The CA dismissed a petition for certiorari filed by petitioners challenging the dismissal of their perjury complaint. The CA held petitioners should have appealed to the Secretary of Justice first. However, the Supreme Court ruled the CA gravely abused its discretion because under DOJ Department Circular No. 70-A, petitioners properly appealed to the ORSP after the OPP dismissal, and the ORSP ruling was final since the complaint was filed outside NCR and involved a crime within the jurisdiction of lower courts. Since the Secretary of Justice did not review the ORSP ruling, petitioners exhausted their administrative remedies and correctly filed a petition for certiorari with the CA. The Supreme Court granted the petition.
