mechanisms or measures to re-integrate into society individuals

dependence through sustainable programs of treatment and
rehabilitation.

passed by the Sangguniang Panlalawigan and the settlement of
boundary conflict between municipalities and other matters relative
to undertaking researches on file and providing assistance in coming
up with right opinion/stand on the matter.

privileges and discipline of government workers including their
benefits and incentives, all other matters relating to the bureaucracy
and/or government and investigation of misfeasance, malfeasance

employees.

Jurisdiction: All matters relating to the implementation of local laws, rules and
regulations, issuances and enforcement of local ordinances, review
of ordinances and resolutions submitted by lower level local
government units, legality of measures to be acted upon by the
Sanggunian as well as matters relating to human rights, and
prevention of human rights and violation, organization and
administration of justice, and other maters pertaining to the
efficiency and reforms on the prosecution service.

LEGISLATIVE OVERSIGHT COMMITTEE

Jurisdiction: All matters pertaining to committee inquiries and hearing, formal
consultation with and reports from the executive branch, on site
visits and actual inspections, sanggunian advice and consent of
certain executive nominations and contracts, informal meetings
between legislators and executive officials, sanggunian membership
on local special bodies and studies by sanggunian committees,
support agencies such as the local COA office, and academic
research institutions, conduct of inquiries on whether legislative
enactments are being implemented by the Executive Branch
through issuance of Executive Orders; determination of whether the
policies and programs are being implemented in accordance with
the legislative intent and performance of legislative functions other
than those specified in the House Rules for the existing
Sangguniang Panlalawigan Committee.
COMMITTEE ON PEACE AND ORDER AND PUBLIC SAFETY

WHEREAS, the newly elected and re-elected Members of the 19th
Sangguniang Panlalawigan
assumed to office as legislators of the Province of Surigao del Sur on July 1, 2019 and conducted their
Committee Meeting in pursuance to Section 26 of the SP House Rules;
WHEREAS, during the said Committee En Banc Meeting, the Body discussed and deliberated the
provisions of the SP House Rules of Procedures of the 19th
Sangguniang Panlalawigan as guide to ensure the
orderly conduct of the Sangguniang Panlalawigan’s sessions, meetings and other legislative activities and to
fulfill their functions, duties and responsibilities as legislative body of the province;
WHEREAS, Section 50 of the Local Government Code of 1991 provides that, “on the first regular
session following the election of its members and within ninety (90) days thereafter, the sanggunian
concerned shall adopt or update its existing rules of procedures”;
WHEREAS, in view of the foregoing;
BE IT ORDAINED BY THE SANGGUNIANG PANLALAWIGAN OF SURIGAO DEL SUR IN A SESSION
ASSEMBLED:
Section 1. There is hereby approved and adopted the House Rules of Procedures of the 19th
Sangguniang Panlalawigan of the Province of Surigao del Sur.
RULE I
MEMBERSHIP
Section 1. Composition. – The Sangguniang Panlalawigan shall be composed of the Provincial Vice
Governor as Presiding Officer, the Regular Members elected by the districts, the President of the Provincial
Chapter of the Liga ng mga Barangay, the President of the Panlalawigang Pederasyon ng mga Sangguniang
Kabataan, the President of the Philippine Councilors’ League, Surigao del Sur Chapter, and such Sectoral
Representatives as may be chosen pursuant to law.
In case of succession by operation of law, any appointed/new Member of the Sangguniang
Panlalawigan shall be officially recognized through a Resolution by the Sangguniang Panlalawigan.
Section. 2. Term of Office. – The term of office of the members of the Sangguniang Panlalawigan
shall be three (3) years, which shall commence on such date as may be provided by law.
Section 3. Oath of Affirmation. – All the members of the Sangguniang Panlalawigan shall, upon
assumption to office, take an oath of office or affirmation in the prescribed form duly subscribed before a
person authorized to administer oath.
Copies of the oath or affirmation of office shall be filed in prescribed form in the Office of the
Provincial Governor and Sangguniang Panlalawigan, copy furnished the Office of the President, the Secretary,
Department of the Interior and Local Government, and the Civil Service Commission.
RULE II
PRESIDING OFFICER
Section 4. The Presiding Officer. – The Vice Governor shall be the Presiding Officer of the
Sangguniang Panlalawigan. The Presiding Officer shall vote only to break the tie.

In the event of inability of the Vice Governor to act as Presiding Officer on account of a trip on
official business, leave of absence, sickness or any temporary incapacity, the members present constituting a
quorum, shall elect from among themselves a Temporary Presiding Officer who shall hold office two days after
session preferably Thursday and Friday to sign legislative and/or official documents transacted by the
Sangguniang Panlalawigan during the Regular Session over which he temporarily presided.
The Temporary Presiding Officer shall be allowed to vote in case of tie. He shall certify within ten
(10) days from the adoption all ordinances and resolutions enacted or adopted by the Sangguniang
Panlalawigan.
Section 4.1. Powers and Duties of the Presiding Officer. – The Presiding Officer shall:
4.1.a. preside over sessions of the Sangguniang Panlalawigan;
4.1.b. preserve order and decorum during session and, in case of disturbance or disorderly
conduct in the session hall or within the premises, take measures as he may deem
advisable or as the majority or the Sangguaniang Panlalawigan members may direct;
4.1.c. decide on all questions or orders, subject to appeal by any Sangguniang
Panlalawigan Member in accordance with this Rules;
4.1.d. sign all acts, ordinances, resolutions, memorials, writs, warrants and subpoenas
issued by, or upon order of the majority of the Sangguniang Panlalawigan Members;
4.1.e. be a chairman of any standing committee and shall have a voice in all committee
deliberations. He may also be a chairman of any special or ad hoc committee which
the Sangguniang Panlalawigan may organize for specific purpose; and
4.1.f. exercise such other powers and perform such other functions as may be provided by
law, ordinance or regulation.
Section 5. Floor Leader. – The Floor Leader shall be either elected by a majority of all the
members of the Sangguniang Panlalawigan or appointed by the Vice Governor upon authority given by the
majority of all members of the Sangguniang Panlalawigan.
Section 5.1. Powers and Duties of the Floor Leader - The Floor Leader shall:
5.1. a. guide the proceedings during Committee Meetings and Sessions to achieve order,
civility and decorum;
5.1.b. in consultation with the Presiding Officer and in coordination with the Secretary to
the Sangguniang Panlalawigan, be responsible for the preparation of the agenda
for each session;
5.1.c. pass upon and approve all items to be calendared in the Order of Business for delib-
eration and action by the sanggunian;
5.1.d. perform such other duties as the Sanggunian may from time to time assign to him/
her; and
5.1.e. exercise the power to vote in all committees where he is an Ex-Officio Member.

RULE III
SECRETARY TO THE SANGGUNIANG PANLALAWIGAN, ASSISTANT SECRETARY TO THE SANGGUNIANG
PANLALAWIGAN AND SUPPORT STAFF
Section 6. The Secretary to the Sangguniang Panlalawigan. – There shall be a Secretary to the
Sangguniang Panlalawigan who shall be appointed by the Vice Governor with the concurrence of the
Sangguniang Panlalawigan in accordance with the Civil Service Law, Rules and Regulations, and whose
compensation, allowances and other emoluments shall be prescribed by law or ordinance.
The Secretary to the Sangguaniang Panlalawigan shall:
a) attend sessions, meetings and hearings of the Sangguniang Panlalawigan and keep journals
of its proceedings;
b) in coordination with the Presiding Officer and Committee Chairman, arrange and prepare all
sessions, meetings and hearings of the Sangguniang Panlalawigan and its Committees;
c) record in a book kept for the purpose, all ordinances and resolutions enacted or adopted by
the Sangguniang Panlalawigan with the dates of their enactment and publication thereof;
d) keep the seal of the Local Government Unit and affix the same with his signature on all
ordinances and resolutions and other official acts of the sanggunian and present the same
to the Presiding Officer;
e) forward to the Governor for approval copies of the ordinances and resolutions enacted or
adopted by the Sangguniang Panlalawigan within ten (10) days after their enactment or
adoption;
g) attest to all ordinances and resolutions approved by the Sangguniang Panlalawigan and
signed by the Governor;
h) cause certain resolutions and ordinances passed to be published as provided by resolution
or ordinance;
i) upon request, furnish certified copies of all records and documents in his/her charge not
otherwise classified as confidential, upon payment to the Provincial Treasurer of the fees
prescribed by ordinance;
j) keep his office and all records therein which are not of confidential in character open to
public inspection during the usual business hours;
k) act as custodian of the provincial library and archives, if any, and annually account for the
properties therein;
l) exercise general supervision over the staff of the Sangguniang Panlalawigan; and
m) exercise such other powers and perform such other duties and functions as may be pre-
scribed by law or ordinance.

Section 7. The Assistant Secretary to the Sangguniang Panlalawigan. – In addition to the
Secretary to the Sangguniang Panlalawigan, the Sangguniang Panlalawigan shall have an Assistant
Secretary to the Sangguniang Panlalawigan who shall exercise the following functions and duties:
a) attend the sessions, meetings and hearings of the Sangguniang Panlalawigan and enter
in a minute book all proceedings therein;
b) assist the Secretary to the Sangguniang Panlalawigan in preparing the calendar of
sessions/hearings of the Sangguniang Panlalawigan and its Committees;
c) notify each member of the Sangguniang Panlalawigan of the schedule of every regular
and special session/hearing of the Sangguniang Panlalawigan as a body or committee
not only by written notices but also thru text messages one day before any scheduled
date and shall also inform, from time to time, the Sangguniang Panlalawigan Members
the status of resolutions and ordinances passed by the Sangguniang Panlalawigan;
d) proofread, finalize and prepare all ordinances and resolutions enacted by the
Sangguniang Panlalawigan for signature by the Presiding Officer to be attested by the
Secretary to the Sangguniang Panlalawigan;
e) keep and secure all records, papers, files and other properties of the Sangguniang
Panlalawigan committed to his charge;
f) supervise the Stenographic Reporters and Support Staff during sessions/hearings of
the Sangguniang Panlalawigan and its committees in the performance of their
functions and duties; and
g) perform such other duties as the Sangguniang Panlalawigan, its Committees and
Secretary to the Sangguniang Panlalawigan may from time to time, direct him to do.
Section 7-A. The Acting Secretary to the Sangguniang Panlalawigan. – The Assistant
Secretary to the Sangguniang Panlalawigan or any of the next ranking official of the Tanggapan ng
Sangguniang Panlalawigan designated by the Secretary to the Sangguniang Panlalawigan to act as
Acting Secretary to the Sangguniang Panlalawigan while the Secretary to the Sangguniang
Panlalawigan is on official leave of absence or on official business shall exercise the following
functions and duties:
a) attend the sessions, meetings and hearings of the Sangguniang Panlalawigan and enter
in a minute book all proceedings therein;
b) notify each member of the Sangguniang Panlalawigan of the schedule of every regular
and special session/hearing of the Sangguniang Panlalawigan as a Body or committee
and shall also inform, from time to time, the Sangguniang Panlalawigan Members of
the status of resolutions and ordinances passed by the Sangguniang Panlalawigan;
c) proofread and attest all ordinances and resolutions enacted by the Sangguniang
Panlalawigan, transcripts and minutes for signature by the Presiding Officer;
d) supervise the Stenographic Reporters and Support Staff during sessions/hearings of
the Sangguniang Panlalawigan and its committees in the performance of their
functions and duties; and
e) perform such other duties that the Sangguniang Panlalawigan and its committees
may, from time to time, direct him/her to do.

Section 8. Stenographic Reporters. – Every session or hearing of the Sangguniang
Panlalawigan and its Committees shall be attended by at least one (1) competent Stenographic
Reporter who shall perform the following duties:
a) record faithfully stenographic notes the proceedings during the session or hearing of
the Sangguniang Panlalawigan and its Committees;
b) at the close of every session or hearing, deliver immediately the stenographic notes
he/she has taken to the Assistant Secretary to the Sangguniang Panlalawigan who shall
initial all its pages and who shall indicate thereon the date of his/her receipt thereof;
c) upon demand of the Sangguniang Panlalawigan and its Committees, transcribe under
the supervision of the Assistant Secretary to the Sangguniang Panlalawigan the
stenographic notes he/she has taken; and
d) submit to the Sangguniang Panlalawigan transcript of proceedings every two weeks
for approval by the Body and providing penalty for violation thereof.
Stenographic Reporters found guilty of violating this Rule shall be dealt administratively
with the following sanctions:
1. First offense – Thirty (30) days suspension without pay;
2. Second offense – Six (6) months suspension without pay; and
3. Third offense – Dismissal from the service.
Section 9. Support Staff. – The Sangguniang Panlalawigan or any of its Committees may
require other employees or personnel of the Sangguniang Panlalawigan to assist during its sessions or
hearings or in the performance of its functions and duties.
RULE IV
SESSIONS
Section 10. Regular Sessions. – The Session of the Sangguniang Panlalawigan shall be every
Tuesday of every month to start at 9:00 o’clock in the morning. Provided, that two sessions shall be held in
District I, particularly in Tandag City, Surigao del Sur every first and third Tuesday of the month and in District
II, particularly in Bislig City, every second and fourth Tuesday of the month effective July 2, 2019. In cases
there are five sessions in a month, automatically the fifth or last session shall be held in the First District,
unless there is a resolution enacted providing that it will be held in the Second District. Any change in the
venue and schedule of the regular session shall be supported by a Resolution. In the absence of a Resolution,
if there are important matters that need immediate attention/action, the Vice Governor/Presiding Officer or
majority of the members may request for a change of venue and date of session. The Secretary to the SP shall
notify all the SP Members thru a call or written Notice of the Change of the Venue and/or schedule of the
regular session specifying therein the date, time and venue/place of the session and purpose.
However, if the scheduled regular session falls on a holiday, the Session shall be
automatically reset to the next working day of the week without need of a resolution for the purpose.
In case of a change in schedule and venue of the session, a notice shall be posted in conspicuous places
for the information of the public. The Committee Meetings and Regular Sessions shall commence on
the second week of January and in no case be held beyond the third week of December.
Section 11. Special Sessions. – As often as necessary, when the public interest so demands,
special sessions may be called by the Governor and the Presiding Officer or by a majority of the
members of the Sangguniang Panlalawigan and may be held in any municipality of the province.
In special sessions, a written notice to the Sangguniang Panlalawigan Members, specifying
the date, time, venue/place of the session and purpose shall be served personally or left with a
member of household of the Sangguniang Panlalawigan Member at his usual place or residence.
Unless otherwise agreed upon by two-thirds (2/3) vote of the members present, there being a quorum,
no other matter may be considered at a special session except those stated in the notice.

Section 12. Call to Order. – When the appointed time to start the session has come, the
Presiding Officer shall call the session to order while he is still standing by rapping the gavel thrice with
or without the presence of quorum.
Section 13. Attendance in Sessions. – Every member of the Sangguniang Panlalawigan shall
be present in all its sessions, meetings or hearings. Attendance to sessions shall mean physical
presence of the Vice Governor and SP Members during the sessions conducted.
Reports of attendance to sessions of the Vice Governor and Sanggguniang Panlalawigan
Members shall be categorized into three, namely: 1) “Present”; 2) “Absent” which shall be further
categorized into Sick/Vacation Leave/Special Privilege Leave (SPL), without justifiable reason, on travel
but with no approved Travel Order and 3) on “Official Business (OB)”.
Sangguniang Panlalawigan Members who will arrive after the roll call shall be marked
“LATE” in the roll of members.
The Vice Governor and Sangguniang Panlalawigan Members who travel with previously
approved Travel Order shall not be marked present or absent but on “Official Business”. In case they
travel without presenting approved Travel Order, they shall be marked absent, however, in the next
session during the approval of the minutes if they can present an approved Travel Order, the Minutes
of the previous session shall be corrected by indicating therein that they were on “Official Business”.
Those who affix his/her signature in the Attendance Sheet during the session, meeting, or hearing, but
before adjournment leaves the Session Hall without permission shall be considered absent.
Section 14. Discipline of Members. – For disorderly behavior and absences without
justifiable cause for four (4) consecutive sessions, any Sangguniang Panlalawigan Member may be
censured, reprimanded or excluded from the session, suspended for not more than sixty (60) days, or
expelled: Provided, that the penalty of suspension or expulsion shall be concurred by at least
two-thirds (2/3) votes of all Sangguniang Panlalawigan Members: Provided, further, that a member
convicted by final judgment to imprisonment of at least one (1) year for any crime involving moral
turpitude shall be automatically expelled from the Sangguniang Panlalawigan.
Section 15. Open to Public. – Sangguniang Panlalawigan sessions or meetings of any
Committee thereof shall be open to the public unless a closed session is decided or ordered by an
affirmative votes of a majority of the members present, there being a quorum, in the public interest or
for reasons of security, decency or morality, or for reasons affecting the dignity of the Sangguniang
Panlalawigan or any of its members, or when confidential matters are being considered.
Upon motion to hold a closed session duly approved, the Presiding Officer shall direct the
session hall cleared and door closed.
Only the Secretary to the Sangguniang Panlalawigan, Assistant Secretary to the Sangguniang
Panlalawigan and such other persons as specifically authorized by the Sangguniang Panlalawigan shall
be admitted to closed sessions. They shall preserve the secrecy of whatever may be read or said at the
session.
Section 16. Suspension and Adjournment of Session. - Sessions of the Sangguniang
Panlalawigan shall not be suspended or adjourned except by direction of the Sangguniang
Panlalawigan itself. But the Presiding Officer may in his discretion, declare a recess of short intervals.
Section 17. Opening and Adjournment to be Entered in the Minutes. – The exact hour of
opening and adjournment of a session shall be entered in the minutes.

RULE V
ROLL CALL AND QUORUM
Section 18. Quorum. - A majority of all members of the Sangguniang Panlalawigan shall
constitute a quorum to transact official business.
Should a question of quorum be raised during a session, the Presiding Officer shall immediately
proceed to call the roll of the members and thereafter announce the results thereof.
Section 19. Absence of Quorum. – A majority of all members of the sanggunian who have been
elected and qualified shall constitute a quorum to transact official business.
a) Should a question of quorum be raised during session, the presiding officer shall
immediately proceed to call the roll of the members and thereafter announce the results;
and
b) Where there is no quorum, the presiding officer may declare a recess until such time a
quorum is constituted, or a majority of the members present may adjourn from day-to-day
and may compel the immediate attendance of any member absent without justifiable cause
by designating a member of the sanggunian, to be assisted by a member or members of the
police force assigned in the territorial jurisdiction of the local government unit concerned, to
arrest the absent member and present him at the session.
If there is still no quorum, despite the enforcement of Section 19 of this House Rules, no business
shall be transacted. The Presiding Officer, upon proper motion, duly approved by the members present, shall
then declare, the session adjourned for lack of quorum.
Section 20. Motion to Adjourn Vacated Call. – At any time after the roll call has been completed,
a motion to adjourn shall be in order, and if approved by a majority of those present, all proceedings shall be
vacated.
RULE VI
COMMITTEES
Section 21. Standing Committees. – The Standing Committees of the Sangguniang Panlalawigan
and its general jurisdiction shall be the following:
1) Committee on Finance and Appropriation. All matters relating to funds for the expenditures
of the provincial government, payment of obligations and indebtedness, approval of annual
and supplemental budgets and appropriation ordinances and other monetary and fiscal
matters.
2) Committee on Social Services and Community Development. All matters relating to
socio-economic planning, programming and socio-welfare ameliorative services, manpower
development, housing and resettlement and recreation.
3) Committee on Rules, Privileges and Ethics. All maters affecting the House Rules of
Procedure of the Sangguniang Panlalawigan, the calendar as well as the parliamentary rules
and the order and manner of transacting business, creation of committees, the conduct of
rights, privileges, safety, dignity, integrity and reputation of the SP Members.
4) Committee on Transportation, Traffic and Communication. All matters pertaining to traffic
rules and regulations, land, air, river and sea transportation, mass communications and
broadcast services and the development and promotion of information technology.
5) Committee on Cooperatives and Livelihood. All matters relating to cooperative
organizations and development, its accreditation, incentives to cooperatives, cooperative
program of the government as well as implementation of socio-economic development,
livelihood and other economic program and projects of the provincial government.

6) Committee on Environmental Protection and Ecology. All matters relating to the conservation
and protection of the environment, promotion or environmental awareness, renewal of
resources in damaged ecosystems, administration management, development, protection,
exploration, storage, renewal, regulation and licensing and wise utilization of the reserves, such as
forest, mineral, public land and offshore areas and all matters relating to human ecology and
settlement.
7) Committee on Tourism, Culture, Arts and Heritage. All matters relating to tourism and tourist
industry promotion, preservation, enrichment and evolution of Filipino arts and culture,
establishment and maintenance of libraries, museums, shrines, monuments and other historical
sites and edifices and other matters related to culture and arts.
8) Committee on Ways and Means and Taxation. All matters relating to revenue generations; taxes,
charges and fees, loans and other sources of local revenues and other matters related to local
taxation.
9) Committee on Public Works and Infrastructure. All matters relating to planning, construction,
maintenance, improvement and repairs of road and bridges, monuments, public buildings, parks,
shrines and other public edifices, drainage, sewerage and flood control and protection, irrigation
and water utilities, tourism, transportation and telecommunication services.
10) Committee on Youth and Sports Development. All matters relating to youth and sports
development.
11) Committee on Indigenous Peoples. All matters relating to the group of indigenous cultural
communities, disabled persons and senior citizens.
12) Committee on Differently Abled or Persons with Disabilities and Senior Citizens. All matters
relating to disabled persons or persons with disabilities and senior citizens.
13) Committee on Women, Children and Family Relations. All matters relating to economic
development of family life, women’s welfare, rights and privileges, women’s organizations, family
welfare and family planning as well as total development, rights and privileges of children.
14) Committee on Laws and Justice and Human Rights. All matters relating to the implementation of
local laws, rules and regulations, issuances and enforcement of local ordinances, review of
ordinances and resolutions submitted by lower level local government units, legality of measures
to be acted upon by the Sanggunian as well as matters relating to human rights, and prevention of
human rights and violation, organization and administration of justice, and other matters
pertaining to the efficiency and reforms on the prosecution service.
15) Committee on Good Government, Public Ethics and Accountability (Blue Ribbon Committee). All
maters relating to the promotion of good governance of provincial government offices,
implementation of the rights and privileges and discipline of government workers including their
benefits and incentives, all other matters relating to the bureaucracy and/or government and
investigation of misfeasance, malfeasance and non-feasance in office by provincial government
officials and employees.
16) Committee on Peace and Order/Public Safety. All matters relating to police matters, maintenance
of peace and order, promotion of public safety and protective services.
17) Committee on Agriculture/Fisheries. All matters relating to agriculture, food production,
agricultural production, inputs, facilities, business enterprises and all other matters related to
agriculture including plants and animals, as well as fisheries and aquatic resources.
18) Committee on Health and Sanitation. All matters relating to health, sanitation or hygiene,
cleanliness and beautification of the community and proposed programs related to hospitals and
health centers.

19) Committee on Education. All matters relating to education, schools, colleges and
universities, scholarship grants, studies and incentives to deserving students, non-formal;
and informal education, educational facilities.
20) Committee on Barangay Affairs. All matters relating to the development of barangays and
promotion of the welfare of barangay officials and their respective constituents as well as
creation matters pertaining to barangay government affairs.
21) Committee on Labor and Employment. All matters relating to labor and employment,
promotion and development of employment, labor, education, standards and statistics,
organization of the labor workers, promotion and development of workers organization of
the labor workers, promotion and development of workers organization and promotion of
employee-employer cooperation.
22) Committee on Urban Planning and Development. All matters relating to housing program,
subdivision development/real estate development, measures pertaining to land uses,
zoning code enactment, squatter problems and other matters related to housing and land
utilization.
23) Committee on Boundary Settlement. All matters affecting the territorial boundaries of the
Province of Surigao del Sur vis-à-vis its adjoining provinces of Davao Oriental, Surigao del
Norte, Agusan del Sur; creation, conversion, division, merger, abolition, and alteration of
boundaries by Ordinance passed by the Sangguniang Panlalawigan and the settlement of
boundary conflict between municipalities and other matters relative to undertaking
researches on file and providing assistance in coming up with right opinion/stand on the
matter.
24) Legislative Oversight Committee. All matters pertaining to committee inquiries and hearing,
formal consultation with and reports from the executive branch, on site visits and actual
inspections, sanggunian advice and consent of certain executive nominations and contracts,
informal meetings between legislators and executive officials, sanggunian membership on
local special bodies and studies by sanggunian committees, support agencies such as the
local COA office, and academic research institutions, conduct of inquiries on whether
legislative enactments are being implemented by the Executive Branch through issuance of
Executive Orders; determination of whether the policies and programs are being
implemented in accordance with the legislative intent and performance of legislative
functions other than those specified in the House Rules for the existing Sangguniang
Panlalawigan Committee.
25) Committee on Anti-Illegal Drugs. All matters relating to safeguarding the integrity of the
Province of Surigao del Sur and the well-being of its constituency particularly the youth,
from the harmful effects of dangerous drugs on their physical and mental well-being, and to
defend the same against acts or emissions detrimental to their development and
preservation and all matters relating to formulation of provisions for effective mechanisms
or measures to re-integrate into society individuals who have fallen victims to drug abuse or
dangerous drug dependence through sustainable programs of treatment and rehabilitation.
26) Committee on Trade, Industry, Investment and SMEs. All matters relating to domestic
trade, private corporations, patents, copyrights, trade names and trademarks, standards,
weights, measure and design, quality control and stabilization of prizes of commodities,
consumer protection, handicraft and cottage industries and marketing of commodities.
27) Committee on Risk Reduction and Climate Change Adaptation. All matters relating to disaster
preparedness, disaster prevention and mitigation, disaster response and recovery, stakeholders
participation and community preparedness and protection.

28) Committee on Local Economic Enterprises and Utilities. All matters relating to public utilities and
economic enterprises and facilities, water utilities, including the implementation of the public
market, slaughterhouse and bus/jeepney terminal.
29. Committee on Energy and Power. All matters relating to exploration and exploitation,
development, extraction, importation, refinery, transport, marketing, distribution, conservation,
storage of all forms of energy products and resources such as from fossil fuels like petroleum,
coal, natural gas and gas liquids, nuclear fuel resources and non-conventional, existing and
potential forms of energy resources, generation and transmission and distribution of electric
power.
30. Committee on Information, Technology and Communication. All matters relating to postal,
telegraph, radio, broadcast, cable television, telephone, convergence, computers and telecommu-
nications technologies including but not limited to broadband access to wired and wireless
connectivity to the internet such as voice over internet protocol, video conferencing, audio/video/
data streaming; any and all other public and private electronic means of capturing, processing,
storing, transmitting information for information technology; information systems inclusive of
hardware, software and content applications; mobile short messaging system (SMS) applications
affecting upstream and downstream business applications; and networks that enable access to
online technology.
The President of the Provincial Chapter of the Liga ng mga Barangay who is a member of the
Sangguniang Panlalawigan shall automatically the Chairman of the Committee on Barangay Affairs.
Likewise, the President of the Panlalawigang Pederasyon ng mga Sangguniang Kabataan who is a
member of the Sangguniang Panlalawigan shall automatically the Chairman of the Committee on Youth and
Sports Development.
Whenever a measure covers subject matters falling within the jurisdiction of more than one
Committee, said measure shall be referred jointly to the Committees concerned.
Participation of Sangguniang Panlalawigan Members in cases of Boundary Conflicts shall be guided
by the following:
a) If a boundary conflict is in District I, it shall be deliberated by the Sangguniang Panlalawigan
Members of District II. Sangguniang Panlalawigan Members in District I shall likewise
deliberate boundary conflict of District II;
b) All Sangguniang Panlalawigan Members shall be allowed to participate during the delibera-
tions at the Committee Level Meetings but not during the Plenary Sessions;
c) A Sangguniang Panlalawigan Member residing in the municipality which is subject of the
boundary conflict and/or is related to the witness of either party, shall automatically inhibit
himself/herself from participating in all deliberations;
d) That Articles 15, 16, 17, 18 and 19 of the Rules and Regulations Implementing the Local
Government Code and Sub-Section hereof shall be adopted into for purposes of trial of all
boundary conflicts and to govern the conduct of hearing on Boundary Conflicts handled by
the Committee; and
e) That the rules on pre-trial, formal presentation, identification and marking of exhibits as well
as formal offer of evidence in civil cases as provided under the Revised Rules on Civil
Procedure shall likewise be adopted as suppletory to these rules.
Section 22. Membership, Officers, Election. – Each standing committee shall have a Chairman, a
Vice Chairman and at least one (1) member but not more than four (4) members.
The Chairmanship and Membership to Committees may be appointed by the Honorable Vice
Governor upon authority of the Sangguniang Panlalawigan through a resolution duly adopted for the purpose.
Membership may be expanded to include other Committee Members who actually present
themselves and participate in the discussion during meetings.

The Vice Governor and Sangguniang Panlalawigan Members shall be a Chairman or Vice Chairman
of at least two Committees but not more than two (2) Committees:
In case of a tie during votation, the Chairman breaks the tie.
1) The Vice Governor and Sangguniang Panlalawigan Members shall submit to the Secretary to
the Sangguniang Panlalawigan the first Committee for Chairmanship or Vice Chairmanship
of his choice. In case there are more than one (1) SP Members who choose the same
Committee, the Chairmanship or Vice Chairmanship shall be submitted to election thru
secret balloting. However, a Sangguniang Panlalawigan Member who does not submit the
Committee of his choice or declines the Chairmanship or Vice Chairmanship of a Committee
shall submit his/her intention thru writing;
2) Every time there are more than one SP Member who chooses the same committee, another
round of election thru secret balloting shall be conducted until such time that all
Committees shall have a Chairman or Vice Chairman; and
3) FABC and SK Presidents shall automatically be the Chairman for the Committees on Youth
and Sports Development and Barangay Affairs. Their positions shall be limited to Vice
Chairman and Membership to only two (2) Committees.
Section. 23. Limitations. – No Sangguniang Panlalawigan Member shall be a Chairman or Vice
Chairman of more than two standing committees.
Expanded Committee Members can suggest, recommend, participate, deliberate, discuss and
make motion during committee meetings but cannot vote.
In cases where there is no quorum and the subject matter needs immediate action, all Members
present shall discuss, deliberate and decide on the matter. In this case, the presence of five (5) Members shall
constitute a quorum.
No member of a committee shall act upon or participate in any matter in which he has a special,
direct and substantial interest.
Section 24. Special Committees.- The Sangguniang Panlalawigan may organize special committees
as it may deem necessary. The officers and members of special committees shall likewise be elected by a
majority vote of all Sangguniang Panlalawigan Members.
Section. 25. Vacancy.- Whenever a vacancy occurs or is declared to exist in any of the committees,
the same shall be filled by election of the Sangguniang Panlalawigan Members. The successor shall serve only
the unexpired term.
Section 26. Committee Meetings and Hearings. – The Sangguniang Panlalawigan committees shall
meet whenever referrals are made to their committees every scheduled committee meetings as provided for
in its House Rules, preferably on Monday, before a regular session day of the Sangguniang Panlalawigan at
2:00 o’clock in the afternoon which will be limited up to ten (10) Committees that are priority for discussion
and may end at least 4:00 o’clock in the afternoon to 6:00 o’clock in the evening. It may be extended as the
need arises.
In case there are four (4) or more committees with invited guests/resources persons, a separate
committee shall be held simultaneously. However, if there are one (1) to three (3) Committees only, it shall be
deliberated by the Committee en Banc with the expanded members.
In cases where there is no quorum and the subject matter needs immediate action, all Members
present shall discuss, deliberate and decide on the matter. In this case, the presence of five (5) shall constitute
a quorum.
The Chairman, shall, from time to time convene the Committee to a meeting. If the Chairman is
absent, sick or otherwise temporarily incapacitated to call/or convene such meeting, the Committee may
nevertheless meet upon the written petition of the majority of the members thereof.

The Committee shall have the power to take testimony of any person in connection with any
investigation or inquiry which may be lawfully or necessarily undertaken or conducted by it. The same power
may, in particular cases, be exercised by any other persons thereunto especially deputized by the Body. The
Committee upon previous authorization by the Body, shall have the power to issue subpoena testificandum
and duces tecum to any person whose attendance at the meeting thereof is considered necessary.
Any person may be required or allowed to appear at any Committee Meeting and present his
views pertinent to the matter under consideration and at such reasonable time as the committee may deem
necessary or whenever such person so requests in writing at least twenty four (24) hours prior to the
scheduled meetings
Unless otherwise previously agreed upon, all questions before the Committee shall be put to a
vote.
After final deliberation and voting, the Committee shall prepare for submission to the
Sanggguniang Panlalawigan a report to be signed by the Chairman, Vice-Chairman and the Members thereof.
Any member of the Committee dissenting therefrom shall submit in writing, his reasons therefor.
A regular member of a committee who absents himself during committee meetings without
justifiable cause shall automatically be marked absent or in accordance with the three categories of absences
identified in this House Rules. In case members of the Committee absent themselves for a justifiable cause
shall inform the Office at least three (3) days before the scheduled meeting, unless the reason is due to
sickness wherein the Sangguniang Panlalawigan members concerned shall inform the Secretariat immediately
upon his return to office.
A majority of the Committee shall constitute a quorum. The presence of one half (1/2) plus one
(1) member of the committee shall also constitute a quorum. The committee meetings shall be held only in a
public building.
Section 27. Committee Reports and Orders. – Committee Reports and Orders on any ordinance or
resolution shall be considered in formal meetings and shall not be submitted to the Sangguniang Panlalawigan
unless accompanied by the Minutes of the meetings or hearings of the Committee which adopted them.
Upon submission by the committee of a report on an issue/concern referred to them, the
members thereof who actually participated in the discussion during the committee meeting shall be
presumed to have concurred in the report and be included as sponsors and shall be precluded from opposing
the same, unless they have entered their objection thereto during the committee meeting.
RULE VII

Every member of the Sangguniang Panlalawigan shall be assigned to prepare and lead the
invocation/prayer. The assignment shall be by District and shall start from the Member who got the highest
number of votes during the local election to the lowest. After all the members have led a prayer, the
assignment shall start again.
All privilege speeches shall be reviewed and screened first by the Committee on Rules and
Privileges and Ethics and shall be signed by the proponent before the same shall be delivered during the
Privilege Hour.
The Speaker shall have the option to submit to the Secretariat a copy of his/her Privilege Speech.
Visitors of the Sangguniang Panlalawigan shall be allowed personally to appear and speak before
the plenary to inform, lobby, pay courtesy and propose measures to the SP. The order of appearance before
the plenary shall be registered in the Office of the SP Secretary which shall be read at the beginning of the
Question Hour.
Any person, official, agent or representative who wants to make an appearance or request to
personally address the SP during Plenary/Regular Session shall first register his/her appearance with the SP
Secretary stating his/her name, office represented, documents or references submitted, address and contact
number, if any.
Prohibited appearances:
1. commercial products/indorsements;
2. personal solicitation, request for personal assistance, medical assistance and other
requests personal in nature and benefit;
3. solicitation for projects, travel allowances by Local Government Units and Offices of
the Provincial Government; and
4. matters already pending before the Committees of the Sangguniang Panlalawigan.
Section 29. Approval of the Minutes and Transcript of Proceedings.- The minutes of each session
shall be submitted to the Sangguniang Panlalawigan for approval, copies of which shall be furnished every
member thereof before the start of every session.
The original copy of the approved minutes shall be signed by all members present at the session.
Each copy of the minutes shall be signed by the Secretary to the Sangguniang Panlalawigan and attested by
the Presiding Officer.
Should copies of the minutes be distributed prior to the session, the reading of the document may
be dispensed with; amendments may be entertained and voted on, and approval of the entire document
would then be in order through articulation of the proper motion.
The Transcript of Proceedings of each session shall be submitted to the Sangguniang Panlalawigan
for approval in accordance with Section 8 of this Rules which is every two weeks after session.
The original copy of Transcript of Proceedings shall be signed by all the members present. Each
copy shall also be signed by the Secretary to the Sangguniang Panlalawigan and attested by the Presiding
Officer.
Section 30. Calendar of Business. – The Calendar of Business shall consist of the following parts:
a. Unfinished Business - Business being considered by the Sangguniang Panlalawigan at the
time of its adjournment. Its consideration shall be presumed enacted until such unfinished
business is disposed of. Thereafter, the Presiding Officer shall call for the business for the
day;

b. Business for the Day - This includes proposed ordinances and resolutions and other
measures reported in the Calendar of Business for consideration on that day, to be
considered in the Order in which they are listed in the Calendar. This include Committee
Reports, First Reading and Referrals to Committees, For Information, items ready for
deliberation on Second Reading and those items for Body’s decision on Third and Final
Reading; and
c. Unassigned Business – This includes proposed ordinances, resolutions and other measures
reported out by the Committee or by SP Members during the Privilege Hour but not
calendared earlier which shall be limited to urgent and emergency measures only. Any
business included in this part of the Calendar of Business may be set for consideration on
motion of a member with unanimous approval of the Sangguniang Panlalawigan Members
present at a session, there being a quorum.
Any legislative matter for approval in Unassigned Business shall be presented during the Privilege
Hour/Speech by the Author/Sangguniang Panlalawigan Member of his intention/purpose.
Any legislative matter that is not presented during the Privilege Hour and considered for approval
in Unassigned Business shall have a corresponding draft resolution and/or ordinance prepared/submitted.
Section. 31. Distribution of Calendar of Business. – The Calendar of Business shall be distributed
every Monday before session, unless there will be addition on the one previously distributed, in which case, a
note to this effect in the Order of Business shall be sufficient.
Section. 32. Ordinance and Resolution Distinguished. – Legislative action of a general and
permanent character shall be enacted in the form of ordinance, while those which are temporary in character
shall be passed in the form of resolution. Matters relating to the propriety functions and to private concerns
shall be acted upon by resolution.
Section 33. Essential Parts of Ordinances and Resolutions. – Ordinances and resolutions
proposed by any Sangguniang Panlalawigan Member shall be prepared by him/her in a written draft and shall
contain an assigned number, a title or caption, an enacting or ordaining clause, and a date of its proposed
effectivity. In addition, every proposed ordinance shall be accompanied by brief explanatory note containing
the justification for its approval and shall be furnished to the Members before any discussion/deliberation
during the Committee Meeting. It shall be signed by the author/s and submitted to the Secretary to the
Sangguniang Panlalawigan who shall report the same to the Sangguniang Panlalawigan at its next session.
RULE VIII
ORDINANCES AND RESOLUTIONS
Section 34. First Reading. – The Secretary to the Sangguniang Panlalawigan shall report all
proposed ordinances and resolutions to the Sangguniang Panlalawigan Members for First Reading and
Referral to Committees at least three (3) days before a regular or special session.
The reading of all requests, proposed ordinances or resolutions calendared for First Reading and
Referrals to Committees shall be dispensed with and instead, the same shall be automatically referred to the
appropriate committees.
An erroneous referral of a proposed ordinance or resolution may be corrected any day after the
approval of the minutes.
Only the Chairman and Vice Chairman of the Committee to which a proposed ordinance or
resolution was erroneously referred, as well as the Chairman or Vice Chairman of the Committee claiming
jurisdiction over the proposed ordinance or resolution may move that the referral be declared erroneous, and
ask for its correction. However, the Presiding Officer may motu propio rectify an erroneous referral.
Section 35. Period to Report. – The Committee shall submit a report on the proposed ordinance
or resolution within thirty (30) days, after it has been referred to it.

If the Committee Report on a proposed ordinance or resolution is favorable, it shall be included in
the Calendar of Business.
If the Committee action on a proposed ordinance or resolution is unfavorable, it shall be laid on
the table and, within ten (10) days, notice of the action will be furnished the author or authors concerned
stating the reason or reasons for such action: Provided, that within five (5) days after receipt of the notice, the
Sangguniang Panlalawigan may reconsider the Committee recommendation.
Section 36. Urgent Measures. – Any legislative matter duly certified by the Governor as urgent,
whether or not it is included in the Calendar of Business, may be presented and considered by the
Sangguniang Panlalawigan in the same session without need of suspending the Rules.
That the Vice Governor and the Chairman, Committee on Rules, Privileges and Ethics shall also be
included in certifying urgent measures.
The Sangguniang Panlalawigan likewise may, on motion made by the Chairman of the Committee
concerned, consider a proposed ordinance or resolution as urgent and consideration thereof shall be
scheduled according to a time table.
If said motion is approved, the Sangguniang Panlalawigan shall forthwith prepare a detailed
timetable fixing the date on or before a Committee Meeting in which the proposed ordinance or resolution
must be reported by the Committee concerned, the number of days or hours, to be allocated to the
consideration of the measure in Second Reading, and the date or hour at which proceedings must be
concluded and final vote on said measure taken.
Section. 37. Second Reading and Debate. – No proposed ordinance or resolution shall be
considered for Second Reading in any regular session unless it has been reported out by the proper
committee to which it was referred or certified as urgent by the Governor.
In the absence of the Chairman, Vice Chairman and all Members of the Committee, action on the
proposed Ordinance or Resolution shall be deferred.
On the day set for the consideration of a proposed ordinance or resolution for Second Reading,
the same shall be read by the Secretary to the Sangguniang Panlalawigan in full with amendments proposed
by the Committee, if any, unless copies thereof have been distributed earlier and such reading is dispensed
with. The proponent shall deliver a sponsorship speech.
Thereafter, the proposed ordinance or resolution shall be subject to debate and pertinent
motions. If the motion for approval in Second Reading is approved by the majority of the members present,
the movant, on his own discretion, may move for the approval of the ordinance or resolution in Third and
Final Reading on the same session day.
Section. 38. Debate and Closure By Members. – In the discussion of any measure, a motion to
close the debate shall be in order after two speeches for and one against, or after only one speech for has
been delivered and none entered against it.
When several members have registered or signified their intention to speak on the matter for
consideration and when said matter has been sufficiently and thoroughly discussed by the member speaking,
the Presiding Officer may motu propio, or upon motion of a Member, order that a Member having the floor
shall desist from speaking further so that other Members may not be deprived for their opportunity to speak.
Section 39. Five Minute Rule. – After closure of debate, the Sangguniang Panlalawigan shall
proceed to the consideration of Committee amendments. The Presiding Officer is given the authority to
set the time limit of five (5) minutes for the speaker to deliver his/her Privilege Speech. In case a
speaker consumes the alloted time for his/her privileged speech, a waiver shall be secured to use
the time alloted to the other members who shall not use their 5 minutes time allocation.

Section 40. Approval of Measures in Second Reading. – The Assistant Secretary to the
Sangguniang Panlalawigan shall prepare copies of the proposed ordinance or resolution in the form it was
passed in Second Reading and shall distribute to each Sangguniang Panlalawigan member a copy thereof,
except that of a measure certified by the Governor as urgent may be submitted for final voting immediately
after debate and/or amendments during the Second Reading.
That the Vice Governor and the Chairman, Committee on Rules, Privileges and Ethics shall also be
included in certifying urgent measures.
After the amendments have been acted upon, the proposed ordinance or resolution shall be
voted in Second Reading.
Section 41. Third Reading. – A proposed ordinance or resolution approved in Second Reading
shall be included in the Calendar of Business under “For Third Reading”.
No ordinance shall be approved unless it has passed three readings, and copies thereof in its final
form have been distributed to the Members at least three (3) days before its passage, except when the
Governor or the Sangguniang Panlalawigan certified to the necessity of its immediate enactment to meet a
public calamity or emergency. Upon third reading of a proposed ordinance or resolution, no amendment
thereto shall be allowed, and the vote thereon shall be taken immediately thereafter and the ayes and nays
entered in the minutes, except on matters involving a question of law and/or regularity, wherein the effect of
this Section is deemed waived for purposes of giving way to the objection raised by any Member of the Body.
Section 42. Approval of Resolutions. – A resolution shall be enacted in the same manner
prescribed for ordinances, except that it need not go through a separate Third Reading for its final
consideration unless decided otherwise by a majority of all the Sangguniang Panlalawigan Members.
Section 43. Majority Requirement. – No ordinance or resolution passed by the Sangguniang
Panlalawigan shall be valid unless approved by a majority of the Members present, there being a quorum. Any
Ordinance or Resolution authorizing or directing the payment of money or creating liability shall require the
affirmative votes of majority of all the Sangguniang Panlalawigan for its passage.
Upon the passage of all ordinances or resolutions, the Assistant Secretary to the Sangguniang Panlalawigan
shall record the ayes and nays. Each approved ordinance or resolution shall be stamped with seal of the
Sangguniang Panlalawigan and recorded in a book kept for the purpose.
Section 44. Special Provision in the Budget Ordinance. – The Sangguniang Panlalawigan shall in
no case increase the appropriation of any project or program of any office of the Provincial Government over
the amount submitted by the Governor in his budget proposal.
After the Governor shall have submitted the annual general appropriation measure, supplemental
appropriation measures shall be considered only if supported by funds actually available as certified by the
Provincial Treasurer or by funds to be raised by corresponding revenue proposal included therein.
Any request for appropriation coming from the different offices of the provincial government
which are under the administrative and/or general supervision of the Provincial Governor shall first be
approved by the Provincial Governor and shall be supported with funds actually available as certified by the
Provincial Treasurer before it is included in the agenda or in the Calendar of Business. Such request for
appropriation shall be in writing and in the form of ordinance and shall contain an assigned number, a title or
caption, an enacting clause, and the date of its proposed affectivity. In addition, the same should be
accompanied by a brief explanatory note containing the justification for its approval signed by the Provincial
Governor.
The proposed appropriation ordinance once certified by the Provincial Governor in writing shall
immediately be submitted for inclusion in the agenda or in the Calendar of Business for First Reading or for
referral to the Committee on Finance and Appropriation.

Section 45. Approval by the Governor. – Every ordinance or resolution adopting a local
development plan and public investment program passed by the Sangguniang Panlalawigan shall be
forwarded to the Governor for approval. The Governor shall affix his initial on each and every page of the
ordinance or resolution and the word “APPROVED” shall appear with his signature on the last page thereof.
Within fifteen (15) days after receipt of the ordinance or resolution, the Governor shall return the
said ordinance or resolution to the Sangguniang Panlalawigan with either his approval or his veto. If he does
not return it within that time, the ordinance or resolution shall be deemed approved.
Section 46. Veto Power of the Governor. – The Governor may veto any ordinance or resolution
on the ground that it is ultra vires or prejudicial to the public welfare particularly stating his reason/s
therefore in writing.
The Provincial Governor shall have the power to veto any particular item or items of an
appropriation ordinance, or of an ordinance, or resolution directing the payment of money or creating
liability. In such case, the veto shall not affect the item/s which is/are not objected to.
The vetoed items shall not have effect unless the Sangguniang Panlalawigan overrides the veto in
the manner hereunder provided, otherwise, the item/s in the appropriation ordinance of the previous year
corresponding to those vetoed shall be deemed reenacted.
The Sangguniang Panlalawigan may override the veto of the Governor by two thirds (2/3) vote of
all its members, thereby making the ordinance or resolution effective.
The Governor may veto an ordinance or resolution only once.
Section 47. Review by the Sangguniang Panlalawigan. – Within seventy two (72) hours after
approval, the Secretary to the Sangguniang Panlalawigan shall forward to the Sangguniang Panlalawigan for
review, copies of approved ordinances, resolutions, or executive orders promulgated by the Sangguniang
Bayan and/or Municipal Mayors of component local government units.
Within thirty (30) days after receipt of such copies of approved ordinances, resolutions and
executive orders, the Sangguniang Panlalawigan shall examine the documents or transmit them to the Office
of the Provincial Prosecutor which shall, within fifteen (15) days from receipt of the documents, inform the
Sangguniang Panlalawigan of his written comments or recommendations which may be considered by the
Sangguniang Panlalawigan in making its decision.
If the Sangguniang Panlalawigan finds that an ordinance, resolution or executive order is beyond
the power conferred upon the Sangguniang Bayan or the Mayor, it shall declare such ordinance, resolution or
executive order invalid in whole or in part. The Sangguniang Panlalawigan shall enter its action upon the
Minutes and shall advice the corresponding municipal authorities of the action it has taken. The action of the
Sangguniang Panlalawigan shall be final.
If no action has been taken by the Sangguniang Panlalawigan within thirty (30) days after
submission of an ordinance, resolution or executive order, the same shall be presumed consistent with law,
and therefore, valid.
Section 48. Enforcement of Disapproved Measures. – Any attempt to enforce, promulgate or
execute any ordinance, resolution or executive order after the disapproval thereof shall be sufficient ground
for the suspension or dismissal of the officer making such attempt.
Section 49. Effectivity of Enactments. – Unless otherwise stated in the ordinance or resolution,
the Secretary to the Sangguniang Panlalawigan shall cause the posting thereof in English and shall record such
fact in a book kept for the purpose, stating the dates of approval and posting thereof.

RULE IX
DECORUM AND DEBATE
Section 50. Manner of Addressing the Chair or a Member. – When a Member desires to speak,
he/she shall rise and respectfully address the Chair, “Mr. or Madam Chairman” or “Mr. or Madam Presiding
Officer.”
Section 51. Recognition of Members to Speak. – When two or more Members rise at the same
time, the Presiding Officer shall determine and recognize the members who is to speak first and should be
addressed as Kagawad…Gentleman from… A Member who is recognized to speak shall use the microphone.
Section 52. The Limit for Speeches. – No Member shall occupy more than fifteen (15) minutes in
debate on question or speak for more than once on any question without consent of the Sangguniang
Panlalawigan, except as hereinafter provided. The period of interpellation shall not be counted against the
time of the member speaking.
Section 53. Sponsor to Open and Close Debate. – The Member reporting a measure under
consideration from a Committee may open the debate thereon. If the debate should extend beyond one
session day, he shall be entitled to an additional fifteen (15) minutes to close.
Section 54. Decorum to Open and Close Debate. – In all cases, the Member who has obtained the
floor shall confine himself to the question under debate, avoiding personalities. He shall refrain from uttering
words, or performing acts which are inconsistent with decorum.
Section 55. Conduct During Sessions. – During the session, the Members shall wear Barong
Tagalog and/or Filipiniana or any formal office or business attire and observe proper decorum.
While the Presiding Officer is addressing the Sangguniang Panlalawigan or putting a question, no
Member shall walk out or cross the session hall except when it is for personal comfort.
Section 56. Discipline of Members. – The Sangguniang Panlalawigan may punish its Members for
disorderly behavior and, with the concurrence of two-thirds (2/3) of all its members, suspend or exclude a
Member from the session, but if the penalty is suspension, this shall not exceed sixty (60) days.
RULE X
VOTING AND MOTIONS
Section 57. A Tie Vote to an Appeal. – A tie vote on an appeal from the ruling of the Chair
sustains the decision of the Chair.
Section 58. Who May Move. – When a motion, report or proposed measure is adopted or lost, it
shall be in order for a Member who votes with majority, to move for the reconsideration thereof on the same
or succeeding session day. Such motion shall take precedence over all other questions, except a motion to
adjourn, to raise a question of privilege and a call to order.
Section 59. Recording of Motion. – Every motion shall be entered in the Minutes with the name
of the Member making it, unless it is withdrawn on the same day.
Section 60. Reading and Withdrawal of Motions. – When a motion is made, the Presiding Officer
shall state it before being debated. Except as herein otherwise provided, a motion may be withdrawn any
time before its approval or amendment.
Section 61. Precedence of Motion. – When a question is under debate, no motion shall be
entertained except to adjourn, raise a question of privilege, declare a recess, lay on the table or postpone to a
certain day (which motion shall be decided without debate), refer, amend or postpone indefinitely (which
motion shall be decided subject to the five-minute rule). Said motion shall take precedence in the foregoing
order. No motion to refer or postpone indefinitely, having failed passage shall again be allowed on the same
day.

Section 62. Amendments. – When a motion or proposition is under consideration, a motion to
amend and a motion to amend that amendment shall be in order. It shall also be in order to offer further
amendment by substitution, but it shall not be voted upon until the original motion or proposition is
perfected. Any of said amendments may be withdrawn before a decision is made thereon.
Section 63. Rider Prohibited. – No motion of position on a subject different from that under con-
sideration shall be allowed under color of amendment.
Section 64. Motion to Cover One Subject Matter. – No motion shall cover more than one subject
matter.
Section 65. Amendment of Title. – Amendments to the title of a proposed ordinance or
resolution shall not be in order until after the text thereof has been perfected. Amendments to the title shall
be decided without debate.
Section 66. Call to Order. – A motion to read any part of the Rules is equivalent to a call and takes
precedence over any motion other than to adjourn.
Section 67. Question of Privilege. – Questions of privilege are:
a. Those affecting the rights of the Sangguniang Panlalawigan, its safety, dignity and
integrity; and
b. Those affecting the rights, reputation and conduct of the Members, individually, in
their capacity as such Members.
Subject to the five-minute rule, questions of privilege shall have precedence over all other
questions, except a motion to adjourn.
Section 68. Privilege Questions. – Privilege questions are those motions or subject matters which,
under the Rules, take precedence over other motions and subject matters.
RULE XI
SUSPENSION OF THE RULES
Section 69. Who Can Move. – Only the Chairman or the Vice Chairman or Member of the
Committee on Rules, Privileges and Ethics can move for the suspension of the Rules. In their absence, the
Presiding Officer can declare the suspension of the Rules.
Section 70. Votes Required. – No Rule shall be suspended except by a vote of two-thirds (2/3) of
the Members, a quorum being present.
Section 71. Interruption of Motion. – When the motion to suspend the Rules is pending, one
motion to adjourn may be entertained. If it is lost, no similar motion shall be entertained until the vote is
taken on the motion to suspend.
Section 72. Effect of Suspension. If the Sangguniang Panlalawigan votes to suspend the Rules, it
shall forthwith proceed to consider the measure. A two-thirds (2/3) vote of the Members present shall be
necessary for the passage of the said measure, a quorum being present.
RULE XII
ANNUAL LEGISLATIVE ACCOMPLISHMENT REPORT (ALAR)
Section 73. Quarterly and Annual Reports Preparation. – TSP Quarterly Reports and Annual
Accomplishment Report (AAR) every end of the quarter and every end of the year, respectively, shall be
prepared by the TSP Secretariat at the end of every year to be signed by the Secretary to the Sangguniang
Panlalawigan, approved by the Honorable Vice Governor and adopted by the Sangguniang Panlalawigan
Members in a session.

Section 74. Rendition of Annual Legislative Accomplishment Report. – The Honorable Vice
Governor shall render an Annual Legislative Accomplishment Report (ALAR) during the State of the Province
Address (SOPA) of the Honorable Provincial Governor on or before March 31 of each year as provided for
under Section 97 of the Local Government Code of 1991.
Section 75. Basis of Reporting Attendance to Sessions. The basis for the record of attendance to
sessions shall be the number of sessions conducted and not the number of scheduled sessions.
The number of scheduled sessions shall mean the number corresponding the number of Tuesdays
for the whole year. The number of sessions conducted on the other hand, shall mean the number of sessions
conducted with or without quorum or whether it be regular or special.
During a scheduled session which was started and the gavel already been banged but is not
completed for lack of quorum, attendance shall be checked. Those who are physically present shall be marked
present while those absent shall be marked absent.
The percentage of attendance of a Sangguniang Panlalawigan Member shall be arrived at by
dividing the total number of physical presence with the total number of sessions conducted.
The report on the number and type of sessions conducted shall as much as practicable, be pre-
sented in a tabular form, a sample of which is hereto provided:

Section 76. Basis of Reporting Attendance to Meetings/Hearings. – Attendance during
Committee Meetings shall mean physical presence during the scheduled meeting of the concerned
committee. If the Sangguniang Panlalawigan Member appears after the end of the committee meeting, he/
she shall be considered absent during the committee meeting concerned but shall be considered present
during the other succeeding committee meetings.
A regular member of a Committee who leaves the meeting before adjournment of a Committee
Meeting shall be marked absent unless with valid or justifiable reason.
RULE XIII
OFFICAL SEAL
Section 77. Official Seal. – The official seal of the Provincial Government shall be the seal of the
Sangguniang Panlalawigan.

Section 78. Amendments. – Any portion of these rules may be amended by a majority votes of all
the Sangguniang Panlalawigan Members.
RULE XV
REPEALING CLAUSE
Section 79. Repealing Clause. – All existing resolutions and ordinances inconsistent with this Rules
are hereby repealed or amended accordingly.
RULE XVI
EFFECTIVITY
Section 80. Effectivity. – This Ordinance shall take effect upon its approval.
