1. 1. Proposal:
When one person signifies to another his willingness to do or to abstain from
doing anything With a view to obtaining the Assent of that other such act or
abstinence is a proposal.it is also known as offer. (Table A)
Essentials of Proposal
It Must create legal relationship
It Must be definite and clear
It Must be different from invitation to offer
It Must be communicated to the offeree
It Should not contain negative condition
It May be subject to nay condition
It Must not contain cross offers
2. Acceptance:
When the person to whom the proposal is
Made signifies his assent thereto,
The proposal is said to be accepted (Table B)
Essential of Acceptance
Must be given by the offeree Or his authorized agent
Must be absolute and un conditional
Must be in a prescribed manner
Must be communicated to the offerer
Must follow the offer
Must be given within reasonable time
3. Promise.
A proposal, when accepted becomes a promise.
4. Promisor and Promisee:
The person making the proposal is called the "promisor", and the person
accepting the proposal is called the "promisee but after acceptance
Before acceptance the former will be called proposer or offerer and the second
will be called proposee or offree.
