that linear thinking has no place in the courtroom.
On the contrary, it is an essential trait for a trial
lawyer.
• But it must be tempered with the creativity and
empathy of the right brain.
2. A Unique Challenge
• A unique challenge that we as lawyers face is
this: “Good acting comes from the heart and
there is no mentality in it. How can we draw
ourselves out of our heads enough to connect
emotionally with the jury, while
instantaneously being able to climb back into
our heads to respond to objections,
evidentiary problems, and case strategy points
at the drop of a hat?”
