ORDER:
By this order, I shall dispose of an application for grant of regular
bail moved by applicant. Reply to the bail application has been filed. Both the
parties have been heard and material on file has been perused.
2. The present case was registered on the basis of statement of
Inspector Ravi Kumar SHO Police Station Kundli, Sonipat with the

allegations that on 12.01.2021, he alongwith other police officials was present
at NIFTEM road, when he received a telephonic call that few persons are
trying to forcibly enter in factory no.349 in Industrial Area HSIIDC Kundli for
extortion while armed with Lathies and Dandas and that HC Rajesh, HC
Surender and SPO Satender have already gone towards the said factory.
Thereafter, he alongwith other staff members also reached there where he saw
that 2/3 girls and 50-60 persons armed with Lathies and Dandas were raising
slogans. He tried to pacify them but a girl leading the crowd said that he is the
same SHO who had earlier registered case against them and today they will
teach them a lesson and kill them. Thereafter, they launched an attack upon
them and caused injuries to police officials with Lathies and Dandas on their
forehead and other parts of the body. One of the assailants tried to snatch
carbine from gunman and one case file was also snatched from the police
official which contained public documents. Several public persons also
gathered at the spot. They tried to disbirse the mob with the help of public
persons namely Ravi, Jitender and Sonu. One girl who was leading the mob
was apprehended who disclosed her name as Naudeep Kaur daughter of
Sukhdev Singh (applicant) whereas remaining persons ran away alongwith
their weapons. While going away also, mob pelted bricks and stones at them
and assaulted, thereby deterred public servants from discharging their duties.
With these allegations, formal FIR under Sections 148, 149, 186, 332, 353,
384, 379-B, 307 IPC was registered.
3. Learned counsel for applicant argued that applicant has been
falsely implicated. Infact, she was beaten by the police officials when she

alongwith other labourers was standing near the factory. Lathi charge was
done by the police on innocent persons without any provocation. Learned
counsel next contended that no offence under Section 307 IPC is made out as
none of the police officials has suffered any injury which could be dangerous
to life. Applicant is in custody since 12.01.2021. Investigation and trial will
take sufficiently long time to conclude. As such, further detention of applicant
is not required and she may be released on bail.
4. On the other hand, Learned Public Prosecutor has opposed the
bail application and argued that applicant alongwith several persons launched
attack on the police party when SHO tried to prevent them from entering the
premises of a factory. Applicant was leading the mob. All of them were armed
with Lathies and Dandas. Earlier also, two cases have been registered against
applicant who claims to be leader of ‘Mazdoor Aadhikar Sangathan Sonipat’
and she indulged in extortion of money from the factory owners with the aid
of people protesting in ‘Kisan Andolan at Kundli’. It is further argued that in
case, she is released on bail, she may try to flee or intimidate the witnesses.
Learned Public Prosecutor lastly contended that applicant has committed a
heinous crime and in view of gravity of offence, the applicant does not
deserve concession of bail.
5. The allegations against applicant are serious in nature. An
information was received by SHO Police Station Kundli that 50-60 persons
armed with Lathies and Dandas are trying to enter a factory for extortion of
money and when police officials reached there, applicant provoked the mob
accompanying her, who launched an attack upon the police officials. Several

police officials have suffered injuries caused with Lathies and Dandas. One of
the assailants tried to snatch a carbine from gunman and one criminal case file
was also snatched in which investigation is going on. Applicant is also facing
two FIRs bearing no.649 dated 28.12.2020 under Sections 148, 149, 323, 384,
506 IPC Police Station Kundli and 26 dated 12.01.2021 under Sections 148,
149, 323, 384, 452, 506 IPC Police Station Kundli, Sonipat relating to
extortion of money and threats. Investigation is still at initial stage and
remaining accused have not been arrested as yet. In view of gravity of
offence, applicant does not deserve concession of bail and bail application is
dismissed. File be consigned to the record room after due compliance.
