UNDER SPECIFIC RELIEF ACT, 1963
Section 36 of the specific relief act provides that, “Preventive
relief is granted at the discretion of the court by injunction,
temporary or perpetual.”
Section 37(1) states that temporary injunctions are regulated by
the Civil Procedure Code, but it does not provide that the court
shall grant only such temporary injunctions as are provided for in
the code. Therefore, the jurisdiction of the court to grant
temporary injunctions, is not restricted by the provisions of civil
procedure code.
