Documents Required to buy a property in India
Before buying a property an important and crucial step is to doDocument Verification.
This criticalstep proves the authenticity, clarity, Ownership and history of the property you are
interested to buy. There are many reasons why you need to verify the documents, but some of them
are matters of concern that definitely needs to be reviewed.
There are many instances where the Seller has Sold properties
- To two or more buyers
- With Fake Documents (Title deeds, No Approved Building Plan and others)
- With Illegal Construction
- With No Clearances from land authorities
- With an Ongoing Case in the Court with claims of Ownership from other parties.
- That are Pledged (Loans taken from bank for the property).
So how will you ensure that the property you decided to buy has Clear titles, ownership, Free from any
Kind of litigations, Clean Property Records. To avoid unexpected trouble and enjoy a hassle free
Purchase of a Property with Peace of Mind, Here are the core list of Documents you need to look for and
get verified from a Legal source.
1) Mother Title Deed / Sale Deed -
Mother Title Deed confirms the Seller is the absolute Owner of the Property with all legal rights
to sell the property. Title Deed has to be verified by a lawyer to check if Seller has mortgaged
the property for a Loan.
Sale Deed: Sale Deed is an important Legal Document executed between the buyer and
seller in a purchase or sale of a property. Sale Deed is an “Agreement to Sell” document that
tells seller will be intending to transfer/sell the property and buyer will be intending to
purchase it. The Purchase or Sale of a Property is not complete until both the buyer and Seller
Signs the sale deed on a Stamp Paper in the Sub-Registers Office. Sale Deed also details the
Property location, address, Size, Identification Number, Buyer, Seller information etc.
2) RTC(Records of Rights and Tenancy Corps) or 7/12 extract – is a document Issued by Land
authorities showing Survey Number, Area, Current Owner of the property.
3) Encumberance Certificate – It’s a Clearance certificate from the local sub-registrar office ( the
property where the deed has been registered ) that it has no legal dues or complaints.
4) Approved Sanction Plan (Blue Print)
5) Tax Paid Receipts
6) Joint Development Agreement ( I’m referring to the type of properties you see on the outskirts
of major cities which are big apartment complexes with large no of units developed in many
acres of land, Such properties usually are jointly developed between a Builder and the Land
Owner. Take extra care to verify the Joint development agreement, its terms and conditions by a
lawyer.)
7) Sale Agreement– Sale Agreement is a valid document prepared by lawyer stating that the Seller
is willing to Sell the property to the buyer for the agreed Amount, Advance amount, time when
actual sale will take place. Usually a Lawyer will prepare the agreement on a Rs 100 or Rs 200
Stamp paper which will be signed by both parties at the time of Sale including 2 witnesses.( Hot
Tip:- Get everything in writing from builders(Price, Delivery date, amenities as promised in
Paperwork, Maintenance charges on a monthly basis, Read the fine print to check if there are
any hidden clause which can allow them to increase the property price later).
8) Builder Reputation ( check previous projects by the same builder, did they delivered in time,
Sometime if bank is not willing to provide home loans for projects built by this builder then that is red
flag.
9) Completion (Occupancy) Certificate:- Builder needs to provide the completion certificate
issued by municipal authorities. This Certificate proves that the building complies with the
approved plan. You would need this certificate for the registration of the house.
