The Ministry of Corporate Affairs issued a general circular extending deadlines for filing certain cost audit forms due to delays in the availability of revised forms on the MCA21 portal. The circular waives additional fees for late filing of Form CRA-2, the notice of appointment of a cost auditor, until June 30, 2015. It also waives fees for late filing of Form CRA-4, the cost audit report, until August 31, 2015. This provides relief to companies facing delays in filing due to the revised forms not being available on the portal within the original deadlines.

An assessee can file a service tax revised return within 90 days of submitting the original return to correct any errors, mistakes, or omissions. 1) The Ministry of Corporate Affairs received representations seeking clarification on processing complaints related to defaults made by companies in repaying deposits accepted before April 1, 2014, when the Companies Act 2013 came into effect.
2) It is clarified that the Company Law Board has been empowered to exercise the powers of the National Company Law Tribunal to hear applications from depositors if a company fails to repay deposits under section 73(4) of the Act. Companies can also apply to the CLB under section 74(2) seeking an extension for repayment.
3) Companies can repay deposits accepted before April 1, 2014 according to the terms under which they were accepted, as long as they comply with Rule 19 of the

Sir, The Ministry has received several representations about the non-availability of the revised form CRA-z on MCA-21 required for filing of notice ofappointment ofthe Cost Auditor for the F.Y. 2015-16, although the time Iimit for filing of the same has either lapsed or will be lapsing. The revised form CRA-2 has now been notified on 12th June, 2015 and is availablc on the MCAZ1 system for filing. 2. ln view ofthe delay in availability of revised Form CRA"2 on the MCAz1 portal, however, thc additional fee on account ofany delay beyond the prescribed period of 30 days from the date of lloard Meeting in which the appointment ofthe Auditor was made for filing of CRA-2 for the financial year starting on ol after 1" April, 2015 is waived for all such filings till 30th June, 2015, 3. The revised e-F'orm cM-4 has also been notified vide the above mentioned notification and will be made available on MCA-21 portal shortly. Therefore, on the similar lines mentioned in above paras, additional fees on delayed filing of form CRA- 4 bcyond the prescribed period of 30 days from the date of receipt of a copy of Cost Audit Rcport from the Cost Auditor for the Financial Year starting on or after 1"t n pril, 2014 is also waived for all such filings till 31$ August, 2015- 4.
