El arbitraje tiene más de 100 años de formar parte del ordenamiento jurídico de El Salvador; sin embargo, era poco utilizado antes del 2002, entre otros factores, debido a la intervención judicial. El 11 de julio de 2002, la sociedad salvadoreña celebró la aprobación de la Ley de Mediación, Conciliación y Arbitraje, que potenció la utilización de medios alternativos para buscar soluciones ágiles a los conflictos tratados con sencillez, flexibilidad y privacidad, elementos esenciales en las reglas mercantiles. Así es como se reafirmó el liderazgo regional de El Salvador, previamente alcanzado al ratificar diversos tratados internacionales sobre esta temática.
