• The harassment of women at the Workplace (Prevention, Prohibition
and Redressal) Act, 2013, commonly mentioned because the ‘PoSH Act’
is an Indian law enacted with the target of creating workplaces safer for
ladies by preventing, prohibiting and redressing acts of harassment
against them within the workplace. The law was made effective within
the whole of India on December 9, 2013, by the Ministry for Women and
Child Development.
• For women, harassment has always followed them within the
workplace. and the government hasn’t done anything about it until
1997. After the landmark Vishakha judgment, the necessity for an anti-
sexual harassment law became a necessity. This cause the event of the
PoSH law.
WhatisPoSHAct?
The PoSH Act protects women within the workplace from
harassment. All women employees no matter whether:
• They're employed regularly, temporary, unplanned or daily
wage basis.
• They're employed directly or through an agent or a contractor.
• They're employed with or, without the knowledge of the
principal employer.
• They're employed for remuneration or on a voluntary basis.
• The terms of employment are expressed or implied.
WhoAretheBeneficiaries?
• PoSH Act makes employers liable for ensuring that the workplace is safe for its
employees. They must employ measures to make sure that their employees are safe
from both employees and non-employees who might enter the workplace (delivery
boys, for example).
• Constitution of an Internal Committee (ICC) in every workplace with
10+employees
• PoSH Act also requires the constitution of a Local Area Committee (LC) in every
District which is liable for hearing and redressing complaints of harassment from
workplaces that will have fewer than 10 employees.

Mandate?
• The IC/LC is required to conduct an inquiry into every complaint of harassment
in accordance with the provisions of the service rules applicable to the respondent
within ninety days (90 days) from the submission of the complaint.
• Organisation of workshops and awareness programs at regular intervals for
sensitizing the workers with the provisions of the Act
• Deciding a redressal mechanism for false and malicious complaints.

Mandate?
The PoSH Act takes a firm stand against non-compliance with its provisions. If an
employer fails to either constitute an Internal Complaints Committee or discharge
any of the duties placed upon them under the act, they shall be punished with a fine
which can reach fifty thousand rupees (Rs. 50,000). In the event an employer
contravenes the provisions of the PoSH Act for a second time, they'll be either fined
twice the quantity because of the fine for the primary contravention or face
cancellation of work permit.
