1. Schedule 1 of the Children Act 1989 allows an application to be made by a parent or step-parent
(and certain others in specific circumstances) against the other parent for financial provision for their
child. This can be particularly helpful when the parents are unmarried and living apart. This financial
provision is different to that which can be claimed by a married parent in the context of a divorce.
Schedule 1 permits the court to consider making one or more of the following financial orders:-
• Child maintenance (in addition to the maximum amount as assessed by the CSA/CMS), which
can include, amongst others, the cost of school fees and, in some cases, the costs of university
education;
• A capital lump sum for costs directly attributable to the child (for example, the purchase of a car
for use by the parent with whom the child lives);
• A transfer or settlement of a property for the purpose of providing a home for the child during
their minority (once the child completes their secondary or tertiary education, the property which
was transferred or settled will be returned to the parent who funded or provided it).
In making a decision as to the appropriate level of financial provision for the child, the court will
consider:-
• The parents’ respective financial resources;
• The parents’ needs and other responsibilities, including to any other children;
• The financial requirements of the child;
• Any disabilities of the child;
• The parents’ intentions as to the education of the child.
