Question du 16 juillet 2013 du député UMP François Cornut-Gentille au Ministre du redressement
productif sur « les moyens d’actions contre les risques de reproduction illégale liés à la diffusion à
venir d’imprimantes 3D sur le marché Français […]» .
Les limites à apporter aux exceptions de reproduction privative, en droit d’auteur et en propriété
industrielle?
Modifier le Code de la Propriété Intellectuelle afin de limiter expressément le nombre maximum de
copies privées d’objets tridimensionnels autorisées (comme la copie de sauvegarde en matière de
logiciel)?
Amendement déposé à l’Assemblée Nationale par l’UDI dans le cadre de l’examen de proposition de loi
tendant à renforcer la lutte contre la contrefaçon. = visait à interdire sans discernement toute forme de copie
par « technique dite d’impression tridimensionnelle »;
Inutile et rédaction à l’encontre de l’approche synthétique et de neutralité technique de la loi. Il a été rejeté et
n’apparait pas dans la proposition de loi adoptée le 26 février 2014;
Limitation légale pas souhaitable.

11. QUELQUES PISTES DE SOLUTION ?
CRÉER BASE DE DONNÉE GLOBALE POUR OBJETS IMPRIMABLES
Création d’un système de gestion de droits (Digital Right Managment – DRM) dédié aux imprimantes
3D afin de contrôler les reproductions d’objets tridimensionnels protégés au titre du droit d’auteur.
Brevet « Système de contrôle de fabrication » publié aux Etats-Unis en octobre 2012 : imprimantes 3D
devront obtenir une autorisation avant d’imprimer les objets demandés;
Techniquement = créer une base de données au sein de laquelle les titulaires de droits pourraient enregistrer
leurs œuvres. Ces derniers enregistreraient alors sur cette base de données une reproduction numérique
tridimensionnelle de l’œuvre sur laquelle ils détiennent des droits. Au stade de l’enregistrement, les titulaires
de droits pourraient choisir de limiter le nombre maximum de copies susceptibles d’être réalisées par
l’utilisateur de l’imprimante.
Limites :
o Nécessité pour les titulaires de droits d’enregistrer leurs œuvres pour obtenir la protection technique
= création in fine d’un enregistrement pour les œuvres protégées par le droit d’auteur;
o Enregistrement de l’ensemble des œuvres tridimensionnelles produites dans le passé et dans le
futur semble matériellement irréalisable = choix par les titulaires de droits parmi les œuvres;
o Détournement du DRM pour empêcher la reproduction d’objets non couverts par un droit d’auteur.
o Techniques : si modification légère de la forme enregistrée?
Nécessité d’un accord entre titulaires de droits (Sociétés de gestions collectives) et fabricants
d’imprimantes pour mettre au point un standard commun = difficile dans un marché pas mature.
