This document discusses privilege for IP professionals in the Netherlands. It notes that there are no specific provisions for privilege in IP laws, and privilege is governed by general codes and case law. Statutory law only guarantees the right to refuse testimony in court. Traditionally, the Supreme Court awarded privilege to lawyers, physicians, notaries, and journalists. The Supreme Court takes an open approach and will consider privilege for other professions on a case-by-case basis if there is a legal obligation of confidentiality and the interests of confidentiality outweigh disclosure. Currently, lawyers admitted to the bar and possibly patent attorneys are guaranteed privilege, while in-house lawyers and other IP professionals are not.
