Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

Administració comparec i com siga més procedent en dret MANIFESTE:
Que de conformitat amb l’article 12.1 del Reial Decret 320/1994, de 25 de febrer,
i en no estar conforme amb el relat dels fets descrits ni amb la sanció proposada
de la denúncia interposada com a conductora del . . . . . . . . . . . . . . . . . . . . ,
passe a evacuar el tràmit conferit en base a les següents:
AL·LEGACIONS
PRIMERA. DETERMINACIÓ DELS FETS.
En el present procediment sancionador es realitza la imputació d’uns fets que no
són prou exactes ni descriptius de la conducta realitzada, i és per això que per a
una millor determinació dels mateixos pose en coneixement de l’òrgan instructor
i del sancionador els fets tal i com van succeir realment:
El proppassat dia . . . . . . . . ., circulava per la carretera AP7 quan vaig trobar-me
un peatge al quilòmetre . . . . i vaig aturar el meu vehicle a la guixeta de
pagament manual. Després que la persona que es trobava a la guixeta del
peatge m’indicara l’import que havia d’abonar, vaig informar-la que m’adheria a
la campanya #novullpagar.

2. Seguidament aquesta persona va indicar-me que si no pagava l’import, no em
deixaria passar, i em va fer esperar una bona estona amb la barrera abaixada i
el senyal lluminós en la posició de color vermell, impedint que poguera avançar i
obstaculitzant-me el pas i el de la resta de vehicles que em seguien. Jo li vaig
oferir que apuntés la matrícula del meu vehicle i que em deixés prosseguir la
marxa, però aquesta persona es va negar tot dient-me que havien avisat als
agents de l’autoritat i que jo m’havia d’esperar al peatge.
Passada una bona estona, la persona treballadora del peatge, coincidint amb
l’arribada dels agents de l’autoritat, va obrir la barrera del peatge, però encara
mantenint el senyal lluminós en la posició de color vermell.
Així doncs, no és cert el fet denunciat, consistent segons la denúncia en “Parar
el vehículo obstaculizando la circulación, negándose a pagar el importe del
trayecto de autopista utilizado, permaneciendo estacionado en cabina de peaje,
creando retención .”
En primer lloc, perquè no em vaig comportar indegudament en la circulació en
cap moment, perquè vaig respectar totes les normes de circulació que em són
d’aplicació, i fins i tot em vaig aturar al peatge, com prescriu l’article 153 del
Reglament General de Circulació.
En segon lloc, perquè no vaig causar perill a les persones en cap moment. Em
vaig limitar a esperar les instruccions que em va donar la persona treballadora i
no vaig utilitzar la violència, ni vaig trencar la barrera, ni vaig forçar la marxa del
meu vehicle ni hi havia cap persona en les immediacions del meu vehicle que
hagués pogut estar en perill en cap moment.
I en tercer lloc, perquè no vaig ser jo qui va obstaculitzar un carril d’entrada al
peatge, ni vaig ser jo qui va obstruir la circulació d’altres vehicles sense causa
justificada. Va ser la persona treballadora del peatge qui, sense causa que ho
justifiqués, va optar per immobilitzar el meu vehicle al carril d’entrada al peatge,
tot i que podia perfectament apuntar el número de matrícula del meu vehicle i
deixar-me passar sense cap altra conseqüència.

3. Per tant, en virtut del principi de presumpció d’innocència que informa el
procediment sancionador, correspon a l’Administració provar la meua culpabilitat,
és a dir, provar que són certs els fets denunciats, així com l’element subjectiu de
l’injust del saber i voler cometre una infracció.
SEGONA. DETERMINACIÓ DELS PRECEPTES LEGALS I REGLAMENTARIS
APLICATS.
Una vegada determinats els fets objecte de denúncia, cal tenir en compte els
preceptes legals i reglamentaris en què es basa la sanció inicialment proposada,
i que són:
Real Decreto 1428/2003, de 21 de noviembre, por el que se aprueba el
Reglamento General de Circulación para la aplicación y desarrollo del texto
articulado de la Ley sobre tráfico, circulación de vehículos a motor y
seguridad vial, aprobado por el Real Decreto Legislativo 339/1990, de 2 de
marzo:
“Artículo 91. Modo y forma de ejecución.
1. La parada y el estacionamiento deberán efectuarse de tal manera que el
vehículo no obstaculice la circulación ni constituya un riesgo para el resto de
los usuarios de la vía, cuidando especialmente la colocación del vehículo y
evitar que pueda ponerse en movimiento en ausencia del conductor (artículo
38.3 del texto articulado).”
Doncs bé, la meua actuació en cap cas pot considerar-se que infringeix
l’establert a l’article citat anteriorment, perquè el dia dels fets denunciants, vaig
parar-me en compliment de l’article 153 del RGC, i ho vaig fer de manera que el
vehicle no obstaculitzava la circulació i no vaig entorpir indegudament la
circulació, ni vaig causar cap perill, perjudici o molèstia a les persones, ni danys
a béns.
El dia dels fets denunciats, la persona treballadora del peatge em va impedir
avançar, obstaculitzant-me el pas, per la qual cosa si el meu vehicle haguera

4. entorpit la circulació no hauria estat a causa de la meva actuació. En qualsevol
cas, al peatge on vaig ser retinguda, hi havia altres carrils i sortides de pagament
per la qual cosa en cap cas vaig entorpir la circulació.
TERCERA. DEGUT COMPLIMENT DEL REGLAMENT GENERAL DE
CIRCULACIÓ.
La meua actuació el dia dels fets denunciats no va incomplir cap norma de
trànsit.
L’article 91.1 del Reglament General de Circulació regula com realitzar les
parades i estacionaments.
La meua actuació el dia dels fets denunciats, no va incomplir cap de les
previsions de l’article 91.1 del RGC i en cap cas va ser la d’entorpir
indegudament la circulació. L’única raó per la qual el meu vehicle va estar aturat
al peatge, fou en primer lloc perquè el senyal R-200 del RGC obliga a aturar-se, i
en segon lloc, per la negativa de la persona treballadora del peatge a posar el
senyal lluminós en color verd. Així doncs, qui, en el seu cas, va obstaculitzar i
entorpir indegudament la circulació, fou la persona encarregada d’alçar la
barrera del peatge i posar el senyal lluminós en color verd.
El fet d’adherir-me a la campanya #novullpagar i no abonar el peatge no és en
cap cas constitutiu de la infracció de l’article 91.1 del Reglament General de
Circulació, que res diu sobre el fet de pagar o no el peatge, sinó únicament sobre
l’entorpiment de trànsit, que, si hi va ser, no va ser causat per mi, sinó per
l’obstacle que m’impedia avançar, responsabilitat de l’empresa concessionària
de l’autopista i propietària del peatge.
La persona treballadora del peatge podria haver apuntat la matrícula del meu
vehicle i deixar que continuara la marxa sense entorpir la circulació, i no ho va
fer, per la qual cosa no sóc jo la persona responsable dels fets denunciats.
En definitiva, la meua actuació el dia dels fets denunciats va ser totalment
respectuosa amb les normes de trànsit i per tant no és constitutiva d’infracció. Si
la conducta sancionada no és típica, ja que en cap moment pot subsumir-se en

5. la infracció sancionable especificada en la normativa citada anteriorment, ni en
una infracció de cap altra norma administrativa, no és possible imposar cap tipus
de sanció.
En cas que es dictés resolució sancionadora en el present procediment, es
vulneraria allò establert a l’article 25 CE, que estableix que ningú pot ser
sancionat per accions que en el moment de produir-se no constituïen infracció
administrativa, d’acord amb la legislació vigent en aquell moment.
Aquest principi constitucional està recollit en la Llei 30/92, de 26 de novembre,
en els seus articles 127 i ss.:
Article 129
Principi de tipicitat
“1. Només constitueixen infraccions administratives les vulneracions de
l'ordenament jurídic previstes com a tals infraccions per una llei, sense
perjudici del que disposa per a l'Administració local el títol XI de la Llei
7/1985, de 2 d'abril, reguladora de les bases del règim local.”
És per tot això que cal procedir a l’arxiu del present expedient administratiu
sancionador.
SISENA. RELACIÓ CIVIL PRIVADA ENTRES LES PARTS.
L’ús de l’autopista i el pagament del peatge és una relació contractual entre
l’empresa concessionària i l’usuari i per tant regulada pel dret civil.
Així doncs, l’impagament del peatge únicament podria considerar-se com un
incompliment d’una obligació contractual de caràcter privat entre les parts. I per
tant aquest incompliment únicament podria donar lloc a reclamacions de caràcter
civil.

6. L’impagament del peatge no era motiu suficient com perquè l’empresa
concessionària m’obstaculitzés el pas, l’obstaculitzés a la resta de conductors, i
paradoxalment m’imputés a mi la infracció d’entorpiment del trànsit.
A això cal afegir que un element que prova que l’impagament d’un peatge no pot
ser objecte de sanció perquè aquest fet no està regulat a l’ordenament jurídic
com a infracció, és que fins i tot les empreses concessionàries de les autopistes
admeten que el vehicle passe pel peatge sense pagar si el seu conductor signa
un reconeixement de deute amb la concessionària, constituint així el naixement
d’una obligació entre el conductor i la empresa concessionària. Però en cap cas
el conductor no pot ser denunciat per no pagar el peatge, perquè no hi ha cap
norma que n’establisca una sanció.
Si realment el fet de no pagar un peatge fos constitutiu d’infracció, ho seria
independentment del reconeixement de deute per part del conductor. De fet, des
que existeixen les vies de pagament, hi ha hagut conductors que, per múltiples
circumstàncies, no han pogut fer front al pagament de l’import del peatge, i amb
la simple signatura d’un document de reconeixement de deute, se’ls ha deixat
continuar la marxa sense ser denunciats. I aquest reconeixement de deute ha
comportat un temps d’espera que mai ha resultat en una obstrucció de la
circulació.
Per tant, la imputació d’una infracció únicament a aquells conductors que no han
reconegut un deute amb la concessionària, constitueix una manipulació de la
norma de trànsit i un frau de llei, perquè s’utilitza la norma únicament perquè un
tercer puga treure’n un benefici, en aquest cas, perquè l’empresa concessionària
de la via de peatge puga cobrar el peatge.
Tenint en compte aquestes consideracions, el funcionari/a o funcionaris/ries que
donaren cobertura a una resolució sancionadora en base als fets que es
denuncien, podrien ser presumptes autors/es d’un delicte de prevaricació
administrativa de l’article 404 del Codi Penal, castigat amb una pena
d’inhabilitació especial per a treball o càrrec públic de set a deu anys.

7. SETENA. VULNERACIÓ DEL PRINCIPI DE SEGURETAT JURÍDICA I DEL
DRET DE DEFENSA.
A tot l’exposat, és precís afegir una divergència de criteris: el Servei Català de
Trànsit, davant els mateixos fets, considera que s’infringeix l’article 153 del
Reglament General de Vehicles, però no l’article 91.1 del Reglament General de
Circulació. Així mateix altres prefectures provincials de trànsit consideren que
vulnera l’article 2 del Reglament General de Circulació.
Aquesta divergència de criteris provoquen una situació d’inseguretat jurídica al
ciutadà, que no pot conèixer si la seua actuació és o no objecte d’infracció i en el
seu cas, de quin tipus d’infracció i amb quin tipus de sanció aplicable.
La qualificació jurídica diferent d’un mateix fet suposa la vulneració del principi
de seguretat jurídica reconegut a l’article 9.3 CE, la qual cosa genera una
limitació del dret de defensa dels ciutadans i per tant la infracció de l’article 24
CE.
VUITENA. VULNERACIÓ DELS PRINCIPIS RECTORS DE L’ACTIVITAT DE
L’ADMINISTRACIÓ.
Una possible resolució sancionadora en el present expedient administratiu
sancionador vulneraria els principis rectors de l’activitat de l’administració, tals
com els previstos a l’article 3.1 i 5 de la Llei 30/1992, de 26 de novembre, que
estableix:
“1. Les administracions públiques serveixen amb objectivitat els
interessos generals i actuen d’acord amb els principis d’eficàcia, jerarquia,
descentralització, desconcentració i coordinació, amb submissió plena a la
Constitució, a la llei i al dret. Han de respectar, igualment, en la seva
actuació els principis de bona fe i de confiança legítima.”
“5. En les seves relacions amb els ciutadans, les administracions
públiques actuen de conformitat amb els principis de transparència i
de participació.”

8. NOVENA. SUBSIDIÀRIAMENT, MANCA DE PROPORCIONALITAT DE LA
SANCIÓ.
Subsidiàriament, en el supòsit improbable que no es tinga en compte la petició
d’arxiu del present expedient, i atès que la sanció proposada infringeix el principi
de proporcionalitat inherent al procediment administratiu sancionador i els criteris
de graduació de les sancions establerts a l’article 131 de la Llei 30/1992, de 26
de novembre, sol·licite que es reduïsca la sanció proposada.
L’actuació de l’òrgan sancionador ha de circumscriure’s als criteris objectius per
graduar correctament la sanció que s’ha d’imposar, per tal que no supose un
exercici incorrecte de discrecionalitat per part seua.
La justa proporcionalitat entre la sanció i les circumstàncies objectives i
subjectives concurrents a la infracció que se sanciona constitueix un principi
declarat reiteradament per la jurisprudència, l’aplicació de la qual, al dret
administratiu sancionador, no implica la substitució de les facultats
administratives, sinó simplement la correcció de l’excés legal que suposa
exercitar la discrecionalitat més enllà d’allò en què consisteixen els fets
determinants de l’acte administratiu, que són els que delimiten i acoten l’àmbit
propi dels poders discrecionals de la graduació de la sanció i assenyalen la
diferència entre el correcte exercici d’aquests i l’arbitrarietat (STS de 10 de juliol
de 1985).
Així doncs, cal procedir subsidiàriament a la reducció de la sanció proposada per
bé que el fet denunciat no implica cap tipus de perill per la seguretat del trànsit,
és totalment intranscendent i no pot considerar-se com a greu.
DESENA. PROPOSICIÓ DE MITJANS DE PROVA.
Per tal de demostrar les afirmacions anteriorment manifestades en aquest escrit,
i sense perjudici de les actuacions que es practiquen d’ofici per l’òrgan instructor
competent, es proposa la pràctica dels següents mitjans de prova:

9. - Testifical, consistent en la declaració d’en ........... amb domicili
a ........................., i de ........................, amb domicili a .................................,
com testimonis dels fets imputats, els quals poden donar raó dels fets
imputats pel seu coneixement directe, essent interrogats de la certesa dels
següents EXTREMS:
- Si el conductor/a d’aquest vehicle, el dia dels fets, va aturar-se davant
la guixeta del peatge citat.
- Si el conductor/a d’aquest vehicle, no va poder reiniciar la marxa del
seu vehicle perquè l’operador del peatge no va aixecar la barrera i
posar el senyal lluminós en color verd.
- Si el conductor/a d’aquest vehicle, el dia dels fets, va reiniciar la serva
marxa quan es va procedir a aixecar la barrera del peatge i el senyal
lluminós es trobava amb el disc verd.
- Ratificació de la persona denunciant per tal que es ratifique o en el seu cas
rectifique els fets que han motivat la iniciació d’aquest expedient, i determine:
1. Si la persona denunciada era la conductora del vehicle . . . . . . . . . .
amb matrícula . . . . . . .
2. Si aquest vehicle va procedir a aturar-se davant la guixeta del peatge.
3. Si el conductor/a d’aquest vehicle va pagar l’import del peatge.
4. Quin import corresponia pagar pel peatge al conductor/a d’aquest
vehicle.
5. Si el vehicle citat va reiniciar la marxa una vegada es va aixecar la
barrera del peatge i es va posar el disc del senyal lluminós de color
verd.
6. Si el possible entorpiment de trànsit fou motivat pel fet que hi havia la
barrera abaixada i/o el senyal lluminós en vermell, cosa que
impossibilitava avançar al conductor denunciat.
Per tot l’exposat,

10. DEMANE A AQUEST ORGANISME que tinga per presentat el present escrit,
l’admeta, i una vegada realitzats tots els tràmits processals oportuns, prèvia
pràctica de les proves proposades es dicte una RESOLUCIÓ ON S’ACORDE
L’ARXIU DE L’EXPEDIENT NÚMERO . . . . . . . . . . . . . . . iniciat o que
subsidiàriament en el supòsit de no estimar la petició d’arxiu formulada, es
reduïsca la sanció inicialment proposada per tal d’adequar-la al principi de
proporcionalitat de les actuacions administratives sancionadores, sense perjudici
dels recursos que aquesta part estime convenients.
ALTRESSÍ DIC que d’acord amb el dret d’accés als arxius i registres públics
establert a l’article 105 b) de la CE i que es troba materialitzat als articles 35 h) i
37 de la Llei 30/1992, que permeten l’accés a l’expedient administratiu, interessa
a aquesta part que es done trasllat de la denúncia i la resta de documentació
que forma part de l’expedient administratiu incoat contra meua, i per això
SOL·LICITE que es resolga d’acord amb l’anterior manifestació.
ALTRESSÍ SEGON DIC que pel cas, negat per qui subscriu, que no s’admeteren
les al·legacions precedents i es resolguera la imposició de sanció, interessa que
se suspenga el termini concedit per abonar l’import reduït de la sanció, de
manera que es reinicie el seu còmput a partir del dia següent a la notificació de
la hipotètica sanció.
Aquesta petició es formula en base als principis inherents al procediment
administratiu, així com de les garanties del procediment sancionador; així, es
preveu el dret a formular al·legacions (articles 35.e i 135 de la Llei 30/1992, de
Règim Jurídic de les Administracions Públiques i del Procediment Administratiu
Comú), dret que, en cap cas pot comportar un greuge econòmic per l’administrat,
i per això,
SOL·LICITE que es resolga d’acord amb l’anterior manifestació.
