LAST WILL and TESTAMENT

Josephine Diggle
I, JosephineDiggle,of Capitol City,Columbiana,revoke all myformerwillsandcodicilsanddeclare this
to be my will.
FIRST: I directthe paymentof my funeral expenses,administrationexpensesandlegally enforceable
debtsas providedbylaw.
SECOND: All of the propertywhichIownat mydeathsubjectto the paymentssetforthinparagraph
FIRST above,Iherebygive,devise andbequeathtomybelovedhusband,JOSEPHDIGGLE,if he survives
me.
THIRD: If my husband,JOSEPHDIGGLE, predeceasesme,all of mypropertywiththe exceptionof the
real estate locatedat3456 ParkPlace,Capitol City,Columbiana,isherebygiventomygrandsons,ADAM
DIGGLE, COREY DIGGLE, and RYAN DIGGLE in equal shares.The real estate isherebygivenasfollows:
A. The real estate locatedat3456 ParkPlace,Capitol City,Columbiana,isgiventomyson,JACOB
DIGGLE.
B. If the youngestgrandsonhasreachedthe age of thirty-five (35) yearsatsuch time, ADAMDIGGLE,
COREY DIGGLE, andRYAN DIGGLE shall receive theirequal sharesoutright.If the youngestgrandsonhas
not reachedthe age of thirty-five (35) yearsatsuch time,the sharesof my grandsons,ADAMDIGGLE,
COREY DIGGLE, andRYAN DIGGLE, shall be retainedbythe trustee in a single trust.The trustee may
make such payment,use,application,expenditure,oraccumulationof the income andprincipal thereof
as he shall thinkproperforany grandson’sbenefit.Whenthe youngestgrandsonreachesthe age of
thirty-five(35) years, the trustee shall payovertomy grandsonsthe principal then remainingplusany
accumulatedincome asprovidedinSectionTHIRDB 3 below.The trustshall be administeredasdirected
inSectionTHIRD B 1-4 below.
1. STATEMENT OF PURPOSES.The provisions of thistrustgive the trustee the discretiontodistribute
income andprincipal.Myobjective ingrantingsuchdiscretionistopermitthe trustee toadministerthe
trust assetsandmake distributionsubstantiallyasImighthave done if living,havinginmind
circumstancesastheychange from time totime.My primarypurpose inestablishingthistrust isto
provide forthe expensesof raisingmygrandsons,includingprovidingorassistingthemwithan
educationappropriate totheirabilitiesandinterests.Secondarily,itismyhope thatadditional fundswill
be available tomake the livesof mygrandsonsmore comfortable andfinanciallysecure. The trustee
shall have noduty to preserve principal intacttothe extenthe considersitscurrentuse inthe best
interestsof the currentbeneficiaries.Distributionsmaybe made fora beneficiary’scare,comfort,
maintenance,education(includinggraduate ortechnical education),purchasesof homes,oranyother
worthwhile purpose.The trusteeshall have noliabilitytoanypersonforany goodfaithexercise of his
powerto make or withholddistributionsof incomeorprincipal.The trustee mayconsiderother
resourcesknowntohimto be available tothe beneficiaries.
2. INCOME AND PRINCIPALUNTILDIVISION ANDDISTRIBUTION.The netincome andprincipal of this
trust maybe distributedtoorappliedforthe benefitof anyone or more of my grandsonsinsuch
amountsand at such timesasthe trustee,inhisabsolute discretion,maydetermine.Anyundistributed
netincome shall be addedtotrust principal.
3. DIVISION ANDDISTRIBUTION.Whenthe youngestlivinggrandsonreachesage thirty-five (35),the
thenremainingnettrustassetsshall be dividedintoequal sharessothatthere isone share foreach of
my thenlivinggrandsons.
4. FAILURE OF BENEFICIARIES.If a grandsondies before all trustassetsare fullywithdrawnor
distributed, the thenremainingassetsshall be dividedintoequal sharessothatthere isone for each of
my thenlivinggrandsons.Eachshare fora thenlivinggrandsonshall be addedtothe assetsof,or
distributedpursuanttothe provisionsof,the singletrustformygrandsonsunderSectionTHIRD B 1-4.
FOURTH: If any beneficiarydiespriortothe entryof an order,decree,orjudgmentinmy estate,
distributingthe propertyinquestion,orwithinsix monthsafterthe date of mydeath,whicheveris
earlier,anyinterestwhichwouldhave passedtosaidbeneficiaryunderotherprovisionsof the Will are
to be disposedof accordingtothe planof distributionwhichwouldhave beeneffective underthisWill if
such beneficiaryhadpredeceasedme.Itismyintentionthatanypropertyorinterestwhichis
distributed frommyestate asa resultof Courtorder,decree,or judgmentwillnotbe revokedor
otherwise affectedbythe subsequentdeathof the distribute.
FIFTH: A. The personal representative,trustee,andanysuccessorsshall have the followingpowers,
exercisable withoutobtainingpriorauthorityfromanycourt:
1. To retain,invest,andreinvestinanypropertywithoutregardtowhetherthe same maybe
authorizedbylawandregardlessof anyrisk,lack or diversification,orunproductivityinvolved.
2. To lend.
3. To borrow.
4. To pay,collect,enforce,andcompromiseclaims.
5. To allot,assign,convey,convert,divide,exchange,hold,improve,insure,lease,maintain,mortgage,
operate,repair,grantandexercise optionson,pledge, sellatpublicorprivate sale,orexchange all or
part of the estate or trustproperty.
6. To purchase life, liability,andanyothertype of insurance.
7. To exercise all incidentsof ownershipof insurance policies.
8. To pay,fromthe residue of the estate ortrust,packing,storage,andshippingexpensesfor,and
relatedinsurance premiumson,anypropertyeventhoughspecificallygiveninthisWill.
9. To participate inanywayin the continuation,organization,operation,discontinuance,ordissolution
of businessincorporate,partnership,orotherforms.
10. To vote stock andotherrights byproxyor otherwise.
11. To holdtitle topropertywithoutdisclosingfiduciarycapacity.
12. To employagents,assistants,counsel,andbrokersandtodelegate powerstothemandto paytheir
reasonable feesandexpenses.
13. To demolishorerectstructures.
14. To make income andgifttax returns.
15. To establishadequatereservesforappropriate purposes.
16. To continue personal representative ortrustee andtodeal withthe estate or trustwithoutregardto
conflictsof interest.
17. To make divisionsanddistributionsinkindorcash,or partlyin each.
18. To distribute propertytoacustodianfora minorbeneficiaryunderapplicable UniformTransfersto
Minors Actor similarlaw.
19. To allocate propertyproportionatelyordisproportionatelyamongbeneficiariesorheirs.
20. To allocate inhisdiscretionall receiptsanddisbursementsbetweenprincipalandincome where
uncertaintyexistsaboutproperallocationunderapplicable law.
21. To make tax elections,allocations,anddecisions(indoingso,he shall seektominimizethe present
and future income andtransfertax burdentothe estate ortrust and beneficiaries,andhe shall make no
reimbursementoradjustmentsbetweenanybeneficialinterest,whetherincome orprincipal,presentor
future).
22. To permitoccupancyof real propertybybeneficiariesonanyterms.
23. To accept additionsof anykindtothe trust.
24. To waive,release,ordelegate,temporarilyorirrevocably,anypower,authority,ordiscretion.
25. In general,withoutlimitationbyreasonof the foregoing,todoanyand everyact and thingthatthe
personal representative ortrustee wouldhave the righttodoas personal representative ortrustee
underapplicable laworasabsolute ownerorproperty.
B. The personal representativeortrustee shall notbe liable forlosscausedtoanypersonbyany good
faithdecision.
SIXTH: A.I herebyappoint JOHN COOPERPersonal Representative of thisWill.If JOHN COOPERcannot
so act, I appointJEFFERYCOOPER as suchPersonal Representative.
B. I appointJACOBDIGGLE as Trustee of the trust createdunderthisWill.
C. Nobond shall be requiredof anyPersonal Representative,Trustee,orSuccessor.
I freelyandwillinglysubscribemyname tothiswill consistingof fourpagesonthisthe 4th
day of May,
2014, at Capitol City,Countyof Capitol,State of Columbiana,inthe presence of thesewitnesses: John
