Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

Шановний Олексіє Юрійовичу!
До Одеського центру правозахисту та медіації звернулись мешканці гуртожитку №4
Державного університету інтелектуальних технологій і зв'язку (далі – ДУІТЗ), який було утворено
розпорядженням Кабінету Міністрів України від 19.08.2020 р. № 1042-р шляхом реорганізації Одеської
національної академії зв’язку ім. О. С. Попова та Одеської державної академії технічного регулювання
та якості, які повідомили про наступне.
І. В гуртожитку № 4 ДУІТЗ, який знаходиться за адресою: м. Одеса, вул. Академічна, 20
мешкають викладачі та працівники ДУІТЗ, студенти ДУІТЗ та Фахового коледжу зв’язку та
інформатизації ДУІТЗ, а також працівники інших підприємств та установ міста Одеси за клопотаннями
відповідних роботодавців, тимчасово переміщені особи, діти, літні люди тощо. Багато мешканців
проживають в гуртожитку постійно (дехто більше 10-ти років), договори багато разів переукладалися
на наступні терміни, мешканцями були зроблені ремонти в кімнатах власним коштом тощо.
Станом на оголошення воєнного стану згідно Указу Президента від 24.02.2022 р. в гуртожитку
№ 4 проживало приблизно 200 осіб. Зараз студентів стало менше, багато з них виїхали, залишивши
речі, та оплативши проживання до кінця навчального року, проте більшість мешканців гуртожитку
залишилися, оскільки іншого житла не мають.
Всі мешканці гуртожитку № 4 проживають на законних підставах, з ними керівництвом ДУІТЗ
було укладено письмові договори на проживання, виписано відповідні ордери, приймається оплата за
проживання на банківський рахунок ДУІТЗ в безготівковому порядку. Слід зауважити, що мешканці
сплачують за житло незважаючи навіть на тяжкий військовий час, зменшення доходів, невиплати
заробітної плати тощо.
Проте 02.06.2022 р. комендант гуртожитку №4 Пислар Оксана Анатоліївна усно повідомила
мешканцям, що отримала від керівництва ДУІТЗ в особі проректора з розвитку інфраструктури
Каравелкова Сергія Івановича вказівку негайно забезпечити виселення всіх мешканців з гуртожитку
до 10 червня 2022 р. Якщо мешканці не зроблять цього «добровільно» у вказаний термін, то тоді в
гуртожитку працівники ДУІТЗ мають відключити електроенергію, водопостачання, газопостачання, а
мешканців гуртожитку будуть виселяти примусово з використанням приватної охоронної фірми.
Жодних письмових документів (наказів, розпоряджень тощо) за підписом керівництва ДУІТЗ
щодо підстав та обґрунтування такого незаконного та безпідставного виселення в воєнний час,
особливо при наявності договорів на проживання (в когось з мешканців до 30.06.2022 р., в когось до
31.08.2022 р. тощо), та вже оплаченій вартості проживання, комендант гуртожитку не надала,

пояснивши це їх відсутністю, та наявністю лише усного розпорядження проректора, довести до відома
мешканців яке вона була зобов’язана в силу посадових обов’язків.
Проте вже наступного дня комендант гуртожитку повідомила мешканцям, що керівництво
ДІУТЗ нібито пішло на поступки, продовжило термін «добровільного» виселення до 30.06.2022 р., але
з умовою, що вже 01.07.2022 р. приміщення гуртожитку буде повністю порожнім, всі мешканці виїдуть
з речами, інакше наступного дня буде повністю припинено електро-, водо-, газопостачання гуртожитку,
приїдуть озброєні бійці охоронної компанії та викинуть усіх, хто залишився, на вулицю. Без винятку
хто це – студент, працівник університету, поселений за клопотанням іншого підприємства чи установи
чи ВПО з зареєстрованим місцем проживання в гуртожитку.
Жодного офіційного документу мешканцям гуртожитку дотепер надано не було, про наступне
виселення в письмовій чи інший формі керівництво ДУІТЗ мешканців дотепер не повідомляло, все
спілкування здійснюється лише усно через коменданта гуртожитку, яка не дає жодних наказів ректора
щодо цього.
Більш того, роботодавці працівників інших підприємств/установ, які проживають в гуртожитку
№ 4 ДІУТЗ, працюють та сплачують податки в Одеській міській територіальній громаді,
у встановленому в договорах на проживання порядку та термін підготували й направили до
керівництва ДУІТЗ листи з клопотаннями продовжити термін їх проживання на наступний період, як
цей й передбачено в договорах на проживання. Інформації про отримання бідь-яких відповідей на такі
звернення у мешканців гуртожитку на даний час відсутня.
ІІ. Відповідно до ст. 47 Конституції України кожен має право на житло. Держава створює
умови, за яких кожний громадянин матиме змогу побудувати житло, придбати його у власність або
взяти в оренду. Ніхто не може бути примусово позбавлений житла інакше як на підставі закону
за рішенням суду.
Слід зазначити, що гарантоване Конституцією в ст. 47 право на житло не обмежується Указом
Президента України № 64/2022 від 24.02.2022 р. «Про введення воєнного стану в Україні».
Більш того, Кабінет Міністрів України постановою від 05.03.2022 р. № 206 «Деякі питання
оплати житлово-комунальних послуг в період воєнного стану» установив, що до припинення чи
скасування воєнного стану в Україні забороняється: нарахування та стягнення неустойки
(штрафів, пені), інфляційних нарахувань, процентів річних, нарахованих на заборгованість, утворену
за несвоєчасне та/або неповне внесення населенням плати за житлово-комунальні послуги;
припинення/зупинення надання житлово-комунальних послуг населенню у разі їх неоплати або
оплати не в повному обсязі.
Також Торгова-промислова палата України засвідчила форс-мажорною обставиною військову
агресію Російської Федерації проти України, що стало підставою введення воєнного стану
24.02.2022 р. (лист № 2024/02.0-7.1 від 28.02.2022 р.). Це означає, що війна є форс-мажором, тобто
обставиною непереборної сили, яка звільняє особу від відповідальності у випадку несплати
чи неповної сплати як за договорами про надання комунальних послуг, так і за договорами на
проживання в гуртожитку тощо.
Проте мешканці гуртожитку №4 ДУІТЗ в цілому не мають такої заборгованості, а якщо хтось з
мешканців й допустив поточну заборгованість за проживання в гуртожитку, таке питання має
вирішуватись керівництвом ДУІТЗ в індивідуальному порядку з таким мешканцем, з врахуванням
конкретних обставин, в тому числі й в судовому порядку, а не шляхом примусового виселення всіх
мешканців гуртожитку з порушенням як положень укладених договорів, так і вимог законодавства
України.
Крім цього, 20.03.2022 р. набрав чинності Закон України від 15.03.2022 р. №2126-IX «Про
внесення змін до деяких законів України щодо державних гарантій в умовах воєнного стану,
надзвичайної ситуації або надзвичайного стану», згідно з яким Закон України «Про освіту» було

доповнено новою статтею 57-1 «Державні гарантії в умовах воєнного стану, надзвичайної ситуації або
надзвичайного стану», згідно якої здобувачам освіти, працівникам закладів освіти, установ
освіти, наукових установ, на час особливого періоду гарантується місце проживання (пансіон,
гуртожиток тощо) та забезпечення харчуванням (у разі потреби).
Проте незважаючи на зазначені вище норми законодавства, мешканців гуртожитку – студентів
ДУІТЗ, неповнолітніх студентів ФКЗІ ДУІТЗ, викладачів, працівників, переселенців, їх дітей, в цей
важкий воєнний час керівництво ДУІТЗ просто «викидає на вулицю» без надання жодного іншого
житла, що спричинить значної шкоди як конституційним правам вказаних осіб на житло, хоча в ДУІТЗ
загалом є шість гуртожитків, в тому числі й чотириповерховий гуртожиток № 2 по
вул. Старопортофранківській, 71А в м. Одесі, 1950-х років будівництва, обладнаний протирадіаційним
укриттям на 80 осіб (згідно даних публічної карти карту Фонду захисних споруд Департаменту
муніципальної безпеки Одеської міської ради), який вже кілька років стоїть пустим, тобто
використовується неефективно, хоча там можна було б розмістити, наприклад, переселенців/біженців
з Миколаєва, Херсона, Нової Каховки, Маріуполя тощо.
Натомість керівництво ДУІТЗ здійснює заходи щодо примусового виселення мешканців
найкращого студентського гуртожитку м. Одеса 2018 року за житлово побутовими умовами, що
підтверджується відповідною грамотою Ради ректорів Одеського регіону
(https://old.suitt.edu.ua/konkurs-na-krashhij-studentskij-gurtozhitok/). Можливо, це пояснюється
місцерозташуванням гуртожитку № 4 – біля найбільшого та найкращого парку Одеси, на відстані 2-х
кілометрів від курортної Аркадії? Час покаже.
ІІІ. Підстави для звернення Одеського центру правозахисту та медіації з даним зверненням.
Відповідно до ст. 40 Конституції України усі мають право направляти індивідуальні чи
колективні письмові звернення або особисто звертатися до органів державної влади, органів
місцевого самоврядування та посадових і службових осіб цих органів, що зобов'язані розглянути
звернення і дати обґрунтовану відповідь у встановлений законом строк.
Згідно ч. 1 ст. 21 Закону України «Про громадські об’єднання» для здійснення своєї мети (цілей)
громадське об'єднання має право: 1) вільно поширювати інформацію про свою діяльність, пропагувати
свою мету (цілі); 2) звертатися у порядку, визначеному законом, до органів державної влади,
органів влади Автономної Республіки Крим, органів місцевого самоврядування, їх посадових і
службових осіб з пропозиціями (зауваженнями), заявами (клопотаннями), скаргами;
3) одержувати у порядку, визначеному законом, публічну інформацію, що знаходиться у володінні
суб'єктів владних повноважень, інших розпорядників публічної інформації; 4) брати участь у порядку,
визначеному законодавством, у розробленні проектів нормативно-правових актів, що видаються
органами державної влади, органами влади Автономної Республіки Крим, органами місцевого
самоврядування і стосуються сфери діяльності громадського об'єднання та важливих питань
державного і суспільного життя; 5) проводити мирні зібрання; 6) здійснювати інші права, не
заборонені законом.
Згідно ст. 1 Закону України «Про звернення громадян» громадяни України мають право
звернутися до органів державної влади, місцевого самоврядування, об'єднань громадян, підприємств,
установ, організацій незалежно від форм власності, засобів масової інформації, посадових осіб
відповідно до їх функціональних обов’язків із зауваженнями, скаргами та пропозиціями, що стосуються
їх статутної діяльності, заявою або клопотанням щодо реалізації своїх соціально-економічних,
політичних та особистих прав і законних інтересів та скаргою про їх порушення. Звернення
адресуються органам державної влади і органам місцевого самоврядування, підприємствам,
установам, організаціям незалежно від форми власності, об’єднанням громадян або посадовим
особам, до повноважень яких належить вирішення порушених у зверненнях питань.
Статтею 5 Закону України «Про звернення громадян» передбачено, що звернення може бути
подано окремою особою (індивідуальне) або групою осіб (колективне). Звернення може бути усним чи

письмовим. Письмове звернення надсилається поштою або передається громадянином до
відповідного органу, установи особисто чи через уповноважену ним особу, повноваження якої
оформлені відповідно до законодавства. Письмове звернення також може бути надіслане з
використанням мережі Інтернет, засобів електронного зв’язку (електронне звернення).
Звертаємо увагу, що Верховний суд у постанові від 31.10.2019 р. в справі № 813/1960/18
наголосив, що дія Закону України «Про звернення громадян» поширюється на звернення громадських
організацій та їх керівників. Ця Постанова містить обов’язкові для застосування висновки щодо
поширення дії Закону України «Про звернення громадян» на звернення громадських
організацій та їх керівників (пункти 36 та 40 Постанови). Практична реалізація цих висновків
полягає в належному розгляді звернень громадських організацій та їх керівників відповідно до ст. 15,
16 та 19 Закону, а також забезпеченні їх прав, встановлених ст. 18 Закону.
Відповідно до положень ст. 7 Закону України «Про звернення громадян» звернення,
оформлені належним чином і подані у встановленому порядку, підлягають обов'язковому
прийняттю та розгляду. Забороняється відмова в прийнятті та розгляді звернення з посиланням на
політичні погляди, партійну належність, стать, вік, віросповідання, національність громадянина,
незнання мови звернення. Якщо питання, порушені в одержаному органом державної влади,
місцевого самоврядування, підприємствами, установами, організаціями незалежно від форм
власності, об'єднаннями громадян або посадовими особами зверненні, не входять до їх
повноважень, воно в термін не більше п'яти днів пересилається ними за належністю
відповідному органу чи посадовій особі, про що повідомляється громадянину, який подав
звернення. У разі якщо звернення не містить даних, необхідних для прийняття обґрунтованого
рішення органом чи посадовою особою, воно в той же термін повертається громадянину з
відповідними роз'ясненнями. Забороняється направляти скарги громадян для розгляду тим
органам або посадовим особам, дії чи рішення яких оскаржуються.
Порядком розгляду звернень, встановленим ст. 15 Закону України «Про звернення громадян»,
передбачено, що органи державної влади, місцевого самоврядування та їх посадові особи, керівники
та посадові особи підприємств, установ, організацій незалежно від форм власності, об'єднань
громадян, до повноважень яких належить розгляд заяв (клопотань), зобов'язані об'єктивно і вчасно
розглядати їх, перевіряти викладені в них факти, приймати рішення відповідно до чинного
законодавства і забезпечувати їх виконання, повідомляти громадян про наслідки розгляду
заяв (клопотань). Відповідь за результатами розгляду заяв (клопотань) в обов'язковому порядку
дається тим органом, який отримав ці заяви і до компетенції якого входить вирішення порушених у
заявах (клопотаннях) питань, за підписом керівника або особи, яка виконує його обов'язки.
Враховуючи вищенаведене, керуючись Конституцією України, Законами України «Про
звернення громадян», «Про громадські об’єднання»,
ПРОСИМО:
1. Здійснити усі можливі заходи реагування в межах наданих законодавством повноважень,
щодо захисту (поновлення) прав і законних інтересів мешканців гуртожитку № 4 Державного
університету інтелектуальних технологій і зв’язку.
2. Про результати розгляду цього звернення та інформацію щодо вжитих заходів направити у
визначений законом термін виключно в електронному вигляді на електронну адресу:
