
with the variety of small dishes.
Modern Luxuries
For those seeking contemporary comforts, Costa Blanca North doesn’t disappoint. The
region boasts several high-end resorts and boutique hotels, along with luxury villas for

Nature’s Bounty
Javea is blessed with a diverse natural landscape. The Montgó Natural Park, which domi-

plethora of flora and fauna, and the summit offers breathtaking views of Javea and the

Villajoyosa:
A Symphony of Color and Culture on the Costa Blanca
Nestled between the towering mountains and the azure Mediterranean Sea, Villajoyosa,
or La Vila Joiosa as it is known in Valencian, is a picturesque coastal town on Spain’s Costa
Blanca. With its rainbow-colored fishermen’s houses, historical heritage, famous chocolate
industry, and pristine beaches, Villajoyosa is a charming destination that encapsulates the
essence of Spanish coastal living.
A Rainbow by the Sea
One of the most striking features of Villajoyosa is the vibrantly colored houses that line its
seafront. This array of reds, blues, yellows, and greens is not just visually captivating but
also historically significant. It is said that the fishermen of Villajoyosa painted their homes in
bright colors so they could be seen from the sea and guided safely back to shore.
The Chocolate Capital
Villajoyosa boasts a rich tradition in chocolate making. The town is home to some of Spain’s
most famous chocolate factories, including Valor Chocolate. Visitors can take a tour of the
chocolate factories, learn about the chocolate-making process, and, of course, sample the
delicious creations.
Beaches and Coves
Villajoyosa’s coastline is adorned with golden sandy beaches and secluded coves. The Playa
Centro is the main beach and is situated adjacent to the town center. For those seeking
more seclusion, the nearby coves such as Playa del Torres and Cala de Finestrat offer serene
environments and crystal-clear waters.
Historical Riches
The town’s history can be traced back over 3,000 years, and it boasts a wealth of historical
sites. The Roman ruins at Allon, the Renaissance-style Church of the Assumption, and the
old town’s narrow streets echo tales of ancient times. Additionally, the impressive walls of
the 16th-century Saint Joseph Castle loom over the town, serving as a reminder of Villa-
joyosa’s rich heritage.
Festivals and Traditions
Villajoyosa is renowned for its traditional festivals, the most famous of which is the Moros
y Cristianos (Moors and Christians) festival, celebrated in late July. This week-long festival,
declared an International Tourist Interest, features vibrant parades, historical re-enactments,
and a breathtaking mock battle on the beach at dawn.
Diverse Culinary Offerings
Villajoyosa offers a culinary experience that reflects its coastal location and cultural heritage.
Fresh seafood is the star of the show, and the town’s beachfront restaurants serve traditional
dishes like arroz a banda (rice with fish) and other seafood delicacies. And of course, choco-
late features prominently on the dessert menus.
Market and Fishing Port
The town’s market, Mercado Municipal, is a must-visit. Here, one can buy fresh produce, fish,
and local delicacies. Moreover, the fishing port of Villajoyosa is one of the few remaining
along the Costa Blanca that retains its traditional character. A visit to the fish auction, where
the day’s catch is sold, is an experience not to be missed.
If you have Villajoyosa or surrounding areas on your real estate radar, get in touch with your
requirements and our expert team will find the property to suit you. We have a wide range

When you have identified the
property you wish to acquire,
the purchasing journey kicks off with
a reservation contract. This agreement
locks in the property’s price and re-
moves it from the market, typically for
30 days, in exchange for a fee ranging
from €3,000 to €5,000. This amount
is typically placed in a client or escrow
account, managed by your legal coun-
sel or agent.
Typically, the contrato de arras man-
dates a deposit payment ranging from
10 to 20 percent of the property’s price.
Upon making this payment, the buyer
must then pay the remaining balance,
and the seller is obligated to transfer
ownership upon receipt of payment.
Following the reservation contract,
within a span of 10 days, the compre-
hensive private purchase agreement
(contrato de arras) is executed be-
tween the buyer and the seller. This
step is akin to the contract exchange
in the UK property acquisition process.
During this period, it is imperative for
your lawyer to conduct due diligence
on the property to confirm that the
seller holds legal title.
The property is free from liens, mort-
gages, and complies with planning
permissions. Once both parties sign
this primary contract, it is legally
binding.
BREAKING DOWN THE
PROPERTY PURCHASE PROCESS
If the seller reneges on the deal, they
must refund double the deposit
amount as compensation. Conversely,
if the buyer withdraws, the deposit is
forfeited. The sale is officially closed
when the title deed, known as “Es-
critura de Compraventa,” is endorsed
in the presence of a Public Notary or
‘‘Notario’’.
This occurs at the Notary’s office, ac-
companied by the final payment and
applicable taxes. Subsequently, the
Notary presents the Escritura to the
Land Registry for registration, which
signifies the transfer of ownership to
the buyer.
Keep in mind that registering the title
deed can take several months. For
newly constructed properties, the
completion timeline may extend, and
payments are distributed across dif-
ferent construction phases. The devel-
oper must provide bank guarantees
against each payment to safeguard
your investments should they fail to
complete the property or go bankrupt.
Lastly, ensure you obtain insurance
for your property, transfer all utility
contracts into your name and register
your property with the local Town Hall
(Ayuntamiento). Your lawyer or agent
can assist with these steps.
Acquiring property in Spain can
be swift, especially if you are
purchasing in cash and possess a
NIE number.
Sometimes, locals might spot a
property and gain ownership the
very next day.
However, as an international buyer,
it is vital to exercise patience.
Provide your lawyer and building
surveyor sufficient time for
thorough investigations. It is better
to forgo an enticing deal than end
up with a problematic property.
A competent estate agent can be invalu-
able in your property hunt. However,
remember that agents typically represent
the seller. It is essential to have
independent representation through a
lawyer of your choosing.
While there are numerous estate agents in
Spain, including those who speak English,
it’s important to choose a reputable one.
Inquire if the agent is part of a professional
association like AIPP. Be skeptical of the
information provided by agents and never
sign any documents without your lawyer.
A proficient agent should be proactive,
well-versed with the local market, and
willing to invest time in offering advice and
support. Delayed responses from an agent
might indicate inefficiencies.
Estate agents’ commissions in Spain vary
and are generally high as they often offer
extensive services to foreign buyers. While
some sellers pay a 3% commission, it can
sometimes go up to 7% or 10%, and even
18% for new-build developments. In some
cases, buyers might be asked to pay a fee,
which can be a significant amount. Always
scrutinize contracts with estate agents
UNDERSTANDING ROLES IN THE
PURCHASING PROCESS
Role of Estate Agents
Understanding Roles in
the Purchasing Process
Though estate agents in Spain are
more hands-on and can provide
local insights compared to UK
counterparts, remember they
primarily represent the seller.
Sometimes they may recommend
a lawyer, but it’s wise to choose an
independent lawyer who you believe
will guard your interests.
Additionally, insist on having all
legal advice documented in writing,
which enhances accountability and
professionalism.
If you’re keen on purchasing
property in Spain, securing legal
representation should be one of
your earliest steps, even before
finding the property.
Having an attorney and the
necessary finances or a mortgage
pre-approval makes you a credible
buyer, which can be advantageous
during price negotiations.
It’s essential to retain an
independent lawyer as early as pos-
sible, much like you would in the
UK. Do not sign any documents
before your lawyer reviews them.
LEGAL ASPECTS OF PROPERTY
PURCHASE IN SPAIN
Start by negotiating your lawyer’s fees, usually around 1% of the property price,
and familiarize yourself with the associated costs (refer to page 36). After en-
gaging the lawyer, they will guide you on subsequent steps, including:
1 Verifying the property’s registration at the Land Registry and obtaining
a ‘nota simple’.
2 Confirming that the property has a license of first occupancy and that
the boundaries are clearly marked.
3 Ensuring the property is registered for local taxes known as ‘impuesto de
bienes inmuebles’.
4 Reviewing recent utility bills and checking for individual meters like
water and electricity.
5 Evaluating the property’s taxable value for transfer taxes.
6 Confirming there are no unpaid charges or mortgages against the
property
Additionally, your lawyer can assist with surveys, valuations, opening a local
bank account, obtaining a NIE number (foreigner’s identification number) and
setting up a Spanish will and power of attorney.
RESPONSIBILITIES OF YOUR
LAWYER:
CHOOSING THE RIGHT
LAWYER:
Ensure that the lawyer you choose is proficient in English, specializes in
conveyancing, has no affiliations with the seller or your estate agent, and
carries liability insurance surpassing your property’s value.
Reiterate the importance of written legal advice.
The purchase costs in Spain typically range between 11% and 14% of the property
price, with an additional 2-4% if you’re getting a mortgage.
These costs include Transfer Tax (ITP), Notario’s fee, Land Registry fees, and legal
fees. For new properties, a VAT of 10% and a stamp duty of 1.5% of the purchase
price apply.

PURCHASE TAXES AND
ASSOCIATED COSTS:
BEWARE OF TAX EVASION:
If a seller suggests an under-the-table cash payment to minimize capital gains
tax, avoid it as it constitutes tax evasion. Engaging in such a practice increases
your future capital gains, resulting in higher taxes when selling the property.
It’s vital to ensure that you pay the purchase tax based on the minimum official
value set by the Spanish tax authorities. Failure to do so can lead to penalties.
Note that attempting to bypass Spanish transfer tax by transferring the asset
company is considered tax fraud.
SECURING FINANCES AND
MORTGAGES:
Before viewing properties, know your budget include the purchase taxes, which
are substantial in Spain. Evaluate your financing options – releasing equity from
your UK home, using savings/pension funds, or applying for a mortgage.
The Spanish mortgage process can be complex, and terms offered by banks may
vary. Contacting a reputable broker can help you secure better mortgage deals.
Mortgages for non-residents usually cover 60-70% of the purchase price, while resi-
dents can up to 80%. For construction or commercial properties, different condi-
tions apply.
Mortgages in Spain are mainly variable-rate, with the Euribor serving as a base.
Initiating the Process:
When looking to acquire property in
Spain, it’s prudent to seek legal
representation as early as possible.
Engage a lawyer who will safeguard
your interests throughout the
transaction, even before
identifying the perfect property.
Having legal representation and
financing (through personal funds
or a mortgage pre-approval) will
enhance your credibility as a serious
buyer, which could work in your favor
during price negotiation.
Importance of Independent Legal
Representation:
Once an offer is accepted, it is
imperative to have an independent
lawyer, similar to the practice in the
UK. Avoid signing any documents
without thorough review by your legal
representative.
While estate agents in Spain are
generally more resourceful compared
to their UK counterparts, remember
that they primarily represent the seller.
Although an estate agent might
recommend a lawyer, it’s wise to
choose an independent lawyer you
trust.
Additionally, insist on receiving written advice from your lawyer, a practice that
might not be customary for some Spanish lawyers. Written advice maintains ac-
countability and encourages a higher level of professionalism.
Role of Your Legal Representative: Initially, agree on the lawyer’s fees, generally
about 1% of the property’s purchase price, and familiarize yourself with associat-
ed costs (see the section on Purchase Taxes). Your lawyer should undertake the
following tasks:
LEGAL REPRESENTATION FOR
PROPERTY ACQUISITION IN SPAIN
1. Verify that the
property is
registered at the
Land Registry and
secure a copy of the
land search or ‘nota
simple’.
4. Review recent
utility bills and
inspect individual
meters like water
and electricity.
2. Confirm that the
property has a license
of first occupation,
affirming compliance
with planning
permissions and clearly
identified
boundaries.
3. Ensure the property is
registered for local taxes
known as ‘impuesto de
bienes inmuebles’.
6. Make sure there
are no outstanding
charges or
mortgages on the
property or confirm
they will be cleared
upon sale.
5. Evaluate the taxable
value of the property
to understand the
acceptable level for
transfer taxes.
PURCHASE TAXES
AND COSTS
Tip! Tip!
The acquisition of property in Spain entails an expense of around 11-14% of the
property’s value in purchase or closing costs, varying by region and property
type. Should you opt for a Spanish mortgage, consider additional costs of 2-4%.
This expense includes Transfer Tax (ITP), notario’s fee, and Land Registry fees. Le-
gal fees generally amount to 1% of the purchase price plus VAT. attract a 10% VAT
and 1.5% stamp duty.
Capital Gains and Purchase Tax Issues:
As a buyer, avoid indulging in tax evasion by under-declaring the purchase price. The
seller might insist on a partial cash payment to reduce capital gains tax, which is un-
lawful. Engaging in such an arrangement will expose you to legal repercussions and
potential financial losses.
Ensure that you pay the purchase tax based on the official value determined by the Span-
ish tax authorities to avoid penalties. Moreover, refrain from circumventing transfer tax
through corporate ownership transfers, as this is fraudulent.
Financing the Property:
Establish a concrete financial plan. Agents advise having finances in order before property
viewing. Factor in the substantial purchase taxes and varying rates across Spanish regions.
Evaluate whether to remortgage your UK property, use savings/pension funds, or secure a
mortgage in Spain.
SECURING A SPANISH MORTGAGE:
Navigating the Spanish mortgage market can be complex. Utilise a broker with
relevant contacts for the best deals. The lending conditions vary by bank and typ-
ically require a deposit of 30-40%. Lending criteria are stringent, requiring proof
of income and affordability. Be cautious of hidden costs such as valuation fees,
opening charges and notary fees. A mortgage may also entail the need for life
assurance and building insurance. Consult your legal representative to scrutinise
the terms before securing a mortgage in Spain.

  • 3. Costa Blanca North: A Paradise of Diversity Along Spain’s White Coast Nestled on the eastern coast of Spain, Costa Blanca is a beloved tourist destination known for its stunning beaches and impeccable weather. The Costa Blanca, or ‘White Coast’, stretches over 200 kilometers along the Mediterranean Sea in the province of Ali- cante. While most travelers are acquainted with the bustling south of Costa Blanca, the northern part of this coastline is a hidden treasure waiting to be explored. Costa Blanca North boasts an exceptional blend of history, culture, natural beauty, and modern luxuries. Charming Towns One of the defining characteristics of Costa Blanca North is its collection of picturesque towns. Among the most enchanting are Denia, Javea, Moraira, Altea, and Calpe. Denia, a historical coastal town, is recognized for its ancient castle, excellent seafood, and natural harbor. Javea, with its pristine beaches and coves, appeals to those seeking solace in nature. Moraira is a former fishing village that has evolved into an upscale resort town without losing its authenticity. Altea, distinguished by its white-washed houses and blue- domed church, offers a touch of artistic charm, while Calpe invites visitors with its impos- ing rock formation, Peñón de Ifach. Culture and History Costa Blanca North is steeped in history. Denia’s Castle and Archaeological Museum are must-visit sites, dating back over 2000 years and providing a glimpse into the region’s Roman and Moorish past. The town of Guadalest, perched atop a mountain, is another historical gem with its ancient fortress and breathtaking views. Festivals like the Moors and Christians in Altea and the Bonfires of San Juan in Alicante, showcase the rich cul- tural heritage and traditions of the area. Natural Beauty The region’s natural landscapes are as varied as they are striking. With its miles of coast- line, Costa Blanca North offers an array of beaches and coves. The Montgó Natural Park, between Denia and Javea, is a haven for hikers and nature enthusiasts, boasting a rich biodiversity and magnificent views of the surrounding areas. The Algar Waterfalls near Callosa d’En Sarrià are another natural attraction that shouldn’t be missed. Culinary Delights The gastronomic scene in Costa Blanca North is a reflection of its Mediterranean setting. Local markets are laden with fresh fruits, vegetables, and seafood. Paella is a regional specialty, and visitors should not miss trying the authentic version with rabbit and snails, or the seafood variation. Tapas bars are abundant, and a glass of local wine pairs perfectly with the variety of small dishes. Modern Luxuries For those seeking contemporary comforts, Costa Blanca North doesn’t disappoint. The region boasts several high-end resorts and boutique hotels, along with luxury villas for rent. The towns of Moraira and Javea are particularly known for their upmarket offerings. Golf enthusiasts will find several world-class golf courses in the region, and the marinas in Denia and Moraira are perfect for yachting aficionados. 1. LIST OF TOWNS ACROSS THE COSTA BLANCA NORTH 2. • 4. Javea: The Crown Jewel of Costa Blanca North Nature’s Bounty Javea is blessed with a diverse natural landscape. The Montgó Natural Park, which domi- nates the skyline, is a favorite among hikers and nature lovers. The park is home to a plethora of flora and fauna, and the summit offers breathtaking views of Javea and the surrounding coastline. Javea also prides itself on its coastline, which stretches over 20 kilometers and is dotted with stunning beaches and secluded coves. La Granadella and Playa del Arenal are two of the most popular beaches, known for their crystal-clear wa- ters and golden sands. Culinary Paradise: No visit to Javea would be complete without indulging in the local cuisine. Being a coast- al town, seafood plays a significant role in Javea’s gastronomy. Local restaurants serve a variety of dishes, with paella being a standout favorite. Traditional Javean fish stew, or ‘bullit de peix’, is another dish that seafood lovers must try. Along the Arenal promenade and in the Old Town, you’ll find numerous restaurants and tapas bars offering these deli- cacies and more, often paired with local wines. A Haven for Water Sports Javea’s extensive coastline and calm waters make it an ideal location for water sports. From kayaking and paddleboarding to scuba diving and sailing, the options are abun- dant. The coves and clear waters around Cap de la Nau and Cap Negre are particularly popular among divers and snorkelers due to the rich marine life and the mesmerizing underwater landscapes. Festivals and Events Javea’s calendar is replete with festivals that celebrate its history and culture. The Moors and Christians festival, celebrated in July, is one of the most vibrant events, where the townsfolk don elaborate costumes and partake in parades and mock battles. Other no- table events include the Bonfires of San Juan in June and the lively Fiesta de la Virgen de Loreto in September. A Place to Call Home For many, a visit to Javea turns into a lifelong love affair. The town’s pleasant climate, with over 300 days of sunshine annually, coupled with its laid-back lifestyle, has made it a popular destination for expatriates and retirees from across Europe. If you have Javea or surrounding areas on your real estate radar, get in touch with your requirements and our expert team will find the property to suit you. Boasting a mix of histori- cal allure, natural splendor, and a tranquil Mediterranean lifestyle, Javea is a place where time seems to slow down and where the worries of the world feel miles away. In this article, we explore the facets that make Javea an enchanting destination. A Rich Tapestry of History Javea’s Old Town is a testament to the area’s rich history. Narrow, winding cobblestone streets are flanked by traditional whitewashed houses, many adorned with wrought-iron balconies and colorful flowers. At the heart of the Old Town, you’ll find the Church of San Bartolomé, a stunning example of late Gothic architecture with fortification elements, re- flecting the town’s past battles with pirates. The Municipal Market, which still serves as a local marketplace, showcases a blend of Modernist and traditional architecture and is an excellent place to immerse oneself in local culture.
  • 5. Benitachell: A Quintessential Spanish Village on the Costa Blanca Breathtaking Landscapes Benitachell’s natural landscape is characterized by its rugged coastline and lush agricul- tural land. The vineyards surrounding the town are a nod to the rich winemaking tradition of the region, with the Muscat grape being a local favorite. However, it’s the coastline that is the star attraction. The “Cumbre del Sol” or “Summit of the Sun” area boasts spectacular cliffs that plunge into the Mediterranean Sea. One of the most renowned spots is Cala del Moraig, a beautiful cove with crystal-clear waters, ideal for swimming, snorkeling, and div- ing. Cultural Tapestry The cultural landscape of Benitachell reflects its history and the diversity of its population. The village celebrates various festivals throughout the year that blend tradition with fes- tivity. The Festivities of the Virgin of Rosario, celebrated in early September, are the most prominent, featuring parades, music, and traditional dancing. The town also has a thriving expatriate community, and this cultural exchange enriches the local fabric. Culinary Delights Benitachell’s cuisine reflects the Mediterranean traditions with an emphasis on fresh, local ingredients. The proximity to the sea ensures that seafood is prominent in many dishes. Typical meals include “arroz caldoso” (a soupy rice dish with fish) and “cocas” (savory pas- tries). The local Muscatel wine is a perfect complement to any meal and should not be missed. Outdoor Activities For those who enjoy an active lifestyle, Benitachell does not disappoint. Hiking along the cliffs offers breathtaking views and the chance to discover hidden coves. The Cova dels Arcs, at Cala del Moraig, is a fascinating sea cave popular among divers. For golf enthusi- asts, the nearby Club de Golf Javea provides an opportunity to enjoy the sport in a beauti- ful setting. Peaceful Living Benitachell is often chosen as a place of residence for those seeking a peaceful environ- ment without being too far from the amenities of larger towns. The village offers a relaxed pace of life, and the sense of community is palpable among both locals and expatriates. If you have Benitachell or surrounding areas on your real estate radar, get in touch with your requirements and our expert team will find the property to suit you. We have a wide range of resale and new-build homes, many of which offer excellent potential for buy-to- let investment. See properties for sale in Benitachell Links of interest: Villas for sale in Benitachell Rent a car in Benitachell Nestled between the more famous towns of Javea and Moraira on the northern Costa Blanca, lies Benitachell, or El Poble Nou de Benitatxell in Valencian. With its stunning coastal cliffs, relaxed ambiance, and rich history, Benit- achell offers an authentic Mediterranean experience away from the bustle of larger tourist hotspots. Historical Heritage While Benitachell may be relatively small, it’s brimming with history. The old town is a laby- rinth of narrow streets with traditional whitewashed houses, most of which are adorned with flowers, reminiscent of a bygone era. The Church of Santa María Magdalena, built in the 18th century, is a Neo-Gothic architectural gem and the center of the village’s spiritual life. Visiting during Easter week offers the opportunity to witness the impressive “Davallament” (Deposition) procession that starts from the church.
  • 6. Denia: The Coastal Gem of Spain’s Costa Blanca North Positioned at the northern tip of Alicante province and the Costa Blanca, Denia is a captivating seaside town that effortlessly combines history, culture, natural beauty, and a vibrant atmosphere. With the imposing Montgó Massif as its backdrop and the Medi- terranean Sea at its doorstep, Denia offers an enticing array of experiences for all types of travelers.
  • 7. Historical Treasures Denia’s history dates back to ancient times, with influences from the Iberians, Romans, and Moors. The most prominent historical landmark is Denia Castle, which towers over the town and was once a fortress during the 11th and 12th centuries. The castle now houses the Archaeological Museum, where visitors can learn about Denia’s ancient history through various exhibits. Strolling through the old town, you’ll find charming streets, historical buildings, and the 18th-century Church of Asunción, reflecting Denia’s rich heritage. Gastronomic Capital Denia was named a UNESCO Creative City of Gastronomy in 2015, and it’s not hard to see why. The town boasts a thriving culinary scene, from traditional Spanish tapas bars and seafood restaurants to innovative fine-dining establishments. Denia’s red prawn, “gamba roja de Dénia,” is a local delicacy, and trying it is a must for seafood enthusiasts. Denia’s Mercado Municipal (Municipal Market) is the place to go for fresh produce and local specialties, while the streets and squares are filled with vibrant cafés and eateries. Beaches and Natural Beauty Denia is blessed with over 20 kilometers of coastline featuring a variety of beaches and coves. The sandy beaches to the north, like Les Marines and Les Deveses, are ideal for families and water sports, while the rocky coves to the south, such as Las Rotas, offer excellent snorkeling and diving spots. The Montgó Natural Park is another natural at- traction, perfect for hiking and exploring local flora and fauna. From the summit, visitors can enjoy panoramic views of Denia and the surrounding coastline. Festivals and Events Denia’s cultural calendar is teeming with events and festivals that celebrate the town’s heritage and traditions. One of the most notable events is the Bous a la Mar (Bulls to the Sea) festival, which is declared to be of National Tourist Interest. Other significant festivals include the Fallas in March, where enormous papier-mâché figures are burned, and the Moors and Christians festival in August, celebrating the historical conflict and coexistence between Moors and Christians in Spain. A Nautical Paradise Denia’s Marina is one of the most modern and well-equipped in the region. It’s a hub for nautical activities and the gateway to the Balearic Islands, with regular ferry services to Ibiza and Mallorca. Sailing, jet-skiing, and boat tours are popular activities, allowing visi- tors to experience the beauty of the Costa Blanca from the water. If you have Villajoyosa or surrounding areas on your real estate radar, get in touch with your requirements and our expert team will find the property to suit you. See properties for sale in Villajoyosa Links of interest: Properties for sale in Villajoyosa Rent a car in Villajoyosa When you have identified the property you wish to acquire, the purchasing journey kicks off with a reservation contract. This agreement locks in the property’s price and re- moves it from the market, typically for 30 days, in exchange for a fee ranging from €3,000 to €5,000. This amount is typically placed in a client or escrow account, managed by your legal coun- sel or agent. Typically, the contrato de arras man- dates a deposit payment ranging from 10 to 20 percent of the property’s price. Upon making this payment, the buyer must then pay the remaining balance, and the seller is obligated to transfer ownership upon receipt of payment. Following the reservation contract, within a span of 10 days, the compre- hensive private purchase agreement (contrato de arras) is executed be- tween the buyer and the seller. This step is akin to the contract exchange in the UK property acquisition process. During this period, it is imperative for your lawyer to conduct due diligence on the property to confirm that the seller holds legal title. The property is free from liens, mort- gages, and complies with planning permissions. Once both parties sign this primary contract, it is legally binding. BREAKING DOWN THE PROPERTY PURCHASE PROCESS If the seller reneges on the deal, they must refund double the deposit amount as compensation. Conversely, if the buyer withdraws, the deposit is forfeited. The sale is officially closed when the title deed, known as “Es- critura de Compraventa,” is endorsed in the presence of a Public Notary or ‘‘Notario’’. This occurs at the Notary’s office, ac- companied by the final payment and applicable taxes. Subsequently, the Notary presents the Escritura to the Land Registry for registration, which signifies the transfer of ownership to the buyer. Keep in mind that registering the title deed can take several months. For newly constructed properties, the completion timeline may extend, and payments are distributed across dif- ferent construction phases. The devel- oper must provide bank guarantees against each payment to safeguard your investments should they fail to complete the property or go bankrupt. Lastly, ensure you obtain insurance for your property, transfer all utility contracts into your name and register your property with the local Town Hall (Ayuntamiento). Your lawyer or agent can assist with these steps.
  • 29. Acquiring property in Spain can be swift, especially if you are purchasing in cash and possess a NIE number. Sometimes, locals might spot a property and gain ownership the very next day. However, as an international buyer, it is vital to exercise patience. Provide your lawyer and building surveyor sufficient time for thorough investigations. It is better to forgo an enticing deal than end up with a problematic property. A competent estate agent can be invalu- able in your property hunt. However, remember that agents typically represent the seller. It is essential to have independent representation through a lawyer of your choosing. While there are numerous estate agents in Spain, including those who speak English, it’s important to choose a reputable one. Inquire if the agent is part of a professional association like AIPP. Be skeptical of the information provided by agents and never sign any documents without your lawyer. A proficient agent should be proactive, well-versed with the local market, and willing to invest time in offering advice and support. Delayed responses from an agent might indicate inefficiencies. Estate agents’ commissions in Spain vary and are generally high as they often offer extensive services to foreign buyers. While some sellers pay a 3% commission, it can sometimes go up to 7% or 10%, and even 18% for new-build developments. In some cases, buyers might be asked to pay a fee, which can be a significant amount. Always scrutinize contracts with estate agents UNDERSTANDING ROLES IN THE PURCHASING PROCESS Role of Estate Agents Understanding Roles in the Purchasing Process
  • 30. Though estate agents in Spain are more hands-on and can provide local insights compared to UK counterparts, remember they primarily represent the seller. Sometimes they may recommend a lawyer, but it’s wise to choose an independent lawyer who you believe will guard your interests. Additionally, insist on having all legal advice documented in writing, which enhances accountability and professionalism. If you’re keen on purchasing property in Spain, securing legal representation should be one of your earliest steps, even before finding the property. Having an attorney and the necessary finances or a mortgage pre-approval makes you a credible buyer, which can be advantageous during price negotiations. It’s essential to retain an independent lawyer as early as pos- sible, much like you would in the UK. Do not sign any documents before your lawyer reviews them. LEGAL ASPECTS OF PROPERTY PURCHASE IN SPAIN Start by negotiating your lawyer’s fees, usually around 1% of the property price, and familiarize yourself with the associated costs (refer to page 36). Engaging in such a practice increases your future capital gains, resulting in higher taxes when selling the property. It’s vital to ensure that you pay the purchase tax based on the minimum official value set by the Spanish tax authorities. Failure to do so can lead to penalties. Importance of Independent Legal Representation: Once an offer is accepted, it is imperative to have an independent lawyer, similar to the practice in the UK. Avoid signing any documents without thorough review by your legal representative. While estate agents in Spain are generally more resourceful compared to their UK counterparts, remember that they primarily represent the seller. Although an estate agent might recommend a lawyer, it’s wise to choose an independent lawyer you trust. Additionally, insist on receiving written advice from your lawyer, a practice that might not be customary for some Spanish lawyers. Written advice maintains ac- countability and encourages a higher level of professionalism. Role of Your Legal Representative: Initially, agree on the lawyer’s fees, generally about 1% of the property’s purchase price, and familiarize yourself with associat- ed costs (see the section on Purchase Taxes).
