「買賣價金履約保證」對買方的主要功能
簽立買賣契約後,若發生可歸責賣方之因素導致無法完成產權轉移登記及完整點
交房地並解除買賣契約依約依法回復原狀時,即由僑馥建經將買方已給付之價金
返還買方,確保買方再依約履行卻未能取得房地時,能完整取回已支付之全部價
金。
「買賣價金履約保證」對賣方的主要功能
當賣方依約將產權轉移至買方名下後,若發生可歸責於買方之因素至其未能配合
結清尾款(或買方之貸款業經核撥卻發生買方惡意違約不給付)並解除買賣契約且
無法回復產權至賣方名下時,即由僑馥建經代替賣方負擔其未能給付之價金,確
保賣方能完整取得出售房地所應得之全部價金。
在賣方依約將產權轉移至買方名下前,若發生可歸責於買方之因素致解除買賣契
約時,即由僑馥建經依據買賣契約書之約定,結算專戶價金後交付賣方沒收。
「買賣價金履約保證」應注意之重要事項
一、於簽約時應在「不動產買賣價金履約保證申請書」上親自簽名,並指名收
受價金之金融機構帳戶。簽約既經完成即由特約代書當場交付由僑馥建經
核發之「不動產買賣價金履約保證證書」即買方「存匯款提示卡」。
二、除簽約款外,其於各期價金皆由買方自行依「存匯款提示卡」所載方式將
價金存匯入專戶。
三、在點交結案前賣方不得要求收取買方給付之價金(含訂金)。
四、買方不須向金融機構貸款者,應於給付完稅款之同時將尾款存匯入專戶。
五、買方若須向金融機構貸款者,除應開具以賣方為受款人之擔保本票外,應
於完稅前完成對保借款手續及指定撥款之書面。
六、賣方如有須以買賣價金清償原借款或其他相關債務者,應配合特約代書或
僑馥建經為必要之查詢與協調作業。
七、申辦履約保證之買賣物件必須是由與僑馥建經具有合作關係之特約地政士
辦理相關產權轉移作業。
八、買賣雙方應詳閱並確實履行「不動產買賣契約書」及「不動產買賣價金履
約保證申請書」所規定之權利義務。
