This rule says that words should be given their plain
     ordinary, everyday grammatical meaning

This rule is usually used when a word has 2 or more
    meanings and judges take the least absurd
          meaning to create a better result

This is the rule known as the rule in ‘Heydon’s Case’,
 where judges can look beyond a word of an Act to
              find Parliament’s intention

This rule allows a judge to add or ignore words in an
 Act to help them give a decision that supports, in
         their view why the Act was created

  2. Extension Activity 1, ask students to write down any additional detail regarding the rules using the prompt questions on extension task sheet 1
  3. Extension 1 answers – to use as directed questioning too It illustrates an absurd result, Bentham should have been found guilty but was not – it shows that Acts cannot be perfectly written – if Parliament makes a mistake, should a judge assume it meant to make the mistake and let it be, or guess what Parliament intended? Lord Esher said ‘if the words in an Act are clear they must be used, even if leads to a manifest absurdity OR Lord Scarman: Acts must be interpreted literally, ‘it is not the job of a judge to say Parliament said one thing but meant another’ Narrow and wide It leads to inconsistency – as what one judge may think is absurd, another may not therefore uncertainty and unpredictability T he Law Commission – since 1969 said it was the best rule to use Lord Scarman Aids Inside and outside of an act The official record of the debates that took place in Parliament when the Act in question was debated Ejusdem Generis or Expressio Unius or Noscitur a sociis External, such as dictionary, hansard, law reform reports If words in an act are obscure or lead to absurdity Human Rights Act 1998
  4. Extension Activity 2 – extra questions regarding the Act (individual Activity) Hansard can be looked at if words in an act are obscure, ambiguous or would lead to an an absurd result, and only if the Minister in Parliament resolved the ambiguity or absurdity. To improve visibility of house numbers – the preamble (intrinsic aid) states this Criminal - £50 fine (section 5) ‘ residential property’
  5. Observe and assist where necessary

Problems/potential problems 1 what about numbers around the house door, e.g. on the gate, is this ‘near’ – perhaps a clear definition by the Minister introducing the Act with resolve this 2 what about numbers that written as letters? This also needs clarifying 3 what about houses such as flats, especially as they are adjoining a commercial residence like scenario 3 – where do these fall? So the Act needs to clarify this
