5. BEFORE RATIONALIZATION RATIONALIZED DEPARTMENT
1. Acts as Legal Counsel for the Office in all matters relating to
administrative, civil and criminal cases pending before any
tribunals, administrative bodies, courts of justice, prosecution
offices and other quasi-judicial bodies;
2. Closely coordinates with the handling Prosecutor and/or assigned
OGCC lawyers on pending cases;
3. Takes appropriate legal action on all defaulted accounts & other
claims referred by the management & other operating units
4. Conducts fact-finding & preliminary investigations of administrative
complaints files against officials & employees of the PCSO &
submits findings & recommendations thereon to the General
Manager;
5. Prosecutes administrative cases before the PCSO Investigating
Committee;
6. Investigates cases involving tampered lotto and sweepstakes
tickets as well as other fraudulent/false claims of winnings and
other anti-fraud cases involving illegal use of charity fund as well as
fraudulent requests for financial/medical assistance and initiates &
prosecutes criminal cases if warranted;
7. Renders legal opinion and advice on matters referred to by the
Board, management and other departments;
8. Prepares & reviews contracts or agreements and other legal
documents of the PCSO;
9. Initiates the foreclosure and consolidation of all properties
mortgaged in favor of PCSO;
10.Performs such other related duties and functions as may be
deemed necessary
1. Under the direct supervision of the General Manager, serves as
Legal Counsel for the Office in all matters relating to legal cases
pending before any tribunals, administrative bodies, courts of
justice, prosecution offices and other quasi-judicial bodies;
2. Coordinates with the Office of the Government Corporate Counsel
(OGCC) on legal matters concerning the Agency, as necessary;
3. Provides the Board of Directors, General Manager, Assistant
General Managers and all the other officials of the Office with
technical (issues) advice on any legal matters, laws, rules and
regulations affecting the PCSO and requiring their collective or
individual actions;
4. Provides and reviews legal opinions, comments, proposals,
contracts and agreements;
5. Prepares contracts or agreements for review and approval of the
Members of the Board, for signature of the Chairman and/or
General Manager;
6. Drafts recommendations of the investigating staff before these are
referred for action to the General Manager and the Chairman;
7. Hears and decides administrative disciplinary cases against erring
officials and employees and recommends to the Board through the
General Manager appropriate disciplinary action;
8. Initiates and prosecutes criminal and civil cases against defaulted
authorized sellers or agents;
9. Administers and supervises real estate mortgages executed by
PCSO and initiates foreclosure proceedings and consolidates
ownership in favor of PCSO of foreclosed properties;
10.Performs such other related duties and functions as may be
deemed necessary.

Despite the limited number of personnel, the
Legal Department had been able to deliver
and perform its functions and assigned
tasks, mainly by performing multi-tasks.
However, such set up directly affects the
completeness, promptness and quality of
the desired output.

With the designation of the 3 lawyers, the number of lawyers
actually performing at the Legal Department remains at 5,

The support staff in the department was likewise reduced
as only 5 were placed in the final placement

acquired the necessary skills and know-how in the
processes and procedures in the operations of the agency;
Personnel are willing, able and highly motivated to
perform multi-tasks;
Personnel are willing to undergo re-tooling and further
studies to enhance their knowledge

Provide/allow lawyers to attend regular trainings and seminar workshops,
particularly on recent and relevant laws, rules and regulations affecting the
operations of the agency, including developments in the gaming industry ;
Encourage the support staff to improve their skills and knowledge on their
respective tasks and responsibilities through regular trainings and skills
development workshops
Immediately fill up the remaining support staff positions in the rationalized
plantilla, including the lawyer positions;
Request the approval of additional support staff personnel and positions in
the approved/rationalized Legal Department, including the retention of the
Legal Records and Library Division and upgrade the lawyer positions to
provide opportunity for promotion to lawyers
