Procceeding
As mentioned in the complaint, the victim, Siddique Kappan is Journalist and general
Secretary of Kerala Journalist Union of State. The victim went to cover Hathras issue. But
Hathras police detained him. He informed some of his friends through SMS and voice call
on Whatsapp. After detention police took his mobile phone also. Police illegally detained
him in toll plaza police post on the highway of Hathras. Vide proceedings dated
02.12.2020, DM Hathras and SP Hathras directed to submit the action taken Report within
04 weeks. In response SP Hathras Delhi vide report dated 14.12.2020 has informed that as
per enquiry, it’s found that in the matter one case 136/20 u/s 307/354/376D IPC r/s 3(2)5
SC/ST Act was registered against accused person for sexually harassing the victim girl
Manisha. The accused persons were arrested and charge sheet against them has also been
filed in the court. Later on some anti-social elements taking the benefit of incident have
tried to cause disturbance in area and have also tried to conspire against the
administration. The case against them bearing no 151/20 u/s
109/120B/124/153A/195/195A/465/468/469/501/505A-1B-1C IPC r/w 67 IT Act was
registered. Certain accused persons after following due procedure were arrested including
the alleged victim Siddique. The allegations in the complaint cannot be substantiated and
investigation in the matter is still pending. Meanwhile another complainant Henri Tipagne
vides separate communication dated 24.02.2021 requested the Commission to update him
with the progress in the matter. The Commission has considered the material placed on
record. SP Hathras is directed to get the investigation completed fairly and to its logical
conclusion within reasonable time. Also, DM Hathras is directed to provide monetary
relief to victim girl Manisha in case 136/20 under applicable rules of SC/ST Prevention of
Atrocities Act. With this direction the case is closed.
