1 Introduction

Following the Framework Agreement dated on 04/02/2014 (Lot 2: Consultancy Company – Solid
Waste ‐ Ref. VP‐1096 – 2013/S 58‐94089, corrig. 2013/S 83‐138535), between EIB and ENVIROPLAN
S.A. as a leader of an International Consortium, a Request for Proposal was sent on 29/05/2015 for
providing the services defined in the assignment’s Terms of Reference, under the title: “Framework
Services Support for Eastern Partnership countries Solid Waste projects”.
ENVIROPLAN S.A. was awarded this assignment on 01/07/2015. The official commencement date of
the project is 24th
August 2015, whereas the total period of implementation is until 30/06/2016. The
Project team has mobilised itself and commenced work; also it has familiarized with the available
reports sent by EIB and in particular:

The kick‐off meeting has been held on 28th
September in the premises of Municipality of Lviv with
the attendance of the Mayor, the Deputy Mayors, the head of the Housing Office, the head of
foreign economic relations and investment office, EIB and the Consultants. During the mission from
28th
– 29th
of September 2015, three (3) site visits to the existing landfill and two (2) new proposed
sites (for landfill and MRF), as well as various technical meetings have taken place. The persons from
Lviv authorities that participated are:
1. Andriy Sadovyy, City Mayor
2. Victor Pushkariov, First Deputy Mayor
3. Volodymyr Shevchuk, deputy mayor on questions of urban planning and infrastructure
4. Yurii Holets, the head of the Housing Office
5. Olha Syvak, head of foreign economic relations and investment office
6. Bohdan Horbal, the director of Lviv Municipal Enterprise “Zbyranka”
The present report regards the Inception Note and outlines the suggested implementation plan for
the assignment, as well as the main findings from the meetings, the site visits and the previous
studies analysed by the project team.
For the mission, the replacement of Mr Reynaldo Cruz‐Rivera Solid Waste Management Expert by Mr
George Tavoularis has been agreed, as per email of 23.9.2015.

2 Project Background

Lviv is a city in Western Ukraine with a population of about 750,000 inhabitants and a total
municipal waste generation of ca. 260,000 tonners per year. Lviv is a progressive cultural and
industrial center of the region, a major transportation hub, a scientific and educational center. The
city is characterized by high density of buildings in a limited area. Tourism and industry are actively
developing.
During the last years, works associated with solid wastes management began, accompanied by
separate collection in certain areas, recycling and treatment. Collection and transportation of solid

waste in the city is performed by 5 companies, each one operating in a certain district. The activities
of the companies are described later in the report. However, waste management system in Lviv is
still underdeveloped with many shortcomings.
Disposal of municipal waste takes place in an EU non‐compliant landfill, located in the village of
Grybovychi (photos 1 and 2). The area of the landfill is 38,8 hectares, of which 26 ha are the disposal
cells. It is operated since 1959. The amount of waste is estimated to 50 millions m3
, with waste
height 45‐60 m (according to report “Options for Private Sector Participation in Waste Management
Solutions for the City of Lviv”, 2012). In 2014, 237.900 t municipal waste have been delivered for
disposal.
In the past (1970 – 1990), industrial, mostly hazardous waste has been deposited, originating from
the oil and galvanizing industry. In certain points, there are 3 acid tar ponds with high hydrocarbon
content (a chemical analysis has been asked). The ponds are owned by the state oil company which
is now bankrupt and not by the municipality. The produced leachate from the landfill are collected in
a leachate pond of 60.000 m3
volume and afterwards are partially treated in a leachate
pretreatment plant. Also a leachate transport pipeline to the closest sewer pipe is currently being
constructed.
Although the site lacks sealing covers, its operation is controlled and there are in place the basic
infrastructure works such as a weighbridge, a security house with entrance control, a radioactivity
detector and a leachate treatment plant 15 m3
/d. The site operates with 38 people personnel (plus
around 40 scavengers), 3 bulldozers and 2 shifts, but occasionally also three. For 5 years, a biogas
collection and combustion facility has been installed and registered under the Kyoto Protocol. The
facility has stopped its operation two years ago. The biogas potential of the site is definitely an
advantage that could bring revenues (through energy utilization), and therefore it should be
included in the concept of future rehabilitation and partially finance the required investment.

The site within the existing boundaries has reached it’s volume capacity, and needs either to be
expanded or to be closed down and rehabilitated.
The expansion is not possible due to land availability and the close distance and optical vicinity of a
neighbour settlement. Therefore the Municipality decided to close and rehabilitate the landfill site.
The duration of landfill’s reclamation according to the prepared design will be 10 years which is
rather long period and needs to be shorter, whereas the total construction cost amounts to
213.155.172 UAH (with VAT) in 2013 prices or 19.378.000 Euro, at an exchange rate of 11 as of
14.10.2013.
A site close to village Verkhnya Bilka in the east of Lviv has been selected for the new municipal
landfill (photo 1).
To address the above shortcomings EIB is planning to support and finance an integrated solid waste
project under “The Municipal Infrastructure Programme” (UMIP) in two phases: initially promote
sustainable no‐regret, high impact/visibility solid waste measures for improving recycling and
recovery in Lviv. At a later stage other components of an integrated solid waste management system

will be prepared, including a new sanitary landfill and potentially closure of the existing landfill and
residual waste treatment facilities.

3 Implementation Plan
The Tasks to be implemented under this Assignment and the respective approach are outlined in the
present section:

Task 1: Review of the current waste collection system
Objective
According to the ToRs, the objective is to “review the current waste collection system with a view to:
‐ Identify ways and means to increase the separate collection of materials,
‐ Assess the potential for collection of food‐waste that could be co‐digested in the planned
anaerobic digestion plant,
‐ Assess the potential for increasing the efficiency of residual waste collection and thus free up
resources to cover the costs of the future upgraded waste treatment and disposal system”.

The Team will review, verify and analyze the existing situation in the waste management sector. The
assessment shall cover:
Collect, review and assess the available waste related information and documentation
regarding national and local level
Review and assess the national waste management legislation
Review and assess the waste management policy with objectives already set up in the
national strategic and planning documents
Review and assess the existing waste organizational structure
Collect, review and assess all available waste related data from waste surveys, feasibility
studies and relevant projects
During the first mission, the Consultant has been informed by the authorities on the organization of
the waste collection system. In particular, Lviv city is separated into 5 territories, each of whom is
served by one collection company (four private and one communal). The companies are i) Ltd. "ABE‐
Lviv", ii) Ltd. "Spetsavtotrans Lions", iii) LCP "Transport firm" Lvivspetskomuntrans", iv) Ltd. "Sankoh"
and v) LLC "DV‐Ekosvit". The contracts are for 3 years and now they are about to finish at the end of
2016. The service users are households, budget institutions and commercial enterprises. The tariffs
set for example by the communal company Lvivspetskomuntrans is 382 UAH/tn, 389 UAH/tn and
416 UAH/tn respectively, whereas disposal costs are separate and range from 73 UAH/tn, 75 UAH/tn
to 80 UAH/tn respectively. Coverage of institutions and commercial enterprises is close to 100%,
whereas for blocks/houses is quite lower, approximately 70% due to unwillingness of private house’s
residents.
Households are billed monthly by the Housing Associations based on waste produced and property
size (sq.m.) and therefore the charging system has partly the characteristics of a PAYT system. The
Housing Associations in respect pay the collection companies and the landfill operator. Charges are
set only for mixed waste and not for recyclables. Bulky waste and WEEE can be collected by an on‐
call service.
The Consultant has also undertaken interview with three of the five waste collection companies,
namely ABE‐Lviv, Spetsavtotrans Lions and Lvivspetskomuntrans. The companies are operating
mainly with new trucks and bins. Recyclable bins are provided for plastic, glass and paper with

collection once per week, but no specific targets are set for separate collection. There are low
revenues for recovered glass and paper. The participants expressed their belief that it is possible to
increase the amounts diverted and that a clean MRF would support and enhance the recycling
activity. It can be said that the Municipality handles sufficiently the collection service, at least for
mixed waste whereas for recyclable system could be improved to increase the efficiency and can be
expanded to include also other streams.
All stakeholders have agreed that public information and awareness is essential for the direction.
The most common problems – deficiencies addressed by the waste collection companies are:
Short period of contracts (3 years) don’t allow for long term planning
Scavengers is a serious constrain for increase recycling level
Public awareness is lacking and is considered essential.
The Consultant has further submitted a waste Questionnaire to the Lviv Municipality and all the
collection companies, so as to assess in detail the current situation and incorporate all data into the
review of the waste collection system and the current needs/ deficiencies. The Questionnaires have
not yet been received.

Task 2. Identification and comparison from effectiveness, cost‐efficiency and environmental point
of view of different waste diversion options ‐ discussion with the Municipality and funders
different options to complement the current separate collection of recyclables and
thereby increase diversion of waste from the landfill

According to the Sub‐Assignment ToRs, the objective of this Task is to “identify and compare from
effectiveness, cost‐efficiency and environmental point of view, and discuss with the Municipality and
funders, different options to complement the current separate collection of recyclables and thereby
increase diversion of waste from the landfill. Such options could e.g. include:
1) Civic amenity sites/recycling centres where citizens can bring e.g. household hazardous waste,
construction and demolition waste, bulky waste, garden waste.
2) Complementary facilities for treating separately collected waste streams, such as a basic
material recovery facility (MRF) for refinement of recyclables, and a composting facility for bio‐
waste, both on a scale that can be well justified. The scoping of waste diversion measures should
consider the need to identify alternative livelihoods for waste pickers that today are active on
the existing landfill that will be closed”.

The Consultant has reviewed and assessed the existing reports, listed above in Task 1. These reports
do not handle waste diversion measures based on source separation; ore report proposes a large
sorting facility from commingled waste to produce RDF for the cement industry. Following the first
mission, the Consultant has identified the following key points:
1. The collection service is up to date and well covered, at least for mixed waste and can be
expanded to increase its efficiency for recovery of recyclables and include other streams.
Separate collection has been introduced to the Municipality (albeit with low quantities
gathered) and the citizens are to a certain degree accustomed to the recycling practice and
the associated benefits to the environment
2. The collection companies are aware that important market opportunities exist in the
recycling sector. However, they have to overcome some barriers with quality, end‐users,
long distances and market extortions and would welcome the construction of a clean MRF in
the municipality

3. In regard to the biowaste, no separate collection is practiced up to date
4. Lviv municipality is very keen to promote waste diversion measures that can act as
demonstrating exemplar in Ukraine and inspire similar initiatives in other local authorities
5. In regard to waste composition, the following analysis has been given in the Pre‐Appraisal
Report Lviv ‐Solid Waste (Aquapro, 2014), page 11:

The rationale of this Task is to assist the Municipality towards a more sustainable waste
management system. Based on the data gathered under Task 1, the short‐term, no regret, high
impact/visibility solid waste measures of suitable capacity will be identified. These investments
could be financed by EIB under the UMIP framework and will include indicatively a number of civic
amenity centers, an MRF for clean recyclables and a composting plant for garden/park/market
waste. As high impact measures, it is expected that they will find high public acceptance. The specific
objective is to identify efficient waste diversion measures that would
i) move upwards the waste hierarchy
ii) sensitize and engage the public in active participation in source separation
programs
iii) produce “high quality” recyclables and compost
iv) contribute to future compliance with the EU Acquis
v) avoid solutions entailing separation of mixed waste
In this respect, the measures must focus on effective separate collection and also not bear an
excessive capital investment. The methodology that will be followed to propose waste diversion
options, includes the following steps:
Step 1: Collection and elaboration of data for the current situation of waste management (Task 1)
Step 2: Forecast of Lviv’s future population and municipal waste production
Step 3: Selection of waste streams that will be collected separately (such as packaging, food, green,
market, household hazardous, bulky, C&D, electronic waste, etc) and associated capture/diversion
rates; search for a number of suitable available urban area for Civic amenity centres (CAC)

Step 4: Analysis of scenarios for sorting/treatment waste streams and justification of the capacity of
the required plants, including: Calculation of targets, mass balances, dimensioning, outputs, end‐
users, investment costs and operational costs
Step 5: Involvement of the private sector and possible institutional re‐arrangements
Step 6: Procurement options, i.e. public financing via loan or PPP or combination, etc
Step 7: Proposals for future improvement via other tools, legislative, institutional, boosting
markets/demand for recyclable materials/compost, etc
Other pilot activities (indicatively home composting), as well as suitable prevention measures (e.g.
re‐use workshop in the CAC), will be also considered.
During the mission, a site visit was also made to the local Heat Power Plant. The visit confirmed that
an available Municipal land of 1000 m x 150m (photo 3) can be allocated for the construction of the
future MRF and Composting Plant.

The deliverable of this Task will be a Waste Diversion Concept Note with proposal for waste
diversion components.

Task 3. Prepare detailed designs and tender documents for agreed waste diversion measures

According to the Sub‐Assignment ToRs, the objective of this Task is to “Prepare detailed designs and
tender documents for agreed waste diversion measures including bill of quantities, cost estimates,
technical specifications and full tender dossier for supplies, and works if applicable, according to a
suitable procurement approach. The designs should comprise relevant design drawings, construction
details and cross‐sections meeting both relevant Ukrainian guidelines and regulations and best
industry practices. For tender purposes it can be assumed that the scope of the measures will be as
described in the preceding Task. The consultant shall assist the Municipality in identifying suitable
sites for any physical installations, and where applicable support the Municipality with obtaining
required approvals and permits for designs prepared under this First Sub‐Assignment”.

The Consultant shall prepare the Detailed Design for the selected solution, in accordance with the
EU and local legislation, with BAT (best available technology) and with current best practice in the
country. Special attention will be given during the design to allow for open technologies, in order to
attract as many as possible candidate Contractors. As mentioned, a site in the local Heat Power Plant
can be allocated for the construction of the future MRF and Composting Plant. The consultant shall
assist the Municipality in evaluation other suitable sites for CACs proposed by the Municipality.
The technical documentation shall comprise explanatory notes and calculations for the following
parts of design: technology, civil construction, water supply and sewerage, heating and ventilation,
electricity supply, automation systems, and economics. Specifications for each of the proposed
works shall be produced. The Specifications shall clearly specify the quality of materials to be used in
all construction and equipment supplied.
Tender Dossier will be prepared both for Works as well as for Supply of equipment.
The Tender Dossier for Works will correspond to FIDIC Red Book and comprise the following main
volumes:
Volume I
Volume I contains the invitation, the instruction to tenders and other forms to be submitted by the
tenderers.
Volume II
Volume II contains the model contract, the General Conditions of Contract and guarantee Forms.
Volume III
Volume III of FIDIC Red Book regards the “Technical Specifications” for the construction (for
earthworks, concrete works, buildings, roads, mechanical and electrical works, etc), which is in line
with the detailed design study.
Volume IV
Volume IV regards the “Bill of Quantities”, containing an itemized breakdown of the works to be
carried out in a unit price contract, indicating a quantity for each item and the corresponding unit
price to be filled.
Volume V
Volume V, contains the “Tender drawings” and the full accompanying surveys, permits, decisions (in
Annex form prepared for each respective facility).

Special attention will be paid to testing and taking‐over of works and the Contractor post‐construction
services.
In regard to the Supply of equipment, the Tender Dossier contains also certain template forms for
invitation, instruction to tenders, model contract, General Conditions guarantee forms, etc.
Additionally, the “Technical Specifications” of the equipment and the Financial Offer are included.
The deliverable of this Task will be Waste Diversion Design and Tender Documents, i.e. full detailed
designs (including but not limited to drawings, BoQ, technical specifications, EIA) and tender
documents for the agreed waste diversion measures.

Task 4. Support the Municipality of Lviv in the consecutive supply, and if applicable, works tender,
responding to clarification requests, evaluation of proposals and conclusion of contract.

The objective of this task is to “support the Municipality of Lviv in the consecutive supply, and if
applicable, works tender, responding to clarification requests, evaluation of proposals and conclusion
of contract”.
There will be launched one tender for works separated into Lots (for example Lot 1: Composting
Plant, Lot 2: MRF, Lot 3: CACs). Also, there will be launched one tender for the supply of equipment
such as , skips, containers and trucks; alternatively the equipment can be incorporated in the works
tender, if the budget is low.
Clarifications will be provided to questions of the candidate Bidders, if the case.
Upon receipt of tenders the Consultant will participate in the tender evaluation committee as an
observer. The Consultant will in this process provide the Contracting Authority with all technical
expertise and opinion required. The Consultant will for each tender received, assess the technical
compliance with the requirements as included in the tender documents and the eligibility of the
bidding company. The Consultant will check the scope of supply for conformity with the technical
specifications. The Consultant may also be called upon to assist Municipality with the negotiations
with the selected bidder.

Task 5. Clarify outstanding issues required for EIB to prepare ToR for the subsequent integrated
solid waste management project preparation assignment, including assessing the
appropriateness of the proposed site for a new landfill based on existing information /
Assist the City of Lviv in awareness building for the neighboring village
The objective of this task is to “clarify outstanding issues required for EIB to prepare ToR for the
subsequent integrated solid waste management project preparation assignment, including assessing
the appropriateness of the proposed site for a new landfill based on existing information. Assist the
City of Lviv in awareness building for the neighbouring village, e.g. through presentation of best
practice sanitary landfills and suggestions for suitable study visits in neighbouring countries”.

According to the previous 2014 report “Pre‐Assessment of Candidate Sanitary Landfill Sites – Lviv”,
two candidate sites are acceptable as sanitary landfill sites for Lviv City, namely Site 1 – Vysloboky
and Site 2 – Verkhnya Bilka. Τhe Municipality is currently considering Site 2 as the preferable one.
One of it’s main advantages is the fact that consists of a single property which belongs to neighbour
Municipality, who have also agreed to offer the area for this development. In the report, it is
quoted:

“The size of the total site is about 100 ha. The village council has reserved a plot of around 35
ha for a cemetery. The remaining 65 ha is available for a landfill site. Thus the actual plot for
the landfill is to be determined.”, and
“The plan of the village council to establish a cemetery next to the landfill is socially
unfavourable.”
Contrary to the above, it has been clarified during the visit to the Verkhyna Bilka site (Photo 4) that i)
the available land for landfill development is 30‐35 ha and not 70 ha, an area which may not be
sufficient for its intended scope, ii) the cemetery is not intended for the village but for the entire
city of Lviv. It was already argued that the proximity of the landfill with the cemetery is not
compatible. Also, visual contact exists from the two neighboring villages, which is considered as a
disadvantage.

With these concerns being raised, it was agreed that the Consultant must first further assess the
suitability of the proposed site and related development plans with a view to conclude whether the
site is suitable for the size of the landfill. In this respect, the Team has asked to receive the cadastral
maps of the plot, in order to measure the exact site’ borders and design – calculate the anticipated
capacity / lifetime, as elongated shape of proposed site elongation can decrease further it’s useful
volume.
Although there are no changes expected in regard to the preliminary agreement with the village,
who owns the plot, it was advised that the municipality continues to search for alternative sites and
re‐approach local communities and/or reconsider the decision for sitting the main municipal
cemetary.
Once the on‐going site selection is finalised, the consultants will also assist the city of Lviv in
awareness building for the local communitites on the operation of sanitary landfills. A study tour can
be organized, for example to Romania to visit similar facilities.
The output of this Task will be a brief Note with the input to the ToR for the integrated solid waste
management project, including assessment of the site proposed for the new landfill and likelihood
for acceptance from the neighbouring village.

Task 6. Review the key aspects of the approved landfill closure design for the existing landfill
serving the city of Lviv with a view to assess its acceptability in relation to international
standards and best practices
The objective of this task is to “review the key aspects of the approved landfill closure design for the
existing landfill serving the city of Lviv with a view to assess its acceptability in relation to
international standards and best practices”.

It is clearly understood that the landfill is in urgent need of closing & rehabilitation, due to a long
operation without undertaking the environmental protective measures and due to volume
limitations. The Team has been informed that the landfill’s restoration design has been elaborated
on a detail level and the respective expertise has been granted. Funding however is not yet
available. Disposal and restoration in phases will be carried in parallel, therefore the duration ‐ 10
years – is rather long compared to similar projects. The consultant noted that some land exploitation
that could achieve additional capacity within the existing boundaries is possible, by rehabilitating the
leachate lagoon.
The Municipality has sent by email layouts of the site, contents of technical description and certain
provisions of the design (for example top cover layers) ‐ but not full design volumes. The acid tar
ponds are not responsibility of the city (but of the state’s oil company now under liquidation),
however due to proximity they are also addressed in the plan.
Key aspects of the design will be reviewed and areas that could be improved or are not acceptable
will be identified. Minor changes to the design and proposal can be done without the need for a new
technical expertise review. Following this, a decision will be taken whether and under what
conditions the closure can be included under EIB funding.
The output of this Task will be a common deliverable of Tasks 5 & 6, “ToR and Landfill Closure Note”
that will include the acceptability of the existing landfill closure design.

4 Coordination with other Projects
At present, there are no other TA projects running in parallel.
However, the Consultant is willing to participate and contribute in any meetings focusing on the
transposition of EU waste legislation to Ukranian law.

5 Timetable
According to the ToR, the Assignment is carried out in the period from 24th
Aug 2015 to 30th
Jun
2016, however initial planning is that deliverables have to be submitted within 4 months from
contract signature.
Due to the local elections on 25th
October and the fact that the waste questionnaires have not yet
been received, it would be necessary to reschedule the timing and duration of the previous Tasks
and the respective deliverables as illustrated in the next Gant Chart.
