Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

5. La Guía que tienen en sus manos es una herramienta útil y práctica para
la creación de una Asociación,fruto del trabajo de profesionales del Área
de Participación Ciudadana del Ayuntamiento de Burgos.
Son muchos los proyectos que pueden llevarse a cabo a través de una
Asociación,muchos los derechos que defender y mucho el esfuerzo que se
tiene que desarrollar para lograr un proyecto asociativo sólido.
El primer paso para construir una entidad es el compromiso personal de
colaborar en el bien común, aunando esfuerzos con otras personas con
iguales objetivos e inquietudes. Después de todo ello, llega la hora de los
trámites, las gestiones, en definitiva: del papeleo. Y aquí es donde, a me-
nudo, a algunas personas y colectivos, les empiezan a surgir serias dudas,
muchas de ellas vinculadas a la legislación vigente o cómo iniciar este
proceso.
Estoy seguro que esta Guía dará información y respuesta precisa sobre
todos aquellos aspectos prácticos a cuantas personas o entidades estén
dispuestas y comprometidas a formar una agrupación de asociaciones
o una asociación concreta. Sin duda, el resultado final de un trabajo bien
hecho.

Presentación
El Derecho de Asociación se regula por la Ley Orgáni-
ca 1/2002, de 22 de marzo, denominada habitualmente
“Ley de Asociaciones”. En su exposición de motivos se
indica que “las asociaciones permiten a los individuos
reconocerse en sus convicciones, perseguir activamente
sus ideales, cumplir tareas útiles, encontrar su puesto en
la sociedad, hacerse oír, ejercer alguna influencia y pro-
vocar cambios”.
Muchos ciudadanos y ciudadanas optan por la fórmula
asociativa para llevar a cabo sus proyectos, defender sus
derechos o propiciar determinados cambios y valores.
Las asociaciones desempeñan un papel fundamental e
imprescindible hoy día en todos los ámbitos contribu-
yendo a un ejercicio activo de la ciudadanía.
Es aconsejable poner en marcha una asociación desde
la perspectiva de apertura o cercanía a las asociaciones

Puede ocurrir que nuestro proyecto e iniciativa sobre-
pasen a los de las actuales asociaciones planteándonos
crear una nueva asociación.
Surgen entonces las dudas sobre cómo iniciar este pro-
ceso, a qué instituciones acudir, que leyes lo regulan...
dificultad aún mayor en asociaciones de inmigrantes
en donde además del desconocimiento de los trámites,
está la dificultad del idioma.
La presente Guía trata de dar respuesta y ser un instru-
mento práctico para cualquier persona o entidad que
quiera formar una asociación y especialmente a perso-
nas de otros países en los que a la dificultad del cono-

Qué es una asociación
y quiénes pueden
constituirla
Son agrupaciones estables de al menos tres personas o co-
lectivos con un interés compartido, sin ánimo de lucro, in-
dependientes formalmente del Estado, partidos políticos o
empresas y con un funcionamiento democrático.
Pueden constituir asociaciones, y formar parte de las mis-
mas, las personas físicas y las personas jurídicas que:
Sean mayores de edad, menores emancipados (con
más de 16 años y que vivan por su cuenta) o menores
no emancipados con consentimiento de sus tutores o
tutoras legales.

Constitución formal de
la asociación: el acta
fundacional
Las personas que quieren formar la asociación son los so-
cios y socias fundadoras también llamados promotores
o promotoras, quienes mantendrán una reunión oficial
(asamblea constituyente) en la que acuerdan la creación de
dicha asociación levantando un acta.
Esta acta se denomina ACTA FUNDACIONAL y es el docu-
mento oficial de constitución de la asociación.
Los elementos que debe contener son:
Nombre y apellidos de los promotores y promotoras
de la asociación si son personas físicas, y la denomi-
nación o razón social si son personas jurídicas, y en
ambos casos: la nacionalidad, domicilio y número de
identificación fiscal.
La voluntad de los promotores y promotoras de cons-
tituir una asociación, los pactos que,en su caso,hubie-
sen establecido y la denominación de ésta.
Los Estatutos aprobados que regirán el funcionamien-
to de la asociación.
Lugar y fecha de otorgamiento del acta Fundacional.

Firma de todos los promotores y promotoras.
Identificación de las personas que ostentan la repre-
sentación de la entidad y sus cargos en los órganos de
gobierno creados.
El órgano más habitual es la Junta Directiva aunque no es
necesaria su existencia pues la asamblea de la asociación
puede asumir estas funciones.
Siempre es obligatoria la elección de los cargos de Presiden-
te o Presidenta,Secretario o Secretaria y Tesorero o Tesorera.
Para el caso de personas jurídicas, deberá acompañar un
certificado del acuerdo adoptado por su órgano competen-
te, en el que figure la voluntad de constituir la asociación y
de formar parte de ella, así como la designación de la per-
sona física que la representará. En este caso, el represen-
tante de la persona jurídica deberá acreditar su identidad,
y firmar el Acta. Lo mismo ocurrirá en el caso de que el pro-
motor persona física actúe a través de representante.

Elaboración de estatutos
Los Estatutos son las normas que rigen el funcio-
namiento de la entidad, delimitan sus objetivos y fines así
como el funcionamiento o modelo organizativo.
Su realización no es un acto sólo jurídico rellenando de
modo mecánico los diversos modelos existentes, es impor-
tante aprovechar este momento para reflexionar sobre el
proyecto asociativo que ofrecemos a la ciudadanía y sobre
nuestro funcionamiento o tipo de organización.
Además de los contenidos que los socios y socias establez-
can, deberán contener obligatoriamente los siguientes
elementos:
Nombre: Nos servirá para distinguirla del resto de aso-
ciaciones. Debe hacer referencia a sus fines estatua-
rios o al principal de ellos.
Domicilio social: En caso de ser un lugar público,se de-
berá adjuntar un certificado de autorización de cesión
de ese espacio. Si es un domicilio particular, se hará
constar expresamente.
Ámbito territorial.

Duración: En caso de que no se constituya por tiem-
po indefinido.
Fines y actividades.
Los requisitos y modalidades de admisión, baja,
sanción y separación de los asociados y, en su caso,
las clases de éstos.
Los derechos y obligaciones de las personas aso-
ciadas y, en su caso, de cada una de sus distintas
modalidades.
Requisitos para la constitución de la Asamblea Ge-
neral, integrada por todos los socios y socias que
adoptará sus acuerdos por mayoría y que deberá
reunirse al menos, una vez al año.
Requisitos y procedimientos para la elección y sustitu-
ción de los cargos de los órganos de gobierno: Atribu-
ciones, duración, causas de cese, forma de deliberar o
adoptar acuerdos, las personas o cargos con facultad
para certificarlos, requisitos para su válida constitu-
ción y el número o porcentaje de sus miembros con
capacidad para convocar sesiones o proponer asuntos
en el orden del día. Cargos obligatorios son la Presi-
dencia, Secretaría y Tesorería. Otros cargos como vice-
presidencia, vocal... son opcionales.

Régimen de administración contabilidad y documen-
tación, así como la fecha de cierre del ejercicio.
Patrimonio inicial y recursos económicos de los que
podrá hacer uso.
Las causas de disolución y el destino del patrimonio
en tal supuesto, el cual no podrá, en ningún caso, des-
virtuar el carácter no lucrativo de la entidad.
Procedimientos para la modificación de estatutos.

El Registro: Registros
Existentes
La Ley de Asociaciones regula la inscripción en el Registro
no como un deber sino como un derecho de carácter vo-
luntario que confiere a la propia entidad mayores garantías
para su funcionamiento.
Los registros varían según el ámbito territorial de actuación
de la asociación y según el tipo de asociación.
Registro Nacional
En el Registro Nacional de Asociaciones se inscribirán las
asociaciones que no desarrollen principalmente sus activi-
dades en el ámbito territorial de una Comunidad autóno-
ma, y asociaciones extranjeras que desarrollen actividades
en España de forma estable disponiendo de delegación en
el territorio español siempre que sean asociaciones y enti-
dades dentro del ámbito de aplicación de la Ley Orgánica
1 / 2002 . Se excluyen por tanto las asociaciones políticas,
religiosas, profesionales y políticas.
La Solicitud cuyo modelo está disponible en la página web
del Ministerio del Interior en www.mir.es se presentará
junto con el Acta Fundacional por duplicado y Estatutos.

Es para las asociaciones de ámbito provincial y regional re-
guladas por la Ley Orgánica 1/2002.
El representante o la representante de la asociación pre-
sentará la Solicitud de inscripción. El modelo de solicitud
se encuentra disponible en la página web de la Junta de
Castilla y León www.jcyl.es.
Se presentará también:
Acta fundacional por duplicado y firmada por todos
los promotores y promotoras acompañada de DNI
para las personas físicas promotoras. En el caso de no
tener la nacionalidad española, hay que aportar la co-
pia auténtica del permiso de residencia. Si es de la C.E.,
el documento acreditativo de que cuenta con la auto-
rización de estancia o residencia en España.

Estatutos por duplicado y con firmas originales en to-
das las páginas por los socios y socias fundadoras. En
la última hoja, al lado de cada firma se hará constar
a máquina el nombre y dos apellidos de la persona a
que corresponde.
Documento acreditativo de que se cuenta con la con-
formidad del propietario o de quien ostenta la repre-
sentación titularidad del Centro o establecimiento de-
signado como domicilio social de la entidad, para su
utilización a tal fin.
Certificación de la composición de los integrantes de
los Órganos provisionales de Gobierno:Nombre y ape-
llidos, DNI, domicilio y cargo que ocupa.
En el caso de las asociaciones juveniles el procedi-
miento sería idéntico si bien es necesario además su
inscripción en el Registro de asociaciones juveniles.
En el caso de las entidades de voluntariado el proce-
dimiento sería idéntico, existiendo además el Regis-
tro específico de entidades de voluntariado.
En el caso de asociaciones deportivas, profesionales, re-
ligiosas o políticas existen otros registros específicos.

Registro municipal de entidades
ciudadanas
Pueden inscribirse todas aquellas asociaciones o entida-
des cuyo ámbito de actuación sea la ciudad de Burgos o
que tengan sede en ella. Es un instrumento para conocer
el número de entidades existentes en el municipio, sus fi-
nes o representatividad y poder desarrollar una adecuada
política municipal de fomento, impulso y desarrollo del
asociacionismo.
La inscripción es voluntaria y deberán entregar los siguien-
tes documentos:
Solicitud de inscripción disponible en la página web
del Ayuntamiento de Burgos.
Acta Fundacional firmada por todos los socios y socias.
Estatutos originales y copia.
Certificación del número de socios por el presidente o
presidenta y secretario o secretaria de la entidad.
Presupuesto y programa de actividades del año en

Las asociaciones inscritas están obligadas a notificar cual-
quier información facilitada: cambio de sede, disolución,
cambio en la junta directiva... y entregar todos los años el
programa de actuaciones y presupuesto.
Las asociaciones inscritas podrán verse beneficiadas de las
ayudas, subvenciones que a nivel municipal existan.

El funcionamiento
interno de la asociación
Tras registrarnos, hemos de sellar en el mismo registro los
tres Libros que ha de llevar la asociación si queremos que
tengan validez:
Libro de socias y socios.
Libro de actas.
Libro de cuentas.
Para mejorar nuestro funcionamiento podemos realizar
un Reglamento. Un Reglamento de funcionamiento inter-
no que nos servirá para concretar las normas de funciona-
miento, recoger la filosofía, valores, principios y objetivos
estratégicos que conforman la ideología de la asociación.
Otros elementos que puede contener: emblema o anagra-
ma, funciones y responsabilidades de cada cargo de la Jun-
ta Directiva, organigrama de funcionamiento, comisiones
de trabajo, voto de los socios, formas de contratación de
personal, creación de comisión de cuentas...
Tiene que ser aprobado y modificado en Asamblea General.

Solicitud del Código de
Identificación Fiscal (CIF)
El CIF es para cualquier asociación como el DNI para una
persona. Es una tarjeta que identifica fiscalmente a la aso-
ciación y necesaria para funcionar legalmente.
SesolicitaenlaAgenciaTributariamáspróximadeldomicilio
fiscal de la asociación según el modelo existente disponible
en la página web de la Agencia Tributaria www.aeat.es. La
solicitud se acompañará de los documentos siguientes:
Acta Fundacional y Estatutos (original y copia) .
Certificado de Registro de la asociación.
Fotocopia DNI del representante.
Documento que acredite quien es el representante.
Además es conveniente abrir una cuenta corriente propia
de la asociación, para que los movimientos económicos fi-
guren a su nombre y no de particulares.Para ello es necesa-
rio presentar en el Banco o Caja de Ahorros:
Copia de los estatutos registrados (o en trámite) con
sello de entrada en el registro.
Copia del CIF.
Acta de la asociación indicando dos personas titules de
la cuenta (preferiblemente presidencia y secretaría).

La declaración de
Utilidad Pública
Para que una asociación sea declarada de Utilidad Pública
es necesario tener una antigüedad mínima de dos años y
perseguir los fines de interés general citados en el art. 42
de la Ley 7/2007.
Debe ser acordado en asamblea o Junta directiva u órgano
que proceda según los estatutos y solicitarse a la Secre-
taría General Técnica del Ministerio del Interior si la aso-
ciación es de ámbito nacional o al Registro autonómico o
Registro de asociaciones específicas.
La Solicitud y documentación a presentar está disponible
en la página web del Ministerio del interior www.mir.es .
La Declaración de Utilidad Pública viene a suponer un re-
conocimiento de la labor social de la entidad y la posibili-
dad de acogerse a una serie de beneficios fiscales.

De la declaración de Utilidad Pública se derivan las siguien-
tes obligaciones:
Rendición de cuentas: memoria de actividades y me-
moria de cuentas de cada ejercicio.
Facilitar a las Administraciones Públicas los informes
que le sean requeridos en relación con las actividades
realizadas para el cumplimiento de fines.
Aplicar las Normas de Adaptación del Plan General
de Contabilidad y Normas de Información Presu-
puestarias de Entidades Sin Fines Lucrativos en el
control económico.

Normativa y
obligaciones básicas
de las asociaciones
Constituirse en asociación conlleva conocer y cumplir la
legislación existente en esta materia. Las asociaciones se
comprometen a:
Tener actualizados los libros de actas, socios y socias y
cuentas de la asociación.
Acatar lo establecido en los estatutos.
Cumplir con las obligaciones fiscales o del tipo que
proceda en caso de desarrollar acciones de las que se
deriven consecuencias legales como, por ejemplo, de-
clarar IVA en caso de realizar actividades económicas.
Convocar la Asamblea General de todos los socios al
menos una vez al año con carácter ordinario aproban-
do cuentas y presupuestos.
Tener algún órgano de representación que gestione y
represente los intereses de la asociación con los cargos
que son obligatorios de cubrir.
Cumplir con la legislación existente en materia de pro-
tección de datos.

Presentation
Association Law is regulated by the Organic Law 1/2002,
of the 22nd of March commonly known as “Association
Law”. In detailing its motives it states that “associa-
tions allow individuals recognise their convictions, ac-
tively pursue their ideas, perform useful tasks, find
their place in society, make themselves heard, exercise
influence or provoke change”.
Many citizens opt for the association model to carry
out projects, defend their rights or to promote certain
changes and values. Associations play a fundamental
and essential role nowadays in all areas, contributing to
active civil participation.
It is advisable to set up an association based on its
proximity and access to other associations: integrating
ourselves and promoting federations, platforms and
networks between similar associations.

It may occur that our project or initiative exceeds the
capabilities of existing associations.
Doubts may arise at this point as to how to start the
process, what institutions to visit, what laws regulate
these associations... a difficulty which is even greater in
immigrant associations where in addition to lack of fa-
miliarity with regard to the processes, lack of language
skills is also a problem.
The current guide aims to respond to these needs and
act as a practical tool to any person or entity which
wishes to form an association and particularly people
from other countries for whom lack of knowledge as to

What Is An Association
And Who Can Form One?
They are stable collectives of at least three people, or
groups with a shared, non-profit based interest, formally
independent of the State, political parties or businesses
and democratic in nature.
Natural persons and legal entities can incorporate
associations and form part of them assuming:
The members are of legal age,emancipated minors (of
more than 16 years of age and who live independently)
or unemancipated minors with the consent of their
legal guardians.
They have the right to work and are not subject to any
legal condition precluding their capacity to exercise
this right.

Formal Incorporation
Of The Association: The
Articles Of Association
Those wishing to form the association are the associates
or founding associates, also known as members, who must
hold an official meeting (founding meeting), during which
the association’s incorporation will be agreed and an offi-
cial document will be issued.
This document is known as the MEMORANDUM OF ASSO-
CIATION and is the official incorporation document for the
association.
The items to be included are:
Names and surname(s) of the members of the associa-
tion if they are natural persons, or the company name
if it is a legal entity. In both cases, the nationalities,
registered addresses and fiscal identification numbers
must be included.
A document stating the members’ express intention
to incorporate an association, details of the agree-
ments which have been put in place and the associa-
tion’s name.
The approved articles of association which will govern
the association’s operations.

Location and Date on which the Articles of Association
were signed.
Signature of all members.
Identification of all persons who will represent the enti-
ty and their positions on the governing bodies created.
The most common body is the Board of Directors although
it is not obligatory as the association’s management meet-
ings can take on these functions.
The positions of President,Secretary and Treasurer must be
assigned.
In the case of a legal entity, there should be a certificate of
the agreement taken by the relevant body, which details
the intention to form an association and be a member of
it, in addition to the nomination of the natural person who
will represent it. In this case the representative of the legal
entity must provide proof of identity and sign the Memo-
randum. The same will apply where a natural person acts
by way of a representative.

Preparing Articles Of
Association
The Articles of the Association govern the entity’s opera-
tion, set its objectives and aims, in addition to defining its
organisational model.
Its completion is not just a legal act which must be com-
plied with by filling out various existing forms, it is impor-
tant that members take the time to reflect on the project
the association aims to offer citizens, in addition to how it
will operate and the type of association in question.
In addition to the contents included by the members, the
following items must be included:
Name: This will distinguish it from all other associa-
tions. It should make reference to the statutory aims
or the main aim of the association.
Registered Company Address: Where this is a public
place, you should include the assignment authorisa-
tion certificate for the area. If it is a private residence,
this should be expressly stated.
Territory.

Registers
Association Law regulates registration not as a duty but as
a voluntary right which confers on the entity greater guar-
antees in carrying out its operations.
The registers differ based on the territory the association
operates in and the type of association.
National Register
The National Register of Associations is used by associa-
tions that do not carry out their activities primarily within
the scope of an autonomous region, and foreign associa-
tions which have stable operations within the Spanish na-
tional territory, assuming these are associations within the
scope of Organic Law 1/ 2002. As a result political, religious
and professional associations are excluded.

submitted with duplicate copies of the Memorandum and

Municipal Register Of Civil Associations
Any association or entity that operates within the city of
Burgos or has their headquarters there can register. It is
an instrument used to monitor how many entities exist in
the municipality, their aims and representation, such that
adequate policies for their development and promotion
can be implemented.
Registration is voluntary and should include the following

To improve operations we can implement operating regula-
tions. These are internal regulations which act to establish
the operating norms, summarise the association’s philoso-
phy, values, principles and strategic objectives in line with
the association’s ideology.
Other items which may be included are: emblem or logo,
functions and responsibilities relating to each position on
the Board of Directors, organisational chart, working par-
ties, member voting process, methods for hiring personnel,
details regarding creation of finance committee,….
It must be approved and modified by the General Meeting.

Request For Fiscal
Identification Code (CIF)
The Fiscal Identification Number is for any association
what National Identity Documents are for people. It is a
card which identifies the association on a fiscal basis and is
necessary for legal operations.
It should be requested at the Tax Office nearest the associa-
tion’s headquarters as per the most up to date example which
is available on the Tax Office’s webpage www.aeat.es. The re-
quest should be accompanied by the following documents:
MemorandumandArticlesofAssociation(originalandcopy).
Association’s Certificate of Registration.
The representative’s national identity document.
Document supporting the representative’s appointment.
Furthermore it is advisable to open a specific current ac-
count, such that the financial movements appear in the as-
sociation’s name and not in that of individuals. To do this
you must present the following in a Bank:
Copy of the registered articles of association (or draft)
with the register stamp.
Copy of the Fiscal Identification Number
Association’s records indicating two account holders
(preferably president and secretary).

Declaration Of Public
Benefit
For an association to be declared of Public Benefit it must
be at least two years old and must pursue general inter-
est goals as stipulated under article 41 of Law 7/2007.
It should be agreed in the General Meeting or manage-
ment or board meeting,who in line with the articles of as-
sociation will request the declaration from the Technical
General Secretary of the Ministry of Interior if the associa-
tion operates on a national basis, or the regional register
or specific association register where applicable.

The Declaration of Public Benefit is recognition of the en-
tity’s social work and the potential to qualify for a series
of fiscal benefits.

Founding an association requires knowledge of and com-
pliance with all existing relevant legislation. The associa-
tions commit to:
Have minutes, membership books and accounting
records up to date.
Comply with articles of association.
Comply with fiscal or any other regulations which may
apply as a result of operations which have legal conse-
quences, such as declaring VAT where economic activi-
ties are carried out.

Présentation
Le droit d’association est régi par la loi organique espa-
gnole 1/2002 du 22 mars, plus communément appelée
« Loi d’association ». Dans l’exposition des motifs, il est
indiqué que « les associations permettent aux individus
d’exprimer leurs convictions, de poursuivre activement
leurs idéaux, de remplir des tâches utiles, de trouver leur
place dans la société, de se faire entendre, d’exercer une
influence quelconque et d’entraîner des changements. »
De nombreux citoyens optent pour la formule asso-
ciative pour mener à bien leurs projets, défendre leurs
droits ou favoriser des changements et valeurs précis.
Les associations jouent de nos jours un rôle essentiel et
indispensable dans tous les domaines en contribuant à
un exercice actif de la citoyenneté.
Il est conseillé de mettre en route une association de-

recourir ? La difficulté est encore plus grande pour les
associations d’immigrés car, outre la méconnaissance
des démarches administratives, se pose le problème de
la langue.

Qu’est-ce qu’une
association et qui peut la

Il s’agit de regroupements stables d’au moins trois person-
nes ou collectifs partageant des intérêts, à but non lucratif,
formellement indépendants de l’Etat, des partis politiques
ou des entreprises et fonctionnant démocratiquement.
Peuvent constituer des associations et en former partie les
personnes physiques et les personnes morales suivantes :
Promoteurs majeurs, mineurs émancipés (de plus de
16 ans et vivant de leurs propres moyens) ou mineurs
non émancipés avec le consentement de leurs parents
ou tuteurs légaux.
Personnes ayant la capacité d’agir et non soumises
à une quelconque condition légale pour l’exercice du
droit.

Constitution formelle
de l’association : l’acte
de fondation
Les personnes qui souhaitent former l’association sont les
partenaires fondateurs, également appelés promoteurs,
qui se réuniront officiellement (assemblée constituante)
pour créer cette association via acte.
Cet acte s’appelle l’ACTE DE FONDATION et il s’agit du
document officiel de constitution de l’association.
Les éléments qu’il doit contenir sont les suivants :
Nom et prénom des promoteurs de l’association si ce
sont des personnes physiques et dénomination ou rai-
son sociale s’il s’agit de personnes morales et, dans les
deux cas :nationalité,domicile et numéro d’identifica-
tion fiscale.
La volonté des promoteurs de constituer une associa-
tion,les accords qui,le cas échéant,ont été établis et la
dénomination de cette dernière.
Les statuts approuvés qui régiront le fonctionnement
de l’association.
Date et lieu de la concession de l’acte de fondation.
Signature de tous les promoteurs.

Identification des personnes qui représentent l’enti-
té et leur poste au sein des organes d’administration
créés.
L’organe le plus courant est le conseil d’administration,
bien que son existence ne soit pas strictement nécessaire
puisque l’assemblée de l’association peut assumer ces
fonctions.
L’élection des postes du président,secrétaire et trésorier est
toujours obligatoire.
En ce qui concerne les personnes morales, un certificat de
l’accord adopté par son organe compétent où figurent la
volonté de constituer l’association et d’en faire partie ainsi
que la personne physique qui la représente est requis.
Dans ce cas,le représentant de la personne morale doit jus-
tifier son identité et signer l’acte. Il en est de même dans
le cas d’une personne physique agissant par le biais d’un
représentant.

Elaboration des statuts
Les statuts sont les normes qui régissent le fonctionnement
de l’entité, délimitent ses objectifs ainsi que le fonctionne-
ment ou modèle d’organisation.
Leur réalisation n’est pas seulement un acte juridique
consistant à remplir mécaniquement les divers modèles
existants. C’est un moment important pour réfléchir sur le
projet associatif que nous offrons à la citoyenneté et sur
notre fonctionnement ou type d’organisation.
Outre les contenus que les partenaires établissent, ils de-
vront obligatoirement comporter les éléments suivants :
Nom : il nous servira à la distinguer des autres associa-
tions. Il doit faire référence aux finalités des statuts ou
à la plus importante.
Siège social :s’il s’agit d’un lieu public,il faudra joindre
un certificat d’autorisation de cession de cet espace.
S’il s’agit d’un domicile particulier, ceci devra être ex-
pressément mentionné.

Le registre : registres
existants
La loi d’association régule l’immatriculation au registre
non comme un devoir mais comme un droit de caractère
volontaire qui confère à l’entité de plus grandes garanties
pour son fonctionnement.
Les registres varient en fonction du champ d’application
territorial concerné de l’association et en fonction du type
d’association.
Registre national
Dans le registre national espagnol des associations sont
inscrites les associations qui ne développent pas principale-
ment leurs activités dans le champ d’application territorial
d’une communauté autonome et les associations étrangè-
res qui développent des activités en Espagne de manière
stable en disposant d’une délégation sur le territoire espa-
gnol dans la mesure où il s’agit d’associations et d’entités
se plaçant dans le cadre de l’application de la loi organique
1/2002. Les associations politiques, religieuses, profession-
nelles et politiques sont par conséquent exclues.

siège social de l’entité pour son utilisation à de telles
fins.
Certification de la composition des membres des or-
ganes provisoires d’administration : nom et prénoms,
carte d’identité, domicile et fonction occupée.
Pour ce qui est des associations de jeunesse, la procé-
dure est identique,bien qu’il faille en outre les imma-

Registre municipal des entités citoyennes
Toutes les associations ou entités, dont le domaine d’acti-
vité est la ville de Burgos ou dont le siège social s’y trouve,
peuvent s’inscrire. Il s’agit d’un instrument pour connaître
le nombre d’entités existantes dans la ville, leurs fins ou
leur représentation et pour pouvoir développer une poli-
tique municipale de développement et de promotion de
l’associationnisme.
L’inscription est volontaire et les documents suivants de-

même registre, sur les trois livres que doit avoir l’association

Pour améliorer le fonctionnement de l’association, il est pos-
sible de créer un règlement. Il s’agit d’un règlement intérieur
qui servira à concrétiser les normes de fonctionnement,y pré-
senter la philosophie, les valeurs, principes et objectifs straté-
giques qui constituent l’idéologie de l’association.

Demande du code
d’identification fiscale
(CIF)
Le CIF est, pour toute association, comme la carte d’identité
d’une personne. Il s’agit d’une carte qui identifie fiscalement
l’association et est nécessaire pour fonctionner légalement.
Il est demandé auprès du service des impôts le plus proche du
siège fiscal de l’association selon le modèle existant disponible
sur la page web www.aeat.es. La demande sera accompagnée
des documents suivants :

Photocopiedelacarted’identitédureprésentant.

Il serait, de plus, judicieux d’ouvrir un compte courant spé-
cifique à l’association pour que les mouvements bancaires

Déclaration d’utilité
publique
Pour qu’une association soit déclarée d’utilité publique, il
faut avoir une ancienneté d’au moins deux ans et pour-
suivre les objectifs d’intérêt général cités dans l’art. 42 de
la loi espagnole 7/2007.
Ceci doit être accordé au cours de l’assemblée générale,
du conseil d’administration ou de l’organe approprié se-
lon les statuts. Il faut également demander au secrétariat
général technique du ministère de l’intérieur espagnol si
l’association appartient au domaine national, au registre
autonomique ou au registre des associations spécifiques.
La demande et la liste des documents à présenter sont
disponibles sur la page web du ministère de l’intérieur es-
pagnol www.mir.es.
La déclaration d’utilité publique implique une recon-
naissance du travail social de l’entité et la possibilité de
bénéficier de plusieurs avantages fiscaux.

de base des associations
Se constituer en association implique de connaî-
tre et de respecter la législation en vigueur en la matière.
Les associations s’engagent à :
Mettre à jour les livres des actes, partenaires et comp-
tes de l’association.
Suivre ce qui est établi dans les statuts.
Remplir les obligations fiscales ou du type approprié si
y sont développées des actions dont dérivent les effets
légaux comme, par exemple, la TVA en cas de réalisa-
tion d’activités économiques.
Convoquer l’assemblée générale de tous les partenaires
(caractère ordinaire) au moins une fois l’an en approu-
vant les comptes et budgets.
Avoir un organe de représentation qui gère et repré-
sente les intérêts de l’association avec les postes devant
être obligatoirement couverts.
Respecter la législation en vigueur en matière de pro-
tection des données.
Respecter la législation en vigueur pour la prévention
des risques et les assurances.

unei Asociaţii, fructul muncii unor profesionişti din cadrul Secţiei de
Participare Cetăţenească din cadrul Primăriei Oraşului Burgos.
Proiectele care se pot realiza prin intermediul unei Asociaţii sunt ne-
numărate, fiind de asemenea nenumărate drepturile care trebuie
apărate şi considerabil efortul care trebuie depus pentru a obţine un
proiect asociativ solid.
Primul pas care trebuie făcut pentru a construi o entitate îl reprezintă
angajarea personală de a acţiona în virtutea binelui comun, străduin-
du-se şi alăturându-se altor persoane cu aceleaşi obiective şi preo-
cupări. După toate acestea, va veni ora formalităţilor, gestiunilor şi în
definitiv, ora hârţoagelor. De-abia de acum încep de obicei adevărate-
le îndoieli pentru multe persoane şi colective, fiind legate acestea de
legislaţia în vigoare sau de cum s-ar putea începe un proces.
Sunt sigur că acest Ghid va oferi informaţii şi un răspuns precis în le-
gătură cu toate acele aspecte pentru toate acele persoane sau entităţi
care sunt dispuse şi hotărâte să formeze o grupare de asociaţii sau
o asociaţie concretă. Fără îndoială, va fi rezultatul final al unei lucrări

Prezentare
Dreptul de a constitui o Asociaţie este regulat de către
Legea Organică 1/2002, din 22 Martie, denumită “Le-
gea Asociaţiilor“. Din respectiva lege reiese că “aso-
ciaţiile permit indivizilor să se recunoască în convin-
gerile lor, să-şi continue în mod activ idealurile, să-şi
îndeplinească activităţile utile, să-şi găsească un loc
în societate, să se facă auziţi, să-şi exercite o oareca-
re influenţă şi să provoace schimbări“.
Mulţi cetăţeni şi cetăţene optează pentru o formulă aso-
ciativă pentru a-şi duce la îndeplinire proiectele, pentru
a-şi apăra drepturile sau pentru a prilejui determinate
schimbări şi valori. Asociaţiile au un rol fundamental şi
indispensabil în ziua de azi, în toate sferele, contribu-
ind la exercitarea activă din partea cetăţenilor.
Este de preferat punerea în funcţiune a unei asociaţii în
perspectiva unei deschideri sau a unei apropieri de asoci-
aţii deja existente: integrându-ne sau dând un impuls între

Se poate întâmpla ca proiectul şi iniţiativa noastră să
depăşească pe cele ale actualelor asociaţii, propu-
nându-ne crearea unei noi asociaţii.
În acest caz se vor ivi îndoieli în legătură cu modul
de iniţiere a acestui proces, cu ce fel de instituţii ne
prezentăm, ce fel de legi intervin..., dificultăţi care s-ar
putea accentua atunci când este vorba de asociaţii de
imigranţi, în cadrul cărora pe lângă necunoaşterea
formalităţilor, intervin şi greutăţile legate de necunoaş-
terea limbii.
Ghidul de faţă încearcă să dea un răspuns şi să de-
vină un instrument practic pentru orice persoană sau
entitate care doreşte să formeze o asociaţie şi în spe-
cial, pentru persoane din alte ţări care întâmpină atât
greutăţi administrative, cât şi lingvistice.

Ce este o asociaţie şi
cine o poate constitui
Sunt grupări stabile compuse din cel puţin trei persoane
sau colective cu obiective comune, fără scopuri lucrative,
independente faţă de stat din punct de vederea formal,
faţă de partide politice sau întreprinderi şi cu o funcţionare
democratică.
Pot alcătui asociaţii şi pot face parte din acestea, persoa-
nele fizice şi persoanele juridice, având:
Persoanele promotoare peste optsprezece ani, fiind
minori emancipaţi (peste şaisprezece ani şi indepen-
denţi) sau minori ne emancipaţi, însă cu consimţă-
mântul tutorului sau tutorilor legali.
Capacitate de a acţiona şi de a nu fi condiţionate de
nici o formalitate legală pentru a-şi exercita dreptul.

Constituirea formală a
asociaţiei: Documentul
Fundaţional
Persoanele care doresc să alcătuiască o asociaţie, sunt
însuşi asociaţii sau asociatele fundatoare, numite de
asemenea promotori sau promotoare şi care vor convo-
ca o reuniune oficială (adunare constitutivă), în cadrul
căreia vor acorda crearea respectivei asociaţii, elabo-
rând un document.
Acest document se numeşte DOCUMENT FUNDAŢIO-
NAL, fiind documentul oficial de constituire a asociaţiei.
Respectivul document va trebui să conţină următoarele:
Numele şi prenumele promotorilor şi promotoarelor
asociaţiei, în cazul persoanelor fizice şi denumirea
sau numele companiei în cazul persoanelor juridice,
specificându-se în ambele cazuri: naţionalitatea, do-
miciliul şi numărul de identificare fiscală.
Voinţa promotorilor sau promotoarelor de a constitui
o asociaţie, pactele care, după caz, au fost stabilite,
precum şi denumirea acesteia.
Statutele aprobate care vor dirija funcţionarea
asociaţiei.

Locul şi data aprobării Documentului Fundaţional.
Semnătura tuturor promotoarelor şi promotorilor.
Identificarea persoanelor care reprezintă entitatea şi
funcţiile acestora în cadrul organelor de guvern create.
Organul cel mai frecvent este Consiliul de Conducere,
deşi nu este necesară existenţa acestuia, deoarece în-
săşi adunarea asociaţiei poate asuma aceste funcţii.
Va fi întotdeauna obligatorie desemnarea funcţiilor de
Preşedinte sau Preşedintă, Secretar sau Secretară şi
Trezorier.
În cazul persoanelor juridice, se va aporta un certificat
după acordul adoptat de către organul competent, în care
să figureze voinţa de a constitui asociaţia şi de a face
parte din aceasta, aşa precum desemnarea persoanei fi-
zice care o va reprezenta. În acest caz, reprezentantul
persoanei juridice va trebui să-şi acrediteze identitatea şi
să semneze Documentul. Acelaşi lucru se va întâmpla în
cazul în care promotorul ca şi persoană fizică, acţionează
printr-un reprezentant.

Elaborarea statutelor
Statutele reprezintă normele care dirijează funcţionarea
entităţii, delimitează atât obiectivele şi scopurile acesteia,
cât şi funcţionarea sau modelul organizaţional.
Realizarea sa nu se limitează doar la completarea mecani-
că a unor formulare deja existente, constituind doar un act
juridic; de asemenea este important un timp de gândire,
atât în ceea ce priveşte proiectul asociativ, proiect pe care
îl oferim cetăţenilor, cât şi în ce priveşte funcţionarea sau
tipul de organizare.
Pe lângă conţinuturile pe care asociaţii şi asociatele le sta-
bilesc, acestea vor trebui să conţină în mod obligatoriu ur-
mătoarele elemente:
Numele: Va fi necesar pentru a o distinge de celelalte
asociaţii. Trebuie să facă referinţă la obiectivele sta-
tutare sau principalul obiectiv al acestora.
Domiciliul social: În cazul în care este un spaţiu pu-
blic, va trebui aportat un certificat de autorizare de
cesiune a respectivului spaţiu. Dacă este un domici-
liu particular, aceasta va consta în mod necesar.

Cadrul teritorial.
Durata: În cazul în care nu se constituie pe timp ne-
limitat.
Scopuri şi activităţi.
Condiţiile şi modalităţile de admisie, încetare, sancţi-
une şi separaţie a asociaţilor şi după caz, a claselor
acestora.
Drepturile şi obligaţiile persoanelor asociate şi după
caz, a fiecăreia din diferitele sale modalităţi.
Condiţiile pentru constituirea Adunării Generale,
compuse din toţi asociaţii care vor adopta acordurile
prin majoritate de voturi şi care vor trebui să se adu-
ne cel puţin odată pe an.
Condiţii şi proceduri în vederea alegerii şi înlocuirii
funcţiilor organelor de guvern: Atribuţiile, durata, ca-
uzele de încetare din funcţie, forma de deliberare sau
adoptarea a acordurilor, persoanele sau responsabilii
de certificările acestora, condiţiile pentru constituirea
sa valabilă şi numărul sau procentajul membrilor săi
cu capacitate de a convoca sesiuni sau de a propu-

te funcţii cum ar fi vicepreşedinţia, purtătorul de cu-
vânt,… sunt opţionale.
Regimul de administraţie, contabilitate şi documen-
taţie, aşa precum data de închidere a exerciţiului.
Patrimoniul şi resursele economice de care ar putea
face uz.
Cauzele de dizolvare şi destinaţia patrimoniului în
acest caz, în care nu se va putea în nici un fel neu-
traliza caracterul nelucrativ al entităţii.

Registrul: registre
existente
Legea Asociaţiilor regulează înscrierea în Registru nu ca
fiind o datorie, ci ca un drept de caracter voluntar care
conferă propriei entităţi mai multe garanţii de funcţionare.
Registrele variază în funcţie de cadrul teritorial de acţiune
a asociaţiei şi în funcţie de tipul acesteia.
Registru Naţional
În Registrul Naţional de Asociaţii se vor înscrie asociaţiile
care nu-şi desfăşoară în mod principal activităţile pe teri-
toriul unei Comunităţi Autonome, asociaţiile străine care
îşi desfăşoară activitatea pe teritoriul Spaniol în mod sta-
bil, dispunând de delegaţii în Spania şi atâta timp cât sunt
asociaţii şi entităţi încadrate în sfera de aplicare a Legii
Organice 1/2002. Se exclud deci asociaţiile politice, religi-
oase, profesionale şi politice.
Cererea a cărei model este disponibil pe Site-ul Ministeru-
lui de Interne – www.mir.es – se va prezenta împreună cu
Documentul Fundaţional în duplicat şi cu Statutele.

Site-ul Comunităţii Castilla y León: www.jcyl.es.
Se va prezenta de asemenea:
Documentul fundaţional în duplicat şi semnat de că-
tre toţi/toate promotorii/promotoarele, fiecare dintre
aceştia/ea prezentând DNI-ul corespunzător. Dacă
nu se deţine naţionalitatea spaniolă, trebuie aporta-
tă copia autentică după permisul de rezidenţă. Dacă
interesaţii aparţin CE, va trebui aportat documentul
doveditor care autorizează şederea sau rezidenţa
în Spania.

Documentul doveditor al condiţiei de proprietar a
celui care deţine calitatea de titular al Centrului sau
localului desemnat ca fiind domiciliul social al enti-
tăţii, în vederea utilizării sale pentru acest scop.
Certificarea alcătuirii persoanelor integrante ale Or-
ganelor provizorii de Guvern: Numele şi prenumele,
DNI-ul, domiciliul şi funcţia pe care o deţine.
În cazul asociaţiilor juvenile, procedura va fi identi-
că, fiind necesară înscrierea acestora în registrul de
asociaţii juvenile.
În cazul entităţilor de voluntariat, procedura este
identică, existând pe lângă aceasta Registrul speci-
fic pentru entităţile de voluntariat.
În cazul asociaţiilor sportive, profesionale, religioa-
se sau politice, există alte registre specifice.

Registrul municipal al entităţilor
cetăţeneşti
Se pot înscrie toate acele asociaţii sau entităţi ale căror
cadru de acţiune este oraşul Burgos sau care-şi are sediul
în acesta. Este un instrument pentru a cunoaşte numărul
entităţilor din municipiu, obiectivele acestora sau reprezentati-
vitatea şi pentru a putea organiza o adecvată politică munici-
pală de dezvoltare, impuls şi dezvoltare a asociaţionismului.
Înscrierea este voluntară şi vor trebui aportate următoa-
rele documente:
Cererea de înscriere disponibilă pe Site-ul Primăriei
oraşului Burgos.
Documentul Fundaţional semnat de către toţi asociaţii
şi asociatele.
Statutele originale şi copia după acestea.
Certificarea numărului de asociaţii de către preşedin-
tele sau preşedinta entităţii şi de către secretarul sau
secretara acesteia.
Bugetul şi programul activităţilor anului în curs.

Asociaţiile înscrise sunt obligate să notifice orice informa-
ţie furnizată: schimbarea sediului, dizolvarea, schimbarea
consiliului de conducere,... şi de a înmâna în fiecare an
programul de acţiuni şi de buget.
Asociaţiile înscrise se vor putea beneficia de ajutoarele şi
subvenţiile care pot exista la nivel municipal.

Funcţionarea internă
a asociaţiei
După înregistrare, trebuie ştampilate în acelaşi registru cele
trei Registre (de contabilitate) pe care trebuie să le gestio-
neze asociaţia pentru a se conferi acesteia validitatea ne-
cesară:
Registrul asociatelor şi asociaţilor;
Registrul de documente;
Registrul de conturi.
Pentru a îmbunătăţi gradul nostru de funcţionare, putem ela-
bora un Regulament. Este vorba de un Regulament de func-
ţionare internă care ne va folosi pentru a concreta normele
de funcţionare, pentru a oglindi filozofia, valorile, principiile şi
obiectivele strategice care confirmă ideologia asociaţiei.
Alte elemente pe care le-ar putea conţine: emblema sau
anagrama, funcţiile şi responsabilităţile fiecărei funcţii din ca-
drul Consiliului de Conducere, organigrama de funcţionare,
comisiile de lucru, votul asociaţilor, formele de contractare a
personalului, crearea de comisii de conturi,...
Respectivul regulament trebuie aprobat şi modificat în ca-
drul Adunării Generale.

Solicitarea Codului
de Identificare
Fiscală (CIF)
CIF-ul reprezintă pentru asociaţie ceea ce înseamnă pen-
tru fiecare persoană DNI-ul. Este un Card care identifică din
punct de vedere fiscal asociaţia, fiind necesar pentru a conferi
funcţionării acesteia legalitatea necesară.
Se solicită la Fisc-ul de pe lângă domiciliul asociaţiei, com-
pletând modelul existent disponibil pe Site-ul Agenţiei Tri-
butare: www.aeat.es. Cererea va fi însoţită de următoarele
documente:
Documentul Fundaţional şi Statutele (original şi fotocopie);
Certificatul de Registru al asociaţiei;
Fotocopia după D.N.I.-ul reprezentantului;
Documentul care identifică reprezentantul.
Pe lângă aceasta, este convenabilă deschiderea unui
cont curent propriu al asociaţiei, pentru ca rulajele econo-
mice să figureze pe numele acesteia şi nu a particularilor.
Pentru aceasta, este necesară prezentarea la Bancă sau
la Casa de Economii a următoarelor documente:
Copia statutelor înregistrate (sau în proces de forma-
lizare), cu ştampilă de intrare în registru;
Copia CIF-ului;
Actul asociaţiei, indicând două persoane titulare ale
contului (de preferat preşedintele şi secretarul).

Declaraţia de Utilitate
Publică
Pentru ca asociaţia să fie declarată de Utilitate Publică,
este necesară o vechime minimă de doi ani şi va trebui
să vizeze obiective de interes general citate în cadrul art.
42 din Legea 7/2007.
Trebuie aprobată în cadrul adunării sau a Consiliului
de Conducere sau organului corespunzător, după cum
se prevede în statute, trebuind solicitat la Secretariatul
General Tehnic din cadrul Ministerului de Interne dacă
asociaţia aparţine vreunui mediu naţional sau la Regis-
trul autonom sau la Registrul asociaţiilor specifice.
Cererea şi documentaţia care se va prezenta este dispo-
nibilă pe Site-ul Ministerului de Interne, www.mir.es.
Declaraţia de Utilitate Publică se traduce ca fiind o recu-

noaştere a activităţii sociale a entităţii şi presupune posi-
bilitatea de a se beneficia de anumite favoruri fiscale.
Din Declaraţia de Utilitate Publică se derivă următoarele
obligaţii.
Predarea conturilor: memoria activităţilor şi memoria
conturilor din fiecare exerciţiu.
Facilitarea Administraţiilor Publice a rapoartelor so-
licitate în legătură cu activităţile realizate în vederea
atingerii obiectivelor.
Aplicarea Normelor de Adaptare a Planului General
de Contabilitate şi a Normelor de Informare Bugetară
a Entităţilor fără Scopuri Lucrative în cadrul controlului
economic.

Normativa şi
obligaţiile bazice ale
asociaţiilor
Constituirea unei asociaţii implică cunoaşterea şi îndepli-
nirea legislaţiei existente în această materie. Asociaţiile
se angajează să :
Menţină actualizate registrele de documente, asociaţi
şi asociate şi conturile asociaţiei;
Respecte cele specificate în Statute;
Îndeplinească obligaţiile fiscale sau de orice alt tip în
cazul în care se înfiinţează asociaţii obligate să decla-
re TVA-ul, realizând deci activităţi economice;
Convoace Adunarea Generală a tuturor asociaţilor cel
puţin odată pe an, cu caracter ordinar, aprobând con-
turi şi bugete.
Dispună de vreun organ administrativ c are să gestio-
neze şi să reprezinte interesele asociaţiei cu funcţiile
care sunt obligatorii de acoperit.
Îndeplinească legile în vigoare în materie de protecţie
de date.
Îndeplinească legile în vigoare în materie de prevenire
de riscuri şi în materie de asigurări.

109. Ръководството, което държите в ръцете си, е полезен практичес-
ки инструмент за създаването на сдружение, плод на труда на спе-
циалисти в сферата на гражданското участие на Градския съвет
на Бургос.
Чрез едно сдружение могат да се реализират множество проекти
и да се защитават множество права, но за постигане на трайни
резултати в един такъв проект за сдружение трябва да се вложат
и много усилия.
Първата стъпка за създаване на една организация е личната анга-
жираност за съвместна работа в името на общото благо, съгла-
сувано с усилията на други хора със същите цели и интереси. След
всичко това идва времето на формалностите, на мероприятията и
в крайна сметка: на бумащината. Често това е моментът, в който
някои хора и колективи започват да изпитват сериозни съмнения,
много от които са свързани с действащото законодателство или с
това, как да стартират едно дело.
Убеден съм, че настоящото ръководство ще ви предложи информа-
ция и точни отговори по всички онези аспекти, във връзка с които
отделни лица или организации са готови и поемат задължението
да създадат обединение на сдружения или конкретно сдружение. Не-
съмнено, това е крайният резултат от добре свършена работа.
