However, the main flaws of the French bankruptcy law are that it violates priority rules during bankruptcy proceedings and out-of-court negotiations by allowing junior creditors to monetize their votes. To have more efficient pre-insolvency proceedings, France needs to properly address valuation issues, introduce an absolute priority rule, and reform distribution of creditors into committees.
