AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF1
ORLANDO, FLORIDA, AMENDING CHAPTER 39 OF THE CITY CODE2
REGARDING PARKING BY AMENDING THE BOUNDARIES OF THE3
DOWNTOWN PARKING DISTRICT, AMENDING VARIOUS4
DEFINITIONS AND TITLES USED IN CHAPTER 39, RENUMBERING5
THE DEFINITIONS, UPDATING THE PARKING REGULATIONS AND,6
INCLUDING THE USE OF PARKING METER TECHNOLOGY,7
PROVIDING LEGISLATIVE FINDINGS, AND FOR SEVERABILITY,8
CODIFICATION, CORRECTION OF SCRIVENER’S ERRORS, AND AN9
EFFECTIVE DATE.10

WHEREAS, Chapter 39 of the Code of the City of Orlando provides for regulation12
of traffic and parking in the City; and13
14
WHEREAS, the Parking Division is responsible for regulating and enforcing15
parking the downtown area of the City; and16
17
WHEREAS, it is desirable to amend the boundary lines of the Parking Division’s18
jurisdiction; and19
20
WHEREAS, it is further desirable to update the definitions, titles, and terminology21
used in Chapter 39 to reflect current practices; and22
23
WHEREAS, the Orlando City Council hereby finds and declares that this ordinance24
is in the best interest of the public health, safety, and welfare; and25
26
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY27
OF ORLANDO, FLORIDA, AS FOLLOWS:28

SECTION 1. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE30
AMENDED. Chapter 39, Article 1, Code of the City of Orlando, Florida, is hereby amended31
as follows:32
ARTICLE I. – IN GENERAL33
Sec. 39.01. – Short Title34
This Chapter may be known and cited as the “Orlando Traffic and Parking Code” or35
in the alternative as Chapter 39 of the Code of the City of Orlando.36
Sec. 39.02. – Definitions.37

(2) Approved Device. Any means by which a parking meter or timed parking39
space is placed into operation without insertion of legal tender and shall include, but40

not limited to, a key, card, token, parking meter technology or other means approved41
by the Parking Bureau Chief Parking Division Manager.42

(11) Downtown Area Parking Division Downtown District. The area bounded44
on the east by Summerlin Avenue from Palmer Street to Livingston Street, on the45
north by Livingston Street from Summerlin Avenue to Highland Avenue, on the east46
by Highland Avenue from Livingston Street to Orange Avenue, on the north by Orange47
Avenue from Highland Avenue to South Ivanhoe Boulevard, continuing on the north48
by South Ivanhoe Boulevard from Orange Avenue to Interstate 4, on the west by49
Interstate 4 from South Ivanhoe Boulevard to West Colonial Drive at the Interstate 450
East off-ramp/Hughey Avenue intersection, continued on the north by Colonial Drive51
from Hughey Avenue to Parramore Westmoreland Avenue, continuing on the west by52
Parramore Westmoreland Avenue from Colonial Drive to SouthChurch Street,53
continuing on the south by South Church Street from Parramore Westmoreland54
Avenue to Division Parramore Avenue, continuing on the west by Parramore Avenue55
from Church Street to Anderson Street, continuing on the south by Anderson Street56

(25) Parking Meter. Any mechanical or electronic device, meter or timed65
parking system means, either by device or machine, used to control or otherwise66
regulate timed parking spaces upon any street or in any off-street parking facility,67
including but not limited to single space meters, multi-space meters, and parking68
meter technology.69
(26) Parking Meter Space. Any space within a parking meter zone regulated70
by a parking meter, device, or within a timed parking zone, and which is duly71
designated for the parking of a single vehicle by lines painted or otherwise durably72
marked on the curb or on the surface of the street or public parking area or adjacent73
to or adjoining parking meters.74
(27) Parking Meter Technology. Any technology that allows payment for75
parking in parking meter zones without the use of mechanical parking meters,76
including but not limited to telephone, smartphone, applications, website, storefront77
payment, single or multi-space meters, or any other technology as deemed78
appropriate by the City to pay for parking. Parking meter technology may utilize79
parking space numbers, license plates, sticker numbers, or any other means80
designated by the specific parking meter technology to process parking payment.81
(286) Parking Meter Zone. The side of a CtyCity block alongside which82
designated parking spaces with parking meters are located or an entire parking lot83

wherein designated parking spaces with parking meters are located. Includes any84
street, portions thereof, parking area or lot, upon which parking meters, devices, or85
timed parking systems are installed or parking is regulated, which is in operation for86
the parking of vehicles for a limited time, subject to compliance with regulations.87
(297) Parking Permit. Any decal, card, placard, sticker, barcode, hangtag or88
any other means used to allow parking, loading/unloading, vehicle registration and89
any other uses in conjunction with vehicle parking.90
(3028) Parking Zone. The side of a City block alongside which non-metered91
parking is specifically permitted or an entire parking lot wherein non-metered,92
designated parking spaces are provided.93
(3129) Parking System. All off-street parking facilities and all on-street parking94
facilities as both of such facilities have been combined into a single system pursuant95
to Section 1.01(F) of an ordinance adopted September 8, 1954, and amended October96
6, 1954, relating to the establishment of off-street parking facilities.97
(320) Parking Violation Notice. The written notification that is issued by an98
authorized individual informing the operator of a motorized vehicle that a parking99
violation has occurred. The notification is also referred to as a parking ticket or citation.100
(331) Parkway. That portion of a street between the curb lines or the lateral101
lines of a roadway and the adjacent property lines not designated or intended for the102
use of pedestrians.103
(342) Pedestrian. Any person afoot.104
(353) Person. Any natural person, firm, copartnership, association, or105
corporation.106
(364) Police Officer. Every officer of the municipal Police Department.107
(375) Private Road or Driveway. Any privately owned way or place used for108
vehicular travel by the owner and those having express or implied permission from109
the owner, but not by other persons.110
(386) Railroad. A carrier of persons or property upon cars operated upon111
stationary rails.112
(397) Railroad Sign or Signal. Any sign, signal or device erected by authority113
of a public body or official or by a railroad, and intended to give notice of the presence114
of railroad tracks or the approach of a railroad train.115
(4038) Recreational Vehicle. Any vehicle designed as, or altered to be, a116
recreational vehicle including, but not limited to, a camper, travel trailer, motor home,117
mobile home or bus, meeting any of the following criteria:118
(a) a gross vehicle weight rating (GVWR) exceeding 8,000 pounds;119

(b) a vehicle width exceeding 80 inches; or120
(c) an overall length exceeding 20 feet, and specifically not including a121
boat or boat trailer.122
(4139) Residence District. The territory contiguous to, and including, a123
highway within an area zoned for residential use.124
(420) Right-of-Way. The right of one vehicle or pedestrian to proceed in a125
lawful manner in preference to another vehicle or pedestrian approaching under such126
circumstances of direction, speed, and proximity as to give rise to danger of collision127
unless one grants precedence to the other.128
(431) Safety Zone. The area or space officially set apart within a roadway or129
parking facility, not intended for parking, for the exclusive use of pedestrians and130
protected or so marked by adequate signs or authorized pavement markings as to be131
plainly visible at all times while set apart as a safety zone.132
(442) School Bus. Any motor vehicle that compiles with the color and133
identification requirements of Florida Statutes ch. 234, and is used to transport134
children to or from school or in connection with school activities, but not including135
buses operated by common carriers in urban transportation of school children.136
(453) Sidewalk. That portion of a street between the curb line, or the lateral137
line of a roadway and the adjacent property lines, intended for use by pedestrians.138
(464) Stand or Standing. The halting of a vehicle temporarily for the purpose139
of and while actually engaged in, receiving or discharging passengers or materials,140
regardless of whether the vehicle is in operation or occupied.141
(475) Stop or Stopping. Any halting, even momentarily, of a vehicle, whether142
occupied or not, except when necessary to avoid conflict with other traffic or to comply143
with the directions of a law enforcement officer or traffic control sign or signal.144
(486) Street, Highway, or Roadway. The entire width between the boundary145
lines of every way or place of whatever nature when any part thereof is open to the146
use of the public for purposes of vehicular traffic.147
(497) Traffic. Pedestrians, ridden or herded animals, and vehicles, street cars,148
and other conveyances either singly or together while using any street or highway for149
purposes of travel.150
(5048) Truck. Any motor vehicle designed, used or maintained primarily for the151
transportation of property.152
(5149) Truck Tractor. Any motor vehicle designed and used primarily for153
drawing other vehicles and not so constructed as to carry a load other than a part of154
the weight of the vehicle and load so drawn.155

(520) Vehicle. Any device, in, upon, or by which any person or property is or156
may be transported or drawn upon a street or highway.157

Sec. 39.04-2. - Referral of Cases to Designated Official.159
Effective October 1, 1994, cases alleging the violation of any provision of this160
Chapter may be referred by the City Prosecutor, or as to parking violations by the161
Parking Bureau Chief Parking Division Manager, or their designees, to a designated162
official for disposition as provided by law, within three (3) years of the violation.163
SECTION 2. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE164
AMENDED. Chapter 39, Article II, Code of the City of Orlando, Florida, is hereby165
amended as follows:166
ARTICLE II. – POLICE TRAFFIC ENFORCEMENT167
Sec. 39.05. - Duties Generally.168
It shall be the duty of the Chief of Police and other police officers to enforce169
this Chapter and all other traffic ordinances of the City, to make arrests and/or issue170
citations for traffic violations, to investigate accidents, and to cooperate with the City171
Transportation Engineering Bureau Division and Parking Bureau Chiefs Division172
Manager in developing ways and means to improve traffic conditions. Parking173
enforcement specialists may exercise those powers of enforcement granted by Florida174
Statute.175
SECTION 3. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE176
AMENDED. Chapter 39, Article III, Code of the City of Orlando, Florida, is hereby177
amended as follows:178
ARTICLE III. – TRANSPORTATION ENGINEERING BUREAU DIVISION.179
Sec. 39.06. - Office Established; Appointment.180
The Transportation Engineering Bureau Division is hereby established. The181
Transportation Engineering Bureau Chief Division Manager shall be designated the182
City Transportation Engineer, shall be appointed by the Mayor, and shall exercise the183
powers and duties as provided in this Chapter under the direction of the City Public184
Works Transportation Director.185
Sec. 39.07. - Duties Generally.186
(1) It shall be the general duty of the Transportation Engineering Bureau Chief187
Division Manager to determine the installation and proper timing and maintenance of188
traffic-control devices, to conduct engineering analyses of accidents and to devise189
remedial measures, to conduct engineering investigation of traffic conditions and to190

cooperate with other City officials in the development of ways and means to improve191
traffic conditions.192
(2) The Transportation Engineering Bureau Chief Division Manager shall193
prepare annually a traffic safety report which shall contain the number of traffic194
accidents, the number of persons killed or injured, and other pertinent traffic accident195
data as well as plans and recommendations for future traffic safety activities.196
Sec. 39.08. - Special Duties.197
The Transportation Engineering Bureau Chief Division Manager or his198
designee is authorized to:199
(1) Determine and designate certain streets as one-way and promulgate, adopt200
and amend schedules naming such streets and erect appropriate signs giving notice201
thereof.202
(2) Implement traffic regulations to cover emergency, hazardous or special203
conditions and place and maintain traffic-control devices as he deems necessary to204
regulate traffic or warn the public.205
(3) Make temporary rules regulating traffic and on-street parking outside the206
Downtown Area Parking Division Downtown District or testing traffic-control devices207
under actual conditions of traffic. Such rules regulating traffic may remain in effect for208
up to one hundred twenty (120) days; provided, however, that such period may be209
extended by action of City Council for a period not to exceed two (2) years. Such rule210
shall not be binding upon the public unless indicated by appropriate signs or under211
the personal direction of a police officer.212
(4) Determine the location of passenger loading zones and on-street parking213
outside the Downtown Area Parking Division Downtown District and place and214
maintain appropriate signs indicating the same and stating the hours during which the215
provisions of this section are applicable. The Transportation Engineering Bureau216
Chief Division Manager shall not designate or mark any such zone upon special217
request of any person, unless such person makes application for a permit for such218
zone and for two (2) signs to indicate the ends of each such zone.219
(5) Establish bus stops and taxi stands for passenger common carrier motor220
vehicles, including taxicabs, on the public streets, in such places and in such number221
as he shall determine to be of the greatest benefit and convenience to the public.222
Every such bus stop or stand for passenger common carrier motor vehicles shall be223
designated by appropriate signs. A service fee may be imposed, in accordance with224
a schedule adopted by the City Council, under this section upon the operator of any225
such bus or other passenger common carrier motor vehicle for the privilege of using226
such stop or stand; provided, however, that nothing herein contained shall be deemed227
to affect in any manner the provisions of Chapter 55 of this Code.228
(6) Determine and designate certain streets as "through streets" and229
promulgate, adopt and amend schedules naming such streets. When such230
determination is made, the Transportation Engineering Bureau Chief Division231

Manager or his designee shall place and maintain a traffic-control device on each and232
every street intersecting such "through street" or that portion thereof described and233
designated as such.234
(7) Determine and designate where particular hazards exist at intersections235
with other than through streets and require that vehicles shall stop or yield at one or236
more entrances to any such intersection, by a stop or yield sign, or in the event he237
determines that reduced speed rather than a stop is adequate for safe operation at238
any such intersection, he shall determine such safe speed by engineering239
investigation, and shall provide signs upon the approaches to such intersection giving240
notice of such speed.241
(8) Mark and maintain lanes or zones for traffic on streets at such places as242
he may deem advisable for safety and for expediting traffic, either vehicular or243
pedestrian.244
(9) Determine those intersections and other locations at which drivers of245
vehicles shall not make a right, left, or "U" turn, and shall place proper signs at such246
intersections or locations.247
(10) Issue a special permit for specific vehicles to be operated, driven or248
parked on Wall Street between Orange Avenue and Court Street subject to certain249
terms and conditions as specified in the permit if, in the Transportation Engineering250
Bureau Chief's Division Manager’s determination, such privilege is reasonably251
necessary in the conduct of an abutting property owner's business or for a special252
event or circumstance, and such privilege will not create an unreasonable safety253
hazard.254
(11) Recommend geometric improvements to roadways and intersections to255
improve traffic flow and safety and implement or test such improvements to correct256
traffic safety hazards.257
(12) Implement truck routes, through truck restrictions and weight limit258
restrictions for City maintained roadways and intersections, as determined by259
engineering studies. All recreational vehicles/trailers shall be exempt from weight limit260
restrictions.261
(13) For streets outside the Downtown Area Parking Division Downtown262
District, the Transportation Engineering Bureau Chief Division Manager shall263
determine the location of on-street freight loading zones and place and maintain264
appropriate signs indicating the same and stating the hours during which same are in265
effect. The Transportation Engineering Bureau Chief Division Manager shall not266
designate or mark any such zone upon special request of any person unless such267
person makes application for a permit for such zone and for two (2) signs to indicate268
the ends of each such zone.269
(14) Outside the Downtown Area Parking Division Downtown District, the270
Transportation Engineering Bureau Chief Division Manager shall determine and271
designate whether or not parking shall be allowed upon one or both sides of any272
street, the parking time or limitations or promulgate, adopt and amend schedules273

designating parking limitations and shall erect, place and maintain signs, devices or274
markings giving notice thereof.275
(15) Coordinate with residential/neighborhood groups and associations any276
written request for a residential parking permit program, determined by field study as277
necessary, to regulate on-street parking in residential neighborhoods.278
(16) Install and maintain regulatory, warning and informational signing279
determined by the Transportation Engineering Bureau Chief Division Manager as280
necessary to maintain the safe and efficient movement of pedestrians, bicycles, and281
motor vehicles over City maintained right-of-way.282
(17) Review applications and other requests for use or closure of sidewalks,283
traffic lanes and streets, set conditions for same, and authorize or deny street, lane,284
or sidewalk use or closure accordingly. The fee for such use or closure authorization285
shall be established by Resolution of City Council. The Transportation Engineer shall286
determine the impact of events on adjacent sidewalks, traffic lanes and streets and287
shall require and authorize a street, lane, or sidewalk closure if such impact would288
necessitate closure in order to assure the safety of vehicular and/or pedestrian289
movement in the area. The Transportation Engineer shall also recommend approval290
or disapproval of, or modification to, proposed plans affecting City-maintained right-291
of-way. The Transportation Engineering Bureau Chief Division Manager shall292
determine the appropriate manner to maintain traffic through detours, signs,293
barricades, temporary pavement markings, traffic signal control modifications and the294
use of law enforcement officers.295
For the purpose of this section, the term "closure" shall mean and include296
erection of barricades and appropriate signage to divert traffic for a specified length297
of time. The term shall not include a "roving roadblock" which occurs when police298
officers temporarily block a roadway for a short period of time.299
(18) Review all construction plans and building permits with existing or300
proposed pedestrian or vehicular access on or across the public right-of-way for301
compliance with applicable codes and standards for access management and issue302
variances from standards when justified by physical constraints or engineering study.303
Sec. 39.09. - Regulations, Schedules, Permits, etc., Subject to Review by304
Council.305
All rules, regulations, orders, schedules, permits or determinations of, or306
made or issued by, the Transportation Engineering Bureau Chief Division Manager307
may, at any time, be revoked, modified, suspended or reinstated by the City Council.308
SECTION 4. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE309
AMENDED. Chapter 39, Article IV, Code of the City of Orlando, Florida, is hereby310
amended as follows:311
ARTICLE IV. – PARKING BUREAU DIVISION.312

The Parking Bureau Division is hereby established. The Parking Division314
Manager Bureau Chief shall be appointed by the Mayor and shall exercise the powers315
and duties as provided in this Chapter under the direction of the City Public Works316
Transportation Director.317
Sec. 39.11. - Duties Generally.318
(1) It shall be the general duty of the Parking Bureau Chief Division Manager319
to determine the installation, rates and location of parking meters or the use of parking320
meter technology; the operation of on-street and off-street parking facilities; and to321
formulate programs and policies regarding rate changes, enforcement, and service322
levels to meet current and future municipal parking needs and the improvement of323
parking methods and options.324
(2) In the Downtown Area Parking Division Downtown District, the Parking325
Bureau Chief Division Manager shall determine the location of on-street freight326
loading zones and place and maintain appropriate signs indicating the same and327
stating the hours during which same are in effect. The Parking Bureau Chief Division328
Manager shall not designate or mark any such zone upon special request of any329
person unless such person makes application for a permit for such zone and for two330
(2) signs to indicate the ends of each such zone.331
(3) In the Downtown Area Parking Division Downtown District, the Parking332
Bureau Chief Division Manager shall determine and designate whether or not parking333
shall be allowed upon one or both sides of any street or within or upon off-street334
parking facilities; shall determine and designate the type, style and manner of on-335
street parking and parking within off-street parking facilities; and shall erect, place and336
maintain signs, devices or markings giving notice thereof.337
(4) In the Downtown Area Parking Division Downtown District, the Parking338
Bureau Chief Division Manager shall determine the parking time or limitations upon339
any on-street or off-street parking facility and promulgate, adopt and amend340
schedules designating such limitations, and erect, place and maintain signs, devices341
and markings giving notice thereof.342
Sec. 39.12. - Regulations, Schedules, Permits, etc., Subject to Review by343
Council.344
All rules, regulations, orders, schedules, permits or determinations of, or made345
or issued by, the Parking Bureau ChiefDivision Manager may, at any time, be revoked,346
modified, suspended or reinstated by City Council.347
SECTION 5. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE348
AMENDED. Chapter 39, Article V, Code of the City of Orlando, Florida, is hereby349
amended as follows:350

Sec. 39.14. - Parking of Vehicles Without Affixed Current and Valid354
Registration License Plate and Validation Sticker; Removing, Impounding and355
Immobilization of Vehicles Without Affixed Current and Valid Registration License356

(3) It shall be the duty of the parking enforcement specialist immobilizing such359
motor vehicle, or under whose direction such vehicle is immobilized, to post on such360
vehicle, in a conspicuous place, notice sufficient to inform the owner or operator of361
the vehicle that:362
(a) such vehicle has been immobilized pursuant to and by the authority of363
Section 39.14 of the Orlando City Code; and364
(b) the owner of such immobilized vehicle, or other duly authorized365
person, shall be permitted to repossess or to secure the release of the366
vehicle upon compliance with either of the following alternative367
procedures:368
(i) payment to the Parking Bureau Division of the City of Orlando of369
the fine prescribed in Section 39.68 of this Code for the offense of370
parking a vehicle without a current and valid registration license plate371
and validation sticker affixed to it; or372
(ii) request a hearing before a designated official concerning the373
validity of the issuance of the parking violation notice for the offense374
of parking a vehicle without a current and valid registration license375
plate and validation sticker affixed to it and provide the Parking376
BureauDivision of the City of Orlando with the owner's current and377
valid home address.378
(4) It shall be unlawful for anyone, except those persons authorized by the379
Parking Bureau ChiefDivision Manager, to remove or attempt to remove, tamper with,380
or in any way damage or alter the immobilization device.381

Sec. 39.16. - Stopping, Standing or Parking Prohibited in Specified383
Places.384
(1) No person shall stop, stand or park a vehicle, except when necessary to385
avoid conflict with other traffic or in compliance with the directions of a police officer386
or traffic-control device, in any of the following places:387
(a) On a sidewalk or in such manner that any part of such vehicle is388
protruding over a sidewalk or any part of the sidewalk area;389

(b) In front of a public or private driveway;390
(c) Within an intersection;391
(d) Within fifteen (15) feet of a fire hydrant;392
(e) On a crosswalk;393
(f) Within ten (10) feet of a crosswalk at an intersection, unless permitted394
to do so by appropriate signs or devices posted in such area;395
(g) Within thirty (30) feet of any flashing beacon, stop sign or other official396
traffic-control device located at the side of a roadway, unless the397

of points on the curb immediately opposite the ends of a safety zone,401
unless the Transportation Engineering Bureau Chief Division Manager402
indicates a different length by signs or markings;403
(i) Within thirty (30) feet of the nearest rail of a railroad crossing;404
(j) Within twenty (20) feet of the driveway entrance to any fire station and405
on the side of a street opposite such station, if prohibited by a sign;406
(k) On a roadway side of any vehicle stopping or parked at the edge or407
curb of a street or on the roadway end of any vehicle parked at an angle408
to curb or street edge, except commercial vehicles engaged in loading or409
unloading from 2:00 a.m. to 7:00 a.m. only;410
(l) Upon any bridge or other elevated structure upon a highway or within411
a highway tunnel;412
(m) At any place where an official sign prohibits stopping, standing or413
parking;414
(n) Opposite a dead-end or jog street outside of the central business415
district;416
(o) At any place in such a manner as to block access to commercial refuse417
containers by the City of Orlando refuse removal equipment;418
(p) Alongside any curb which has been painted yellow or red, unless419
otherwise specifically permitted by appropriate signs or devices posted by420
the City;421
(q) In any parking space specifically designated and marked for persons422
with disabilities unless such vehicle displays a parking permit as required423

by State Law; or in such a manner as to block or obstruct a wheelchair424
ramp;425
(r) In any parking space marked "Reserved" or "Assigned Personnel Only"426
unless such vehicle has affixed to the vehicle the appropriate permit427
issued by the Parking Bureau Chief Division Manager;428
(s) In a designated bus stop or taxicab stand unless the vehicle is a bus429
or taxicab, respectively;430
(t) If the vehicle is a commercial or recreational vehicle, upon the public431
streets or on or within privately owned driveways or property within all432
residential zoning districts or office zoning districts as defined by Chapter433
66 of this Code, except for loading or unloading purposes or when parked434
within a completely enclosed garage or as provided by Chapter 58 of this435
Code (effective December 1, 1995);436
(u) In a metered parking space which has been reserved with an official437
sign or covered by a bag placed thereon by Parking Bureau Division438
personnel and indicating no public parking;439
(v) In an area designated as a fire lane pursuant to Chapter 24 of the City440
Code;441
(w) On any property owned or controlled by the City of Orlando not442
designated for parking, unless otherwise approved by the Parking Bureau443
Chief Division Manager, City Council, or authorized City departments;444

Sec. 39.20. – Parking Prohibited at All Times or During Certain Hours. On446
Certain Designated Streets.447
When a sign is erected giving notice thereof, no person shall park a vehicle at448
any time upon any of the streets so signed. so designated and posted parking area,449
lot, street and/or right of way of the City or between the prohibited hours as designated450
and posted.451

Sec. 39.22. - Parking for Certain Purposes Prohibited.453
No person shall stand or park a vehicle:454
(1) Upon a public or private street, public parking lot or any other public455
property for the purpose and intent of displaying such vehicle thereon for sale, hire,456
or rental;457

(2) Upon any public or private street, public parking lot or any other public458
property for the purpose of painting, greasing or repairing such vehicle, except repairs459
necessitated by an emergency;460
(3) Upon any public or private street, public parking lot or any other public461
property for the purpose of washing or polishing such vehicle or any part thereof462
unless approved by the Parking Bureau Chief Division Manager;463
(4) Upon any public or private street, public parking lot or any other public464
property for the purpose of displaying advertising;465
(5) Upon any public or private street, public parking lot or any other public466
property for the purpose of selling merchandise from the motor vehicle, except in a467
duly established marketplace or when so authorized or licensed under the laws of the468
City.469

Sec. 39.25. - Same—Permit for Use of Freight Loading Zones.471
(1) The Parking Bureau Chief Division Manager (or designee) of the City shall472
issue to applicants, as hereinafter provided, permits which shall be effective October473
first through September thirty of the next succeeding year. Loading and unloading474
zone permits may be purchased after October 1 for a prorated fee, and such permits475
shall be effective until September thirty of the succeeding year unless purchased after476
December thirty-first in which case the permit shall be valid until September thirty of477
the same calendar year. Such permits shall be issued upon the payment of the478
applicable fees contained in the Schedule of Fees in Section 39.68 of this Code. A479
charge of ten dollars ($10.00) will be made for replacement of misplaced, lost or stolen480
permits.481
(2) The Parking Bureau Chief Division Manager (or designee) is further482
authorized to establish rules and regulations governing such designated freight483
loading and unloading zones, and the use thereof.484
(3) All applications for tag permits for the use of loading and unloading zones485
shall contain the following information:486
(a) Whether the applicant is a wholesaler, retailer, or common carrier;487
(b) The number of vehicles operated by the applicant;488
(c) The number of vehicles owned by the applicant which will carry loading489
and unloading permits;490
(d) The number of stops per day for loading and unloading purposes491
(average);492

(e) The name of business, type of business, location of business, mailing493
address and telephone number.494
(4) All applications will be submitted in writing to the Parking Bureau495
ChiefDivision Manager (Manager (or designee) of the City, and the Parking Bureau496
Chief Division Manager (or designee) shall have the authority to issue such permits.497
The applicant shall have the right of appeal to City Council.498
(5) Violation of any such terms and conditions shall be grounds for immediate499
revocation of the permit by the Parking Bureau ChiefDivision Manager who shall give500
written notice thereof to the holder of the permit. The permit holder may appeal such501
revocation to the City Council by filing a written notice of appeal with the City Clerk502
within seven (7) working days from the date of the revocation notice. Should the permit503
be revoked, any and all fees paid in advance shall be forfeited and retained by the504
parking system, subject to further action by City Council in the event of appeal.505

Sec. 39.27. - Parking on Parkways.507

(4) The prohibition contained in Subsection (2) shall not apply to parkway509
areas which have been officially designated and signed by the Transportation510
Engineering Bureau Chief Division Manager as permissible areas for parking when511
such is deemed to be in the public interest after review by the Transportation512
Engineering Bureau Chief Division Manager.513
Sec. 39.28. - Assignment of Parking Spaces in City Employee Parking514
Facilities; Public Use and Parking Time in Public Spaces at City Hall.515

(4) The Parking Bureau Chief Division Manager is directed to set aside517
parking spaces for City officials and employees in an appropriately designated parking518
facility. No person shall use any parking space in an appropriately designated parking519
facility designated for any other person. No person shall stop, stand or park a vehicle520
in any parking space designated for members of City boards unless such vehicle has521
affixed to said vehicle in an area designated by the Parking Bureau Division an522
appropriate permit or unless such vehicle has displayed in the front window a dated523
special parking authorization card issued by the Mayor or designee.524
Sec. 39.29. - Removal and Impounding of Illegally Parked, Abandoned or525
Disabled Vehicles—Authority of Police Department and Parking Bureau526
Division.527
Police officers, community service officers, and parking enforcement528
specialists of this City are hereby authorized to remove any vehicle from any street529
or other public property within the City, to a public garage or other place of safety,530
under the circumstances hereinafter enumerated:531

(1) When any vehicle is left unattended:532
(a) On a sidewalk;533
(b) In front of a public or private driveway;534
(c) Within fifteen (15) feet of a fire hydrant or in a fire lane;535
(d) Within an intersection;536
(e) On a crosswalk;537
(f) Between a safety zone and the nearest curb or within thirty (30)538
feet of points on the curb immediately opposite the ends of a safety539
zone, unless the Transportation Engineering Bureau Chief Division540
Manager has indicated a different length;541
(g) In a space designated for emergency vehicles only;542
(h) Within twenty (20) feet of a driveway entrance to a fire station and,543
if prohibited by a sign, on the side of a street opposite such station;544
(i) Alongside or opposite any street excavation or obstruction when545
stopping, standing or parking would obstruct traffic and is prohibited546
by sign;547
(j) At any place where official signs prohibit parking, stopping or548
standing and the vehicle is obstructing traffic or otherwise creating a549
safety hazard;550
(k) In a City off-street parking facility or parking meter zone for any551
period of time longer than twenty-four (24) hours or upon any552
particular street for a period of time longer than seventy-two (72)553
consecutive hours, unless during the seventy-two (72) hour period554
the vehicle has been removed from the particular street for a period555
of at least twelve (12) consecutive hours;556
(l) Upon any bridge, elevated structure, viaduct, causeway, tube or557
tunnel where such vehicle is obstructing traffic or otherwise creating558
a safety hazard;559
(m) In any space which has been officially reserved by a sign so560
indicating;561
(n) In a metered parking space which has been reserved by an official562
sign or covered by a bag placed thereon by Parking Bureau Division563
personnel and indicating "No Public Parking."564

Sec. 39.30. - Removing, Impounding and Immobilization of Vehicles566
Bearing Outstanding Citations.567

(2) If, after contacting the appropriate state agency which acts as custodian569
of vehicle registration and license tag records for the state from which the license tag570
attached to the motor vehicle was issued, the Parking Bureau Division is unable to571
determine the motor vehicle owner's address, the motor vehicle may be immobilized572
in accordance with the provisions of the preceding subsection (1), except it shall not573
be necessary for the Parking Bureau Division to mail Notice of Summons before the574
motor vehicle may be immobilized.575
(3) It shall be the duty of the parking enforcement specialist immobilizing such576
motor vehicle, or under whose direction such vehicle is immobilized, to post on such577
vehicle, in a conspicuous place, notice sufficient to inform the owner or operator of578
the vehicle that:579
(a) such vehicle has been immobilized pursuant to and by the authority of580
Section 39.30 of the Orlando City Code; and581
(b) the owner of such immobilized vehicle, or other duly authorized person,582
shall be permitted to repossess or to secure the release of the vehicle upon583
compliance with either of the following alternative procedures:584
(i) payment to the Parking Bureau Division of the City of Orlando of585
the applicable fee for removal of the immobilization device listed in586
Section 39.68 of this Code and all civil penalties for outstanding587
parking violation notices; or588
(ii) posting with the Parking Bureau Division of the City of Orlando of589
a cash or surety bond or other adequate security equal to the amount590
of the applicable fee listed in Section 39.68 of this Code. If, during the591
hearing on the outstanding parking violation notices which592
necessitated the immobilization of the vehicle, the City prevails on any593
or all of the outstanding violations, the cash or surety bond shall be594
forfeited to the City of Orlando.595
(4) It shall be unlawful for anyone, except those persons authorized by the596
Parking Bureau Chief Division Manager, to remove or attempt to remove, tamper with,597
or in any way damage or alter the immobilization device.598

Sec. 39.32. - Notice of Owner's Claim for Loss or Damage to Immobilized600
Vehicles.601
At the time of the release of a vehicle immobilized pursuant to Sections 39.14602
and 39.30 the owner of such vehicle or other duly authorized person, shall inspect the603
vehicle and shall give a receipt to the Parking Bureau ChiefDivision Manager or604

designee reciting any claims he said owner or authorized person has for loss or605
damage to the vehicle.606

DIVISION 2. - PARKING METERS608
Sec. 39.34. - Designation of Parking Meter Zones by Parking Bureau609
ChiefDivision Manager.610

The Parking Bureau Chief Division Manager shall, from time to time, designate612
those certain described parts of public streets, public parking lots or any other public613
property streets for the installation of parking meters or use of parking meter technology,614
and the same shall be established as parking meter zones. The City Council shall have615
the right to rescind or change any such designation so made by the Parking Bureau616
ChiefDivision Manager.617
Sec. 39.35. - Legal Time Limits in Parking Meter Zones.618
The Parking Bureau ChiefDivision Manager shall designate and establish the619
legal time limit for parking in each designated parking meter zone. The Parking Bureau620
ChiefDivision Manager is authorized and empowered, whenever and wherever it621
appears to be in the public interest, to designate lesser periods of time as the legal622
time limit for any parking space in any parking meter zones in the City, and to change623
such designated periods from time to time as may appear in the best interest of the624
public for the proper regulation of traffic and parking; provided, however, that any such625
parking spaces so designated shall have the legal time limit thereof plainly marked626
and posted on the parking meter or within the parking meter technology applicable to627
each such parking space or on signs conspicuously placed within that parking meter628
zone; and provided further, that not less than ten (10) days prior to the effective date629
of any such designation or change of designation, one copy of each such designation630
or change of designation shall be furnished to the Chief of Police, and one copy shall631
be filed with the City Clerk where the same shall be available for inspection by the632
public. The City Council shall have the right to rescind or change any such designation633
or change of designation so made by the Parking Bureau ChiefDivision Manager.634
Sec. 39.36. - Installation, Operation and Maintenance of Meters;635
Collection, etc., of Revenue.636
(1) The Parking Bureau ChiefDivision Manager is hereby authorized, empowered637
and directed to install or cause to be installed parking meters, devices, timed parking638
systems or authorize the use of parking meter technology in parking meter zones639
established under authority of Section 39.34 of this Code, and to designate or cause to be640
designated in accordance with the provisions of this division parking meter spaces in such641
zones. Such Mechanical parking meters shall be placed alongside of or adjacent to642
individual parking spaces or conspicuously located within an off-street parking facility to643
be designated as aforesaid. For any parking meter zone or spaces where no mechanical644
parking meters are installed, the Parking Division Manager shall install signage in the area645
and visible from the parking spaces indicating that payment of the parking meter rates for646

those spaces shall be made using parking meter technology, and indicating the procedure647
for using said technology.648
(2) The Parking Bureau ChiefDivision Manager shall provide for the regulation,649
control, operations and use of the parking meters provided for in this division and shall650
maintain such meters in good working condition.651
(3) The Parking Bureau ChiefDivision Manager shall provide for the652
administration, collection, safeguarding and accountability of all revenue derived from653
on and off-street parking meters; such revenue to be deposited as directed by the654
Chief Financial Officer.655
Sec. 39.37. - Hours and Days of Operation.656
Notwithstanding the authority of the Parking Division Manager as set forth in657
this Chapter, Pparking meters and parking meter technology as required by this658
division shall be in operation as follows:659
(1) On-Street Parking. From 8:00 a.m. to 6:00 p.m., daily, except Sundays and660
City holidays as designated in subsection (4) of this Section.661
(2) Off-Street Parking. In municipal parking facilities from 7:00 a.m. to 2:00662
a.m., daily, except Sundays and City holidays designated in subsection (3) of this663
Section; and except as set forth in subsection (5) for Orlando Centroplex Venues664
facilities; provided, however, that certain such off-street parking areas shall be in665
operation twenty-four (24) hours daily, including Sundays and City holidays666
designated in subsection (3) of this Section; and provided further, that the hours of667
operation in such twenty-four (24) hour off-street parking facilities shall be plainly668
marked and posted on the parking meters or by the parking meter technology or on669
signs conspicuously placed in such facilities or both.670
(3) The following days are hereby designated as City holidays on which671
parking meters and parking meter technology in on-street and off-street metered672
parking facilities are not in operation.673
(a) New Years Day—January 1;674
(b) Dr. Martin Luther King, Jr. Day—the third Monday in January;675
(c) Memorial Day—the last Monday in May;676
(d) Independence Day—July 4;677
(e) Labor Day—the first Monday in September;678
(f) Thanksgiving Day—the fourth Thursday in November;679
(g) Christmas Day—December 25.680

(4) Parking at Centroplex Orlando Venues Parking Facilities. Notwithstanding681
anything to the contrary contained herein, hours and days of operation of parking682
meters and parking meter technology, or the charging of parking fees for parking683
facilities under the control of, or used in conjunction with facilities under the control of,684
the Orlando Centroplex Bureau Venues shall be established by the Director of the685
Orlando Centroplex Chief Venues Officer. When so established, such hours and days686
of operation shall be plainly marked and posted at such parking facilities.687
Sec. 39.38. - Rates.688
The rates for parking meters and parking meter technology established by this689
division shall be determined and set by the Parking Bureau Chief Division Manager690
subject to the approval of City Council. Such rates shall be plainly marked and posted691
on the parking meters or by the parking meter technology, or on signs conspicuously692
placed in an off-street parking facility or both.693
Sec. 39.39. - Construction of Meters and Use of Parking Meter Technology.694

Parking meters shall be placed or set in such a manner as to show or display by a696
signal that the parking space regulated or controlled by such meter is legally in use.697
Parking meters installed shall indicate by proper legend parking time established by the698
City and when operated shall indicate by its dial or indicator the duration of the period of699
legal parking time and on the expiration of such period shall indicate illegal or overtime700
parking. When parking meter technology is in use, it shall notify the user and the parking701
enforcement officer of the legal parking time for which payment has been made, the702
balance of legal parking time and can notify the user when the legal parking time has703
expired.704

Sec. 39.40. - Marking of Spaces; Vehicles to be Parked Within Marked Lines.706
The Parking Bureau Chief Division Manager shall place or cause to be placed707
lines or markings upon the curb or upon the street adjacent to each parking meter, or708
on both, or upon the paved surface in an off-street parking facility, for the purpose of709
designating the parking space to which each such parking meter or parking meter710
technology appertains. It shall be unlawful for any person to park a vehicle outside of,711
alongside of, or adjacent to any such parking space unless the parked vehicle is within712
the lines defined.713
Sec. 39.41. – Deposit of Coin Funds and Operation of Meter Required;714
Exceptions.715
When any vehicle shall be parked in any space regulated or controlled by a716
parking meter in accordance with the provisions of this division, the operator of such717
vehicle shall, upon entering such parking space, immediately deposit or cause to be718
deposited in such parking meter or parking meter technology for such space, legal719
tender of the United States of America of the denomination and amount required as720
the rate or an approved device for such parking, depending upon the length of time721
during which it is desired to park such vehicle. Upon the deposit of such funds and722
the placing of such parking meter in operation, the parking space may be lawfully723
occupied by such vehicle during the period indicated on the meter. Such operator724

shall thereupon relate the handle or otherwise put the meter in operation according to725
the directions thereon contained. The failure to deposit such legal tender or approved726
device and place such meter in operation, or both, shall constitute a violation of this727
section and is declared to be unlawful.728
Sec. 39.42 - Use of Parking Space for Profit Prohibited.729

(2) Nothing in this section shall be deemed to prohibit the deposit of legal tender731
or an approved device in any parking meter and the placing of such meter in operation by732
a person other than the owner or operator of the vehicle using the metered parking space733
adjacent to such meter where the depositor thereof is making such deposit merely as a734
courtesy to a customer on behalf of any business not primarily in the business of furnishing735
parking facilities for profit.736

Sec. 39.45. - Meter Violation Overtime.738

It shall be unlawful for any vehicle to be placed or remain parked in any metered740
parking space beyond the time period allowed by the deposit of legal tender or an741
approved device. The parking meter or parking meter technology shall indicate expiration742
of time and, in that event, such vehicle shall be considered parked overtime and a citation743
may be issued. A subsequent citation may be issued for each violation of the time limits.744
provided on the legend of the meter.. It shall not constitute a defense to prosecution for745
violation of this section that, at the time the vehicle was parked, the meter registered746
unexpired time. Legal parking time is that amount of time afforded by the deposit of legal747
tender or approved devices.748

DIVISION 3. - OFF-STREET PARKING FACILITIES751

Sec. 39.50. - Designation and Marking of Areas.753
The Parking Bureau ChiefDivision Manager shall designate certain areas of754
such facilities for the parking of vehicles and the individual spaces to be used for755
parking by each permissible vehicle and such other areas as are necessary for the756
movement of motor vehicles into and from such designated parking areas. The757
Parking Bureau ChiefDivision Manager shall cause the various areas designated as758
above to be marked by visible markings, signs or signals necessary for the direction759
of drivers into the appropriate areas of the parking facilities.760
Sec. 39.51. - Use Restricted to Parking and Incidents Thereof.761

No person shall at any time operate or park a vehicle on any City off-street762
parking facility for any purpose other than parking purposes and the necessary driving763
on such facility required of the operator of any vehicle in entering and leaving such764
facility in connection with the use of the facility as a parking area; provided, however,765
the Parking Bureau Chief Division Manager may reserve or set aside a facility, or766
portion thereof, for a special event.767

Sec. 39.59. - Rates.769
(1) The rates to be charged and paid for the use of the off-street parking770
facilities shall be determined and set by the Parking Bureau ChiefDivision Manager771
subject to the approval of City Council, except as otherwise provided herein. The rates772
to be charged and paid for the use of the off-street parking facilities under the control773
of the Orlando Centroplex BureauVenues shall be determined and set by the Director774
of the Orlando CentroplexChief Venues Officer, subject to the approval of the City775
Council.776
(2) The Director of the Orlando CentroplexChief Venues Officer shall have the777
authority to waive or modify the rates established pursuant to subsection (1) if such is778
deemed to be in the best interests of the City and after due consideration of the779
following:780
(a) Nature of a specific event;781
(b) Expected/anticipated attendance at the event;782
(c) Time and duration of the event;783
(d) Necessity for the orderly flow of pedestrian and/or vehicular traffic in784
and around the CentroplexOrlando Venues sites;785
(e) Necessity for parking in order to facilitate the efficient staging of events786
at CentroplexOrlando Venues facilities;787
(f) Cost effectiveness of maintaining attended parking for an event;788
(g) Support of the marketing efforts for Centroplex Orlando Venues789
facilities;790
(h) Direct participation by the City in the event under consideration.791

Where appropriate signs are erected giving notice thereof, it shall be unlawful to794
park, stop, or stand a vehicle in a place designated for parking by permit only, unless such795
vehicle has a permit issued by the Parking Bureau Chief Division Manager or his designee.796
Sec. 39.62. - Liability for Payment of Parking Ticket Violations.797
Under authority of Florida Statutes ch. 316, the owner of a vehicle is responsible798
and liable for payment of any parking violation under this Chapter unless the owner can799
furnish evidence that the vehicle was, at the time of the parking violation, in the care,800
custody, or control of another person. In such instances, the owner of the vehicle is801
required, within a reasonable time after notification of the parking violation, to furnish to802
the Parking Bureau Chief Division Manager or his designated assistant, the name and803
address of the person or company who leased, rented, or otherwise had the care, custody,804
or control of the vehicle. The owner of a vehicle is not responsible for parking violations if805
the vehicle involved was, at the time, stolen or in the care, custody, or control of some806
person who did not have permission of the owner to use the vehicle. Prima facie evidence807
that the vehicle involved was, at the time, stolen or in the care, custody, or control of some808
person who did not have permission of the owner to use the vehicle, shall be in the form809
of a report from the appropriate law enforcement official that the said vehicle was not under810
the care, custody, or control of the owner of the vehicle.811

Sec. 39.64. - Permit Parking Areas, Permits and Cards—Designation.813
(1) The Parking Bureau Chief Division Manager is hereby authorized to designate814
areas in City off-street parking facilities for parking by permit only and to issue parking815
permits and cards which shall entitle the purchaser thereof to park authorized motor816
vehicles bearing such a permit or card in such designated areas on a non-exclusive basis.817

(2) The Parking Bureau Chief Division Manager is further authorized to establish819
rules and regulations governing such designated permit areas and the use thereof.820

(3) The Parking Bureau Chief Division Manager is hereby authorized to establish822
various parking permit programs for parking at downtown off-street parking facilities which823
may include, but not be limited to, monthly permits, annual permits, group permits, and824
such other special classes of permits as the Parking Bureau Chief Division Manager may825
from time to time designate. The Parking Bureau Chief Division Manager is also826
authorized to issue parking permits and cards which shall entitle the purchaser thereof to827
park authorized motor vehicles bearing such permit or card in such off-street parking828
facilities as allowed by the particular permit program.829

(4) The Parking Bureau Chief Division Manager is further authorized to establish831
rules and regulations governing the issuance of such permits and cards and the use832
thereof.833
Sec. 39.65. - Same—Application for Parking Permit; Conditions; Fee.834
(1) Application for a parking permit shall be made to the Parking Bureau Division835
on a form provided by that section.836

(2) The application and the rules and regulations promulgated under authority of838
Section 39.64 shall set forth the terms and conditions of the parking privileges granted839
under the permit parking program.840

(3) Violation of any such terms and conditions shall be grounds for immediate842
revocation of the parking permit by the Parking Bureau Chief Division Manager who shall843
give written notice thereof to the holder of the permit. The permit holder may appeal such844
revocation to the City Council by filing a written notice of appeal with the City Clerk within845
seven (7) working days from the date of the revocation notice. Should the permit be846
revoked, any and all fees paid in advance shall be forfeited and retained by the Parking847
BureauDivision, subject to further action by City Council in the event of appeal.848

(4) The Parking Bureau ChiefDivision Manager is hereby authorized to establish850
rates for permit parking authorized in Section 39.64 as he shall from time to time851
determine, and such rates shall become effective upon approval by the City Council of852
Orlando.853
(5) Upon completion and approval of the application and payment of the fee, a854
parking permit shall be issued for use on each motor vehicle described in the855
application, which permit shall only be valid for and utilized in the appropriate off-street856
parking facility and for the time period indicated.857
Sec. 39.66. - Same—Parking in Designated Area.858
(1) It shall be unlawful for any person to park a motor vehicle in an area designated859
for permit parking only, unless said vehicle has properly affixed to it, in accordance with860
the Rules and Regulations promulgated by the Parking Bureau Chief Division Manager861
governing parking in designated permit areas, a current parking permit issued for use on862
that vehicle for that particular off-street parking facility.863

(2) Any person violating the provisions of Subsection (1) shall pay the civil penalty865
as prescribed in Section 39.68 of this Code.866

SECTION 6. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE869
AMENDED. Chapter 39, Article VI, Code of the City of Orlando, Florida, is hereby870

(3) Where an act is prohibited or where an act is required but not performed, it888
shall be deemed to be a violation of this Chapter.889
(4) Where a civil penalty is not otherwise provided in Subsection (2) for a890
parking violation under this Chapter, the civil penalty shall be fifteen dollars ($15.00).891
(5) (a) Any person receiving a parking violation notice shall, within fourteen892
(14) calendar days, pay the civil penalty as prescribed in Subsection (2) of this section893
or request a hearing before a designated official. Failure to pay the civil penalty as894
prescribed in Subsection (2) or to request a hearing within fourteen (14) calendar days895
of the issuance of the parking violation notice will result in the imposition of a896
delinquent fee of fifteen dollars ($15.00).897
(b) Any person electing to appear before the designated official shall be898
deemed to have waived his right to pay the civil penalty as set forth in Section899
39.68(2). The designated official, after a hearing, shall make a determination as to900
whether a violation has been committed. If the commission of a violation has been901
proven, the designated official may impose a fine not to exceed one hundred dollars902
($100.00) plus court costs; provided, however, that for a violation of Florida Statutes903
§ 316.1955 or 316.1956, or for a violation of City Code Section 39.16(q), the904

designated official may impose a fine not to exceed two hundred and fifty dollars905
($250.00) plus court costs.906
(6) If an individual who has received a parking violation notice for parking a907
motor vehicle in a parking space, the proper use of which requires a specific permit908
or decal, appears at the offices of the Parking BureauDivision within fourteen (14)909
calendar days of the date of such notice and furnishes proof that the required permit910
or decal was issued to such motor vehicle and that such permit or decal was valid911
prior to the time of the violation, the Parking BureauDivision may reduce the civil912
penalty authorized by Section 39.68(2) to five dollars ($5.00).913
(7) A fee of one hundred dollars ($100.00) is hereby imposed for removal of914
an immobilization device placed on a vehicle pursuant to Sections 39.14, 39.29 and915
39.30 of this Code.916
(8) To the extent permitted by the policies and procedures of the City, the917
Parking Bureau ChiefDivision Manager shall have the authority to dismiss parking918
violation notices and/or waive delinquent fees set forth in Section 39.68(5)(a);919
provided, however, that such dismissal and/or waiver shall be appropriately920
documented with the reason(s) for dismissal or waiver placed in writing in the921
designated files that bear the parking violation notice's citation number.922
Sec. 39.69. - Procedures upon Non-Compliance with Parking Violation923
Notice.924
(1) The Parking BureauDivision shall accept payment of civil penalties for parking925
violations and issue receipts for such payments. The Parking BureauDivision shall926
maintain a record of such civil penalties and shall daily report the monies collected and927
deposited in the City's depository bank to the City Comptroller.928

(2) If any person summoned by a parking violation notice affixed on a motor930
vehicle does not respond to such notice within fourteen (14) calendar days, the Parking931
BureauDivision shall assess the fifteen dollar ($15.00) delinquent fee per violation against932
the registered owner of the motor vehicle as prescribed in Section 39.68(5)(a) of this Code,933
and a Notice of Summons shall be sent, by mail, to the registered owner of the motor934
vehicle which was cited, informing such owner of the parking violation notice and the935
failure to comply therewith. Such notice shall direct the recipient to respond within ten (10)936
calendar days; otherwise, a Summons may be issued for failure to comply in violation of937
Section 39.70(1) of this Code.938

Sec. 39.70. - Failure to Obey Notice; Alteration or Destruction of Notice942

(1) It shall be unlawful for the responsible party, as defined in Section 39.62 of945
this Code to neglect to answer to the charge set forth in a parking violation notice affixed946
to a motor vehicle by a police officer, community service officer, parking enforcement947
specialist, or City Code inspector.948

(2) The notice referred to in Subsection (1) of this section is and shall remain the950
property of the City before and after the serving, delivery or affixing thereof. All persons951
receiving any such notice in writing, whether by personal service or by affixing the same952
to a motor vehicle, shall be and are hereby required to preserve such notice and to bring953
and present or otherwise transmit the same to the Parking BureauDivision when954
answering the charge set forth in such notice.955

Sec. 39.73. - Parking Violation Information to be Furnished to State957
Department of Highway Safety and Motor Vehicles.958
The Parking BureauDivision is hereby authorized and directed to supply the959
State of Florida Department of Highway Safety and Motor Vehicles with a listing of960
persons, in a State Department of Highway Safety and Motor Vehicles approved961
communications format, who have three (3) or more outstanding parking violations or962
one (1) or more parking violation(s) of Florida Statutes § 316.1955 or Florida Statutes963
§ 316.1956, or any City ordinances which regulate similar parking in spaces for964
persons who have disabilities.965
SECTION 7. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE966
AMENDED. Chapter 39, Article VII, Code of the City of Orlando, Florida, is hereby967
amended as follows:968
ARTICLE VII. - CRUISING CONTROL969
Sec. 39.75. - Same—Definitions.970
For the purpose of this Article, the following definitions shall apply:971

(5) Traffic Control Point. A clearly identified reference point on a designated973
street, as determined and marked by an "official traffic control device" posted at the974
direction of the Transportation Engineering Bureau ChiefDivision Manager or his975
designee.976
(6) Official Traffic Control Devices. All signs, signals, markings, and devices977
placed or erected by authority of a public body or official having jurisdiction for the978
purpose of regulating, warning, or guiding traffic.979
(7) Restricted Hours. The days and times that cruising is prohibited,980
specifically between the hours of 7:00 p.m. and 4:00 a.m., on any day.981
(8) Restricted Area. Those streets or roadways designated by The982
Transportation Engineering Bureau ChiefDivision Manager as a "No Cruising Area"983
and that are within that area of the City of Orlando bounded on the north by Colonial984
Drive, on the south by Anderson Street, on the west by Hughey Avenue, including the985

Church Street garage, and on the east by Rosalind Avenue south of Livingston Street986

Sec. 39.81. - Same—Designation of Streets.989
The Transportation Engineering Bureau Chief Division Manager is authorized990
to designate a public street or roadway as a designated street or "No Cruising Area"991
based upon a prior determination that a state of congested traffic is likely to occur992
during the restricted hours. Such designation shall include any portion of the street or993
roadway within which the congested traffic condition is likely to exist. Upon the994
designation of a street or roadway as a designated street or "No Cruising Area," the995
Transportation Engineering BureauDivision shall post or cause to be posted notices996
to the public to such effect, and shall establish one or more traffic control points to997
identify the vehicles being operated upon the designated street.998
SECTION 8. CODIFICATION. The City Clerk and the City Attorney shall cause999
the Code of the City of Orlando, Florida, to be amended as provided by this ordinance1000
and may renumber, re-letter, and rearrange the codified parts of this ordinance if1001
necessary to facilitate the finding of the law.1002
SECTION 9. SCRIVENER’S ERROR. The City Attorney may correct scrivener’s1003
errors found in this ordinance by filing a corrected copy of this ordinance with the City1004
Clerk.1005

SECTION 10. SEVERABILITY. If any provision of this ordinance or its application1007
to any person or circumstance is held invalid, the invalidity does not affect other provisions1008
or applications of this ordinance which can be given effect without the invalid provision or1009

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF1 ORLANDO, FLORIDA, AMENDING CHAPTER 39 OF THE CITY CODE2 REGARDING PARKING BY AMENDING THE BOUNDARIES OF THE3 DOWNTOWN PARKING DISTRICT, AMENDING VARIOUS4 DEFINITIONS AND TITLES USED IN CHAPTER 39, RENUMBERING5 THE DEFINITIONS, UPDATING THE PARKING REGULATIONS AND,6 INCLUDING THE USE OF PARKING METER TECHNOLOGY,7 PROVIDING LEGISLATIVE FINDINGS, AND FOR SEVERABILITY,8 CODIFICATION, CORRECTION OF SCRIVENER’S ERRORS, AND AN9 EFFECTIVE DATE.10 11 WHEREAS, Chapter 39 of the Code of the City of Orlando provides for regulation12 of traffic and parking in the City; and13 14 WHEREAS, the Parking Division is responsible for regulating and enforcing15 parking the downtown area of the City; and16 17 WHEREAS, it is desirable to amend the boundary lines of the Parking Division’s18 jurisdiction; and19 20 WHEREAS, it is further desirable to update the definitions, titles, and terminology21 used in Chapter 39 to reflect current practices; and22 23 WHEREAS, the Orlando City Council hereby finds and declares that this ordinance24 is in the best interest of the public health, safety, and welfare; and25 26 NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY27 OF ORLANDO, FLORIDA, AS FOLLOWS:28 29 SECTION 1. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE30 AMENDED. Chapter 39, Article 1, Code of the City of Orlando, Florida, is hereby amended31 as follows:32 ARTICLE I. – IN GENERAL33 Sec. 39.01. – Short Title34 This Chapter may be known and cited as the “Orlando Traffic and Parking Code” or35 in the alternative as Chapter 39 of the Code of the City of Orlando.36 Sec. 39.02. – Definitions.37 ****38 (2) Approved Device. Any means by which a parking meter or timed parking39 space is placed into operation without insertion of legal tender and shall include, but40

The area bounded44 on the east by Summerlin Avenue from Palmer Street to Livingston Street, on the45 north by Livingston Street from Summerlin Avenue to Highland Avenue, on the east46 by Highland Avenue from Livingston Street to Orange Avenue, on the north by Orange47 Avenue from Highland Avenue to South Ivanhoe Boulevard, continuing on the north48 by South Ivanhoe Boulevard from Orange Avenue to Interstate 4, on the west by49 Interstate 4 from South Ivanhoe Boulevard to West Colonial Drive at the Interstate 450 East off-ramp/Hughey Avenue intersection, continued on the north by Colonial Drive51 from Hughey Avenue to Parramore Westmoreland Avenue, continuing on the west by52 Parramore Westmoreland Avenue from Colonial Drive to SouthChurch Street,53 continuing on the south by South Church Street from Parramore Westmoreland54 Avenue to Division Parramore Avenue, continuing on the west by Parramore Avenue55 from Church Street to Anderson Street, continuing on the south by Anderson Street56 from Parramore Avenue to Division Street, continuing on the west by Division Avenue57 from South Anderson Street to Gore Street, continuing on the south by Gore Street58 from Division Avenue to Delaney Avenue, continuing on the east by Delaney Avenue59 from Gore Street to Ponce de Leon Place, continuing on the south by Ponce de Leon60 Place from Gore Delaney Street to Lake Street, continuing on the east by Lake Street61 from Ponce de Leon Place to Palmer Street, continuing on the south by Palmer Street62 from Ponce de Leon Place Lake Street to Summerlin Avenue. (See Figure 1).63 ****64 (25) Parking Meter. Any mechanical or electronic device, meter or timed65 parking system means, either by device or machine, used to control or otherwise66 regulate timed parking spaces upon any street or in any off-street parking facility,67 including but not limited to single space meters, multi-space meters, and parking68 meter technology.69 (26) Parking Meter Space. Any space within a parking meter zone regulated70 by a parking meter, device, or within a timed parking zone, and which is duly71 designated for the parking of a single vehicle by lines painted or otherwise durably72 marked on the curb or on the surface of the street or public parking area or adjacent73 to or adjoining parking meters.74 (27) Parking Meter Technology. Any technology that allows payment for75 parking in parking meter zones without the use of mechanical parking meters,76 including but not limited to telephone, smartphone, applications, website, storefront77 payment, single or multi-space meters, or any other technology as deemed78 appropriate by the City to pay for parking. Parking meter technology may utilize79 parking space numbers, license plates, sticker numbers, or any other means80 designated by the specific parking meter technology to process parking payment.81 (286) Parking Meter Zone. The side of a CtyCity block alongside which82 designated parking spaces with parking meters are located or an entire parking lot83

Includes any84 street, portions thereof, parking area or lot, upon which parking meters, devices, or85 timed parking systems are installed or parking is regulated, which is in operation for86 the parking of vehicles for a limited time, subject to compliance with regulations.87 (297) Parking Permit. Any decal, card, placard, sticker, barcode, hangtag or88 any other means used to allow parking, loading/unloading, vehicle registration and89 any other uses in conjunction with vehicle parking.90 (3028) Parking Zone. The side of a City block alongside which non-metered91 parking is specifically permitted or an entire parking lot wherein non-metered,92 designated parking spaces are provided.93 (3129) Parking System. All off-street parking facilities and all on-street parking94 facilities as both of such facilities have been combined into a single system pursuant95 to Section 1.01(F) of an ordinance adopted September 8, 1954, and amended October96 6, 1954, relating to the establishment of off-street parking facilities.97 (320) Parking Violation Notice. The written notification that is issued by an98 authorized individual informing the operator of a motorized vehicle that a parking99 violation has occurred. The notification is also referred to as a parking ticket or citation.100 (331) Parkway. That portion of a street between the curb lines or the lateral101 lines of a roadway and the adjacent property lines not designated or intended for the102 use of pedestrians.103 (342) Pedestrian. Any person afoot.104 (353) Person. Any natural person, firm, copartnership, association, or105 corporation.106 (364) Police Officer. Every officer of the municipal Police Department.107 (375) Private Road or Driveway. Any privately owned way or place used for108 vehicular travel by the owner and those having express or implied permission from109 the owner, but not by other persons.110 (386) Railroad. A carrier of persons or property upon cars operated upon111 stationary rails.112 (397) Railroad Sign or Signal. Any sign, signal or device erected by authority113 of a public body or official or by a railroad, and intended to give notice of the presence114 of railroad tracks or the approach of a railroad train.115 (4038) Recreational Vehicle. Any vehicle designed as, or altered to be, a116 recreational vehicle including, but not limited to, a camper, travel trailer, motor home,117 mobile home or bus, meeting any of the following criteria:118 (a) a gross vehicle weight rating (GVWR) exceeding 8,000 pounds;119

(b) a vehicle width exceeding 80 inches; or120 (c) an overall length exceeding 20 feet, and specifically not including a121 boat or boat trailer.122 (4139) Residence District. The territory contiguous to, and including, a123 highway within an area zoned for residential use.124 (420) Right-of-Way. The right of one vehicle or pedestrian to proceed in a125 lawful manner in preference to another vehicle or pedestrian approaching under such126 circumstances of direction, speed, and proximity as to give rise to danger of collision127 unless one grants precedence to the other.128 (431) Safety Zone. The area or space officially set apart within a roadway or129 parking facility, not intended for parking, for the exclusive use of pedestrians and130 protected or so marked by adequate signs or authorized pavement markings as to be131 plainly visible at all times while set apart as a safety zone.132 (442) School Bus. Any motor vehicle that compiles with the color and133 identification requirements of Florida Statutes ch. 234, and is used to transport134 children to or from school or in connection with school activities, but not including135 buses operated by common carriers in urban transportation of school children.136 (453) Sidewalk. That portion of a street between the curb line, or the lateral137 line of a roadway and the adjacent property lines, intended for use by pedestrians.138 (464) Stand or Standing. The halting of a vehicle temporarily for the purpose139 of and while actually engaged in, receiving or discharging passengers or materials,140 regardless of whether the vehicle is in operation or occupied.141 (475) Stop or Stopping. Any halting, even momentarily, of a vehicle, whether142 occupied or not, except when necessary to avoid conflict with other traffic or to comply143 with the directions of a law enforcement officer or traffic control sign or signal.144 (486) Street, Highway, or Roadway. The entire width between the boundary145 lines of every way or place of whatever nature when any part thereof is open to the146 use of the public for purposes of vehicular traffic.147 (497) Traffic. Pedestrians, ridden or herded animals, and vehicles, street cars,148 and other conveyances either singly or together while using any street or highway for149 purposes of travel.150 (5048) Truck. Any motor vehicle designed, used or maintained primarily for the151 transportation of property.152 (5149) Truck Tractor. Any motor vehicle designed and used primarily for153 drawing other vehicles and not so constructed as to carry a load other than a part of154 the weight of the vehicle and load so drawn.155

Any device, in, upon, or by which any person or property is or156 may be transported or drawn upon a street or highway.157 ****158 Sec. 39.04-2. - Referral of Cases to Designated Official.159 Effective October 1, 1994, cases alleging the violation of any provision of this160 Chapter may be referred by the City Prosecutor, or as to parking violations by the161 Parking Bureau Chief Parking Division Manager, or their designees, to a designated162 official for disposition as provided by law, within three (3) years of the violation.163 SECTION 2. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE164 AMENDED. Chapter 39, Article II, Code of the City of Orlando, Florida, is hereby165 amended as follows:166 ARTICLE II. – POLICE TRAFFIC ENFORCEMENT167 Sec. 39.05. - Duties Generally.168 It shall be the duty of the Chief of Police and other police officers to enforce169 this Chapter and all other traffic ordinances of the City, to make arrests and/or issue170 citations for traffic violations, to investigate accidents, and to cooperate with the City171 Transportation Engineering Bureau Division and Parking Bureau Chiefs Division172 Manager in developing ways and means to improve traffic conditions. Parking173 enforcement specialists may exercise those powers of enforcement granted by Florida174 Statute.175 SECTION 3. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE176 AMENDED. Chapter 39, Article III, Code of the City of Orlando, Florida, is hereby177 amended as follows:178 ARTICLE III. – TRANSPORTATION ENGINEERING BUREAU DIVISION.179 Sec. 39.06. - Office Established; Appointment.180 The Transportation Engineering Bureau Division is hereby established. The181 Transportation Engineering Bureau Chief Division Manager shall be designated the182 City Transportation Engineer, shall be appointed by the Mayor, and shall exercise the183 powers and duties as provided in this Chapter under the direction of the City Public184 Works Transportation Director.185 Sec. 39.07. - Duties Generally.186 (1) It shall be the general duty of the Transportation Engineering Bureau Chief187 Division Manager to determine the installation and proper timing and maintenance of188 traffic-control devices, to conduct engineering analyses of accidents and to devise189 remedial measures, to conduct engineering investigation of traffic conditions and to190

ORDINANCE NO. 2019-43 Page 6 of 29 Chapter 39 CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. cooperate with other City officials in the development of ways and means to improve191 traffic conditions.192 (2) The Transportation Engineering Bureau Chief Division Manager shall193 prepare annually a traffic safety report which shall contain the number of traffic194 accidents, the number of persons killed or injured, and other pertinent traffic accident195 data as well as plans and recommendations for future traffic safety activities.196 Sec. 39.08. - Special Duties.197 The Transportation Engineering Bureau Chief Division Manager or his198 designee is authorized to:199 (1) Determine and designate certain streets as one-way and promulgate, adopt200 and amend schedules naming such streets and erect appropriate signs giving notice201 thereof.202 (2) Implement traffic regulations to cover emergency, hazardous or special203 conditions and place and maintain traffic-control devices as he deems necessary to204 regulate traffic or warn the public.205 (3) Make temporary rules regulating traffic and on-street parking outside the206 Downtown Area Parking Division Downtown District or testing traffic-control devices207 under actual conditions of traffic. Such rules regulating traffic may remain in effect for208 up to one hundred twenty (120) days; provided, however, that such period may be209 extended by action of City Council for a period not to exceed two (2) years. Such rule210 shall not be binding upon the public unless indicated by appropriate signs or under211 the personal direction of a police officer.212 (4) Determine the location of passenger loading zones and on-street parking213 outside the Downtown Area Parking Division Downtown District and place and214 maintain appropriate signs indicating the same and stating the hours during which the215 provisions of this section are applicable. The Transportation Engineering Bureau216 Chief Division Manager shall not designate or mark any such zone upon special217 request of any person, unless such person makes application for a permit for such218 zone and for two (2) signs to indicate the ends of each such zone.219 (5) Establish bus stops and taxi stands for passenger common carrier motor220 vehicles, including taxicabs, on the public streets, in such places and in such number221 as he shall determine to be of the greatest benefit and convenience to the public.222 Every such bus stop or stand for passenger common carrier motor vehicles shall be223 designated by appropriate signs. A service fee may be imposed, in accordance with224 a schedule adopted by the City Council, under this section upon the operator of any225 such bus or other passenger common carrier motor vehicle for the privilege of using226 such stop or stand; provided, however, that nothing herein contained shall be deemed227 to affect in any manner the provisions of Chapter 55 of this Code.228 (6) Determine and designate certain streets as "through streets" and229 promulgate, adopt and amend schedules naming such streets. When such230 determination is made, the Transportation Engineering Bureau Chief Division231

Manager or his designee shall place and maintain a traffic-control device on each and232 every street intersecting such "through street" or that portion thereof described and233 designated as such.234 (7) Determine and designate where particular hazards exist at intersections235 with other than through streets and require that vehicles shall stop or yield at one or236 more entrances to any such intersection, by a stop or yield sign, or in the event he237 determines that reduced speed rather than a stop is adequate for safe operation at238 any such intersection, he shall determine such safe speed by engineering239 investigation, and shall provide signs upon the approaches to such intersection giving240 notice of such speed.241 (8) Mark and maintain lanes or zones for traffic on streets at such places as242 he may deem advisable for safety and for expediting traffic, either vehicular or243 pedestrian.244 (9) Determine those intersections and other locations at which drivers of245 vehicles shall not make a right, left, or "U" turn, and shall place proper signs at such246 intersections or locations.247 (10) Issue a special permit for specific vehicles to be operated, driven or248 parked on Wall Street between Orange Avenue and Court Street subject to certain249 terms and conditions as specified in the permit if, in the Transportation Engineering250 Bureau Chief's Division Manager’s determination, such privilege is reasonably251 necessary in the conduct of an abutting property owner's business or for a special252 event or circumstance, and such privilege will not create an unreasonable safety253 hazard.254 (11) Recommend geometric improvements to roadways and intersections to255 improve traffic flow and safety and implement or test such improvements to correct256 traffic safety hazards.257 (12) Implement truck routes, through truck restrictions and weight limit258 restrictions for City maintained roadways and intersections, as determined by259 engineering studies. All recreational vehicles/trailers shall be exempt from weight limit260 restrictions.261 (13) For streets outside the Downtown Area Parking Division Downtown262 District, the Transportation Engineering Bureau Chief Division Manager shall263 determine the location of on-street freight loading zones and place and maintain264 appropriate signs indicating the same and stating the hours during which same are in265 effect. The Transportation Engineering Bureau Chief Division Manager shall not266 designate or mark any such zone upon special request of any person unless such267 person makes application for a permit for such zone and for two (2) signs to indicate268 the ends of each such zone.269 (14) Outside the Downtown Area Parking Division Downtown District, the270 Transportation Engineering Bureau Chief Division Manager shall determine and271 designate whether or not parking shall be allowed upon one or both sides of any272 street, the parking time or limitations or promulgate, adopt and amend schedules273

ORDINANCE NO. 2019-43 Page 8 of 29 Chapter 39 CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. designating parking limitations and shall erect, place and maintain signs, devices or274 markings giving notice thereof.275 (15) Coordinate with residential/neighborhood groups and associations any276 written request for a residential parking permit program, determined by field study as277 necessary, to regulate on-street parking in residential neighborhoods.278 (16) Install and maintain regulatory, warning and informational signing279 determined by the Transportation Engineering Bureau Chief Division Manager as280 necessary to maintain the safe and efficient movement of pedestrians, bicycles, and281 motor vehicles over City maintained right-of-way.282 (17) Review applications and other requests for use or closure of sidewalks,283 traffic lanes and streets, set conditions for same, and authorize or deny street, lane,284 or sidewalk use or closure accordingly. The fee for such use or closure authorization285 shall be established by Resolution of City Council. The Transportation Engineer shall286 determine the impact of events on adjacent sidewalks, traffic lanes and streets and287 shall require and authorize a street, lane, or sidewalk closure if such impact would288 necessitate closure in order to assure the safety of vehicular and/or pedestrian289 movement in the area. The Transportation Engineer shall also recommend approval290 or disapproval of, or modification to, proposed plans affecting City-maintained right-291 of-way. The Transportation Engineering Bureau Chief Division Manager shall292 determine the appropriate manner to maintain traffic through detours, signs,293 barricades, temporary pavement markings, traffic signal control modifications and the294 use of law enforcement officers.295 For the purpose of this section, the term "closure" shall mean and include296 erection of barricades and appropriate signage to divert traffic for a specified length297 of time. The term shall not include a "roving roadblock" which occurs when police298 officers temporarily block a roadway for a short period of time.299 (18) Review all construction plans and building permits with existing or300 proposed pedestrian or vehicular access on or across the public right-of-way for301 compliance with applicable codes and standards for access management and issue302 variances from standards when justified by physical constraints or engineering study.303 Sec. 39.09. - Regulations, Schedules, Permits, etc., Subject to Review by304 Council.305 All rules, regulations, orders, schedules, permits or determinations of, or306 made or issued by, the Transportation Engineering Bureau Chief Division Manager307 may, at any time, be revoked, modified, suspended or reinstated by the City Council.308 SECTION 4. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE309 AMENDED. Chapter 39, Article IV, Code of the City of Orlando, Florida, is hereby310 amended as follows:311 ARTICLE IV. – PARKING BUREAU DIVISION.312 Sec. 39.10. - Office Established; Appointment.313

The Parking Division314 Manager Bureau Chief shall be appointed by the Mayor and shall exercise the powers315 and duties as provided in this Chapter under the direction of the City Public Works316 Transportation Director.317 Sec. 39.11. - Duties Generally.318 (1) It shall be the general duty of the Parking Bureau Chief Division Manager319 to determine the installation, rates and location of parking meters or the use of parking320 meter technology; the operation of on-street and off-street parking facilities; and to321 formulate programs and policies regarding rate changes, enforcement, and service322 levels to meet current and future municipal parking needs and the improvement of323 parking methods and options.324 (2) In the Downtown Area Parking Division Downtown District, the Parking325 Bureau Chief Division Manager shall determine the location of on-street freight326 loading zones and place and maintain appropriate signs indicating the same and327 stating the hours during which same are in effect. The Parking Bureau Chief Division328 Manager shall not designate or mark any such zone upon special request of any329 person unless such person makes application for a permit for such zone and for two330 (2) signs to indicate the ends of each such zone.331 (3) In the Downtown Area Parking Division Downtown District, the Parking332 Bureau Chief Division Manager shall determine and designate whether or not parking333 shall be allowed upon one or both sides of any street or within or upon off-street334 parking facilities; shall determine and designate the type, style and manner of on-335 street parking and parking within off-street parking facilities; and shall erect, place and336 maintain signs, devices or markings giving notice thereof.337 (4) In the Downtown Area Parking Division Downtown District, the Parking338 Bureau Chief Division Manager shall determine the parking time or limitations upon339 any on-street or off-street parking facility and promulgate, adopt and amend340 schedules designating such limitations, and erect, place and maintain signs, devices341 and markings giving notice thereof.342 Sec. 39.12. - Regulations, Schedules, Permits, etc., Subject to Review by343 Council.344 All rules, regulations, orders, schedules, permits or determinations of, or made345 or issued by, the Parking Bureau ChiefDivision Manager may, at any time, be revoked,346 modified, suspended or reinstated by City Council.347 SECTION 5. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE348 AMENDED. Chapter 39, Article V, Code of the City of Orlando, Florida, is hereby349 amended as follows:350 ARTICLE V. – STOPPING, STANDING AND PARKING351 DIVISION 1. - IN GENERAL352

ORDINANCE NO. 2019-43 Page 10 of 29 Chapter 39 CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. ****353 Sec. 39.14. - Parking of Vehicles Without Affixed Current and Valid354 Registration License Plate and Validation Sticker; Removing, Impounding and355 Immobilization of Vehicles Without Affixed Current and Valid Registration License356 Plate and Validation Sticker.357 ****358 (3) It shall be the duty of the parking enforcement specialist immobilizing such359 motor vehicle, or under whose direction such vehicle is immobilized, to post on such360 vehicle, in a conspicuous place, notice sufficient to inform the owner or operator of361 the vehicle that:362 (a) such vehicle has been immobilized pursuant to and by the authority of363 Section 39.14 of the Orlando City Code; and364 (b) the owner of such immobilized vehicle, or other duly authorized365 person, shall be permitted to repossess or to secure the release of the366 vehicle upon compliance with either of the following alternative367 procedures:368 (i) payment to the Parking Bureau Division of the City of Orlando of369 the fine prescribed in Section 39.68 of this Code for the offense of370 parking a vehicle without a current and valid registration license plate371 and validation sticker affixed to it; or372 (ii) request a hearing before a designated official concerning the373 validity of the issuance of the parking violation notice for the offense374 of parking a vehicle without a current and valid registration license375 plate and validation sticker affixed to it and provide the Parking376 BureauDivision of the City of Orlando with the owner's current and377 valid home address.378 (4) It shall be unlawful for anyone, except those persons authorized by the379 Parking Bureau ChiefDivision Manager, to remove or attempt to remove, tamper with,380 or in any way damage or alter the immobilization device.381 ****382 Sec. 39.16. - Stopping, Standing or Parking Prohibited in Specified383 Places.384 (1) No person shall stop, stand or park a vehicle, except when necessary to385 avoid conflict with other traffic or in compliance with the directions of a police officer386 or traffic-control device, in any of the following places:387 (a) On a sidewalk or in such manner that any part of such vehicle is388 protruding over a sidewalk or any part of the sidewalk area;389

(b) In front of a public or private driveway;390 (c) Within an intersection;391 (d) Within fifteen (15) feet of a fire hydrant;392 (e) On a crosswalk;393 (f) Within ten (10) feet of a crosswalk at an intersection, unless permitted394 to do so by appropriate signs or devices posted in such area;395 (g) Within thirty (30) feet of any flashing beacon, stop sign or other official396 traffic-control device located at the side of a roadway, unless the397 Transportation Engineering Bureau Chief Division Manager indicates a398 different length by signs or markings;399 (h) Between a safety zone and the adjacent curb or within thirty (30) feet400 of points on the curb immediately opposite the ends of a safety zone,401 unless the Transportation Engineering Bureau Chief Division Manager402 indicates a different length by signs or markings;403 (i) Within thirty (30) feet of the nearest rail of a railroad crossing;404 (j) Within twenty (20) feet of the driveway entrance to any fire station and405 on the side of a street opposite such station, if prohibited by a sign;406 (k) On a roadway side of any vehicle stopping or parked at the edge or407 curb of a street or on the roadway end of any vehicle parked at an angle408 to curb or street edge, except commercial vehicles engaged in loading or409 unloading from 2:00 a.m. to 7:00 a.m. only;410 (l) Upon any bridge or other elevated structure upon a highway or within411 a highway tunnel;412 (m) At any place where an official sign prohibits stopping, standing or413 parking;414 (n) Opposite a dead-end or jog street outside of the central business415 district;416 (o) At any place in such a manner as to block access to commercial refuse417 containers by the City of Orlando refuse removal equipment;418 (p) Alongside any curb which has been painted yellow or red, unless419 otherwise specifically permitted by appropriate signs or devices posted by420 the City;421 (q) In any parking space specifically designated and marked for persons422 with disabilities unless such vehicle displays a parking permit as required423

ORDINANCE NO. 2019-43 Page 12 of 29 Chapter 39 CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. by State Law; or in such a manner as to block or obstruct a wheelchair424 ramp;425 (r) In any parking space marked "Reserved" or "Assigned Personnel Only"426 unless such vehicle has affixed to the vehicle the appropriate permit427 issued by the Parking Bureau Chief Division Manager;428 (s) In a designated bus stop or taxicab stand unless the vehicle is a bus429 or taxicab, respectively;430 (t) If the vehicle is a commercial or recreational vehicle, upon the public431 streets or on or within privately owned driveways or property within all432 residential zoning districts or office zoning districts as defined by Chapter433 66 of this Code, except for loading or unloading purposes or when parked434 within a completely enclosed garage or as provided by Chapter 58 of this435 Code (effective December 1, 1995);436 (u) In a metered parking space which has been reserved with an official437 sign or covered by a bag placed thereon by Parking Bureau Division438 personnel and indicating no public parking;439 (v) In an area designated as a fire lane pursuant to Chapter 24 of the City440 Code;441 (w) On any property owned or controlled by the City of Orlando not442 designated for parking, unless otherwise approved by the Parking Bureau443 Chief Division Manager, City Council, or authorized City departments;444 ****445 Sec. 39.20. – Parking Prohibited at All Times or During Certain Hours. On446 Certain Designated Streets.447 When a sign is erected giving notice thereof, no person shall park a vehicle at448 any time upon any of the streets so signed. so designated and posted parking area,449 lot, street and/or right of way of the City or between the prohibited hours as designated450 and posted.451 ****452 Sec. 39.22. - Parking for Certain Purposes Prohibited.453 No person shall stand or park a vehicle:454 (1) Upon a public or private street, public parking lot or any other public455 property for the purpose and intent of displaying such vehicle thereon for sale, hire,456 or rental;457

(2) Upon any public or private street, public parking lot or any other public458 property for the purpose of painting, greasing or repairing such vehicle, except repairs459 necessitated by an emergency;460 (3) Upon any public or private street, public parking lot or any other public461 property for the purpose of washing or polishing such vehicle or any part thereof462 unless approved by the Parking Bureau Chief Division Manager;463 (4) Upon any public or private street, public parking lot or any other public464 property for the purpose of displaying advertising;465 (5) Upon any public or private street, public parking lot or any other public466 property for the purpose of selling merchandise from the motor vehicle, except in a467 duly established marketplace or when so authorized or licensed under the laws of the468 City.469 ****470 Sec. 39.25. - Same—Permit for Use of Freight Loading Zones.471 (1) The Parking Bureau Chief Division Manager (or designee) of the City shall472 issue to applicants, as hereinafter provided, permits which shall be effective October473 first through September thirty of the next succeeding year. Loading and unloading474 zone permits may be purchased after October 1 for a prorated fee, and such permits475 shall be effective until September thirty of the succeeding year unless purchased after476 December thirty-first in which case the permit shall be valid until September thirty of477 the same calendar year. Such permits shall be issued upon the payment of the478 applicable fees contained in the Schedule of Fees in Section 39.68 of this Code. A479 charge of ten dollars ($10.00) will be made for replacement of misplaced, lost or stolen480 permits.481 (2) The Parking Bureau Chief Division Manager (or designee) is further482 authorized to establish rules and regulations governing such designated freight483 loading and unloading zones, and the use thereof.484 (3) All applications for tag permits for the use of loading and unloading zones485 shall contain the following information:486 (a) Whether the applicant is a wholesaler, retailer, or common carrier;487 (b) The number of vehicles operated by the applicant;488 (c) The number of vehicles owned by the applicant which will carry loading489 and unloading permits;490 (d) The number of stops per day for loading and unloading purposes491 (average);492

(e) The name of business, type of business, location of business, mailing493 address and telephone number.494 (4) All applications will be submitted in writing to the Parking Bureau495 ChiefDivision Manager (Manager (or designee) of the City, and the Parking Bureau496 Chief Division Manager (or designee) shall have the authority to issue such permits.497 The applicant shall have the right of appeal to City Council.498 (5) Violation of any such terms and conditions shall be grounds for immediate499 revocation of the permit by the Parking Bureau ChiefDivision Manager who shall give500 written notice thereof to the holder of the permit. The permit holder may appeal such501 revocation to the City Council by filing a written notice of appeal with the City Clerk502 within seven (7) working days from the date of the revocation notice. Should the permit503 be revoked, any and all fees paid in advance shall be forfeited and retained by the504 parking system, subject to further action by City Council in the event of appeal.505 ****506 Sec. 39.27. - Parking on Parkways.507 ****508 (4) The prohibition contained in Subsection (2) shall not apply to parkway509 areas which have been officially designated and signed by the Transportation510 Engineering Bureau Chief Division Manager as permissible areas for parking when511 such is deemed to be in the public interest after review by the Transportation512 Engineering Bureau Chief Division Manager.513 Sec. 39.28. - Assignment of Parking Spaces in City Employee Parking514 Facilities; Public Use and Parking Time in Public Spaces at City Hall.515 ****516 (4) The Parking Bureau Chief Division Manager is directed to set aside517 parking spaces for City officials and employees in an appropriately designated parking518 facility. No person shall use any parking space in an appropriately designated parking519 facility designated for any other person. No person shall stop, stand or park a vehicle520 in any parking space designated for members of City boards unless such vehicle has521 affixed to said vehicle in an area designated by the Parking Bureau Division an522 appropriate permit or unless such vehicle has displayed in the front window a dated523 special parking authorization card issued by the Mayor or designee.524 Sec. 39.29. - Removal and Impounding of Illegally Parked, Abandoned or525 Disabled Vehicles—Authority of Police Department and Parking Bureau526 Division.527 Police officers, community service officers, and parking enforcement528 specialists of this City are hereby authorized to remove any vehicle from any street529 or other public property within the City, to a public garage or other place of safety,530 under the circumstances hereinafter enumerated:531

(1) When any vehicle is left unattended:532 (a) On a sidewalk;533 (b) In front of a public or private driveway;534 (c) Within fifteen (15) feet of a fire hydrant or in a fire lane;535 (d) Within an intersection;536 (e) On a crosswalk;537 (f) Between a safety zone and the nearest curb or within thirty (30)538 feet of points on the curb immediately opposite the ends of a safety539 zone, unless the Transportation Engineering Bureau Chief Division540 Manager has indicated a different length;541 (g) In a space designated for emergency vehicles only;542 (h) Within twenty (20) feet of a driveway entrance to a fire station and,543 if prohibited by a sign, on the side of a street opposite such station;544 (i) Alongside or opposite any street excavation or obstruction when545 stopping, standing or parking would obstruct traffic and is prohibited546 by sign;547 (j) At any place where official signs prohibit parking, stopping or548 standing and the vehicle is obstructing traffic or otherwise creating a549 safety hazard;550 (k) In a City off-street parking facility or parking meter zone for any551 period of time longer than twenty-four (24) hours or upon any552 particular street for a period of time longer than seventy-two (72)553 consecutive hours, unless during the seventy-two (72) hour period554 the vehicle has been removed from the particular street for a period555 of at least twelve (12) consecutive hours;556 (l) Upon any bridge, elevated structure, viaduct, causeway, tube or557 tunnel where such vehicle is obstructing traffic or otherwise creating558 a safety hazard;559 (m) In any space which has been officially reserved by a sign so560 indicating;561 (n) In a metered parking space which has been reserved by an official562 sign or covered by a bag placed thereon by Parking Bureau Division563 personnel and indicating "No Public Parking."564 ****565

Sec. 39.30. - Removing, Impounding and Immobilization of Vehicles566 Bearing Outstanding Citations.567 ****568 (2) If, after contacting the appropriate state agency which acts as custodian569 of vehicle registration and license tag records for the state from which the license tag570 attached to the motor vehicle was issued, the Parking Bureau Division is unable to571 determine the motor vehicle owner's address, the motor vehicle may be immobilized572 in accordance with the provisions of the preceding subsection (1), except it shall not573 be necessary for the Parking Bureau Division to mail Notice of Summons before the574 motor vehicle may be immobilized.575 (3) It shall be the duty of the parking enforcement specialist immobilizing such576 motor vehicle, or under whose direction such vehicle is immobilized, to post on such577 vehicle, in a conspicuous place, notice sufficient to inform the owner or operator of578 the vehicle that:579 (a) such vehicle has been immobilized pursuant to and by the authority of580 Section 39.30 of the Orlando City Code; and581 (b) the owner of such immobilized vehicle, or other duly authorized person,582 shall be permitted to repossess or to secure the release of the vehicle upon583 compliance with either of the following alternative procedures:584 (i) payment to the Parking Bureau Division of the City of Orlando of585 the applicable fee for removal of the immobilization device listed in586 Section 39.68 of this Code and all civil penalties for outstanding587 parking violation notices; or588 (ii) posting with the Parking Bureau Division of the City of Orlando of589 a cash or surety bond or other adequate security equal to the amount590 of the applicable fee listed in Section 39.68 of this Code. If, during the591 hearing on the outstanding parking violation notices which592 necessitated the immobilization of the vehicle, the City prevails on any593 or all of the outstanding violations, the cash or surety bond shall be594 forfeited to the City of Orlando.595 (4) It shall be unlawful for anyone, except those persons authorized by the596 Parking Bureau Chief Division Manager, to remove or attempt to remove, tamper with,597 or in any way damage or alter the immobilization device.598 ****599 Sec. 39.32. - Notice of Owner's Claim for Loss or Damage to Immobilized600 Vehicles.601 At the time of the release of a vehicle immobilized pursuant to Sections 39.14602 and 39.30 the owner of such vehicle or other duly authorized person, shall inspect the603 vehicle and shall give a receipt to the Parking Bureau ChiefDivision Manager or604

ORDINANCE NO. 2019-43 Page 17 of 29 Chapter 39 CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. designee reciting any claims he said owner or authorized person has for loss or605 damage to the vehicle.606 ****607 DIVISION 2. - PARKING METERS608 Sec. 39.34. - Designation of Parking Meter Zones by Parking Bureau609 ChiefDivision Manager.610 611 The Parking Bureau Chief Division Manager shall, from time to time, designate612 those certain described parts of public streets, public parking lots or any other public613 property streets for the installation of parking meters or use of parking meter technology,614 and the same shall be established as parking meter zones. The City Council shall have615 the right to rescind or change any such designation so made by the Parking Bureau616 ChiefDivision Manager.617 Sec. 39.35. - Legal Time Limits in Parking Meter Zones.618 The Parking Bureau ChiefDivision Manager shall designate and establish the619 legal time limit for parking in each designated parking meter zone. The Parking Bureau620 ChiefDivision Manager is authorized and empowered, whenever and wherever it621 appears to be in the public interest, to designate lesser periods of time as the legal622 time limit for any parking space in any parking meter zones in the City, and to change623 such designated periods from time to time as may appear in the best interest of the624 public for the proper regulation of traffic and parking; provided, however, that any such625 parking spaces so designated shall have the legal time limit thereof plainly marked626 and posted on the parking meter or within the parking meter technology applicable to627 each such parking space or on signs conspicuously placed within that parking meter628 zone; and provided further, that not less than ten (10) days prior to the effective date629 of any such designation or change of designation, one copy of each such designation630 or change of designation shall be furnished to the Chief of Police, and one copy shall631 be filed with the City Clerk where the same shall be available for inspection by the632 public. The City Council shall have the right to rescind or change any such designation633 or change of designation so made by the Parking Bureau ChiefDivision Manager.634 Sec. 39.36. - Installation, Operation and Maintenance of Meters;635 Collection, etc., of Revenue.636 (1) The Parking Bureau ChiefDivision Manager is hereby authorized, empowered637 and directed to install or cause to be installed parking meters, devices, timed parking638 systems or authorize the use of parking meter technology in parking meter zones639 established under authority of Section 39.34 of this Code, and to designate or cause to be640 designated in accordance with the provisions of this division parking meter spaces in such641 zones. Such Mechanical parking meters shall be placed alongside of or adjacent to642 individual parking spaces or conspicuously located within an off-street parking facility to643 be designated as aforesaid. For any parking meter zone or spaces where no mechanical644 parking meters are installed, the Parking Division Manager shall install signage in the area645 and visible from the parking spaces indicating that payment of the parking meter rates for646

ORDINANCE NO. 2019-43 Page 18 of 29 Chapter 39 CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. those spaces shall be made using parking meter technology, and indicating the procedure647 for using said technology.648 (2) The Parking Bureau ChiefDivision Manager shall provide for the regulation,649 control, operations and use of the parking meters provided for in this division and shall650 maintain such meters in good working condition.651 (3) The Parking Bureau ChiefDivision Manager shall provide for the652 administration, collection, safeguarding and accountability of all revenue derived from653 on and off-street parking meters; such revenue to be deposited as directed by the654 Chief Financial Officer.655 Sec. 39.37. - Hours and Days of Operation.656 Notwithstanding the authority of the Parking Division Manager as set forth in657 this Chapter, Pparking meters and parking meter technology as required by this658 division shall be in operation as follows:659 (1) On-Street Parking. From 8:00 a.m. to 6:00 p.m., daily, except Sundays and660 City holidays as designated in subsection (4) of this Section.661 (2) Off-Street Parking. In municipal parking facilities from 7:00 a.m. to 2:00662 a.m., daily, except Sundays and City holidays designated in subsection (3) of this663 Section; and except as set forth in subsection (5) for Orlando Centroplex Venues664 facilities; provided, however, that certain such off-street parking areas shall be in665 operation twenty-four (24) hours daily, including Sundays and City holidays666 designated in subsection (3) of this Section; and provided further, that the hours of667 operation in such twenty-four (24) hour off-street parking facilities shall be plainly668 marked and posted on the parking meters or by the parking meter technology or on669 signs conspicuously placed in such facilities or both.670 (3) The following days are hereby designated as City holidays on which671 parking meters and parking meter technology in on-street and off-street metered672 parking facilities are not in operation.673 (a) New Years Day—January 1;674 (b) Dr. Martin Luther King, Jr. Day—the third Monday in January;675 (c) Memorial Day—the last Monday in May;676 (d) Independence Day—July 4;677 (e) Labor Day—the first Monday in September;678 (f) Thanksgiving Day—the fourth Thursday in November;679 (g) Christmas Day—December 25.680

(4) Parking at Centroplex Orlando Venues Parking Facilities. Notwithstanding681 anything to the contrary contained herein, hours and days of operation of parking682 meters and parking meter technology, or the charging of parking fees for parking683 facilities under the control of, or used in conjunction with facilities under the control of,684 the Orlando Centroplex Bureau Venues shall be established by the Director of the685 Orlando Centroplex Chief Venues Officer. When so established, such hours and days686 of operation shall be plainly marked and posted at such parking facilities.687 Sec. 39.38. - Rates.688 The rates for parking meters and parking meter technology established by this689 division shall be determined and set by the Parking Bureau Chief Division Manager690 subject to the approval of City Council. Such rates shall be plainly marked and posted691 on the parking meters or by the parking meter technology, or on signs conspicuously692 placed in an off-street parking facility or both.693 Sec. 39.39. - Construction of Meters and Use of Parking Meter Technology.694 695 Parking meters shall be placed or set in such a manner as to show or display by a696 signal that the parking space regulated or controlled by such meter is legally in use.697 Parking meters installed shall indicate by proper legend parking time established by the698 City and when operated shall indicate by its dial or indicator the duration of the period of699 legal parking time and on the expiration of such period shall indicate illegal or overtime700 parking. When parking meter technology is in use, it shall notify the user and the parking701 enforcement officer of the legal parking time for which payment has been made, the702 balance of legal parking time and can notify the user when the legal parking time has703 expired.704 705 Sec. 39.40. - Marking of Spaces; Vehicles to be Parked Within Marked Lines.706 The Parking Bureau Chief Division Manager shall place or cause to be placed707 lines or markings upon the curb or upon the street adjacent to each parking meter, or708 on both, or upon the paved surface in an off-street parking facility, for the purpose of709 designating the parking space to which each such parking meter or parking meter710 technology appertains. It shall be unlawful for any person to park a vehicle outside of,711 alongside of, or adjacent to any such parking space unless the parked vehicle is within712 the lines defined.713 Sec. 39.41. – Deposit of Coin Funds and Operation of Meter Required;714 Exceptions.715 When any vehicle shall be parked in any space regulated or controlled by a716 parking meter in accordance with the provisions of this division, the operator of such717 vehicle shall, upon entering such parking space, immediately deposit or cause to be718 deposited in such parking meter or parking meter technology for such space, legal719 tender of the United States of America of the denomination and amount required as720 the rate or an approved device for such parking, depending upon the length of time721 during which it is desired to park such vehicle. Upon the deposit of such funds and722 the placing of such parking meter in operation, the parking space may be lawfully723 occupied by such vehicle during the period indicated on the meter. Such operator724

The failure to deposit such legal tender or approved726 device and place such meter in operation, or both, shall constitute a violation of this727 section and is declared to be unlawful.728 Sec. 39.42 - Use of Parking Space for Profit Prohibited.729 ****730 (2) Nothing in this section shall be deemed to prohibit the deposit of legal tender731 or an approved device in any parking meter and the placing of such meter in operation by732 a person other than the owner or operator of the vehicle using the metered parking space733 adjacent to such meter where the depositor thereof is making such deposit merely as a734 courtesy to a customer on behalf of any business not primarily in the business of furnishing735 parking facilities for profit.736 ****737 Sec. 39.45. - Meter Violation Overtime.738 739 It shall be unlawful for any vehicle to be placed or remain parked in any metered740 parking space beyond the time period allowed by the deposit of legal tender or an741 approved device. The parking meter or parking meter technology shall indicate expiration742 of time and, in that event, such vehicle shall be considered parked overtime and a citation743 may be issued. A subsequent citation may be issued for each violation of the time limits.744 provided on the legend of the meter.. It shall not constitute a defense to prosecution for745 violation of this section that, at the time the vehicle was parked, the meter registered746 unexpired time. Legal parking time is that amount of time afforded by the deposit of legal747 tender or approved devices.748 749 ****750 DIVISION 3. - OFF-STREET PARKING FACILITIES751 ****752 Sec. 39.50. - Designation and Marking of Areas.753 The Parking Bureau ChiefDivision Manager shall designate certain areas of754 such facilities for the parking of vehicles and the individual spaces to be used for755 parking by each permissible vehicle and such other areas as are necessary for the756 movement of motor vehicles into and from such designated parking areas. The757 Parking Bureau ChiefDivision Manager shall cause the various areas designated as758 above to be marked by visible markings, signs or signals necessary for the direction759 of drivers into the appropriate areas of the parking facilities.760 Sec. 39.51. - Use Restricted to Parking and Incidents Thereof.761

No person shall at any time operate or park a vehicle on any City off-street762 parking facility for any purpose other than parking purposes and the necessary driving763 on such facility required of the operator of any vehicle in entering and leaving such764 facility in connection with the use of the facility as a parking area; provided, however,765 the Parking Bureau Chief Division Manager may reserve or set aside a facility, or766 portion thereof, for a special event.767 ****768 Sec. 39.59. - Rates.769 (1) The rates to be charged and paid for the use of the off-street parking770 facilities shall be determined and set by the Parking Bureau ChiefDivision Manager771 subject to the approval of City Council, except as otherwise provided herein. The rates772 to be charged and paid for the use of the off-street parking facilities under the control773 of the Orlando Centroplex BureauVenues shall be determined and set by the Director774 of the Orlando CentroplexChief Venues Officer, subject to the approval of the City775 Council.776 (2) The Director of the Orlando CentroplexChief Venues Officer shall have the777 authority to waive or modify the rates established pursuant to subsection (1) if such is778 deemed to be in the best interests of the City and after due consideration of the779 following:780 (a) Nature of a specific event;781 (b) Expected/anticipated attendance at the event;782 (c) Time and duration of the event;783 (d) Necessity for the orderly flow of pedestrian and/or vehicular traffic in784 and around the CentroplexOrlando Venues sites;785 (e) Necessity for parking in order to facilitate the efficient staging of events786 at CentroplexOrlando Venues facilities;787 (f) Cost effectiveness of maintaining attended parking for an event;788 (g) Support of the marketing efforts for Centroplex Orlando Venues789 facilities;790 (h) Direct participation by the City in the event under consideration.791 ****792 Sec. 39.61. - Permit Parking.793

Where appropriate signs are erected giving notice thereof, it shall be unlawful to794 park, stop, or stand a vehicle in a place designated for parking by permit only, unless such795 vehicle has a permit issued by the Parking Bureau Chief Division Manager or his designee.796 Sec. 39.62. - Liability for Payment of Parking Ticket Violations.797 Under authority of Florida Statutes ch. 316, the owner of a vehicle is responsible798 and liable for payment of any parking violation under this Chapter unless the owner can799 furnish evidence that the vehicle was, at the time of the parking violation, in the care,800 custody, or control of another person. In such instances, the owner of the vehicle is801 required, within a reasonable time after notification of the parking violation, to furnish to802 the Parking Bureau Chief Division Manager or his designated assistant, the name and803 address of the person or company who leased, rented, or otherwise had the care, custody,804 or control of the vehicle. The owner of a vehicle is not responsible for parking violations if805 the vehicle involved was, at the time, stolen or in the care, custody, or control of some806 person who did not have permission of the owner to use the vehicle. Prima facie evidence807 that the vehicle involved was, at the time, stolen or in the care, custody, or control of some808 person who did not have permission of the owner to use the vehicle, shall be in the form809 of a report from the appropriate law enforcement official that the said vehicle was not under810 the care, custody, or control of the owner of the vehicle.811 ****812 Sec. 39.64. - Permit Parking Areas, Permits and Cards—Designation.813 (1) The Parking Bureau Chief Division Manager is hereby authorized to designate814 areas in City off-street parking facilities for parking by permit only and to issue parking815 permits and cards which shall entitle the purchaser thereof to park authorized motor816 vehicles bearing such a permit or card in such designated areas on a non-exclusive basis.817 818 (2) The Parking Bureau Chief Division Manager is further authorized to establish819 rules and regulations governing such designated permit areas and the use thereof.820 821 (3) The Parking Bureau Chief Division Manager is hereby authorized to establish822 various parking permit programs for parking at downtown off-street parking facilities which823 may include, but not be limited to, monthly permits, annual permits, group permits, and824 such other special classes of permits as the Parking Bureau Chief Division Manager may825 from time to time designate. The Parking Bureau Chief Division Manager is also826 authorized to issue parking permits and cards which shall entitle the purchaser thereof to827 park authorized motor vehicles bearing such permit or card in such off-street parking828 facilities as allowed by the particular permit program.829 830 (4) The Parking Bureau Chief Division Manager is further authorized to establish831 rules and regulations governing the issuance of such permits and cards and the use832 thereof.833 Sec. 39.65. - Same—Application for Parking Permit; Conditions; Fee.834 (1) Application for a parking permit shall be made to the Parking Bureau Division835 on a form provided by that section.836

ORDINANCE NO. 2019-43 Page 23 of 29 Chapter 39 CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. 837 (2) The application and the rules and regulations promulgated under authority of838 Section 39.64 shall set forth the terms and conditions of the parking privileges granted839 under the permit parking program.840 841 (3) Violation of any such terms and conditions shall be grounds for immediate842 revocation of the parking permit by the Parking Bureau Chief Division Manager who shall843 give written notice thereof to the holder of the permit. The permit holder may appeal such844 revocation to the City Council by filing a written notice of appeal with the City Clerk within845 seven (7) working days from the date of the revocation notice. Should the permit be846 revoked, any and all fees paid in advance shall be forfeited and retained by the Parking847 BureauDivision, subject to further action by City Council in the event of appeal.848 849 (4) The Parking Bureau ChiefDivision Manager is hereby authorized to establish850 rates for permit parking authorized in Section 39.64 as he shall from time to time851 determine, and such rates shall become effective upon approval by the City Council of852 Orlando.853 (5) Upon completion and approval of the application and payment of the fee, a854 parking permit shall be issued for use on each motor vehicle described in the855 application, which permit shall only be valid for and utilized in the appropriate off-street856 parking facility and for the time period indicated.857 Sec. 39.66. - Same—Parking in Designated Area.858 (1) It shall be unlawful for any person to park a motor vehicle in an area designated859 for permit parking only, unless said vehicle has properly affixed to it, in accordance with860 the Rules and Regulations promulgated by the Parking Bureau Chief Division Manager861 governing parking in designated permit areas, a current parking permit issued for use on862 that vehicle for that particular off-street parking facility.863 864 (2) Any person violating the provisions of Subsection (1) shall pay the civil penalty865 as prescribed in Section 39.68 of this Code.866 867 ****868 SECTION 6. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE869 AMENDED. Chapter 39, Article VI, Code of the City of Orlando, Florida, is hereby870 amended as follows:871 ARTICLE VI. - FEES, PENALTIES AND PROCEDURES872 Sec. 39.68. - Schedule of Loading and Unloading Zone Tag Permit Fees, Civil873 Penalties for Parking Violations, and Fee for Removal of an Immobilization Device.874 (1) There is hereby adopted the following schedule of fees for the875 acquisition of the first and additional loading and unloading zone tag permits for which876 payment may be made at the Parking BureauDivision in accordance with Section877

Failure to pay the civil penalty as894 prescribed in Subsection (2) or to request a hearing within fourteen (14) calendar days895 of the issuance of the parking violation notice will result in the imposition of a896 delinquent fee of fifteen dollars ($15.00).897 (b) Any person electing to appear before the designated official shall be898 deemed to have waived his right to pay the civil penalty as set forth in Section899 39.68(2). The designated official, after a hearing, shall make a determination as to900 whether a violation has been committed. If the commission of a violation has been901 proven, the designated official may impose a fine not to exceed one hundred dollars902 ($100.00) plus court costs; provided, however, that for a violation of Florida Statutes903 § 316.1955 or 316.1956, or for a violation of City Code Section 39.16(q), the904

ORDINANCE NO. 2019-43 Page 26 of 29 Chapter 39 CODING: Words stricken are deletions; words underlined are additions; **** denote omitted text. designated official may impose a fine not to exceed two hundred and fifty dollars905 ($250.00) plus court costs.906 (6) If an individual who has received a parking violation notice for parking a907 motor vehicle in a parking space, the proper use of which requires a specific permit908 or decal, appears at the offices of the Parking BureauDivision within fourteen (14)909 calendar days of the date of such notice and furnishes proof that the required permit910 or decal was issued to such motor vehicle and that such permit or decal was valid911 prior to the time of the violation, the Parking BureauDivision may reduce the civil912 penalty authorized by Section 39.68(2) to five dollars ($5.00).913 (7) A fee of one hundred dollars ($100.00) is hereby imposed for removal of914 an immobilization device placed on a vehicle pursuant to Sections 39.14, 39.29 and915 39.30 of this Code.916 (8) To the extent permitted by the policies and procedures of the City, the917 Parking Bureau ChiefDivision Manager shall have the authority to dismiss parking918 violation notices and/or waive delinquent fees set forth in Section 39.68(5)(a);919 provided, however, that such dismissal and/or waiver shall be appropriately920 documented with the reason(s) for dismissal or waiver placed in writing in the921 designated files that bear the parking violation notice's citation number.922 Sec. 39.69. - Procedures upon Non-Compliance with Parking Violation923 Notice.924 (1) The Parking BureauDivision shall accept payment of civil penalties for parking925 violations and issue receipts for such payments. The Parking BureauDivision shall926 maintain a record of such civil penalties and shall daily report the monies collected and927 deposited in the City's depository bank to the City Comptroller.928 929 (2) If any person summoned by a parking violation notice affixed on a motor930 vehicle does not respond to such notice within fourteen (14) calendar days, the Parking931 BureauDivision shall assess the fifteen dollar ($15.00) delinquent fee per violation against932 the registered owner of the motor vehicle as prescribed in Section 39.68(5)(a) of this Code,933 and a Notice of Summons shall be sent, by mail, to the registered owner of the motor934 vehicle which was cited, informing such owner of the parking violation notice and the935 failure to comply therewith. Such notice shall direct the recipient to respond within ten (10)936 calendar days; otherwise, a Summons may be issued for failure to comply in violation of937 Section 39.70(1) of this Code.938 939 ****940 941 Sec. 39.70. - Failure to Obey Notice; Alteration or Destruction of Notice942 Prohibited.943 944 (1) It shall be unlawful for the responsible party, as defined in Section 39.62 of945 this Code to neglect to answer to the charge set forth in a parking violation notice affixed946 to a motor vehicle by a police officer, community service officer, parking enforcement947 specialist, or City Code inspector.948 949

(2) The notice referred to in Subsection (1) of this section is and shall remain the950 property of the City before and after the serving, delivery or affixing thereof. All persons951 receiving any such notice in writing, whether by personal service or by affixing the same952 to a motor vehicle, shall be and are hereby required to preserve such notice and to bring953 and present or otherwise transmit the same to the Parking BureauDivision when954 answering the charge set forth in such notice.955 ****956 Sec. 39.73. - Parking Violation Information to be Furnished to State957 Department of Highway Safety and Motor Vehicles.958 The Parking BureauDivision is hereby authorized and directed to supply the959 State of Florida Department of Highway Safety and Motor Vehicles with a listing of960 persons, in a State Department of Highway Safety and Motor Vehicles approved961 communications format, who have three (3) or more outstanding parking violations or962 one (1) or more parking violation(s) of Florida Statutes § 316.1955 or Florida Statutes963 § 316.1956, or any City ordinances which regulate similar parking in spaces for964 persons who have disabilities.965 SECTION 7. CHAPTER 39, ORLANDO TRAFFIC AND PARKING CODE966 AMENDED. Chapter 39, Article VII, Code of the City of Orlando, Florida, is hereby967 amended as follows:968 ARTICLE VII. - CRUISING CONTROL969 Sec. 39.75. - Same—Definitions.970 For the purpose of this Article, the following definitions shall apply:971 ****972 (5) Traffic Control Point. A clearly identified reference point on a designated973 street, as determined and marked by an "official traffic control device" posted at the974 direction of the Transportation Engineering Bureau ChiefDivision Manager or his975 designee.976 (6) Official Traffic Control Devices. All signs, signals, markings, and devices977 placed or erected by authority of a public body or official having jurisdiction for the978 purpose of regulating, warning, or guiding traffic.979 (7) Restricted Hours. The days and times that cruising is prohibited,980 specifically between the hours of 7:00 p.m. and 4:00 a.m., on any day.981 (8) Restricted Area. Those streets or roadways designated by The982 Transportation Engineering Bureau ChiefDivision Manager as a "No Cruising Area"983 and that are within that area of the City of Orlando bounded on the north by Colonial984 Drive, on the south by Anderson Street, on the west by Hughey Avenue, including the985

Church Street garage, and on the east by Rosalind Avenue south of Livingston Street986 and Magnolia Avenue north of Livingston Street.987 ****988 Sec. 39.81. - Same—Designation of Streets.989 The Transportation Engineering Bureau Chief Division Manager is authorized990 to designate a public street or roadway as a designated street or "No Cruising Area"991 based upon a prior determination that a state of congested traffic is likely to occur992 during the restricted hours. Such designation shall include any portion of the street or993 roadway within which the congested traffic condition is likely to exist. Upon the994 designation of a street or roadway as a designated street or "No Cruising Area," the995 Transportation Engineering BureauDivision shall post or cause to be posted notices996 to the public to such effect, and shall establish one or more traffic control points to997 identify the vehicles being operated upon the designated street.998 SECTION 8. CODIFICATION. The City Clerk and the City Attorney shall cause999 the Code of the City of Orlando, Florida, to be amended as provided by this ordinance1000 and may renumber, re-letter, and rearrange the codified parts of this ordinance if1001 necessary to facilitate the finding of the law.1002 SECTION 9. SCRIVENER’S ERROR. The City Attorney may correct scrivener’s1003 errors found in this ordinance by filing a corrected copy of this ordinance with the City1004 Clerk.1005 1006 SECTION 10. SEVERABILITY. If any provision of this ordinance or its application1007 to any person or circumstance is held invalid, the invalidity does not affect other provisions1008 or applications of this ordinance which can be given effect without the invalid provision or1009 application, and to this end the provisions of this ordinance are severable.1010 1011 SECTION 11.
