What is Islamic Will?

DEFINITION

It is a legal document covering inheritance-related
wishes to protect assets to comply with shariah and
legal laws.

It is a misconception that Islamic Wills do not need to
comply with legal laws, but every Muslim must comply
with the laws of the land in addition to shariah law.

What are the different
names of Islamic Wills?

NAMES

Various names are used across the internet for
Islamic Wills, and not all Muslims are familiar
with all names. Some of them areIslamic Wills,
Muslim Wills, Muslim Will, Wasiyat, Wassiyyat,
Wasiyyat, Wasiya, Wasiyya, Wassiyyah,
wasiyyah or simply last will.

How does Islamic
Will work?

NAMES

DISTRIBUTING ESTATES: It is your wish, so you must ensure that the
Islamic Wills provides clear legal wording regarding distributing estates per
Islamic Inheritance law. Muslim minority countries do not prefer your Will;
it just mentions distribution as per Shariah or Islamic Inheritance law as
they are not familiar with Islamic Inheritance law. You must include a
properly detailed appendix that is interpretable by the non-Muslim court if
needed. Wassiyyah ensures that your Will is properly drafted.

EXECUTORS DUTY: Give your executor power and rights to execute your
Will in its entirety. DO NOT LIMIT the executor's duty in the Will which can
restrict your Will from being executed as per your Wish.

INFORMATION

TESTATOR & FAMILY MEMBERS:: Name, Address, Email, Phone, Place of
birth, and birth name.

EXECUTORS: Name, Address, Phone, and Email.

WITNESSES: Name, Address, Email, and Phone

LAWYER: Name and address of Lawyer if you are creating International Will

PUBLIC NOTARY: Just leave it blank and it can be filled out during the
signing process.

Testator information

A testator is a person whose Will is
created. Testator name, address,
birth date, and place of birth are
required to complete this section.

My Immediate Family

If you are creating family Will then
your spouse and children information
need to be

illed out.

Testator

Testator declares the mental capacity of him
or herself and revokes all will, i.e., if you have
Wills made before, then it would become
invalid upon creating this will.

Executor

Executors’ information, including name,
city, state, or country to be

illed out. The
husband will be the
f
irst executor for the
wife and vice-versa. You need to have at
least two executors on the Will.

Custody of minor children

You give an executor power to manage the
estates until they reach to the adulthood.

Declaration of faith

In this section, you may declare
about your faith, religious wishes on
burial arrangements etc.
Wishes

In this section, you may declare your
wishes about some special gifts
including jewelries, belongings etc.

Signing

Testator and Witnesses must
meet at one location and sign the
printed your last will document

lands, etc., are on Joint Tenancy which poses a
challenge for many on Shariah compliance.
