Agreement by beneficiary or heir to assign their interest. Particularly useful when purchasing an interest in real estate at discount during probate or other court proceedings.
1. ASSIGNMENT OF ENTIRE INTEREST IN ESTATE
This Agreement is entered into by and between Edward York, (hereinafter called "Assignor"
and Daniel Newton, (hereinafter called "Assignee").
RECITALS
A. Assignor as a heir to the estate of Donald York (hereinafter called “deceased”)
now deceased, whose last place of residence was 1502 Diamond Street Brooklyn, NY 11225,
and who died intestate on April 2, 2011; and
B. Assignor desires to assign his rights and interest to the deceased’s estate and
Assignee desires to purchase such rights and interests pursuant to the terms of this Assignment
Agreement.
NOW, THEREFORE, the parties agree:
1. For the sum of $6,500.00 from Assignee to Assignor, Assignor hereby assigns to Assignee the
Assignee's right, title and interest in the estate of the deceased.
2. Assignor warrants that the value of property due to him is at least $50,000.00, and agrees to
execute on demand any and all documents necessary or convenient to transfer to assignee all of
the interest in either the real or personal property of the deceased to which Assignee is entitled
by virtue of the death of the deceased.
3. Assignor acknowledges and agrees that he voluntarily assigned his interest in the deceased’s
estate and signed this Assignment Agreement with full knowledge that on signing this
Assignment Agreement and accepting the sum of $6,500.00 from Assignee Assignor will no
longer have any financial or monetary interest in the deceased’s estate except as provided for in
this Assignment Agreement.
4. Assignor warrants and represents that he is a child and an heir of the deceased and never
assigned or ever will assign his interest in the deceased’s estate except for this assignment to
Assignee pursuant to this Assignment Agreement and that Assignor will not attempt to sell,
market, or assign any portion of their interest or execute any other document purporting to
assign or convey any portion of their interest in the deceased’s estate to another party.
5. Assignor acknowledges and agrees and represents that, to his knowledge, the deceased did not
leave a last will and testament or other document conveying any portion of the deceased’s estate
and that Assignor is entitled to a present 1/5 interest in the deceased’s estate.

2. 6. Assignor acknowledges and agrees that Assignor will take all necessary steps, including but
not limited to supporting and assisting Assignee in every way possible with present or future
legal proceedings related to Assignee’s legal right to his interest in the deceased’s estate, within
his power and ability to assist, support and ensure that Assignee receives the assigned portion of
the deceased estate.
