Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

krävs ett gediget förarbete i form av ett franchiseprojekt
där affärskonceptet är tydligt beskrivet och där
ansvarsområdena har fördelats på ett korrekt sätt.
Varje franchiseavtal är därefter anpassat till konceptet
och till aktörerna. Trots detta kan nedanstående
checklista fungera för att undvika att något område som
bör förhandlas om inte kommer med i ett slutligt avtal.

6. GEMENSAM IDENTITET OCH
FÖRHÅLLANDET TILL TREDJE MAN
Genom ett franchisesamarbete vill man skapa en illusion att
alla enheter ingår i ett och sammaföretag. Det finns därför
en skyldighet att agera under gemensam identitet.
Varumärken och andra kännetecken ägs dock av franchisegivaren samtidigt
som franchisetagarna hjälper till att vårda och att skydda identiteten.
Den andra sidan av sammamynt är att franchisegivare och
franchisetagare är juridiskt och ekonomiskt oberoende från
varandra och att ingen har fullmakt för den andre.
Båda har därför en skyldighet att markera oberoendet
utåt för att undvika missförstånd.

7. KONFIDENTIELL HANDBOK
OCH INFORMATION
Man kan inte beskriva hela affärskonceptet
och allt handhavande i franchiseavtalet.
Man inkluderar därför en Handbok som kan
sägas utgöra franchisekedjans hjärta.
Handboken omfattas av upphovsrätt
och utgör företagshemligheter.

8. UTVECKLING
Varje franchisekedja måste förnyas löpande
och utan utveckling stannar varje system.
Båda parter har en skyldighet att bidra till utveckling.
Franchisegivaren skall dock leda utvecklingen
och ansvara för utbildningen.

9. MARKNADSFÖRING
Det som kan göras med stordriftsfördelar bör ske centralt
som i storföretag. Marknadsföring är en sådan uppgift.
Om franchisetagaren får producera lokal
marknadsföring så bör den granskas av
franchisegivaren så att allt sker enhetligt.

10. EKONOMI OCH ADMINISTRATION
På samma sätt som i storföretag bör ekonomihanteringen
ske enhetligt för att skapa möjligheter för statistik.
Franchisetagaren har skyldighet att betala i
rätt tid. Detta gäller även till andra leverantörer
så att varumärket inte ”smutsas”.
I de fall där avgifterna baserar på omsättningen
är det naturligt att franchisegivaren har rätt
att granska franchisetagarens ekonomi.

11. AVGIFTER
För att möjliggöra driften av en franchisekedja så
betalar franchisetagarna avgifter till franchisegivaren.
De vanligast förekommande avgifterna är inträdesavgift,
serviceavgift, marknadsföringsavgift och transferavgift.

12. ÖVERLÅTELSE AV RÄTTIGHETER
Ingen skall vara bunden av en viss form för all framtid.
Därför förbehåller sig oftast franchisegivaren en
rätt att överlåta sina rättigheter till annan så länge
skydd för franchisetagarna har förbehållits.
På samma sätt bör franchisetagaren ha en
rätt att överlåta sina rättigheter, dock först
efter godkännande av franchisegivaren.
Franchisegivaren bör då applicera samma kriterier
som vid antagande av en ny franchisetagare.

13. AVTALETS FÖRTIDA
UPPHÖRANDE
Avtalet inom franchising är nästan undantagslöst
ett tidsbestämt avtal (ej tills vidare).
Ett sådant avtal upphör på en bestämd dag.
Vissa inträffade händelser kan dock innebära att ena
eller andra parten har rätt att säga upp avtalet i förtid.
Detta kan ske då ett minimiåtagande inte uppfylls,
då någon av parterna har begått avtalsbrott
eller vid dödsfall eller långvarig sjukdom.

14. REGLER EFTER AVTALETS
UPPHÖRANDE
Oavsett om avtalet upphör i förtid eller i rätt tid så skall
franchisetagaren avidentifiera sin enhet den dagen.
I vissa kedjor förekommer en återköpsrätt för
franchisegivaren avseende kedjans varor och inredning.
Parterna skall fortsatt iaktta lojalitet och sekretess
gentemot varandra och ofta gäller ett konkurrensförbud
på max 1 år så att franchisegivaren kan nyetablera
en ny franchisetagare på samma område utan risk för
att den tidigare franchisetagaren tar alla kunderna.

15. TOLKNINGSDATA
Liksom många andra avtal innehåller ett franchiseavtal
vissa bestämmelser som avser hur avtalet skall tolkas.
Man föreskriver t.ex. att tillägg och förändringar skall vara
skriftliga och att det skrivna dokumentet utgör hela avtalet,
dvs. att inga muntliga sidoöverenskommelser förekommer.
Skulle något hända som är utanför parternas kontroll,
sk force majeure så är detta en avtalsbefrielse.

16. AVTALSTID
Som tidigare nämnts så är franchiseavtal
tidsbestämda avtal.
Normalt löper de på 3 eller 5 år med en ev
förlängningsoption till franchisetagarens förmån.

17. TVISTELÖSNING
Tvister kan lösas i allmän domstol eller
skiljenämnd eller genom medling.

18. AVSLUTNING
Ett avtal av detta omfång och stora betydelse
för framtiden bör man inte kasta sig in i.
Franchisegivaren bör därför tillse att tillräcklig
tid har givits för franchisetagarens möjlighet
till överläggning med sakkunskap.
Man pratar ofta om en särskild tid att tänka
efter, en sk cooling off-period.

19. BILAGOR
För att avtalet inte skall tyngas av detaljer
särskiljer man vissa saker i bilagor.
Detta gäller framförallt Handboken men kan också avse
en karta över marknadsområdet och profilanvisningar.

För att avtalet skall bli ett enhetligt dokument
och med tanke på att det ska utgöra regelverket
för ett långvarigt affärsförhållande så bör avtalet
författas av en kunnig franchiseadvokat.
En ytterligare fördel med detta är att en advokat
inte bara har sakkunskapen utan också tar
ansvar för eventuella misstag och har en
ansvarsförsäkring som täcker eventuella skador.
