PROFESSIONAL EXPERIENCE
EMPLOYMENT LITIGATION
• Manage single, multiple plaintiff and class action employment litigation matters including wrongful termination,
discrimination, harassment, retaliation, wage and hour, breach of contract,trade secret disputes,and otheremployment
claims in both state and federal court.
• Conduct and manage all phases oflitigation including: drafting of pleadings and written discovery; case analysis and
preparation of litigation strategy; taking and defending fact and expert depositions,including taking of plaintiff depositions
and defending individual defendant depositions; drafting and arguing discovery motions, motions to compel arbitration,
and motions for summary judgment; negotiating and preparing settlement agreements; and conducting mediations and
settlement conferences.
• Represent employers before administrative agencies including the California Department of Fair Employment and
Housing, the California Division of Labor Standards Enforcement and the Equal Employment Opportunity Commission;
investigate and respond to charges or complaints, and participate in mediation, arbitration and settlement of such matters.
• Train, supervise and mentor associates; manage large discovery teams; coordinate numerous expert witness opinions;
coordinate trial preparation; draft pretrial pleadings.
Representative Engagements
• Successfully obtained summary judgment in several single plaintiff lawsuits on behalf of Kaiser Foundation Hospitals
(and other Kaiser-related entities).
• Successfully moved to compel the enforcement of First Republic Bank’s employee arbitration agreement, which was
upheld on appeal and has served to clarify conflicting lower court holdings.
• Successfully defended Lowe’s Home Improvement Inc. in several single-plaintiff harassment and discrimination
lawsuits.
• Defended Chili’s Restaurant in wage and hour misclassification class action; interviewed and prepared declarations of
putative class members to defeat class certification.
• Assisted in successfulrepresentation of Nektar Therapeutics in Sarbanes-Oxley whistleblower suit.
EMPLOYMENT COUNSELING
• Advise clients on all aspects ofemployment law, including: compliance with state and federal anti-discrimination and
harassment laws; disability accommodation and family/medical leaves; WARN compliance; wage and hour laws
(including overtime requirements, exemptions, and other wage and hour compliance requirements); disciplining and
terminating employees and other adverse employment decisions; administering leaves of absence; non-competition and
non-solicitation agreements; and the treatment of trade secrets and other confidential and proprietary information under
state and federal law.
• Draft and review employee handbooks,personnelpolicies, confidentiality and other employment related agreements.
OTHER LITIGATION EXPERIENCE
• Represented plaintiffs and defendants in a variety of substantive areas including commercial claims, contract actions,
intellectual property disputes,patent actions,securities actions,internal investigations,and complex commercial litigation ,
including matters involving foreign parties.
• Performed all aspects of discovery and motion practice including: taking and defending both fact and expert witness
depositions; drafting and arguing motions in court; conducting legal research and drafting briefs; managing junior
associates and contract attorneys; participating in mediations and negotiations; and working closely with exp ert witnesses.
Representative Engagements
• Assisted in the successfulrepresentation ofFujitsu Ltd. in a large multi-party contract dispute concerning defective
semiconductor chips sold to Fujitsu.
• Assisted in the successfulrepresentation ofBehr Process Corporation (and its corporate parent, Masco Corporation) as
National Coordinating Defense Counsel in multiple state and national class action lawsuits filed in Alabama, Alaska,
California, Illinois, New York, New Jersey, Oregon and Washington which alleged that exterior wood coatings failed
to retard mildew growth and ultraviolet light degradation.
