Commercial drivers facing DUI charges in Georgia may, if
convicted, incur serious penalties laid out in the Uniform
Commercial Driver's License Act. Before the court can
enforce such penalties, the state must show an individual was
driving a commercial vehicle while impaired enough to have a
blood alcohol level (BAC) of at least 0.04 percent. In proving
its case, the state may provide evidence from urine, blood, or
breath tests.

 Commercial drivers may have their licenses
suspended before their criminal cases are closed.
To prevent this eventuality, the defendant must file
a response to the state’s administrative license
suspension petition within 10 days. If such
responses do not appear, the state will
automatically suspend the driver’s license, even if
the driver ultimately secures a “not guilty” verdict.
