Bankruptcy allows individuals to discharge certain qualifying unsecured debts, such as credit cards. The individual files for either Chapter 7 or Chapter 13 bankruptcy. In Chapter 7, qualifying debts are discharged but the individual may lose property. In Chapter 13, a repayment plan is set up to pay back debts over time but prevents wage garnishment and debt collection.
