This document is a notice of motion from Hon. Kiragu Karanja, MCA for Waithekawa Ward, to the Nairobi City County Assembly. The motion calls for the sanctioning and removal of Hon. AWARE,thatArticle73(2)(d)and(e)oftheConstitutionofKenyaprovidesfor
accountabilityofastateofficertothePublic,fordecisionsandactionsasakeyguiding
principleofleadershipandintegrity,NOTINGthattheLeadershipandIntegrityAct,2012
andtheRegulationsemanatingtherebyfurtherprovideextensivelyforthespecificsof
theconductofStateofficers,REGRETTINGthattheconductoftheHon.BeatriceK.
Elachithrough her actions and omissions has caused the Assembly great
embarrassmentandbroughttheOfficeoftheSpeakerintodisreputecontrarytothe
gamutoflawsonconductofStateofficersofhercaliber,thisAssemblyRESOLVESto
sanctionandremovetheHon.BeatriceElachiasholderoftheofficeoftheSpeakerof
theCountyAssemblyofNairobiCity,pursuanttoSection11oftheCountyGovernments
Act,2012,Section21(5(c)oftheElectionsAct,2011andStandingOrder65ofthe
NairobiCityCountyAssemblyStandingOrders,onthefollowinggrounds;
1.ConflictofInterest-GrossviolationoftheConstitutionofKenya,2010;The
CountyGovernmentAct,2012;ThePublicProcurementandDisposalAct,2015
andTheLeadershipandIntegrityAct,2012.
a)Violation ofChapterSix ofthe Constitution,specifically Article 73 on
Responsibilitiesofleadershipwhichrequiresobjectivityandimpartialityin
decision making,and in ensuring thatdecisions are notinfluenced by
nepotism,favoritism,otherimpropermotivesorcorruptpractices;violationof
Article75(1)(a),(b)and(c),violationofArticle201(a)oftheConstitutionon
PrinciplesofPublicFinance,violationofSection16and17oftheLeadership
and IntegrityAct,2012,violation ofSection 42 and 43 ofthe Public
ProcurementandDisposalAct,2005byaggressivelyandcontrarytothelaw

2. interferingwithprocurementprocesseswithaviewtohavetendersawarded
topartiesclosetoher,forinstanceinthepurchaseoftheresidenceofthe
holderoftheOfficeofSpeaker,wheresheactivelyinterfered,including
threatening,bullyingandintimidatingstafftohaveapartyclosetoherwinthe
awardforthepurchaseofthesaidresidencedespitethatpartyhavingclearly
failedthemandatorycriteriaforawardofthetender,havingmarkedupthe
price by overKshs 30 million above whatthe marketsurvey Report
recommended,evidenceofwhichisavailablefrom procurementrecords,
audiorecordingsandelectroniccorrespondenceswiththesaidpartyandher
proxies,whichtenderhassincebeenrefloatedandbidsreceived,anaction
which prompted herdeleterious unilateraldecisions lastweek to the
embarrassmentoftheCountyAssemblyServiceboardandtheAssembly;
2.UnderminingtheAuthorityoftheCountyAssemblyServiceBoard-Gross
ViolationoftheConstitutionofKenya,2010;CountyAssemblyServicesAct,
2017;ThePublicOfficerEthicsAct;TheLeadershipandIntegrityAct,2012.
a)ViolationofSection12oftheCountyGovernmentsAct,2012andSection12of
theCountyAssemblyServicesAct,2017onPowersoftheBoardasabody
corporatebyunderminingtheauthorityoftheCountyAssemblyServiceBoard
throughheractionsandomissionsbypurportingtounilaterallyundertakethe
functionsoftheBoardandinvitinginvestigatorstoprobetheconductof
officersoftheCountyAssemblyandtheBoard’spriordecisionsdespitethere
nothavingbeenaboardmeetingtoaddressthesaidmattersandgiveexpress
authorizationforsuchactionascontemplatedbylawastheBoardsawfit;
b)ViolationofSection12oftheCountyGovernmentsAct,2012andSection12of
theCountyAssemblyServicesAct,2017onPowersoftheBoardasabody
corporate by inviting investigators to probe alleged irregularities in
Procurementmattersfallingsquarelyunderthepurview oftheBoard,which
matterssheshouldhave,bytheBoard’sownregulationsandpractice,tendered
beforetheBoardforconsiderationbeforeinvitingthirdpartieswithoutthe
Board’spriorconsentandknowledge;
c)Violation ofSection 23 oftheCountyAssemblyServicesAct,2017 and
StandingOrder92byunilaterallypurportingtoallowdebateontheconductof
theClerkoftheCountyAssemblyonThursday14

Motionofwhichatleastthreedays‘noticehasbeengiven,thusundermining
theauthorityoftheBoardwhichhasexclusivemandatetorecommendthe
suspensionorremovaloftheClerkwhereitconsidersitnecessarytoremove
theClerkundersection22ofthesaidAct.
d)ViolationofSection11,12and23oftheCountyAssemblyServicesAct,2017,
Section12oftheCountyGovernmentsAct,2012byunilaterally,unprocedurally
andillegallyusurpingthefunctionsoftheboard,therebypurportingtotake
certainactionswhichcanonlyemanatefromtheBoardasaconsequenceofits
decisionswhileexercisingitsfunctionsunderthesaidActs,therebygreatly
underminingtheauthorityoftheboardandbringingitsreputationasabody
Corporateintodisrepute,circumstanceswhichrenderherunfittoholdtheseat
oftheChairpersonoftheBoard.
