Mrs. Donoghue went to a café in Paisley with a friend and ordered an ice cream float. After taking a sip, she discovered a decomposed snail in the drink and suffered gastroenteritis and nervous shock as a result. She sued the manufacturer of the ginger beer, Stevenson, that was included in the drink on the grounds of negligence. The court found that Stevenson owed a duty of care to eventual consumers even without a direct contractual relationship. Stevenson was found liable for negligence, breach of duty, and the damages from Mrs. Donoghue's injuries. This case established that manufacturers can be held liable for defective products that cause harm to consumers.
