Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

1. EMNİYET VE JANDARMA PERSONELİNİN SİLAH KULLANMA YETKİSİ VE
SORUMLULUĞU
İlgili Mevzuat :
1. Yaşam Hakkı Başlıklı İnsan Hakları Avrupa Sözleşmesi
Madde 2/2- Öldürme, aşağıdaki durumlardan birinde kuvvete başvurmanın kesin
zorunluluk haline gelmesi sonucunda meydana gelmişse, bu maddenin ihlali suretiyle
yapılmış sayılmaz: a) Bir kimsenin yasadışı şiddete karşı korunması için, b) Usulüne
uygun olarak yakalamak için veya usulüne uygun olarak tutuklu bulunan bir kişinin
kaçmasını önlemek için, c) Ayaklanma veya isyanın, yasaya uygun olarak
bastırılması için.
2. 1982 Anayasası
Madde 17/4- Meşru müdafaa hali, yakalama ve tutuklama kararlarının yerine
getirilmesi, bir tutuklu veya hükümlünün kaçmasının önlenmesi, bir ayaklanma veya
isyanın bastırılması, sıkıyönetim veya olağanüstü hallerde yetkili merciin verdiği
emirlerin uygulanması sırasında silah kullanılmasına kanunun cevaz verdiği zorunlu
durumlarda meydana gelen öldürme fiilleri, birinci fıkra hükmü dışındadır.
3. 5237 sayılı Türk Ceza Kanunu
Kanunun hükmü ve amirin emri
Madde 24- 1) Kanunun hükmünü yerine getiren kimseye ceza verilmez. (2) Yetkili bir
merciden verilip, yerine getirilmesi görev gereği zorunlu olan bir emri uygulayan
sorumlu olmaz. (3) Konusu suç teşkil eden emir hiçbir surette yerine getirilemez. Aksi
takdirde yerine getiren ile emri veren sorumlu olur. (4) Emrin, hukuka uygunluğunun
denetlenmesinin kanun tarafından engellendiği hallerde, yerine getirilmesinden emri
veren sorumlu olur.
Meşru savunma ve zorunluluk hali
Madde 25- Meşru savunma: (1) Gerek kendisine ve gerek başkasına ait bir hakka
yönelmiş, gerçekleşen, gerçekleşmesi veya tekrarı muhakkak olan haksız bir saldırıyı
o anda hal ve koşullara göre saldırı ile orantılı biçimde defetmek zorunluluğu ile
işlenen fiillerden dolayı faile ceza verilmez.
Zorunluluk hali: (2) Gerek kendisine gerek başkasına ait bir hakka yönelik olup,
bilerek neden olmadığı ve başka suretle korunmak olanağı bulunmayan ağır ve
muhakkak bir tehlikeden kurtulmak veya başkasını kurtarmak zorunluluğu ile ve
tehlikenin ağırlığı ile konu ve kullanılan vasıta arasında orantı bulunmak koşulu ile
işlenen fiillerden dolayı faile ceza verilmez.
Sınırın aşılması
Madde 27- (1) Ceza sorumluluğunu kaldıran nedenlerde sınırın kast olmaksızın
aşılması halinde, fiil taksirle işlendiğinde de cezalandırılıyorsa, taksirli suç için
kanunda yazılı cezanın altıda birinden üçte birine kadarı indirilerek hükmolunur.
2. (2) Meşru savunmada sınırın aşılması mazur görülebilecek bir heyecan, korku veya
telaştan ileri gelmiş ise faile ceza verilmez.
4. 3713 sayılı Terörle Mücadele Kanunu
Madde 20- Yukarıda sayılanlardan kamu görevlileri, görevlerinden ayrılmış olsalar
dahi terör suçluları tarafından kendilerine veya eş ve çocuklarının canına vuku bulan
bir taarruzu savmak için silah kullanmaya yetkilidirler
Ek 2. Madde- Terör örgütlerine karşı icra edilecek operasyonda 'teslim ol' emrine
itaat edilmemesi veya silah kullanmaya teşebbüs edilmesi halinde kolluk görevlileri,
tehlikeyi etkisiz kılabilecek ölçü ve orantıda, doğrudan ve duraksamadan hedefe karşı
silah kullanmaya yetkilidirler.
5. Polis Vazife ve Salahiyet Kanunu
Madde 16- Polis, görevini yaparken direnişle karşılaşması halinde, bu direnişi kırmak
amacıyla ve kıracak ölçüde zor kullanmaya yetkilidir.
Zor kullanma yetkisi kapsamında, direnmenin mahiyetine ve derecesine göre ve
direnenleri etkisiz hale getirecek şekilde kademeli olarak artan nispette bedenî
kuvvet, maddî güç ve kanunî şartları gerçekleştiğinde silah kullanılabilir.
İkinci fıkrada yer alan;
a) Bedenî kuvvet; polisin direnen kişilere karşı veya eşya üzerinde doğrudan
doğruya kullandığı bedenî gücü,
b) Maddî güç; polisin direnen kişilere karşı veya eşya üzerinde bedenî kuvvetin
dışında kullandığı kelepçe, cop, basınçlı ve/veya boyalı su, göz yaşartıcı gazlar veya
tozlar, fizikî engeller, polis köpekleri ve atları ile sair hizmet araçlarını,
(1) ifade eder.
Zor kullanmadan önce, ilgililere direnmeye devam etmeleri halinde doğrudan
doğruya zor kullanılacağı ihtarı yapılır. Ancak, direnmenin mahiyeti ve derecesi göz
önünde bulundurularak, ihtar yapılmadan da zor kullanılabilir.
Polis, zor kullanma yetkisi kapsamında direnmeyi etkisiz kılmak amacıyla
kullanacağı araç ve gereç ile kullanacağı zorun derecesini kendisi takdir ve tayin
eder. Ancak, toplu kuvvet olarak müdahale edilen durumlarda, zor kullanmanın
derecesi ile kullanılacak araç ve gereçler müdahale eden kuvvetin amiri tarafından
tayin ve tespit edilir.
Polis, kendisine veya başkasına yönelik bir saldırı karşısında, zor kullanmaya
ilişkin koşullara bağlı kalmaksızın, 5237 sayılı Türk Ceza Kanununun meşru
savunmaya ilişkin hükümleri çerçevesinde savunmada bulunur.
Polis;
a) Meşru savunma hakkının kullanılması kapsamında,
b) Bedenî kuvvet ve maddî güç kullanarak etkisiz hale getiremediği direniş
karşısında, bu direnişi kırmak amacıyla ve kıracak ölçüde,
3. c) Hakkında tutuklama, gözaltına alma, zorla getirme kararı veya yakalama emri
verilmiş olan kişilerin ya da suçüstü halinde şüphelinin yakalanmasını
sağlamak amacıyla ve sağlayacak ölçüde,
d) Kendisine veya başkalarına, işyerlerine, konutlara, kamu binalarına, okullara,
yurtlara, ibadethanelere, araçlara ve kişilerin tek tek veya toplu halde
bulunduğu açık veya kapalı alanlara molotof, patlayıcı, yanıcı, yakıcı, boğucu,
yaralayıcı ve benzeri silahlarla saldıran veya saldırıya teşebbüs edenlere
karşı, saldırıyı etkisiz kılmak amacıyla ve etkisiz kılacak ölçüde,
Silah kullanmaya yetkilidir.
Polis, yedinci fıkranın (c) bendi kapsamında silah kullanmadan önce kişiye
duyabileceği şekilde "dur" çağrısında bulunur. Kişinin bu çağrıya uymayarak
kaçmaya devam etmesi halinde, önce uyarı amacıyla silahla ateş edilebilir. Buna
rağmen kaçmakta ısrar etmesi dolayısıyla ele geçirilmesinin mümkün olmaması
halinde ise kişinin yakalanmasını sağlamak amacıyla ve sağlayacak ölçüde silahla
ateş edilebilir.
Polis, direnişi kırmak ya da yakalamak amacıyla zor veya silah kullanma
yetkisini kullanırken, kendisine karşı silahla saldırıya teşebbüs edilmesi halinde,
silahla saldırıya teşebbüs eden kişiye karşı saldırı tehlikesini etkisiz kılacak ölçüde
duraksamadan silahla ateş edebilir.
Madde 25- Polis teşkilatı bulunmayan yerlerde il, ilçe ve bucak jandarma komutanları
ile jandarma karakol komutanları bu kanunda yazılı vazifeleri yapar ve yetkileri
kullanırlar.
6. 1481 sayılı Asayişe Müessir Bazı Fiillerin Önlenmesine Hakkında Kanun
Madde 1/B- Polis ve jandarma, diğer kanun ve tüzüklerde yazılı yetkileri saklı kalmak
üzere, aşağıda yazılı hallerde de silah kullanmaya yetkilidirler:
…
B)(A) bendindeki yetkiler saklı kalmak üzere, ‘ağırlaştırılmış müebbet ağır hapis’ veya
ağır hapis cezasını gerektiren suçlardan bir veya birkaçını işlemekten sanık veya
hükümlü olup da haklarında tevkif veya yakalama müzekkeresi çıkarılan ve silahlı
dolaşarak emniyet ve asayişi tek başına veya toplu olarak fiilen tehdit ve ihlal ettikleri
anlaşılanlardan, teslim olmaları için İçişleri Bakanlığınca tespit edilen tarihte
başlamak üzere 10 günden az ve 30 günden çok olmamak şartıyla verilecek mühlet
ile ad, san ve eylemleri de belirtilerek sanık veya hükümlünün dolaştığı bölgelerde
mutat vasıtalarla ve uygun görülen yayın organlarıyla radyo ve televizyonla da ilan
edilenlerin belirtilen süre sonuna kadar adli makamlara, zabıtaya veya herhangi bir
resmi mercie teslim olmamaları hallerinde”.
Madde 2- Birinci maddenin (B) bendinde sayılan hallerde:
a. Sanık veya hükümlünün teslim olması için yapılan (Teslim ol) ihtarından sonra,
b. Polis veya jandarmaya karşı silah kullanmaya filhal teşebbüs etmeleri halinde ise
ihtara lüzum olmaksızın,
Silah kullanılır.
Müsademe sırasında; sanık veya hükümlüye müsademede veya kaçmada yardımcı
olanlar haklarında da birinci fıkra hükmü uygulanır.
4. 7. Türk Ceza Kanunu
Tanımlar
Madde 6- (1) Ceza kanunlarının uygulanmasında;
f) Silah deyiminden;
1. Ateşli silahlar,
2. Patlayıcı maddeler,
3. Saldırı ve savunmada kullanılmak üzere yapılmış her türlü kesici, delici veya
bereleyici alet,
4. Saldırı ve savunma amacıyla yapılmış olmasa bile fiilen saldırı ve savunmada
kullanılmaya elverişli diğer şeyler,
5. Yakıcı, aşındırıcı, yaralayıcı, boğucu, zehirleyici, sürekli hastalığa yol açıcı nükleer,
radyoaktif, kimyasal, biyolojik maddeler,
Anlaşılır.
8. Jandarma Teşkilat, Görev ve Yetkileri Kanunu
Silah Kullanma Yetkisi
Madde 11- Jandarma, kendisine verilen görevlerin ifası sırasında hizmet özelliğine
uygun ve görevin gereği olarak kanunlarda öngörülen silah kullanma yetkisine
sahiptir.

MADDE 49- (1) Jandarma, ilgili mevzuatına göre silah kullanma yetkisine sahiptir.
10. 5607 Sayılı Kaçakçılıkla Mücadele Kanunu
Madde 22- (1) Gümrük Kanunu gereğince belirlenen kapı ve yollardan başka
yerlerden gümrük bölgesine girmek, çıkmak veya geçmek isteyen kişiye “dur”
uyarısında bulunulmasına rağmen bu uyarıya uymaması halinde, havaya ateş
edilmek suretiyle uyarı yinelenir. Ancak silâhla karşılığa yeltenilmesi ve sair surette
meşru müdafaa durumuna düşülmesi halinde, yetkili memurlar saldırıyı etkisiz kılacak
oranda doğrudan hedefe ateş edebilir. Memurların silâh kullanmalarından dolayı
haklarında soruşturma ve kovuşturma açılması halinde, bağlı bulunduğu kurum
tarafından avukat sağlanır ve avukatlık ücreti kurumlarınca karşılanır.
(2) Kaçakçılığı önleme, izleme ve araştırmakla yükümlü olanlar, gümrük bölgesindeki
her nevi deniz araçlarına yanaşıp yük ve belgelerini incelemeye yetkilidir. Görevlilerin
yanaşmasına izin vermeyerek kaçan veya kaçmaya teşebbüs eden her nevi deniz
araçlarına uluslararası deniz işaretlerine göre telsiz, flama, mors ve benzeri
işaretlerle durması ihtar olunur. Bu ihtara uymayan deniz araçlarına uyarı
mahiyetinde ateş edilir. Buna da uymayıp kaçmaya devam ettiği takdirde durmaya
zorlayacak şekilde üzerine ateş edilir.
5. GENEL DEĞERLENDİRME
Polis ve jandarma, bozulan düzenin tekrar kurulması, daha fazla bozulmaması
ve düzenin bozulmasını engellemek amacıyla silah kullanabilir. Silah; bazı
durumlarda biber gazı, cop, boyalı veya tazyikli su olabileceği gibi, somut olayın
ağırlığı ve büyüklüğüne göre ateşli silah da olabilir. Polis ve jandarma; elinde silah
olmayan, silahı olup da silahına davranmayan veya davranacağına dair herhangi bir
izlenim uyandırmayan kişilere karşı silah kullanmayacaktır.
Polis ve jandarma istisnai olarak, ister adına görevin ifası, isterse meşru
müdafaa denilsin, kendi ve başkalarının can, mal ve sair haklarını korumak amacıyla
gerektiğinde silahını kullanabilir. Silah kullanma, saldırıda bulunanın direncini kıracak
veya yakalanmasını sağlayacak ölçüde olmalıdır. Polis ve jandarma "dur" veya
"teslim ol" ihtarında bulunmadan, kişi silahlı olsa dahi silahına davranamayacaktır.
Ateşli silahla saldırıda bulunan veya saldırıda bulunma tehdidini ortaya koyan kişiye
karşı polis ve jandarma; öldürmek için değil, tehlike haline son vermek veya
yakalamak için silah kullanabilir.
Polis ve jandarma; terör örgütlerine karşı icra edilecek operasyonlarda “teslim
ol” emrine uyulmaması veya silah kullanmaya teşebbüs edilmesi halinde, tehlikeyi
etkisiz kılabilecek ölçüde, doğrudan ve duraksamadan hedefe karşı silah kullanmaya
yetkilidir. Bu yetki, terör saldırılarına karşı koyan polis ve jandarma için de geçerlidir.
Buna göre polis ve jandarma; bir operasyonda veya kendisine veya üçüncü kişilere
karşı gerçekleştirilen terör saldırılarında “teslim ol” uyarısında bulunmaksızın,
tehlikeyi etkisiz kılabilecek ölçüde, doğrudan ve duraksamadan hedefe karşı silah
kullanabilir.
Kanun koyucu, tüm bu hususları ‘görevin ifası’ adlı hukuka uygunluk sebebi
kapsamında görmüş ve bu kapsama giren eylemlerde hukuka aykırılık unsurunun
oluşmayacağını ve bu eylemlerin suç sayılmayacağını kabul etmiştir.
Kolluk kuvvetlerinin silah kullanabilmesinin ön şartı niteliğinde uyması gereken
bazı koşullar vardır. Bu koşullardan öncelikle silah kullanma yetkisinin kolluk
açısından son çare olarak başvurulması gerektiğini belirtmek uygun olacaktır. Kolluk
silah kullanmak zorunda kalsa bile öncesinde ihtarda bulunmalıdır. İhtara uyulmadığı
takdirde kolluk personeli havaya uyarı ateşi açarak karşı tarafı hukuka aykırı
eyleminden vazgeçirmeye çalışmalıdır. Buna rağmen karşı tarafın hukuka aykırı
eylemleri devam etmekteyse son çare olarak mevzuata ve mesleğin gereklerine
uygun olarak silah kullanma yoluna gidilmelidir. Bu halde dahi silah kullanımı hukuka
aykırı eylemle ölçülü olması gerektiğine dikkat edilmelidir.
Yeri gelmişken ve son olarak silah kullanma yetkisinde ölçülülük ilkesinin
kapsamından da bahsetmek gerekmektedir. Ölçülülük ilkesi, “elverişlilik”, “gereklilik”
ve “orantılılık” olmak üzere üç alt ilkeden oluşmaktadır. “Elverişlilik”, başvurulan
önlemin ulaşılmak istenen amaç için elverişli olmasını, “gereklilik” başvurulan önlemin
ulaşılmak istenen amaç bakımından gerekli olmasını, “orantılılık” ise başvurulan
önlem ile ulaşılmak istenen amaç arasında olması gereken ölçüyü ifade etmektedir.
Kolluk kuvvetlerinin silah kullanma yetkilerinin olduğu hallerde kolluk kuvveti
personeli, her olay bazında değerlendirmede bulunarak silah kullanma eyleminin
6. hukuka aykırı eylemi bertaraf etme noktasında ölçülülük ilkesine uygun olup
olmadığını değerlendirmesi gerekmektedir.
